Sir,
We the undersigned employees belonging to the post of LDC/UDC are working in Farakka Barrage Project, under your kind control as well as under Govt. of India, Ministry of Water Resources beg to lay the following facts for your kind consideration and necessary appropriate action please.
01. That, most of us have joined in Govt. Service between 01-09-1984 prior to 1990 as LDC category, then our Pay Scale was Rs. 260-400/- as per 3rd CPC later on as per 4th CPC w.e.f. 01-01-1986 the Pay Scale was Rs. 950-1500/- and gradually promotional post was UDC / Head Clerk or Assistant respectively and the Pay Scale of UDC was Rs. 4000-6000/- and the Scale of Head Clerk was Rs. 5000-8000/- (Copy of Fixation of Pay or pre-revised and Revised are enclosed for ready reference).
02. The Financial Up-gradation under ACP Scheme was initially introduce in year 1999 i.e. on 09-08-1999 and as per this Scheme a Govt. servant (LDC in the instant case) with 12 years of regular service in the same post, Financial up-gradation to the next Scale of Pay Rs. 4000-6000/- in the same way the 2nd Up-gradation to the Scale of Pay Rs. 5000-8000/- was admissible after 24 years of regular service. There was no further Up-gradation in the ACP Scheme.
03. Consequent upon the recommendation of the 6th CPC and acceptance of GOI, DOPT was pleased to issue MACP Scheme vide OM NO. dated 19-05-2009 in which it was clearly indicated that the MACP Scheme will take prospective effect from 01-09-2008. It was also clearly mentioned in the OM that this order is issued in supersession of all previous orders i.e. ACP Scheme. In the OM a schedule regarding placement from one PB/GP to other upgraded PB/GP has been indicated in the Section-I, Part – A of the First Schedule of the CCS (Revised Pay) Rules 2008.
04. It is further stated that, under the modified MACP Scheme the above said two financial Up-gradation were converted into three Up-gradation as under :-

Sl. No. Description PB-1 Grade Pay
01 First Up-gradation on completion of 10 years of regular service 5200-20200 Rs. 2000/-
02 Second Up-gradation on completion of 20 years of regular service 5200-20200 Rs. 2400/-
03 Third Up-gradation on completion of 30 years of regular service 5200-20200 Rs. 2800/-

From the above it is evident that in the PB-1, 5200-20200 having GP Rs. 2400/- and the same PB-1 having GP Rs. 2800/- bears same and identical scale of pay, therefore placement from GP Rs. 2400/- in Pay Band 1 to GP Rs. 2800/- in same Pay Band-1, can not be termed as promotional/up-gradational benefit.
Thus granting of GP Rs.2800/- in same PB i.e. PB-1 is a cause of utter deprivation upon us from having our legitimate and lawful payments i.e. we instead of getting GP of Rs.4200/- in PB-2 is presently getting GP of Rs. 2800/- in PB-1.
In view of the above fact, it is further stated that who have joined before 01-09-1984 in various categories in the Govt. service they have got benefit second financial Up-gradation as per ACP Scheme, later on said employees are entitled for third Up-gradation as per MACP Scheme. In this connection a copy of Judgment of Hon’ble Principal Bench CAT, NewDelhi is enclosed for ready reference and kind
Therefore, we the petitioners are fervently request you to kindly process the case immediately for solving the utter discrimination caused upon us.
Hence we pray before your goodself to kindly unfurl the banner of Justice and save us from the financial crunch we are facing for.

2. Large number of posts of Assistant is lying vacant in NSSO Offices due to not taking up the merger of the posts of Office Superintendents & Assistants after a lapse of long 8 years since 6th CPC.
3. Posts of Administrative Officers are lying vacant very long for want of recruitment rules for the post.

