Sub: Implementation of Government’s decision on the recommendations of the Seventh Central Pay Commission – Revision of pension of pre-2016 retired Medical Officers of Army Medical Corps/ Army Dental Corps/ Remount & Veterinary Corps-reg.

Sir,

The undersigned is directed to refer to this Ministry’s letter No. 17(01)/2017/ (02)/D(Pension/ Policy) dated 5 September 2017. In accordance with Para-4 of this letter, the revised pension/ family pension of all Armed Forces Personnel who retired/ died prior to 01.01.2016, shall be revised by notionally fixing their pay in the pay matrix recommended by the 7t CPC in the level corresponding to the pay in the pay scale/pay band and grade pay at which they retired/ died. This will be done by notional pay fixation under each intervening Pay Commissions based on the formula for revision of pay. The revised rates of Military Service Pay, Non-Practice Allowance, where applicable, and ‘X’ Group. Pay & Classification Allowance for JCO/ORs, if applicable notified in terms of 7th CPC orders, shall also be added to the amount of pay notionally arrived at under the 7th CPC pay matrix and shall be termed as notional reckonable emoluments as of 01.01.2016 while fixing pay on notional basis. It was further decided at para-6 of the letter that higher of the two formulations ice. the pension/ family pension already revised in accordance with this Ministry’s letter No. 17 (01)/ 2016-D(Pen/Pol) dated 29.10.2016 or the revised pension/family pension as worked out in accordance with Para-5 of the MoD letter dated 05.09.2017 referred above, shall be granted to pre-01.01.2016 ‘Armed Forces pensioners as revised pension/family pension w.e.f. 01.01.2016.

2. Department of Pension & Pensioners’ Welfare vide their OM No. 38/37/16-P&PW(A){iii) dated 11th September 2017 have decided that NPA at the rate as applicable as of 01.01.2016 shall be added to notional pay as of 01.01.2016 to arrive at pension/ family pension of retired medical officers w.e.f. 01.01.2016 and the pension/ family pension of retired medical officers shall be further revised w.e.f, 01.07.2017 by adding NPA @ 20% to the notional pay as on 01.01.2016, instead of NPA admissible as on 01.01.2016 subject to the condition that the notional pay as on 01.01.2016 plus NPA does not exceed the average of basic pay of the revised scale applicable to the Apex Level and the level of Cabinet Secretary.

 

3. The matter regarding revision of all kinds of pension/ family pension of medical officers of Armed Forces who have retired/ died prior to 01.01.2016 has been examined by the Govt. and it has been decided that NPA at the rate as applicable as of 01.01.2016 shall be added to notional pay worked out in terms of Para-4 of the MoD letter No. 17(01)/2017/(02)/D (Pension/ Policy) dated 5th September 2017 to arrive at notional reckonable emoluments as on 01.01.2016 for calculation of pension/ family pension of pre-01.01.2016 retired/ died Medical Officers of Armed Forces, w.e.f. 01.01.2016. All kinds of pension/ family pension of pre-01.01.2016 retired/ died medical officers of Armed Forces Pensioners/ family pensioners shall be further revised w.e.f. 01.07.2017 by adding NPA @ 20% of notional pay in VIIth CPC scale to the notional pay as on 01.01.2016, instead of NPA admissible as on 01.01.2016 (which was 25% of pre-revised scale).

4. The fixation of pension/ family pension of retired Medical officers of Armed Forces in the above manner, shall be further subject to the condition that emoluments (ie. Basic Pay + MSP + NPA) to be reckoned for pension do not exceed Rs. 2,37,500/- (Rupees two lakh thirty seven thousand five hundred only). Amount of Gratuity and CVP which has already been notified, shall remain unchanged.

5. This issues with the concurrence of the Ministry of Defence (Finance/ Pension) vide their ID No. 10(8)/2018/Fin/Pen dated 23.12.2020.

(iii) Railway Board’s reply vide No.E(P&A)II-2017/HW-1 dated June,2020 to NFIR.
(iv) NFIR’s letter No. I/5(E) dated 24/07/2020 addressed to Railway Board.
(v) Railway Board’s letter No. E(P&A)II-2017/HW-1 dated 29/09/2020 (RBE No.83/020).

