2. It has been observed that, so far, the necessary action for abolition of 85% posts of JSA falling vacant has not been complied with.

3. The concerned Ministries/Departments are requested to take necessary action to abolish the remaining posts immediately and furnish a compliance report to this Department along-with a copy of the Office Order of the number of posts abolished.

A Question was raised by Shri Rajkumar Dhoot in Rajya Sabha regarding abolishment of Clerical Posts in Government establishments. In a Reply to this Question No.2086, the Minister of State in the Ministry of Personnel, Public Grievances and Pensions DR. JITENDRA SINGH has stated the following..

“The Government of India has not abolished all Clerical Posts in all Government establishments. SSC has made recruitment for the posts of Lower Division Clerk (LDC) and Upper Division Clerk (UDC) in respect of vacancies reported by various Ministries/Departments/Sub-ordinate offices of Government of India.

However, the First Cadre Review of Central Secretariat Service was taken up in the year 2001. The Government had accepted recommendations of the committee in the year 2003 that Direct Recruitment LDC in Central Secretariat Clerical Services (CSCS) cadre may be stopped with immediate effect and all posts of LDC in CSCS presently filled through Direct Recruitment mode be abolished as and when these fall vacant. It was also decided to abolish 90% of the posts in the grade of UDC as and when these fall vacant, in future”

Subject: Abolition of 85% post falling vacant meant for direct recruitment in the grade of JSA(erstwhile LDC)-reg.
In pursuance of DoP&T’s O.M. No. 9/2/2003-CS-ll dated 20th April, 2005, it was decided to abolish 85% of the posts falling vacant on or after 03-10-2003 meant for direct recruitment quota in the grade of JSA (erstwhile LDC) of CSCS. The said decision was taken by the Cabinet after considering the recommendations of the report of First Cadre Restructuring of CSS.

2. However, it is observed that though a number of the cadre units have achieved the target of abolition of 85% of the posts falling vacant on or after 03-10-2003 meant for direct recruitment in the grade of JSA(erstwhile LDC) of CSCS every year. Some cadre units as shown in Annexure still have to achieve the target.

3. The Ministries/Departments shown in the Annexure are requested to take necessary action to abolish the remaining posts immediately and furnish a compliance report to DoP&T by 13th May, 2016 along-with a copy of the Office Order of the number of posts abolished. The deadline may please be strictly adhered to.

Centre says goodbye to clerk era, changes designation for its staff

Lower Division Clerk (LDC) and Upper Division Clerk (UDC)


New Delhi: Designations like Lower Division Clerk (LDC) and Upper Division Clerk (UDC) in central government’s employee hierarchy have been replaced with new nomenclature.

The posts of UDC and LDC under Central Secretariat Clerical Service (CSCS) have been rechristened as Senior Secretariat Assistant and Junior Secretariat Assistant, respectively, Order F.No.21/12/2010-CS.I(P) dated December 21 issued by the Department of Personnel and Training (DoPT) said.

Besides, the post of Assistant under Central Secretariat Service (CSS) has been renamed as Assistant Section Officer, it said.

Both the CSCS and CSS form the backbone of administrative work in the central government.
The total sanctioned strength of CSS and CSCS is 11,467 and 5,933 respectively.

Earlier in March, the DoPT had decided to replace the ‘class’ categorisation for specifying the seniority of its employees with new alphabetical groupings.

The posts under the central government will be denoted as groups A, B, C and D instead of classes I, II, III and IV in the service rules, it had said.

The Class-III (Group C) employees had expressed concern that they were taunted as ‘third-class’ employees due to the categorisation.

The Class-I classification is for gazetted officers while Class-II refers to mainly the non-gazetted officers, though there are some gazetted officers in this category too.

Class-III comprises clerical staff and Class-IV (which is now subsumed in Class III or Group C) includes peons and helps or multi-tasking staff in the government hierarchy.

