OFFICE MEMORANDUM

Subject: Protection of pay in cases of deputation under Central Staffing Scheme in terms of Rule 12 of Central Civil Services (Revised Pay) Rules, 2016 (7th CPC) – Regarding.

The undersigned is directed to say that this Department has been receiving queries from various Ministries/ Departments regarding method of pay protection in terms of Rule 12 of Central Civil Services (Revised Pay) Rules, 2016 which is as under :

 

’12. Pay protection to officers on Central deputation under Central Staffing Scheme – If the pay of the officers posted on deputation to the Central Government under Central Staffing Scheme, after fixation in the revised pay structure either under these rules or as per the instructions regulating such fixation of pay on the post to which they are appointed on deputation, happens to be lower than the pay these officers would have been entitled to, had they been in their parent cadre and would have drawn that pay but for the Central deputation, such difference in the pay shall be protected in the form of Personal Pay with effect from the date of notification of these rules.’

Rule 12 of Central Civil Services (Revised Pay) Rules, 2016 was subsequently amended vide Department of Expenditure Notification No.1-2/ 2016-IC dated 15th June 2017 which inter-alia provides that the aforesaid provision would take effect from 01.01.2016.

  1. Pay protection of officers on deputation under Central Staffing Scheme after implementation of CCS (Revised Pay) Rules 2016 has been considered in consultation with the Department of Expenditure and is elaborated in subsequent paras.
  2. Pay Protection of officers who were already on deputation under Central Staffing Scheme on 01.01.2016 or who join deputation under Central Staffing Scheme on or after 01.01.2016

(a) Pay of such officers, as on 01.01.2016 [or a subsequent date from which they have opted to switch over to the CCS (Revised Pay) Rules, 2016] will be fixed in the Level of the post held by them on deputation under Central Staffing Scheme on the basis of the pay fixed in their parent cadre. The cell corresponding to the basic pay fixed in the parent cadre will be located in the Level in the Pay Matrix of the post in which the officer is serving on deputation under the Central Staffing Scheme and pay shall be fixed at the same stage/ equivalent cell. If no such cell is available in the applicable Level of the ex-cadre post, the pay shall be fixed at the immediate lower cell in that Level of the ex-cadre post and the difference in pay will be granted as Personal Pay.

Illustration :
If an officer holding the post in Level 15 in parent cadre and drawing pay of Rs. 2,05,100/ – goes on deputation under Central Staffing Scheme in Level 14 on 04.05.2017, his pay will be fixed as under:

(a)Existing Level in the parent cadreLevel 15
(b) Existing pay in Level 15 as on 04.05.2017 in the parent cadreRs. 2,05, 100/-

(b) However, if an officer currently drawing pay up to Level 13 is appointed on deputation to a post in the equivalent or lower level on deputation under Central Staffing Scheme OR during the continuance of deputation under Central Staffing Scheme gets an up-gradation in his parent cadre to a Level higher than pay Level of deputation post up to Level 13 of the Pay Matrix, his pay will be fixed at the same cell and Level in which he is placed in the parent cadre. He will also be eligible to draw the CDTA on the pay of Level of the post in parent cadre at the prevailing rates. For the active period of a deputation from 1.1.2016 to 30.6.2017, CDTA will be admissible at the pre-revised rates in the pre-revised pay structure, i.e. as if the pay had not been revised w.e.f. 1.1.2016. Provisions of this Department’s OM No.2/ 10/2017-Estt(Pay-II) dated 24th April 2018 shall stand amended to this effect. For the active period of a deputation from 1st July 2017 onwards, CDTA will be admissible as per the guidelines in this Department’s OM No. 2 / 10/2017- Estt. Pay-II dated 24th April 2018.