Responding to Railway Board’s reply vide letter No. E(P&A)II-2017/HW-1 dated June 2020 to the GS/NFIR, Federation vide its letter dated 27/07/2020, requested the Railway Board to provide a copy of the proposal sent to Department of Expenditure (DoE) for taking further action at Government’s level. It is however observed that copy has not been made available till now, while the Railway Board vide RBE No. 83/2020 dated 29/09/2020 since issued instructions revising the rates of Night Duty Allowance (NDA), fixing unjustified pay ceiling at Rs. 43,600/-per month for entitlement of Night Duty Allowance to be applicable with effect from 01/07/2017. The said decision of the Railway Ministry prescribing pay ceiling of Rs. 43,600/- per month has resulted in deprival of Night Duty Allowance to large number of Railway employees, therefore unacceptable to the Federation in view of the following:-

  • All Group ‘C’ Railway employees (working in GP 1800 to 4600, PB-1 & 2) are eligible to receive Night Duty Allowance (NDA) as could be verified vide Board’s letters dated 09/06/2016, 14/12/2016, 17/11/2017 & 08/03/2018. These provisions are also applicable to the Group ‘C’ Railway employees in GP 4600 and also those who got financial upgradation under MACPS in GP 4800 & 5400 respectively.
  • It is relevant to note that since 6th CPC pay of the Railway employees has been fixed in 7th CPC pay levels applying multiplication factor of 2.57, similar criteria should have been applied for fixing rates of Night Duty Allowance without imposing any ceiling limit.
  • With the issuance of Railway Board’s instructions vide dated 29/09/2020, prescribing pay ceiling of Rs. 43,600/-, the Railway employees working even in GP 1900, 2000, 2400/Pay Level 2, 3, 4 and above have been deprived of Night Duty Allowance, although they ‘continued to perform night duty for smooth running of train services at all times.
  • The decision of Railway Board vide letter dated 29-09-2020 prescribing pay ceiling of Rs.43,600/- p.m w.e.f. July 1, 2017 would also cause financial hardship to the staff who have already been paid Night Duty Allowance at the rates prevailed till date as it may lead to recovery of the NDA already paid. This situation may lead to resentment and agony among Group ‘C’ employees of all pay levels. The Railway Ministry should take initiative and place the case before DoP&T, highlighting the uniqueness and complex working to review and allow Railway to sort out the matter in consultation with the Federations.
  1. Federation also desires to re-iterate again that the issue relating to grant of Night Duty Allowance to Railway Employees w.e.f. 01-07-2016 and 01-01-2017 consequent to increase in the Dearness Allowance rates from 125% to 132% raised vide NFIR’s PNM Agenda Item No.35/2018 and discussed already has not yet been resolved, therefore the same needs to be addressed now.

NFIR, therefore, once again requests to Railway Board to kindly review and see that all the points relating to grant of Night Duty Allowance to Railway employees mentioned above and also in PNM Agenda No.15/2018 are addressed and the correspondence exchanged with the DoE be also made available to the Federation. An early action in the matter is solicited.

Consequent upon revision of Grade Pay Pay Level of the category of Ticket Collector from GP 1900 to GP-2000 Pay Level-3 vide Railway Board’s letter dated 02-8-2016, one of the Federations (AIRF) raised the issue of revision of rates of stipend to Ticket Collector Ticket Examiner. The matter has been considered and it has been decided to revise the rates of stipend of the category of Ticket Collector at S.No. 41. of the Schedule of Board’s letters of even number dated 02.02.2017 and 1 1-9-2018 as under:

Subject: Clarification on Children Education Allowance / Hostel subsidy.
Consequent upon the implementation of Seventh Pay Commission Allowances after the Reorganization of the State of Jammu & Kashmir, Finance Department has issued Govt. Order No. 473-F dated: 28.11.2019 wherein CEA /Hostel Subsidy was granted in favour of the employees of Union Territory of Jammu & Kashmir. Various queries have been received in the Finance Department from certain quarters regarding CEA/Hostel Subsidy.
After examining the issue, it has been decided to issue the following clarification on the subject of Children Education Allowance and Hostel Subsidy:-
1. The maximum ceiling amount for reimbursement of Children Education Allowance is Rs 2250/-per month per child and Rs 6750/- per month per child for hostel subsidy. The CEA amount is fixed irrespective of actual expenses incurred, but for claiming Hostel subsidy a certificate from the institute, where the child is studying shall indicate the amount of lodging and boarding charges paid by the employee to the residential educational institute. The reimbursable amount of the Hostel subsidy will be the actual expenses incurred or Rs 6750/- per month whichever is less.
2. Children Education Allowance and Hostel subsidy can be claimed by only one employee if both spouses are employed.
3. The reimbursement of CEA and Hostel subsidy will be made only once in a year after the completion of Financial year i.e., in the month of April/May. For example claim of CEA and Hostel subsidy for the financial year 2020-21 shall be submitted in April /May 2021.
4. The application for claiming the reimbursement is attached as Annexure “A”. In addition a bonafide certificate is to be obtained from Head of Educational Institution confirming that the child studied in the school during the period of the claim (Annexure “B”). In case such a certificate cannot be obtained, a self attested copy of the report card and receipt/ e- receipt of the institute can be produced as a supporting document.

While enclosing copy of NFIR’s letter No.IV/NFIR/ 7 CPC (Imp)/2016/Allowance/Part II dated 24/12/2018 on the subject, the Federation expresses its disappointment over continued denial of Risk & Hardship Allowance to the Track Maintainers working in Construction Organizations on Indian Railways. The Federation in its letter dated 24/12/2018 had elaborately explained the merits, justifying payment of Risk & Hardship Allowance to the Track Maintainers of Construction Organizations also. Sadly, due to Railway Board’s clarification issued to the General Manager (P), E.C. Railway vide letter dated 25th October, 2018, the payment of Risk and Hardship Allowance to the Construction Organizations Track Maintainers has been denied and wherever paid for the previous period, the same is being recovered.

Though nearly ten months passed from the date of letter of Federation, there has been no reply indicating action taken on this issue. This has compelled the Federation to seek intervention of Railway Board (ME & MS) for reviewing the case and allowing payment of Risk and Hardship Allowance to the Track Maintainers working in the Construction Organizations.

NFIR, therefore, requests the Railway Board (ME & MS) to kindly consider the matter objectively and accord approval for payment of Risk & Hardship Allowance to those Track Maintainers working in Construction Organizations over Indian Railways. It may kindly be appreciated that this issue deserves to be settled immediately without waiting for the report of EDs Committee in view of the merits involved for payment.

After the Parliament passed the Jammu and Kashmir Reorganization Bill, 2019, Prime Minister, Shri Narendra Modi addressed the nation on 8th August, 2019, wherein he announced that all the financial facilities being given to the employees of other Union Territories (UT), as per the recommendations of 7th CPC, would soon be extended to the employees of UT of Jammu & Kashmir and UT of Ladakh.

Accordingly, Union Home Minister, Shri Amit Shah has approved the proposal of payment of all 7th CPC allowances to the Government employees of UT of Jammu & Kashmir and UT of Ladakh, which shall come into existence from 31st October, 2019. Union Home Ministry has issued orders in this regard. The move will benefit 4.5 lakh Government employees, who are working in the existing State of Jammu & Kashmir and will become the employees of UT of Jammu & Kashmir and UT of Ladakh from 31st October, 2019.

The annual financial implication of 7th CPC allowances like Children Education Allowance, Hostel Allowance, Transport Allowance, LTC, Fixed Medical Allowance etc. in respect of 4.5 lakh Government employees of existing State of Jammu & Kashmir shall be Rs. 4800 crore tentatively:

A reference has been received in the Directorate seeking clarification regarding admissibility of Cash Handing and Treasury Allowance on DOPT OM No - 4/6/2017-Estt. (Pay-II) Date 18.01.2019 ,circulated vide Directorate letter No. 06-04/2018-PAP dated 22.01.2019, on the following issues from Chief Postmaster General Mumbai vide his letter No.Estt/19-1/Cash Handling Allowance/2008-14 dated at Mumbai 28.06.19

The matter has been considered in the Directorate and clarified the queries are as under.

Query No.1. Whether the revised rates of 7th CPC for Cash Handling Allowance and Treasury Allowance are also applicable for cash handling to the Sub Postmasters in single and double handed Post offices and to those Sub Postmasters in Post Offices where there is no separate Treasury is justified.