Dear comrade,
This is in connection with LDC/UDC, MACP on Promotional hierarchy and other issues related to Administrative Staff of Subordinate offices. It is surprising to note that the 7th Pay Commission has turned down the genuine issue of LDC & UDC on the ground that the government has stopped direct recruitment for the clerical cadre and gradually phasing out the existing incumbents. If this is true, it is a matter of great concern that the Government has chosen to take a unilateral decision on an important policy matter without consulting the Staff side. The reason given for rejection of the demand is not convincing.
Besides Confederation/Staff Side JCM, several Departments had recommended upgradation of grade pay of LDC & UDC of Administrative Offices especially the LDC & UDCs of subordinate offices of Government of India.
Extracts of the Pay Commission comments on the matter is given below:
By analyzing the demand of SVP, National Police Academy under Para 11.22.100 the Commission has said “This issue has been dealt in Chapter 7.7. Recommendations made there would apply in this case also”
As against the demand of Directorate of Printing under Para 11.52.32 Commission maintained that “posts like LDC, UDC, Accountant are common to a number of ministries/ departments. Recommendations regarding their pay are contained in Chapter 7.7 and Chapter 11.35.”
But, in Chapter 7.7, deals common category, no recommendation for LDC/UDC is given.
However by recording disagreement to increase promotional quota of MTS to LDC under Para 7.7.37 & 11.35.28 Commission has said that “government has already stopped direct recruitment for the clerical cadre and gradually phasing out the existing incumbents, this demand cannot be accepted.”
But the fact is that Staff Selection Commission is frequently conducting recruitment for the post of LDC. Combined higher secondary examination for the selection of LDC also has been conducted recently. Moreover, no alternative recommendation to replace the LDC post is given in the report.  It is to be noted that the normal ratio of LDC and UDC in subordinate offices is 5:2 and thus LDCs have been allocated responsible sections and in many smaller offices LDC alone is handling the work of entire Administration.
On the other hand rejecting Central Secretariat Clerical service demand for parity with DEO, the commission observes “Even though the entry requirements are similar, historically the pay scales of the two posts have been different. Besides, they comprise two distinct cadres with different set of roles and responsibilities. Hence, the demand for parity of pay of LDC with DEOs cannot be acceded to by the Commission.”(Para 11.35.38).
Historically these cadres may be different set of roles but the fact is that functions of LDC are more complex than that of DEO and same was brought before the commission by various Associations/Administrative Authorities. Earlier pay Commissions have fixed Pay Scale to DEO considering their work on computer. But today LDCs are selected on the basis of their expertise in computer operation also.
By concluding the LDC issue, I give hereunder two comments among the dozens of comments/e-mail received us on the subject. This signifies the sufferings of LDCs in subordinate offices.
(1)   I am really disappointed with the decision of 7th CPC, I was hoping that I would get atleast GP 2400 as per their calculation, they don’t even think about lower classMyself Ashutosh, LDC and I am appointed on 2012, 3000 KM far from my house and from last 2 years I am doing the work of cashier along with all the work of Income Tax and budget, apart from me 4 more LDC’s are working here instead of UDC’s and they are the backbone of their branch but as per 7th CPC words we are not having as much responsible work they think LDC’s are recruits only for “dispatch” and “typing” which is not true.
I request to them, sir please come and see how much responsibility we have and what we are getting,
(2)    I am s murugan LDC, handling with pay bills, income tax, TDS and what are related to taxable income such as LTC encashment, final bills, HRA claim and etc…
In 7th Cpc report every where it is stated that this is dealt with chapter 7.7 and 11.35. But, there are no clear instructions for clerical.
The major error is clerical cadre is not included in common categories (chapter 7).
II      Grant of MACP on Promotional Hierarchy:
Even though the Confederation has clarified that the Commission has recommended MACP on promotional hierarchy, the report of the Commission is confusing and contradictory. Para 5.1.44 reads in the new Pay matrix, the employees will move to the immediate next level in the hierarchy. This can be interpreted as fixation in the same principle as that for a regular promotion. But Para 11.52.45 is contradictory.

III     The Grade Pay of  Assistants/Stenographers of Central Secretariat is brought down to Rs. 4200 from the existing Rs. 4600 and NFSG granted to the UDCs of Central Secretariat has been withdrawn thereby the demand for parity with the Grade Pay of Assistant/UDC of Central Secretariat is turned down.
Comrades, Government is bent upon to contractorise all the Administrative posts below the post of Assistants. The demand for merger of Grade Pay of LDC & UDC and upgradation to Rs. 2800, as recommended by the staff side is genuine in accordance with duties assigned. Confederation/JCM (Staff Side) is requested to please help LDC/UDC and other Administrative Staff of subordinate Offices to resolve these genuine issues.

7TH PAY COMMISSION RECOMMENDATION LDC-UDC ISSUE-GOVERNMENT STAND REITERATED

On the issue of LDC/UDC 7th Pay Commission reiterated the deceiving stand of the Government. Despite of realizing the issue as genuine, Government had not taken a positive decision at their level. The tens of thousands of LDC & UDC, solely responsible for the smooth running of many of the subordinate offices, were hoping that 7th Pay Commission will study the problem faced by them and take a positive decision. Staff Side JCM having convinced the importance of the issue, had also recommended merger & upgradation of the Grade Pay of LDC & UDC to Rs. 2800. But here we see that 7th Pay Commission has not taken any decision on the issue except giving some confusing and misleading statements to vindicate the stand taken by the Government as true. Extracts of some of their views on LDC UDC issue spread over various chapters of the reports is given below:

Higher GP 2400 to LDC and consequent upgradation of pay for other civilian posts in the Ministerial hierarchy.

11.22.100 The Academy has urged that LDC should be placed in higher GP 2400 as against the existing GP 1900 at par with grade pay of Data Entry Operator (DEO), on the grounds that both LDC and DEO enter service on the basis of same educational qualification i.e., Class XII and that the functions of LDC are more complex than that of a DEO. This issue has been dealt in Chapter 7.7. Recommendations made there would apply in this case also.

11.52.32 They have demanded upgradation in pay of certain category of non-industrial posts viz., LDC, UDC, Accountant, Junior Head Clerk, Head Clerk, Office Superintendent and Assistant Manager (Admin).