Illustration :
(i) If an officer holding the post in Level 13 in parent cadre and drawing pay of Rs. 1,26,800/- goes on deputation under Central Staffing Scheme in Level 13 on 22.02.2017, his pay will be fixed as under:-

(a)Existing Level in the parent cadreLevel 13
(b) Existing pay in Level 13 as on 22.02.2017 in the parent cadreRs. 1,26,800/- (cell 2 of Level 13)

(ii) If an officer holding the post in Level 13 in parent cadre and drawing pay of Rs. 1,26,800/- goes on deputation under Central Staffing Scheme in Level 12 on 22.02.2017, his pay will be fixed as under :-

the parent cadre

  1. Protection/ Fixation of pay of officers who were on deputation under Central Staffing Scheme on 01.01.2016 or who joined deputation under Central Staffing Scheme on or after 01.01.2016 and got Proforma promotion in parent cadre:-

(a) In case the officer was on deputation under CSS on 01.01.2016 or joined thereafter and his junior is promoted to a higher post in his parent cadre on or after 01.01.2016 but was not granted proforma promotion under the ‘Next Below Rule’, there will be no change in the pay fixation already done as per extant rules.

(b) In case an officer on deputation to a post under Central Staffing Scheme gets proforma promotion in his cadre to a post-up to Level 13 in the Pay matrix, his pay in the Level of the post will be fixed with reference to the presumptive pay that he would have got had he remained and promoted in the parent cadre of his service in the manner as provided in para 3(b).

(c) In case an officer on deputation under Central Staffing Scheme gets promoted in his cadre to a higher post in Level 13A or above in the Pay matrix, his pay in the Level of the post held on deputation under Central Staffing Scheme will be fixed with reference to the presumptive pay of the officer in the parent cadre of his service. The Cell corresponding to such basic pay fixed in parent cadre will be located in the Level in the Pay Matrix of the post in which the officer is serving on deputation under Central Staffing Scheme, and pay shall be fixed at same stage/equivalent cell and if no such cell is available in the applicable Level, the pay shall be fixed at the immediate lower cell in that Level of the post and the difference in pay will be granted as Personal Pay. Illustrations may be seen below: –

If an officer holding the post in Level 16 in parent cadre drawing pay of Rs.2,24,400 / -, who is on deputation under Central Staffing Scheme in Level 15 and drawing pay Rs. 2,24,100/ – + Rs.300/ – (Personal pay) gets proforma promotion in Level 17, his pay will be fixed as under:

(a)Pay Level in the pay matrix in parent cadre before joining on deputation under Central Staffing SchemeLevel 16

  1. (a) The officer shall get Dearness Allowance on the admissible from time to time. However, no other allowances this Personal Pay. said Personal Pay as shall be admissible on this Personal Pay.

(b) The Basic Pay Plus Personal Pay, from time to time, shall not exceed Rs.2,25,000.

7th Pay Commission Revised Pay Matrix Table for Central Government Employees – Pay Matrix Level 12

  1. Grant of annual increment to officers on Deputation under Central Staffing Scheme

    On grant of annual increment to an officer in parent cadre (upto Level 16,) who is on deputation under Central Staffing Scheme, the pay will be fixed incrementally moving down one cell in the Level of pay in which the officer is serving on deputation under Central Staffing Scheme. Accordingly, the Personal Pay, if any, will be re-computed as the difference in the pay (after increment) that he would have drawn in the parent cadre and the current pay on deputation under Central Staffing Scheme.
  2. This O.M. shall take effect from 01.01.2016.
  3. This issues with the concurrence of the Department of Expenditure.
  4. In their application to employees of the Indian Audit and Accounts Department, these orders are issued after consultation with the Comptroller and Auditor General of India as mandated under Article 148 (5) of the Constitution.

Subject: Stepping up of pay of senior Assistants of CSS drawing less pay on promotion in the Section Officers Grade than their juniors – OM No. 18/2/2007- CS-I dated 20.05.2014 – Writ Petitions filed in the matter -regarding.

The undersigned is directed to refer to this Department’s OM of even number dated 01.07.2019 wherein instructions, for dealing with stepping up of pay cases consequent to directions of Hon’ble High Court of Delhi vide their interim orders in various Writ Petitions filed in the matter, were issued.

2. In this connection it is reiterated that the pay of the petitioners and similarly placed non-petitioners is to be restored only if they submit the ‘Affidavit of Undertaking’ as directed by the Hon’ble High Court of Delhi in the format attached with this Department’s OM under reference.

3. As regards the manner in which the pay is to be restored, it is clarified that the pay of the petitioners and non-petitioners, who submit the affidavit of undertaking in the prescribed format, may be restored notionally from the date with effect from which the stepping up of pay was granted earlier and regularly from the date of submission of the affidavit of undertaking as directed by Hon’ble High Court of Delhi subject to the outcome of the Writ Petitions or orders of any competent court in related matters.