Sir,
This Association had written a letter to your office vide letter No. Assn/2/2012/GS Dated 23/07/2012 to apprise the inordinate delay in implementation of cadre restructuring of Administrative Staff in NSSO Offices thereby bringing you the disappointment of the Staff shouldering heavy responsibilities of Administrative Officers in the NSSO Offices retiring on the post of UDC/Assistants without getting any pay parity (copy enclosed). Thereafter, I have contacted the concerned authorities in the Ministry several times and explained the miseries of the Administrative Staff of the NSSO Offices carrying higher responsibilities without getting a matching pay scale. But despite of a lapse of 1 year and 9 months after the submission of the aforesaid letter no significant development in the implementation of the Cadre restructuring has been taken place.
It is worth mentioning here that this is the only cadre restructuring for Administrative Staff which has been initiated by the Ministry since the very inception of the NSSO. But unfortunately the maiden Cadre restructuring itself has not reached anywhere even after 5 years from its initiation.

2. Non filling of vacancies of Assistant.
Large number of posts of Assistant is lying vacant in FOD Offices where UDCs are discharging duties of Assistant in addition to their own duties as UDC without any additional remuneration and forced to retire on the post itself. FOD has informed that vacant post of Assistant is not being filled up due to the pending merger of the posts of Office Superintendent and Assistant. In the Regional Offices of FOD Office Superintendent with Gazetted status were functioning as Section Officer and DDO and on the ground a request for upgradation of the OS post to the Section Officer was made by this Association immediately after implementation of the 6th Pay Commission. But the same was not considered by the Ministry. And yet, merging of these two posts has not taken place even after 8 years of implementation of 6th CPC. This has largely affected career of the UDC and LDCs of the FOD.

3. Non filling of vacancies of Administrative Officer.
Majority of the posts of Administrative Officer, sanctioned in the FOD Offices has been lying vacant for the reason that the recruitment rule for the post of Administrative Officer has not been finalized. The initiation for change of recruitment rule for the post would have been started immediately after the implementation of the Pay Commission. But it pains to note that after 8 years of implementation of the Pay Commission the recruitment rule for the post has not been modified and due to this only reason, the person qualified to get promoted to the post of AO are suffering.

It is requested to please take a favorable action on the matter immediately.

 Sub: Upgradation of grade pay of LDC & UDC in the Administrative branch of Government of India Offices.
Respected Sir,

With due respect it is to bring to your kind notice that the undersigned in the capacity as General Secretary of All India Association of Ministerial Staff (Group C) under the Ministry of Statistics & Programme Implementation, had made an appeal to your good office vide letter dated 16/04/2010(Enclosed in Annexure I) wherein it was described how the 6th Pay Commission recommendations disappointed the lakhs of LDC & UDC working in the Central Government Offices. Our contention was that while the 6th Pay Commission has recommended the merger of the various group D posts and upgraded the grade pay from 1400 to 1800, for the LDCs, only a replacement grade pay of Rs. 1900 i.e. just Rs. 100 above the MTS has been granted, even after raising the academic and technical qualification to get selected on the post. Moreover, all the pre-revised pay scales above UDC -from Accountant to Assistant Administrative Officer- have been merged and granted Rs. 4200 - 4600 grade pay. Thus the basic cadres who are responsible for the smooth functioning of the Central Government offices, especially in the subordinate offices, have ignored/neglected by the Pay Commission as well as the Government.

Considering the gravity of the subject contained in it the aforesaid appeal was forwarded to the Secretary, Department of Personal & Training for action vide PMO ID No. 4/3/2010-PMP4/158890 dated 18/05/2010 (Copy enclosed in annexure II). When any action on the matter has visibly been not taken by the DoPT till 2012, and having aggrieved on the prolonged delay, follow up correspondences have been made as follows

1.  Shri A.H. Lokhande, Jabalpur has sought the action taken report under RTI (copies enclosed in Annexure III (A) & III(B). But both CPIO & appellate authority vide letter No. 20/2/2012-Estt(Pay-1) dated 29Aug 2012 & letter No 20/2/2012-Estt(Pay-1) dated 23rd Oct 2012 respectively have confirmed that the said letter has not received at  DoPT and as such no action taken report can be given(copies enclosed in Annexure IV(A) & IV (B).

2.   Subsequently, the undersigned has obtained a copy of the acknowledgement in confirmation of the receipt of my letter dated 16/04/2010 at DoPT from the PM’s Office. In the light of the said acknowledgement, a letter seeking the copy of the action taken report/Noting drafting under RTI was sent to the CPIO DoPT vide letter dated 09/03/13 (Copy enclosed in Annexure V (A)-V(E).