Analysis and Recommendations

11.52.33 The Commission has not received the views of the ministry/department on the issue. However, posts like LDC, UDC, Accountant are common to a number of ministries/ departments. Recommendations regarding their pay are contained in Chapter 7.7 and Chapter 11.35. The Commission does not find any justification for increase in pay scale of the other cadres.

But in Chapter 7.7 no direct recommendation except to decline the demand of LBSNAA to increase the promotional quota of MTS to LDC, is visible. The extract of Para 7.7.37 is give below:


Analysis and Recommendations

7.7.37 Looking at the qualification requirements and their job profile, the Commission does not recommend any changes in the pay structure or the promotional prospects of the MTS. Regarding MTS in Delhi Police, the Commission is of the view that since MTS is a common category, any special dispensation to MTS in Delhi Police is not justified. In so far as the MTS of LBSNAA are concerned, the Commission notes as per the recruitment rules for LDC, presently only 5 percent of MTS can get promoted to LDC through limited departmental examination. However, since the government has stopped direct recruitment for the clerical cadre and gradually phasing out the existing incumbents, their demand cannot be accepted.

LDCs

11.35.27 There are demands that 50 percent posts of LDCs be earmarked for filing up by promotion/departmental examination by MTS. It has been argued that the educational qualification for the post of MTS is Class X and they are recruited through SSC for performing the work of Peon, Mali, Cobbler, and Sweeper etc. Since most of the MTS join the post with higher qualification of Higher Secondary and Graduation, there is high rate of attrition in the MTS cadre.

Analysis and Recommendations

11.35.28 As per the recruitment rules for LDC, presently 5 percent of MTS can get promoted to LDC through limited departmental examination. Since government has already stopped direct recruitment for the clerical cadre and gradually phasing out the existing incumbents, this demand cannot be accepted. Moreover enhancement of promotional quota is an administrative matter to be considered by the relevant administrative ministry.

Between the lines it can be read that the Government prevented the 7th Pay Commission to not consider the LDC/UDC issue positively and reiterated the wrong statement of the Government that that Government of India has stopped direct recruitment of LDC through Staff Selection as its recommendation. But the fact is that Staff Selection Commission is frequently conducting recruitment for the post of LDC and without the permission of the Government how they can done at their own. Combined higher secondary examination for the selection of LDC also has been conducted recently. If we take the intention of Government of phasing out the LDC post as true, then where is the alternative recommendation? Who will do the arduous work done by the young and energetic LDCs in the subordinate offices? It is to be noted that the normal ratio of LDC and UDC in subordinate offices is 5:2 and thus LDCs have been allocated responsible sections and in many smaller offices LDC alone is handling the work of entire Administration.

On the other hand rejecting Central Secretariat Clerical service demand of parity with DEO the commission observes “Even though the entry requirements are similar, historically the pay scales of the two posts have been different. Central Secretariat Clerical Service

11.35.38 The Central Secretariat Clerical Service (CSCS) consists of the following grades:

i. Upper Division Clerk (GP 2400)
ii. Lower Division Clerk (GP 1900)
LDC and Data Entry Operator (DEO)

11.35.39 It has been demanded that LDC of CSCS drawing pay in GP 1900 be placed in GP 2400 at par with the DEOs on the grounds that post VI CPC, the entry requirements for the two posts is almost similar.

Analysis and Recommendations

11.35.40 Even though the entry requirements are similar, historically the pay scales of the two posts have been different. Besides, they comprise two distinct cadres with different set of roles and responsibilities. Hence, the demand for parity of pay of LDC with DEOs cannot be acceded to by the Commission.
From the above it is clear that Government is adamant on not granting pay scale to LDC & UDCs in subordinate offices at par with the duties assigned to them. Even though the 7th CPC claimed that they have recommended pay scales on the principle of equal pay for equal work, the genuine issue of LDC/UDC is ignored. Thus we are forced to represent against the recommendation to the Government/JCM (Staff Side).

All our LDC/UDC friends are requested to raise the issue in their respective Association/Office to force them to represent the issue to the implementation committee for consideration. Also please join all action programmes including strike action, called by the JCM (Staff Side), as published in this web site from time to time, to combat the situation.