4. If an officer, whose pay has been restored in accordance with the above instructions, superannuates or retires voluntarily, his/ her case may be dealt as per the provisions of CCS (Pension) Rules 1972 relating to provisional pension, payment of gratuity etc.

  • The post is to be filled up by transfer on deputation (including short term contract) for a period of five years or age of superannuation whichever is earlier.
  • Officers from the Central or State Governments, Universities, Central Educational Institutions, Central Autonomous Bodies. Recognised Research Institutions or Public Sector Undertakings.

  • Seven years experience in the field of education, educational administration, policy planning, academic work concerning school education including planning, implementation and research in an institution of open and distance learning.
Note. 1 - Period of deputation including period of deputation in another ex-cadre post held immediately preceding this appointment in the same or some other organization or Department of the Central Government shall ordinarily not exceed five years or till the date of superannuation (60 Years) whichever is earlier.

Note.2 - The maximum age limit for appointment by deputation including short term contract shall not be exceeding 58 years as on the closing date of the receipt of applications.

This is regarding filling up the posts of Deputy Secretary/ Director level in the National Institution for Transforming India (NITI) Aayog under the Central Staffing Scheme on lateral shift basis. The applications were invited for the post vide circular of even number dated 27.11.2019 (copy enclosed).

2. It has been decided to extend the last date for submission of application till 05.02.2020.

If the officer is selected for the post, it will be treated as a 'lateral shift', which would entail additional tenure of three year as per the special dispensation allowed for appointment in NITI Aayog that permits total deputation tenure up to 8 years on shift to NITI Secretariat or vice versa. The +3 option would be available only to those officers who are already working on a CSS/Non-CSS post/ex-cadre post the, centre. The additional tenure is subject to completion of two years on the present stint on the deputation post and availability of cadre clearance in the absence of cadre clearance (for +3 tenure), the tenure will he restricted to the balance period of four/five years central deputation tenure

Subject:- Submission of Immovable Property Return (IPR) for the year 2019 (as on 31.12.2019) by the Officers of Central Secretariat Services (CSS) reg.

In terms of Rule 18 of CCS (Conduct) Rules, 1964, the Immovable Property Return is required to be furnished by the CSS Officers in the grade of Under Secretary and above, latest by 31 .01.2020. IPR should be submitted by all the CSS Officers through Web Based Cadre Management System which is hosted at cscms.nic.in. A copy of the print out (IPR submitted online) duly signed, should also be submitted to CS.I (PR/CMS) Section, which is the custodian of Immovable Property Return (IPR) of these Officers. Assistant Section Officers and Section Officers of CSS will also submit the print out (IPR) duly signed, to their respective Admin/ Vigilance Division.

Ministries/ Departments are therefore, requested that the contents of this O.M. may be widely circulated to the notice of all CSS Officers/Officials working under their respective control. They should also ensure that the IPR for the year 2019 (as on 31.12.2019) is submitted within the stipulated time by all the CSS Officers. The officers are also informed that non-submission of IPR within the stipulated date, would invite the denial of vigilance clearance for empanelment, deputation and applying to sensitive posts and assignment to training programme (except mandatory training) as the IPR status needs to be checked for the said purpose(s).

It is, therefore, requested that all the CSS Officers may be directed to file their Immovable Property Return (IPR) for the year 2019 (as on 31.12.2019) well in time, latest by 31.01.2020, through Web Based Cadre Management System only. IPRs received beyond the stipulated date, shall not be regarded as conforming to the extant guidelines. It is also stated that the date of filing of IPR will start from 01st January, 2020 and the "Immovable Property Returns" window shall be opened/provided at cscms.nic.in. automatically from that date only.

The undersigned is directed to refer to this Department's OM of even number dated 01.07.2019 where by the Ministries / Departments were asked to defend the Writ Petitions filed in Hon'ble High Court of Delhi in the above matter on the basis of inputs provided by this Department

2. The above said instructions were issued with a view to ensure that uniform facts are placed before the Hon'ble High Court with analysis of method of pay fixation/re-fixation of the petitioners pursuant to issue of DOPT OM dated 20.05.2014.

3. All the applications filed by a number of applicants were heard together and orders had been passed by the Learned CAT on 11.01.2019 rejecting prayer of the applicants.