3.   On 25th April 2013 I have received a letter from CS Section of DoPT (Annexure VI), which has not given the pointed reply I sought, and as such the same was not convincing. And accordingly an appeal was sent to the appellate authority under RTI act vide letter dated 29/04/2013 for which I have received a letter vide letter No. 20/1/2013-CS-II (B) dated 21st May 2013.(enclosed in Annexure VII (A) & VII(B)  wherein it was informed that “CS-II Division deals only with the LDCs & UDCs of the Central Secretariat Service and as such no records available CS-II Division, there is no proposal to upgrade the grade pay of the LDC & UDC of CSCS Cadre. The application of Shri A.H. Lokhande has not been received in this Division”. Accordingly an order for the disposal of the appeal has been passed.

From the above it is clear that the letter received in the DoPT from the PM’s office has not taken in the records of DoPT where it appears to have been  misplaced which led CPIO and appellate authorities  to state that no such letter is received at DoPT from the PM’s Office. In this respect, even after submitting/providing the proof the acknowledgement of the said letter (obtained from the PM’s Office), DoPT has not bothered to change their version. Moreover, the copies of the applications submitted by Shri A.H. Lokhande have been supplied and even after CS-II division has not changed their version of not receiving any letter from Shri A.H. Lokhande.

Above all, both Shri A.H. Lokhande and myself have sought information regarding the action taken report/noting/drafting in disposal of the letter forwarded to the Secretary, DoPT by the PM’s office vide letter No. 4/3/2010-PMP4/158890 dated 18/05/2010. In reply, the CPIOs and Appellate authorities (pay Division & CS-II Division) have been informing us that the said letter is not received in their section and as such no action is taken.

Sir, the Confederation of Central Government Employees & Workers, All India Railway men’s Federation, National Federation of India Railway men, the Defense Employees Federation and various other Central Government Employees’ Organizations have been writing to the Government to consider the upgradation of the grade pay of the LDC & UDC. Besides, the issue has been put up in the National JCM but the matter could not be discussed as the meeting of the National JCM meeting has not been called so far. Moreover, this item has been placed in the National Anomaly Committee (NAC) but the same has not been taken up for discussion in the NAC so far. It is also bring to your kind notice that all the websites related to the Central Government Employees have actively been discussing the issue as genuine.

Sir, the upgradation of the grade pay of LDC & UDCs is a genuine issue. Cases of all cadres baring the LDC & UDC were considered and favorable decision was taken by the 6th CPC. Similarly, the LDC and the UDC are also deserving  higher grade pays than the present one, to commensurate with the qualifications and assignments attached to these posts after the implementation of the recommendations of the 6th Pay Commission.

In view of the above, we seek your kind intervention to get a favourable decision in this   regard.

CONFEDERATION RESOLUTIONS IN FAVOUR OF ADMINISTRATIVE STAFF
 

Dear friends,

The issues related to the Administrative Staff of the Government of India as follows have been placed before the 24th Conference held at Kolkata during 4th to 6th May 2013 by the undersigned in the capacity as National Organizing Secretary of the Confederation. The resolution committee of the Conference has finally adopted these demands and the same will be taken up with the Government by the Confederation in the coming days.

1) Merger of LDC and UDC upgradation of Grade pay to 2800/- (Confederation resolution modified this as Rs. 2400/- for LDC & Rs. 2800 for UDC).

2) Parity in pay scales of the Ministerial and Stenographers between Field and Secretariat offices.

3) Granting Rs. 4200 grade pay to 30% UDC after completion 5 years service.

4) Granting of MACP on promotional hierarchy. Abolition of Grade pay Rs. 2000/- for granting of MACP.

5) Finalization & implementation of cadre restructuring pending with various Ministries/Ministry of Finance/DOPT before constitution of 7th CPC.

6) Continuation of the Association with the already identified cadres. Stop re-identification of already identified groups for recognition which is against the CCS (RSA) Rules.