Respected Sir,

1. The All India MES Adm Cadre and Ministerial Staff Association avails this opportunity to convey your honour its best compliments Warm regards, while putting the following problems before the Honble Prime Minister of India.
(a) GRADE PAY OF OFFICE SUPDT/STENO IN MES :- From 1st CPC to 5th CPC there is historical pay parity of Office Supdt of MES and Assistant .of Central Secretariat and AFHQ, but during Sept 2006 the Govt has upgraded the pay scale from Rs. 5500-175-9000 to 6500-200-10500 of Assistant of Central Secretariats through back door vide DOPT letter No. 20/ 29/ 2006. CS-II dt. 25 Sept 2006 (copy enclosed). Thereafter the matter was raised in the department JCM meeting of Min of Defence during July 2007 and it was told in the department JCM meeting that the matter is being referred to 6th CPC. The 6th CPC vide Para 3.1.14,(copy enclosed) of its report has clearly stated that there should be pay parity between field and secretariat staff upto the level of Assistant. Accordingly the pay of Office Supdt of MES and Assistant of Central Secretariats and AFHQ was equal. Again the DoP&T vide its letter No. 7/7/2008/CS-1(A) dt. 21 Dec 2009 (copy enclosed) has upgraded the grade pay of Assistant of Central Secretariats and AFHQ from Rs. 4200/- to Rs. 4600/- on the request of some Service Associations and individual Officials and ignored the recommendation of the expert body ie. VIth CPC by not granting similar pay scale for similarly situated staff i.e. Office Supdt. of MES. Although, the Assistant of Central Secretariat remains in Delhi throughout their entire services whereas the office supdts of Military Engineers Service are posted from one place to another after regulars intervals of times. The office supdt of MES is serving in peace, filed and high altitude area shoulder to shoulder with combatants as well as in AFHQ (in E-in-C’s Branch, Integrated HQ MoD) (Army) across the table of Assistant of AFHQ for a very long time. It is further submitted that the’ charter of duties of office supdt of MES is larger than the charter of duties of Assistant of Central Secretariat and AFHQ. The copies of charter of duties of office supdt of MES and Assistant of AFHQ are enclosed for perusal please. Therefore it is requested to please upgrade the pay scale of Office Supdt of MES in pre-revised pay scale from Rs. 6500-10500 to Rs. 7450-225-11500 as already upgraded for the Assistant of Central Secretariat. and AFHQ.
b) GRADE PAY OF UDC STENO III OF MES :- Similarly the Govt of India has upgraded the grade pay of 30% UDCs/Steno D of Central Secretariats and AFHQ from Rs. 2400/ – to Rs. 4200/ – by giving them NFSG grade while ignoring the UDCs of MES, although the 6th CPC vide Para 3.1.14 of its report has stated that there should be pay parity between field and secretariat staff up to the level of Assistants. Therefore, it is requested that suitable instructions may please be issued to upgrade the grade pay of UDCs of MES from Rs. 2400/ – to Rs. 4200/ – w.e.f. 01.01.2008 as already upgraded for UDCs servicing in Central Secretariat & AFHQ by the Govt vide DOPT letter No. 20 / 49 / 2009-CS-II(B) dt. 22.06.2011 (copy enclosed).
2. The Association has, already approached to the following authorities on the above issues :-
(a) DG (Pers) E-in-C’s Branch vide letter No. ‘AIMESCCGDEA/Thu/2009 dt. 18.06.09 (copy’ enclosed) and discussed the issue in all the meetings held in E-in-C’s Branch but no action has been taken.
(b) Secretary Ministry of Defence vide letter No. AIMESCCGDEA/Wed/20011 dt. 30 Aug 2011 (copy enclosed).
(c) Defence Minister vide letter No. AIMESCCGDEA/Fri/2011 dt. 09 Sep 2011 (copy enclosed).
(d) Sh. Pranab Mukherjee, The then Hon’ble Finance Minister, Govt of India vide letter No. AIMESCGGDEA/Mon/2011 dt. 09.05.11 (copy enclosed).
(e) Dr. Man Mohan Singh the then Hon’ble Prime Minister of. India vide letter No. IMESCDEA/Mon/ZOI dt.12.09.2011 (copy enclosed)
(f) Sh Manohar Parrikar, Defence Minister vide letter No AIMESAC&MSA/CHQ/2015 dt 23 Mar 2015.
3. The above pay scales have been provided to the Assistant and UDCs serving in the Central Secretariat and AFHQ due to the influence of PMO office as revealed from the letter attached as Appendix ‘A’. Therefore, the Association is approaching to the Honble Prime Minister of India to give similar pay scales to the staff of Military Engineering Services under Ministry of Defence. If our above requests are not accepted by the Honble Prime Minister of India by 30th June 2015, then the members of this Association has left no other option except to sit on indefinite fast on 04th July 2015 at the official residence of Prime Minister of India in support of the demands of this Association.

Subject:- Instructions on exemption from passing the Typewriting Test on Computer in respect of LDCs, regarding.

The undersigned is directed to say that instructions issued by this Department vide O.M.No.14020/2/91-Estt(D) dated 29th September, 1992 provide for grant of exemption from passing the typing test for drawal of increments and confirmation in respect of LDCs.

2(i) . The above mentioned instructions provide for exemptions as under:-

a) If above 45 years of age on the date of their appointment, such persons may be granted exemption from the date of their appointment.

b) If between the age of 35 years and 45 years at the time of their appointment, such persons may be granted exemption on attaining the age of 45 years.

c) If below 35 years of age on the date of appointment, such persons may be given exemption after 10 years of service as LDC provided they have made two genuine attempts to pass the typing test; otherwise they may be granted exemption after attaining the age of 45 years.

d) Those LDCs who have made two genuine attempts for passing the typing test prior to issue of this 0 M but have not completed 8 years service as LDC, may be granted exemption from passing the typing test after completion of 8 years of service or on attaining the age of 45 years, whichever is earlier.