4. Against the above orders of CAT, the applicants have filed Writ Petitions in Hon’ble High Court of Delhi. As on date, 10 Writ Petitions have been filed by individual/group of officers. The Ministries/Departments concerned have been asked to prepare counter replies based on the reply filed by this Department in WP No.1225/2019 (Pramod Sahoo & Ors Vs. UOI). Accordingly, the Ministries/Departments are sending the counter replies prepared by them to this Department for meeting.

5. It is observed that the cause of action, prayers made and issues under adjudication in all the cases are the same. Hence, it has been decided that the Ministries / Departments may file the counter reply based on inputs made available by this Department (reply filed in Pramod Sahoo case) in consultation with Government Counsel after ensuring factual accuracy of the case. A copy of the reply so filed may be endorsed to this Department for records.

6. However, all fresh cases filed in Delhi High Court in the matter may be duly reported to this Department by the Ministry / Department concerned as and when the WPs are received at their end. Further, the counter replies may be filed immediately, under intimation to this Department.
7. The Ministries / Departments have also been requested to get their cases tagged/connected with WP No. 1225/2019 so that all the cases containing similar cause of action could be heard together.

ORDER

This Department's order of even number dated 09.08.2019 directed the concerned Ministries/ Departments to relieve the officers(s) concerned by 13.08.2019 under Rotational transfer policy so that the officers could join the allocated Ministry/ Department. However, it has been observed that not all the officers have been relieved so far

Apart from this, there have been request from Ministries/ Departments for retention of officers. The matter has been examined in the Department. However, it has been decided not to accede to request for retention of any officer.

According, all the Under Secretaries who have not yet been relieved, are hereby deemed relieved from their respeclive Ministries/ Departments w.e.f. 09.2019(AN) with the direction to report for duty to their allotted Ministries/ Departments. The only exception will be in respect of Officers who are Presently undergoing mandatory E Level Training till 04.10.2019. They will join the new Ministries/ Departments on completion of training.

The concerned cadre units as well as the officers concerned are requested to comply with the order. The onus to join the allocated Ministry/ Department on the basis of order dated 09.08.2019 issued by this Department will be on the officer concerned and failure to do so may attract punitive action. It will also be incumbent upon the Ministry/ Department and the officer concerned not to draw salary beyond the stipulated date.

If the officer is selected for the post, it will be treated as a lateral shift'. which would entail additional tenure of three years as per the special dispensation allowed For appointment in NITI Aayog that permits total deputation tenure up to 8 years on shift in NITI Secretariat or vice versa. The +3 option would be available only to those officers who are already working on a CSS/Non-CSS post/ex-cadre post at the centre. The additional tenure is subject to completion of two years on the present stint on the deputation post and availability of cadre clearance. In the absence of cadre clearance (for +3 tenure), the tenure will be restricted to the balance period of four/five years central deputation tenure.

The post may be circulated amongst tile officers working on deputation at Deputy Secretary / Director or equivalent level on Central Staffing Scheme/ Non Central Staffing Scheme/ ex-cadre posts in the Government of India on priority basis. Names of the willing and eligible officers who can be spared by the Ministries/ Departments may be forwarded to this Department along with the approval of the Minister-in-Charge, cadre clearance (for +3 tenure vigilance clearance, detailed bio-data in the enclosed proforma and attested copies of ACR (s).

Sir/Madam,
The Training Division of the Department of Personnel and Training is the nodal agency for training of government functionaries and is primarily responsible for formulating policies with regard to training -. With the objective of addressing competency gaps of government employees, the Division also directly implements certain training components. Under One Week In-Service Training (1ST) Scheme, officers of All India Services (lAS, IPS & IFoS), officers working under Central Staffing Scheme and officers of CSS/CSSS (DS/Sr. PPS and above level) are offered one week training programmes at various reputed institutes in India.

