OFFICE MEMORANDUM


Subject : Recommendations of 6th CPC in para 6.1.13 regarding lateral entry against identified SAG/HAG posts requiring technical/ Specialized knowledge.

Reference is invited to this Department’s OM of even number dated 17.06.2013 on the above subject.

2. A copy of the relevant extracts of 6th CPC recommendations, note on Guidelines for making contract appointment alongwith draft contract agreement were sent with the above referred OM with the request that the comments on this issue may be sent to this Department by 15th July, 2013. It is requested that the samemay kindly be sent at an early date.

Framing of Rules for Unit Run Canteen employees (URC)

The Unit Run Canteen employees are getting paid as per the rules regulating the terms and conditions of the services of the civilian employees of the URCs, issued by Army Headquarters in April 2003. These rules were made as per the directions of Hon`ble Supreme Court.

It has been held by the Hon`ble Supreme Court in its order dated 28-4-2009, in the case of R.R. Pillai Vs the commanding officer HQ SAC(U), that employees of the URC are not government servant.

Unit Run Canteens (URCs) employees are not Government employees, hence recommendations of Sixth Central Pay Commission are not applicable to them.

This information was given by Defence Minister Shri AK Antony in a written reply to Shri Shadi Lal Batra in Rajya Sabha today.

Pension to retired employees covered under PF scheme

    (a)when the Ministry has submitted for giving pension to all those retired employees who are covered under Provident Fund Scheme;

    (b)whether it is a fact that Government is working on giving pension to the tune of Rs. 1000 per month to all those who are covered by Provident Fund;

    (c)if so, the details thereof; and

    (d)what would be the burden on Government once this proposal is
    fructified?

ANSWER

    (a):     The Employees’ Pension Scheme, 1995 came into effect from 16th November, 1995 replacing the erstwhile Employees Family Pension Scheme, 1971, which inter-alia provides superannuation/retirement and family pension.

    (b) to (d):     Yes, Sir. In order to secure a minimum pension of Rs. 1,000/- per month under Employees’ Pension Scheme (EPS), 1995 to the member pensioners, the present Government contribution to EPS, 1995 is required to be raised from the existing 1.16% to 1.79% of wages thereby increasing the Government’s present contribution from approximate Rs.990 crore per annum to Rs.1533 crore per annum in the first year. An analysis of the trend in the contribution made by the Central Government suggests that the contribution of the Central Government has been increasing at an average of 10-15% per annum over the last five years.

CONFEDERATION CALLS UPON THE CENTRAL GOVERNMENT EMPLOYEES TO ORGANIZE TWO HOURS WALK-OUT PROGRAMME ON THE DAY WHEN THE BILL IS TAKEN UP FOR DISCUSSION IN PARLIAMENT

As you are aware, Central Government is going ahead with their agenda on pension privatization. The controversial PFRDA Bill (Pension Fund Regulatory and Development Authority Bill) is listed as an agenda item for the current Parliament session. The bill may be taken up for discussion in Parliament on any day. Confederation of Central Government Employees & Workers has opposed the Contributory Pension Scheme and also the PFRDA Bill from the very beginning.

We have conducted so many agitational programmes including strike. The left parties in the parliament have also strongly opposed the Bill. Inspite of the opposition from employees (both Central Government and State Government Employees & Teachers) and also from left political parties, the Central Government is not ready to withdraw the contributory Pension scheme or to scrap the PFRDA Bill.

The National Secretariat of the Confederation has viewed the move of the Government with grave concern and decided to call upon the entirety of the Central Government Employees & Workers to organize mass protest demonstration in front of all offices throughout the country after walking out from offices for two hours, on the day when the bill is taken up for discussion in Parliament or on the next day if information is received late.

All India office bearers, State level COCs and other COCs are requested to make the two hours walk out programme a grand success.