(ii) For the Physically handicapped persons, these instructions provide for exemptions as under:-

a) Physically handicapped persons who are otherwise qualified to hold clerical post and who are certified as being unable to type by the Medical Board attached to Special Employment Exchanges for the Handicapped (or by a Civil Surgeon where there is no such Board) may be exempted from passing the typing test.

b) The term ‘physically handicapped persons’ does not cover those who are visually handicapped or who are hearing handicapped but cover only those whose physical disability permanently prevents them from typing.

3. Model RRs for the post of Lower Division Clerk (LDC) were issued vide this Department’s O.M.No.AB-14017/32/2009-Estt(RR) dated 7th October, 2009. The entries pertaining to Skill Test Norms prescribed in the Col. 8 of the Model RRs for the post of LDC were modified to include the Skill Test Norms ‘only on computers’ vide this Department’s O.M.No.AB-14017/32/2009-Estt(RR) dated 17) 11May, 2010.

4. This Department has received references whether the instructions as contained in this Department’s OM dated 29.9.1992 are applicable for test on Computer or not. The matter has been examined and it has been decided that the criteria for grant of exemption from passing the typing test in respect of such LDCs including Physically Handicapped persons/Persons with Disabilities as stipulated in this Department’s O.M.No.14020/2/91-Estt(D) dated 29th September, 1992 would also be applicable to the test on Computers.

5. It has also been decided to extend the above instructions to Sportspersons recruited against Sports quota under the Scheme of appointment of meritorious Sportspersons.

Tendering of Oral Evidence before 7 CPC
The 7th CPC had invited the All India Audit & Accounts Association for tendering oral evidence on 27th March 2015 at this office at Qutab Institutional Area, New Delhi. In addition to the Secretary General, Coms M.Duraipandian, V.Nageswara Rao, KL Gautam and Anilkumar appeared before the Commission for the oral evidence. The Commission was present in full strength

The following demands were placed before the Commission:
1. Upgradation of LDC of GP 2400

2. Correcting the distortions in the implementation of 6 CPC recommendations with respect to IA & AD and organised Accounts Viz.
i) grant of GP 4200 to Auditor / Accountant
ii) grant of GP 4600 to SA, granting parity with Assistants of CSS
iii) grant of GP 5400 to AAO on completion of 4 years
3. Grant Promotion to SA to GP 4800 and higher starting pay of PB 2, 5400 to AAO and space for further career advancements for these orders

There was detailed discussion on each of our demands. It was pointed out by us that CAG of India has also recommended each of above demand and also grant of GP 6600 and 7600 to AOs and SAOs. The Chairman appreciated it. The Commission assured to take a positive look on our demands which are also supported by CAG.

The demands were explained in its historical background and also on functional basis. The recommendations of the past pay commissions were also brought to the notice of the CPC. The award by the Central Board of Arbitration in favour of the employees in respect of parity between SA and Assistants in CSS was particularly pointed out. Chairman expressed his unhappiness on the non implementation of the award by the employees and workers.

On our demand for career progression for SA and AAO, the Commission stated that though it is sympathetic it is not sure what could be done, given the hierarchical structure available in IA and AD.

We also raised the issue of re-introduction of Touring Special Pay and pointed out to the Award that was won by the All India Audit & Accounts Association from the Board of Arbitration and its rejection by the Parliament in 2002.

We further requested for introduction of 4 advance increments on passing of Departmental confirmatory examination, explaining the system prevailed before 3rd CPC, recommendation of 3rd CPC following which it was discontinued and its re introduction in 1981 an amount equivalent to 3 increments. We pointed out that the conversion of this qualification pay into deemed allowance after 5 CPC and requested for its re-introduction.

During the discussion the Chairman observed that the commission is of the view to discard the PB-GP System.

ORAL EVIDENCE BY STAFF SIDE NC, JCM

On 23-24 March 2015, the Standing Conïnittee of Staff Side, NC, JCM, tendered the oral evidence before the 7 CPC. The delegation was led by Shri Raghavaiah, Leader, Staff Side and Corn Shiva Gopal Mishra, Secretary, Staff Side.

Com KKN Kutty presented the memorandum on behalf of the NC, JCM. The gist of discussion is given in the enclosed Circular issued by Corn Shiva Gopal Mishra, Secretary, Staff Side.

The Pay Commission stated that the principle that vuld guide to determine the minimum wage shall be Dr Aykroid formula on it (ie 15 ILC norms). It has further stated its intention to do away with pay band/grade pay system. On some other issues, the Pay Commission has sought the views of the Staff Side (which shall be conveyed to the Commission shortly).

REINTRODUCTION OF DIRECT RECRUITMENT IN THE GRADE OF LDC

As a part of first cadre review of CSS in the year 2003, direct recruitment to the Lower Division Grade (LDC) of CSCS was stopped. Eighty Five percent of the posts of LDCs were then filled up through direct recruitment quota and accordingly, after implementation of the first cadre review, 85% of the posts of
LDCs falling vacant every year are being abolished. The remaining posts are filled up by promotion from the erstwhile Group D employees (now MTS). Over the years, strength of LDCs in the Ministries/ Departments has come down substantially from the original level of about 5300.