This letter is to invite proposals from the interested institutes for conducting one week in service training programme for 2019-20 in diverse and broad thematic areas, such as, Administrative Law, Agricultural & Rural Development, Climate Change (preparedness), Competition Law (policy formulation), Corruption (eradication strategy), Education (reforms & challenges), E-governance (opportunities & challenges), Environment & Natural Resource (management), Environmental Impact Assessment (development projects), Ethics (Public Governance and Administration), Financial Markets (regulation), Fiscal Policy (Macroeconomic Management), Governance (IT management and improving through accountability), Infrastructure (Finance), Innovations (public service), Land Acquisition (rehabilitation & resettlement), Leadership, Participatory Management (Community Mobilization), PPP (negotiating strategies and urban development), Procurement (procedure & contracting), Project Analysis/Appraisal (risk analysis/management), Public Policy (management/governance), Quantitative Methods (management), Service Delivery (management), Social Policy (Governance), Social Sector (financing/marketing), Urban Development, WTO (basic/advance course), Citizen Centric, Cyber Crime, Stress Management, etc.

The proposal should include:

(a) A brief about the institute, infrastructure, faculty, core competence, and previous experience in conducting such programmes;
(b) Thematic focus of the course and the course title;
(c) Two suitable dates for each course between July 2019 to February 2020 as in April & May 2019 and March 2020 courses are not scheduled in view of Budget Session of the Parliament;
(d) Names and CV of the faculty members who would be imparting the training;
(e) How will the training be relevant to government servants and help them discharge their duties more effectively;
(f) Specific skills proposed to be instilled in the participants with regard to governance and administrative/technical skills;
(g) Name and CV of proposed Course Coordinator along with contact details;
(h) Draft programme design, content and pedagogy, draft time table-starting on Monday and closing on Friday;
(i) A paragraph on how the proposed course will be different from those offered by competing institutions;
(j) One page flyers with regard to programs the institute proposes to conduct for the academic year 2019-20 for the information of potential participants;
(k) Allocation of one day of the 1ST programs for field visit to important organizations or public sector bodies so as to give greater exposure to the government officers to policy implementation and ground level working;
(l) Feedback received from participants

Formal proposal may be sent to this Department before May 6, 2019.

The undersigned is directed to refer to this Departments' O.M. of even number dated 04.02.2019 whereby transfer order of 143 Under Secretaries (adhoc) who were initially promoted on "as is where is basis" was issued. So far around 23 officers have not reported to their respective Ministries/Departments where they were ordered to be posted.

2. Meanwhile, preparation is under way for the next round of adhoc promotions in Under Secretary grade. For this, this Department is required to assess the vacancies. Few Ministries/Departments have been reporting vacancies taking into account the current vacancies as well as the vacancies against which Under Secretaries have not reported for duty so far as mentioned in para 1 above. It is clarified that this Department has not cancelled the transfer order of any officers who are yet to join their respective Ministries/ Departments. Therefore, the vacancies remaining unfilled in Ministries/ Departments due to non joining of these officers cannot be filled up by a new incumbent. Simultaneously, the Ministries/Departments from where the officers are yet to be relieved may not adjust them against any subsequent vacancies which have now arisen.

3. All the Ministries/ Departments are requested to account for only those vacancies which have occurred in Under Secretary Grade after 04.02.2019 due to promotion to next higher grade, deputation, retirement etc. and intimate the same to this Department to enable us to fill them up in the fresh exercise of promotion.

All the Ministries/Departments were, therefore, requested vide O.M. dated 29.11.2018 to send ‘alert’ to all the officers for completing action on their part at the earliest and force forward APARs of ORUs, who failed to submit their self- appraisal by 14.12.2018, to next level i.e. Reporting Officer. The ‘SPARROW’ window has been closed on 31.12.2018.

Attention is invited to the O.M. dated 29.11.2018 followed by Secretary (P)’s D.O. dated 11.12.2018, in terms of which the APARs for 2017-18 pending at ORU level were required to be force forward to next level i.e. Reporting Officer. However, 51 APARs for 2017-18 were closed at ORU level. The concerned Ministries/Departments are requested to elaborate reasons for not force-forwarding these APARs to the next level i.e. Reporting Officer. A list of 51 ORUs whose APARs were not force forwarded is enclosed at Annexure.

Secondly, inspite of clear cut instructions from this Department vide O.M. No.21011/02/2009-Estt(A) dated 16.02.2009, a large number of APARs have been closed at the level of Reporting Officers and Reviewing Authorities. Further, around 286 APARs are pending for Disclosure. It is brought to the notice of all the Ministries/ Departments that the APAR for 2017-18 are now available for viewing to the officer concerned by visiting sparrow-css.eoffice.gov.in-> Dossier-Ny Completed PAR. The officers may be advised to view their APARs for 2017-18 through above link and send representation, if any, to their Ministry/Department, within 15 days from the issue of this O.M. Their representations may be examined as per the extant instructions and outcome of such representations may be intimated to the officer concerned under intimation to this Department.