Clarification: Not applicable. Already clarified in para 2 (iv) and (v) of DOPT OM No. 4/6/17- Estt.(Pay-II) dated 18.01.2019.

Query No.2: Whether Rs. 700/- rate of Cash Handling Allowance and Treasury Allowance is to be granted directly to all eligible operative staff as it fixed for amount <=5 lakh average monthly cash handled or whether it is to be calculated and fixed every year based on the statistics of previous financial year’s average quantum cash disbursed for the Treasurers and Sub Postmasters in Post Offices where there is no separate Treasurer is justified.

Clarification: As per para 2(iii) of the said OM dated 18.01.2019 ” the Cash Handling and Treasury Allowance should be reviewed every financial year.”

Query No.3. Whether Cash Handling Allowance and Treasury Allowance will be allowed to all Treasurers in big offices if more than one Treasurer is working in those offices.

Clarification: No. Already clarified in para 2(vi) of the of the aforesaid mention OM dated 18.01.2019 that “not more than one official should be allowed the Cash Handling Allowance and Treasury Allowance in an office.”

Ref: (i) Railway Board’s letter No. PC-VI/2012/I/RSRP/1 (RBE No.40/2012).

        (ii) NFIR’s letter No. I/I 1/Part I dated 07/09/2018.

       (iii) NFIR’s letter No. I/11/Pt. II dated 11/02/2019.

  Federation vide its communications dated 07/09/2018 & 11/02/2019 brought to the notice of Railway Board a specific case of wrong fixation of pay in favour of Shri Satyendra Kumar Lal, Chief Typist, DLW, Varanasi. Along with its communication, Federation also provided a chart highlighting the pay fixation done (Drawn) by the DLW/Varanasi vis-à-vis the pay due to be fixed in pursuance of Board’s instructions contained in RBE No. 40/2012 and requested that suitable instructions be issued to the GM/DLW, as also to other Zonal Railways etc., for proper implementation of Board’s orders (RBE No. 40/2012). Federation is disappointed to note that though period of over one year has passed, no action has been taken in the matter, while the employee continues to draw less salary.

NFIR, therefore, once again requests the Railway Board to connect Federation’s letters dated 07/09/2018 and 11/02/2019 and issue suitable clarification to the Zones etc in general and DLW/Varanasi in particular to ensure correct implementation of the instructions contained in RBE No. 40/2012 so as to avoid financial loss to employees on their pay fixation in 7th CPC Pay Matrix.

A copy of the instructions issued may be endorsed to the Federation.

Sub: Revised pay limits for entitlement of Passes/ PTOs.

Consequent to implementation of 7th Central Pay Commission’s recommendations and notification of Railway Services (Revised Pay) Rules, 2016, the “Grade Pay” component has been dispensed with and “Pay Level in Pay Matrix” (PLPM) has been introduced in the pay structure of railway servants.

Hence, switching over to 7th CPC based PLPM to determine pay limits for entitlement of Passes / PTOs has been under consideration.

The Competent Authority has now accorded his approval for amending the extant provisions of Railway Servants (Pass) Rules-1986 (Second Edition-1993) (RSPR-1986) to switch over to “ Status (i.e. Gazetted/ Non-gazetted) cum PLPM ” basis to determine the entitlement of Passes/ PTOs, as indicated in the enclosed Advance Correction Slip No.81.

The extant provisions of RSPR-1986 and other administrative instructions issued from time to time shall continue to apply in all other respects.

If a railway servant, who is presently entitled to First Class Pass becomes ineligible to First Class Pass on the basis of revised criteria, the First Class Pass may be allowed as personal to the employee.

This issues with the concurrence of the Finance Directorate of the Ministry of Railways.

S.R.O. 08(E).- In exercise of the powers conferred by the proviso to Article 309, and Clause (5) of Article 148 of the Constitution, the President hereby makes the following rules to amend the Civilians in Defence Services (Revised Pay) Rules, 2016, namely :-

(1) These rules may be called the Civilians in Defence Services (Revised Pay) (Amendment) Rules, 2019.

(2) They shall be deemed to have come into force on the 1st day of January, 2016.