2. The Second Administrative Reforms Commission endorsed the decision of phasing out of direct recruitment in LDCs. The Core Group on Administrative Reforms (CGAR) also agreed with the recommendations of ARC. However, the Group of Ministers did not agree phasing out of LDCs and directed that the matter be reconsidered.

3. As the issue of reintroduction of direct recruitment in the LDC has multifarious dimensions / implications like change in work culture in the Govt. of India, E-governance, impact on Multi-Tasking Staff, UDC, Assistant cadre etc. it was referred to the 3rd cadre restructuring committee of CSS.

4. The pros and cons of reintroduction of direct recruitment in LDCs may be as under:

Pros
(i) More availability of manpower in the Sections. Presently, Central Secretariat is heavily top loaded with only 6700 Assistants feeding to 3200 SOs, 1600 USs and 1200 DS/Dirs;

(ii) Salary of a LDC is much less comparing that of an Assistant;


(iii) More continuity and institutional memory as compared to outsourced staff;


(iv) If manpower is to be increased at lower level it could be either at Assistant level or at LDC level. Direct recruitment at LDC level with Promotion to UDC and Assistant would create less problem of stagnation than increased direct recruitment at Assistant level;


(v) Quality of direct recruit LDCs is reasonable.
Cons:
(i) We would be going back from the principles of officer oriented system in the Gentral Secretariat;

(ii) In the era of e-governance, paperless office and multi skilling, maintaining a large cadre of LDCs to carry out routing office jobs manually may be regressive;

(iii) The savings shown in the first cadre restructuring of CSS would disappear;


(iv) LDCs in terms of salary, pension contribution and other benefits would cost much more than outsourced staff;


(iv) There could be conflict of promotional opportunities between direct recruit LDCs and Assistants
5. However, in the absence of LDCs, a number of Ministries/Departments have resorted to engaging out-sourced staff to manage basic activities like diary/dispatch, movement of files/papers, typing etc. and there is a functional need to strengthen the institutional memory and level of commitment cannot be expected from outsourced staff.

6. The 3rd CRC has recommended re-introduction DR in LDC in limited manner with simultaneous reduction in DR in Assistant grade.

7. However, in view of increased use of information technology tools and progressively more officer oriented system there is a much less requirement of ministerial staff than previously and therefore if direct recruitment in LDC is reintroduced it should be limited in number they should mostly be utilised in regulatory ministries where the volume of correspondence/ dak/ diarizing work
is higher.

8. In the changed IT environment, the intake of 200-250 may be adequate  to arrive at the sustainable number of about 2000 LDCs and equal number of UDCs over the years with the combined strength of 4000.

9. To provide adequate promotional avenues to the newly recruited LDCs, the percentage of intake of DR Assistant may be reduced to 60% (from the existing 75%) leaving 40% of the vacancies in the Assistant grade to be filled up by seniority/LDCE quota from the UDC grade. Reduction in direct recruitment in Assistant would in the long run reduce stagnation in senior grades of CSS.

Transfer Guidelines for Lower Divisional Clerks posted in Regional Offices under the administrative control of Directorate of Estates.

Directorate of Estates issued orders to frame transfer guidelines for LDCs from one regional office to another regional office. Directorate of Estates under the Ministry of Urban Development has eight regional offices located in different places all over in Inida. The eight regional offices are Kolkata, Shimla, Chandigarh, Faridabad, Ghazidabad, Mumbai, Nagpur and Chennai.

Normally LDCs are not transferred from one to another office, however requests from LDCs for transfer on different gournds. So far there is no guidelines in the regard. The matter has been considered by the Ministry and decided to frame transfer guidelines for LDCs as under…

UPGRADATION OF GRADE PAY OF LDC & UDC : REGARDING QUERIES RAISED BY THE VIEWERS

Dear friends,

We have been receiving frequent queries through SMS & e-mail in connection with latest position of the case filed. Besides, several of our friends wanted to know the approach of 7th Pay Commission towards the new pay structure of LDC & UDC.

As has already been said, three cases have been filed on the upgradation of Grade Pay of LDC/UDC in various courts so far and all these cases are progressing at their respective places.

In furtherance, we have submitted a very good memorandum to 7th Pay Commission; a copy of the same was published in this web site on 15th July 2014, wherein we demanded the upgradation of grade pay LDC to Rs. 2800 & UDC to 4200. Moreover, leaders of National JCM (Staff side) had contacted us and asked to send a proposal for LDC & UDC to add in the JCM Memorandum. Accordingly, JCM (Staff side) has recommended merger of the grade pay of LDC & UDC and upgradation of Grade Pay to Rs. 2800/ which may be treated as an achievement.

According to our information LDC/UDC issue was raised before the Pay Commission at Bangalore by some LDC/UDC and the commission has given a very positive reply. It means due to our timely efforts, LDC/UDC may get the upgraded scale in the 7th CPC. And we are sure that we will win the case filed in the courts which will pave way for implementation of upgraded Grade pay from 1.1.2006.