All the Ministries/ Departments are, therefore, requested to take necessary action as per extant instructions and send a completion report alongwith a printout of APARs for 2017-18 closed on SPARROW web portal for records in this Division.

Sir/ Madam,
It is proposed to fill up vacancies of Deputy Secretary/Director level in the National Institution for Transforming India (NITI) Aayog under the Central Staffing Scheme on lateral shift basis.

2. The officers who are working at DS/Director level in different Ministries/Departments under tile Central Staffing Scheme/Non Central Staffing Scheme/ex-cadre posts will be eligible to apply for these posts. If the officer is selected for the post, it will be treated as a 'lateral shift', which would entail additional tenure of three years as per the special dispensation allowed for appointment in NITI Aayog that permits total deputation tenure up to 8 years on shift to NITI Secretariat or vice versa. The +3 option would be available only to those officers who are already working on a CSS/Non-CSS post/ex· cadre post at the centre. The additional tenure is subject to completion of two years on the present stint on the deputation post and availability of cadre clearance. In the absence of cadre clearance(for +3 tenure), tile tenure will be restricted to tbe balance period of four/five years central deputation tenure.

3. The post may be circulated amongst the officers working on deputation at Deputy Secretary/Director or equivalent level on Central Staffing Scheme/Non Central Staffing Scheme/ex-cadre posts in the Government of India on priority basis. Names of the willing and eligible officers who can be' spared by the Ministries/Departments may be forwarded to this Department along with the approval of the Minister-in-Charge, cadre clearance (for +3 tenure), vigilance clearance, detailed bio-data in the enclosed proforma and attested copies of ACR(s).

4. It is requested that the application(s) of the eligible officer(s) may please be forwarded so as to reach this Department by 28.01.2019.

Subject: Appointment of officers working in the Ministries/Departments under Central Staffing Scheme(CSS) to non-CSS posts in the Central Vigilance Commission(CVC) on shift basis

It is proposed to fill up vacancies of Deputy Secretary/Director level in the Central Vigilance Commission(CVC) on shift basis. The posts are non-CSS posts to be filled through Civil Services Board procedure.

2. The officers who are working at DS/Director level in different Ministries/Departments under the Central Staffing Scheme will be eligible to apply for these posts. If the officer is selected for the post, it will be treated as a 'shift' from a Central Staffing Scheme post to a non-Central Staffing Scheme post, which will entail additional tenure of two years as per the Consolidated Deputation Guidelines. The +2 option would be available only to those officers who were already working on a CSS post other than in the CVC. The additional tenure is subject to completion of two years on the present CSS post and availability of cadre clearance. In the absence of cadre clearance (for +2 tenure), the tenure will be restricted to the balance period of four/five years central deputation remaining to the officer. The maximum tenure admissible outside the cadre is seven years in both the stints CSS and nonCSS put together.

3. The posts may be circulated amongst the officers working at Deputy Secretary/Director or equivalent level under the Central Staffing Scheme in the Government" of India on priority basis. Names of the willing and eligible officers who can be spared by the Ministries/Departments may be forwarded to the Department alongwith the approval of the Minister-in-Charge, cadre clearance (for +2 tenure), vigilance clearance, detailed bio-data in the enclosed proforma and attested copies of ACR(s) for the period they have worked under CSS.

4. It is requested that the application(s) of the eligible officer(s) may please be forwarded so as to reach this Department upto 20.02.2019.

References have been received from various Ministries/Departments seeking clarity on the issue of granting additional two increments to DS/Sr. PPS on promotion from the grade of US/ PPS after implementation of Seventh Pay Commission.

2. The 7th CPC had recommended for . abolition of giving two increments on promotion to the post of DS/Sr. PPS of CSS/CSSS Cadre.

However, the matter is still under active consideration in consultation with Department of Expenditure. Any decision as and when arrived at will be intimated to all the cadre units of CSS/CSSS.

3. All the Ministries/ Departments are, accordingly, requested to take note of above.