In the Civilians in Defence Services (Revised Pay) Rules, 2016,-

(a) in Rule 5, the following amendment be made;

For:
“Provided further that in cases where a government servant has been placed in a higher grade pay or scale b/w I" day of January, 2016 and the date of notification of these rules on account of promotion or upgradation, the government servant may elect to switch over to the revised pay structure from the date of such promotion or upgradation, as the case may be.”

Read as:
“Provided further that in cases where a government servant has been placed in a higher grade pay or scale b/w 1" day of January, 2016 and the 25" day of July, 2016 on account of promotion or upgradation, the government servant may elect to switch over to the revised pay structure from the date of such promotion or upgradation, as the case may be.”

Sub: Implementation of the recommendation of 7th CPC on Over Time Allowance (OTA) preparation a list of those staff coming under the category of 'Operational Staff' reg.

I am directed to refer to Department of Personnel and Training OM No.A-27016/03/2017- Estt.(AL) dated 19.6.2018 circulated vide letter No.52-0/2018-PAP dated 4.7.2018 on the above subject. According to the said O.M. Government has decided to discontinue OTA for categories other than Operational Staff and industrial employees.

2. As per para 1 of this OM "Ministries/Departments to prepare a list of those staff coming under the category of "Operational Staff. The following definition shall be used to define Operational Staff.
"All non-ministerial non-gazetted Central Government servants directly involved in smooth operation of the office including those tasked with operation of some electrical or mechanical equipment."

3. In this regard, it is requested to prepare a list of operational staff with full justification based on the above parameters for inclusion of a particular of a particular category of staff in the list of operational staff and submit it to this office latest by 04.02.2019.

** In respect of Accounts Department Officers, similar procedure may be followed for fixation of Pay on grant of Non functional Upgradation from Level-9 to Level-10 in respect of officials officiating in Sr.Scale (Level-11) prior to grant of NFU.

*** If the employee in this illustrations is drawing more pay than that computed due to fixation at Rs.80900, the higher pay of that employee in such circumstances shall be protected as “Personal Pay” till the date it is adjusted by the next increment.

Sub: Clarifications regarding payment of Breakdown Allowance.
Ref:- Board's letter of even number dated 30.08.2017 (RBE No.106/2017)

In context of Board's letter cited above, references have been received in Board's office from some Zonal Railways, seeking clarifications regarding entitlement of Breakdown allowance to Technician Gr.11l drawing pay in higher level i.e. Pay level 3 under MACPS rather than the pay level available for the post. The issue has also been raised by AIRF in PNM Forum as item No.15/2018 and NFIR in their letter dated 11.04.2018.

2. The matter has been examined in Board's office and it has been observed that the MACP Scheme provides for grant of financial upgradation to the employees on personal basis and there occurs no change in the designation, classification or status. The concerned employees continue to discharge the duties and responsibilities of the post held by them. In view of this, it is clarified that the Breakdown Allowance has to be paid at the rate(s) as prescribed against the respective post mentioned in para-1 of Board's letter cit. 30.08.2017. Accordingly, Technician Gr.III though drawing pay in higher pay level under MACPS, are entitled for Breakdown Allowance at the rates prescribed for the post held by them.

3. The other terms and conditions relating to Breakdown Allowance will remain the same.

4. This issues with the concurrence of the Finance Directorate of the Ministry of Railways.

Sub: Clarification regarding Travelling allowance (TA) rules after the implementation of 7th CPC.

Sir,
The undersigned is directed to refer to your letter dated 25.07.2018 on the above mentioned subject. In this regard, the following is clarified:-

(i) As per rule position as mentioned in SR-71 of FRSR part-II TA rules, TA for a local journey shall be admissible if the temporary place of duty is beyond 8 km from the normal place of duty irrespective of whether the journey is performed by the Government servant from his residence or from the normal place duty. Further, for local journeys, a Government servant will draw, for journey involved, mileage allowance and in addition draw 50% of daily allowance as per OM dated 13 07.2017

(ii). After the recommendations of 7th CPC on Allowances, OM dated 13 07.2017 regarding TA rules has been issued by this Department wherein Daily Allowance on tour comprises 3 components i.e. Hotel accommodation, travel within the city and food charges. For local journey beyond 8 kms, the following may be admissible:-
a. Hotel accommodation:- Not Applicable.
b. Travel within the city/Mileage Allowance:- As per para 2 (E) (i) of OM dated 13.07.2017.
c. Food charges - 50 % of amount payable on tour as mentioned in pare 2 (E) (v) of OM dated 13.07.2017as follows:-