You are aware that the 7th Pay Commission is scheduled to visit at Mumbai on 6th -8th & Shimla on 12 & 13 November 2014. The Commission will visit more cities in the coming days. Administrative Staff especially the LDC/UDC are requested to please raise the issue of upgradation of Grade Pay of LDC/UDC in its own prominence in the meetings of the Pay Commission.

Will the 7th CPC fulfil the demands of LDCs and UDCs?

For a number of years now, especially after the 6th CPC, the problems faced by LDCs and UDCs have started gaining prominence. The unity and sense of purpose among them makes them look all set for the kind of victory that Pharmacists had. Common sense of purpose, unity and dedication sure make success possible!

In order to decrease the number of grades, the 6th Pay Commission combined all the different grades between Grade Pay 1300 to Grade Pay 1800 into a single grade – Grade Pay 1800, thereby wiping out the entire Group ‘D’. As a result, everybody became Group ‘C’ employees. Even those who lacked the minimum education levels, illiterates and everybody else were lumped into Group ‘C’. Their Grade Pay was also raised to Rs. 1800. But, at the same time, employees working as LDCs, who have a minimum educational qualification of Class XII and also possess some technical education, were not given any upgrading. Instead, they now had to share their grade with lesser-qualified former Grade ‘D’ employees.

The next huge trouble originated from the MACP. Those who didn’t get any promotion for years are given career upgradations through MACP. LDCs who didn’t get any promotions for more than 10 years were given their next grade pay, from Rs. 1900, their pay rose to Rs. 2000. The increase of mere Rs. 100 turned out to be a huge disappointment to many. Similarly, those with Grade Pay 2400 were hoping for a jump to Grade Pay 4200, but were instead forced to upgrade with only Grade Pay 2800 as per MACP rules. That anger kept seething too, because the different is 1400.

The most important demand of the LDCs and UDCs is to upgrade the current Pay Scale-Grade Pay.
Grades are decided based on the educational qualification of the employees. An LDC possesses a minimum educational qualification of Class XII and also has some technical qualifications. The basic salary of an LDC is just Rs. 1900 + 5830 = Rs. 7730.00. They want it revised to Rs. 2400 + 7510 = Rs. 9910.

The big question is – will the 7th CPC grant this demand?

We introduce ourselves as the Ministerial Employees Association based at Karaikal District of the Union Territory Government of Puducherry and affiliated to the Puducherry State Govt. Employees Central Federation.

In response to the reference cited, we hereby submit the replies to the Questionnaire for your kind perusal and favourable consideration.

While submitting the replies to the questionnaire, We also would like to bring the pathetic situation in which the Ministerial Employees of the Government of Puducherry survives and bringforth the gross irregularities and major anomalies that exist in the Ministerial Cadre which needs immediate attention and urgent remedial action. Despite repeated representations and prolonged agitations requesting cadre review, restructure, pay and allowances review and fixation of proper pay scales, the Government of Puducherry has turned a deaf ear to till date except upgrading certain number of posts on functional basis.

But the announcement of the constitution of the Seventh Central Pay Commission  under your esteemed Chairmanship has brought a ray of hope for the entire cadre.

We all want to refer to the report of IV Pay commission in which there are about 10 categories of employees who were in the same / below the pay scale when compared with our pay scale but whose pay scale have since then been stepped up and the pay scale of ministerial employees is still at the rock bottom level without any sort of upgradation. Further, a most of the erstwhile Group ‘D’ posts in the Government of Puducherry have been replaced with the higher scales of pay on par with the scale of LDC. This has led to utter disappointment and total dissatisfaction of the ministerial employees and is now developing into a deep psychological depression.

It is a very well known fact that the ministerial employees are the axis of Administration of the Government of Puducherry whose services have become an indispensable part of the Government Machinery. Each and every welfare measure of the Government reaches the public only through the Ministerial employees which is the basic truth i.e. For every welfare activity in the Government of Puducherry there is a Clerk behind in the grassroot level.

But the ministerial category is totally neglected and faces with a number of anomalies which requires immediate attention and urgent remedial action so as to lift the sagging morale of the vital axis of the Government machinery.

We submit our proposal seeking remedy and justice on our long pending genuine basic, minimum, requirements.

The proposal consists of three parts as outlined below:
Part I: Introduction to issues faced by the Ministerial Employees of  Government of Puducherry.

Part II: Memorandum to 7th Pay Commission incorporating the replies to the Questionnaire

Part III: Morandum to 7th Pay Commission endorsing JCM for issued for which replies are not furnished in this proposal.

Following is the extract of Brief Resume and Decisions of extended Federal Executive Meeting held on 17th & 18th July, 2014 of National Federation of Civil Accounts Association :-

            Initiating the discussion, Secretary General reported about the pay scales devised and recommended by the staff side National Council (JCM) to the 7th CPC. Further,  he stated that as per the demand adopted by the apex JAC necessary documents had been placed before CGA.