It is to inform that Govt. of India vide its OM No. 42/14/2016-P&PW(G) dated 24.10.2016 has provided an option to the pensioners retired between 01.01.2016 to 04.08.2016, in relaxation of Rule 10 of CCS (Commutation of Pension) Rules,1981, not to commute the pension which has become additionally commutable on revision of pay/pension on implementation of recommendations of the 7th CPC.

The Govt. of India OM is also enclosed for ready reference.

Sub: Direct recruitment from open market in Level-1 (7th CPC pay matrix) - Procedure-regarding.

The non-materialization of full panel despite all out efforts made by the Railway recruiting agencies has been engaging the attention of the Board. Accordingly, the procedure for recruitment from open market in Level-1 was reviewed and following decisions taken with respect to different instructions issued from time to time:-

i) Para 1 (ii) of instructions contained under RBE No. 138/2014 dated 10.12.2014 lays down that “the number of candidates called for Physical Efficiency Test (PET) should be 02 (two) times the number vacancies”.

- In modification of above, the number of candidates to be called for PET should now be 03 (three) times the number notified vacancies.

ii) Para 3 of instructions contained in RBE No. 73/2008 dated 17.06.2008 lays down that “the number of candidates called for Document Verification (DV) shall be 20% over & above the number of vacancies”.

- In modification of above, henceforth, the number of candidates to be called for DV shall be twice the number of notified vacancies.

iii) Para 2 of instructions contained in RBE No. 06/2014 dated 10.01.2014 stipulates that “no replacement panels are to be given against non-joining of selected candidates”.

- In modification of the above, it has been decided that the panel will now be formed to the extent of the notified vacancies with a standby panel of 50% of the notified vacancies. In case the main panel plus stand-by is also exhausted and still there is a shortfall vis-a-vis notified vacancies, the recruiting agency may further go down in the list of candidates which meet the requirement of minimum qualifying marks in their respective community for conducting PET (if needed) and DV/ME to the extent of shortfall community-wise. This may be done till the demand from the concerned Railway administration w.r.t. indent placed and vacancies notified are fully met. These provisions shall be subject to currency of the panel.

2. The above guidelines will also be applicable to recruitment notification published under Centralized Employment Notice No. 02/2018, issued by Railway Recruitment Boards.

Comrades,

The meeting of the 7 CPC National Anomaly Committee was held today (17/7/2018). Shri Chandramouli, Secretary(P), DOPT presided over this meeting. The Department of personnel had identified the following six items only for discussion:

1.Item No.3 - Removal of Condition of 3% stipulated to grant bunching benefit
2.Item No.4 - Fixation of pay on promotion
3.Item No.5 - Removal of Anomaly in pay matrix
4.Item No.8 - Lesser pay in higher level of pay matrix
5.Item No.9 - Bunching of steps in the revised pay structure
6.Item No.14 - Grant of GP 5400 to Sr section officer of Railways and AAOs of IA&AD and Organised Accounts (Civil Accounts, Postal Accounts and Defence Accounts)

After completing discussions on the above items the Staff Side insisted that the following remaining items may also be given up for discussion.

Item No.2. 3 % increment at all stages
Item No.6 Anomaly due to index rationalization
Item No.7 Anomaly arising from the decision to reject option No.1 in pension fixation
Item No.10 Minimum Pension

Item No.18 Anomaly in the grant of D.A. installment w.e.f. 1.1.2016

After discussion on the above items, the official side informed that the DOPT had already examined those issues and have come to the conclusion that those items will not come under the ambit of the definition of Anomaly. The Staff Side contested this. It was decided that the DOPT will convey the reasoning to the staff side and hold meeting with the Staff Side to sort out the differences.
The following items has been referred to Departmental Anomaly Committee of the respective Department/Ministries.

Item No.15. Technical Supervisors of Railways
Item No.16 Anomaly in the assignment of replacement of Levels of pay in the Ministry of Defence, Railways, Mines etc in the case of Store Keepers
Item No. 17 Anomaly in the assignment of pay Levels in the case of Research Assistants in Ministry of AYUSH, Homeopathic Department.

The staff side then raised the following other issues.
1. Central Govt employees may bc granted one more option to switch over to 7 CPC from a date subsequent to 251h of July 2016 - the official side in formed that the matter is under consideration and a decision would be taken shortly.

2, The issue of pay fixation of ex-servicemen in the Last pay drawn by them before retirement from armed forces is remaining unsettled - the official side informed that the matter has been referred to Min. of Defence by DOPT for their comments. Decision Would be taken after receipt of comments from MOD.

3. The Staff side raised the issue of not convening meetings of the National Council, JCM and Standing Committee.

4. The Staff Side also informed of the decision taken by the NJCA in its meeting held on 3-7-2018 of the revival of the deferred indefinite strike by the Central Govt Employees if no settlement is brought about on major demands like upward revision of minimum pay, fitment factor and NPS before 7-8-2018.

Railway Board’s order dated 12.06.2018 refers (Annexure-I). A Committee consisting of Executive Director/Pay Commission-II Railway Board as Convener, Executive Director/Estt. (GC) Railway Board and Executive Director/Transformation Cell (Mechanical) Railway Board as Members has been constituted "to examine in detail the issue of granting Group 'B' status (Gazetted / Non-Gazetted) to various existing Group 'C' posts of Indian Railways (including repercussions and modalities) in line with DoP&T's order no. 11012/10/2016-Estt. A -III dated 09.11.2017".

2. It is requested that the above be circulated among all the stakeholders in the Zonal Railways. Their comments/representations if any in this regard can be directly addressed to the undersigned at Room No. 325, 3rd Floor, Railway Board, DFCCIL Building, Pragati Maidan Metro Complex, New Delhi- 110001. The relevant envelopes may clearly be superscribed with "For Committee examining classification of Railway Posts" on top. Ministry of Railway (Railway Board) have decided to constitute a committee to examine classification of Railway Services consequent upon implementation of Railway Services (Revised Pay) Rules, 2016 in consultation with all stakeholders. The Committee will consist of the following :-

i. Executive Director /Pay Commission-II, Railway Board - Convener
ii. Executive Director/Estt.(GC), Railway Board - Member
iii. Executive Director/Transformation (Mechanical), Railway Board - Member

2. The Terms of Reference of the Committee will be as under:
"To examine in detail the issue of granting Group 'B' status (Gazetted/Non-Gazetted) to various existing Group 'C' posts of Indian Railways (including repercussions and modalities) in line with DoP&T's order no.11012/10/2016-Estt.A-III dated 09.11.2017."
3. The Committee should examine the issue in consultation with various stakeholders & submit its report within one month from the date of its constitution.

4. The Headquarters of the Committee will be at New Delhi.

5. PC-VII branch of Railway Board will be the Nodal branch for functioning of the commission Therefore, submission of report of the Committee for consideration of Railway Board, implementation of its recommendations and all related issues including parl. Questions, RTI cases and other formalities with regard to the Committee, shall be dealt with by PC-VII branch.

6. The Convener and Members of the Committee will draw TA/DA as per extant rules.

Subject:- Payment of Dearness Allowance to Haryana Government Employees on revised scales (7th Pay Commission) i.e. 5% to 7% effective from 01.01.2018.

Sir/Madam,
I am directed to invite reference to Finance Department circular letter No.4/3/2016-5FR/30416 dated 23rd October, 2017 on the subject noted above and to say that the Governor of Haryana is pleased to decide that the Dearness Allowance payable to Haryana Government employees on revised scales of pay shall be enhanced from the existing rate of 5% to 7% of the pay w.e.f. 1st January, 2018.

2. The installment of Dearness Allowance payable under these orders shall be paid in cash to all Haryana Government employees with the salary for the month of June, 2018 to be paid in July, 2018.

3. The payment of arrears of enhanced Dearness Allowance for the month from January, 2018 to May, 2018 shall be made in the month of July, 2018.

4. The provisions contained in para 3,4,5,& 7 in FD’s instruction No. 4/3/2016-5FR/35222 dated 25th November, 2016 shall continue to be applicable while regulating Dearness Allowance under these instructions.