The demands are:- 
1. Upgradation LDC as Accounts Assistant with grant of Grade Pay of Rs: 2400/-.
2. Merger of Accountant/Sr. Accountant and grantof Grade Pay of Rs: 4600/-.
3. Grant of Grade Pay of Rs: 5400/- to AAOs.

Accordingly CGA vide letter dated 14.07.2014 recommended to Ministry of Finance to Grade Pay of Rs:- 4600/- to Sr.Accountant and Rs:- 5400/- to AAO with effect from 1.1.2006. 

The apex JAC meeting held on 28th May 2014 reversed its earlier stand and decided to demand following Pay Scales to different categories before the 7th CPC.

It was also reported by the Secretary General to the house that the representatives of NFCAA held repeated dialogue over this matter with the leaders of other constituent of apex JAC, but there could not be any common understanding.
 
            On this agenda item, 26 (twenty six) Federal Executive members took part in the discussion. 25 members were of the opinion that the earlier stand of merger of Accountant and Senior Accountant was most justified and reasonable. Merger would be more beneficial and carrer boosting for all cadres of Civil Accounts Organization as a whole.
 
            However, after hours long discussion, following decisions were taken by the meeting
 
1. A resolution shall be forwarded to CGA conveying the resentment against forwarding the half hearted proposal of cadre restructuring to Ministry of Finance and that too without taking the Associations into confidence. In the same resolution it shall also be demanded to make suitable recommendations for rest of the cadres.
 
2. In the National Convention of Accounts and Audit Employees on 19th July 2014, the representatives of AICAEA and AICAEA Cat-II would unitedly place their views with regard to merger of Accountant and Senior Accountant and also plead for taking this approach before 7th CPC by the apex level JAC. 
 
However, in case the proposal is not accepted in the convention, the AICAEA and AICAEA Cat-II shall obey the majority decision of the National convention so that total unity among the officers and employees and officers of Accounts and Audit departments is maintained.
 
            Secretary General informed that, so far as departmental memorandum for submission to 7CPC in concerned, draft of the same was circulated to all seeking suggestions and proposals from Federal Executive members, Branches and even individuals. Further, Presidents and Secretary General of both Associations and President NFCAA are Co-ordinating among each other on this matter.
 
            The meeting observed that the discussion on this item of agenda had already taken place while discussing the previous agenda. It was therefore decided that, the memorandum shall be finalized after finalization of the approach taken by the National Convention of Accounts and Audit Employees and Officers Organization on 19thJuly 2014. The meeting also directed Presidents and Secretary Generals of both AICAEA and AICEA Cat-II to finalize the memorandum.

Dear friends,
            As has already been informed, the Letter sent to the PM for revision of Grade pay of LDC & UDC by us has been forwarded to JCA, by the DoPT. Accordingly, a letter seeking the status of action taken from the Deputy Secretary, JCA was prepared but before sending the same to him,  the case has received back from the DoP&T wherein it was directed us to take up the matter directly with the Ministry of Finance (Department of Expenditure). The copy of the letter is posted below:

            It is to be noted that while forwarding the case to JCA, the DoPT has observed the LDC & UDC case is related to anomaly and the JCA is the authority to deal the cases of anomaly. An agenda item pertains to the upgradation of the grade pay of the LDC and UDC is pending for discussion in the National Anomaly Committee and the JCA has to convene the meeting for the same. And thus the case should have been put up to National Anomaly Committee. But, now the case is received from the DoPT and not from the JCA and the ground on which the case is returned to the DoPT is not known.

            Since the DoPT has asked us to take up the matter with Ministry of Finance it would be sent. But, we cannot say the action to be taken by the MoF on this most genuine anomaly in the wake of the announcement of 7th Pay Commission/involvement of expenditure. And yet, we have hope, the MoF would suggest something positive. In case it is not happened, as has been suggesting by the readers, it is a case fit to move in the Principle bench of the CAT, I think.

            Suggestions on future action on the matter from the readers are requested please.

CONFEDERATION RESOLUTIONS IN FAVOUR OF ADMINISTRATIVE STAFF
 

Dear friends,

The issues related to the Administrative Staff of the Government of India as follows have been placed before the 24th Conference held at Kolkata during 4th to 6th May 2013 by the undersigned in the capacity as National Organizing Secretary of the Confederation. The resolution committee of the Conference has finally adopted these demands and the same will be taken up with the Government by the Confederation in the coming days.

1) Merger of LDC and UDC upgradation of Grade pay to 2800/- (Confederation resolution modified this as Rs. 2400/- for LDC & Rs. 2800 for UDC).

2) Parity in pay scales of the Ministerial and Stenographers between Field and Secretariat offices.

3) Granting Rs. 4200 grade pay to 30% UDC after completion 5 years service.

4) Granting of MACP on promotional hierarchy. Abolition of Grade pay Rs. 2000/- for granting of MACP.

5) Finalization & implementation of cadre restructuring pending with various Ministries/Ministry of Finance/DOPT before constitution of 7th CPC.

6) Continuation of the Association with the already identified cadres. Stop re-identification of already identified groups for recognition which is against the CCS (RSA) Rules.
