Your kind attention is invited towards AIRF’s letter bearing number even dated 19.11.2020, addressed to Director General (Human Resources), Railway Board (photocopy enclosed for kind perusal), whereby this Federation had elaborately explained the facts necessitating in-house system of medical facilities presently available for Serving / Retired Railwaymen and their dependent family members.
As we have already explained, keeping in view the peculiar nature of duties of the Railwaymen, who work under various arduous conditions in all weathers 24X7 throughout the year for keeping the wheels of the Indian Railways moving to ensure the overall development of the country, the existing medical facilities were created for them and their dependent family members.
It would be pertinent to mention here that, even in the Colonial Days, British Rulers had recognized the need for medical facilities for Railwaymen and established many Dispensaries and Hospitals during those days. Even after the Independence, Medical System over the Indian Railways has been expanded to a greater extent to meet the medical requirements of the Railwaymen and their families.
Medical facilities, so available for the Railwaymen, have been achieved by the Organised Labour after sustained struggle and persuasions in the wake of aforementioned peculiar working conditions.
It is a matter of concern that, Railway Board have not given any cognizance to AIRF’s viewpoint, already communicated to Railway Board vide AIRF’s letter dated 19.11.2020, addressed to D.G.(H.R.), Railway Board, and without consulting Organised Labour, who are representing more than one million Railway Employees and equal number of Retired Railway Employees(total number of beneficiaries being around one crore), Railway Board have been proceeding ahead for Medical Insurance to all the Railway Employees. This arbitrary change in the policy of medical assistance to Railway Employees is bound to create a lot of anguish in the minds of Serving as well as Retired Railway Employees.
AIRF, vide its communications No.AIRF/71 dated 06.08.2020, No.AIRF/101 dated 16.09.2020 and 19.11.2020 has already objected to the Railway Board’s proposal of Medical Insurance to all the Railway Employees, quoting various reasons, but instead of holding a discussion with the Recognised Federations, further information is being sought by the Railway Board from the Zonal Railways and Production Units, vide their letter No.E(W)2020 /Misc./ Dashboard-GIS dated 30.12.2020, with a view to proceed further in the matter.
AIRF is of the firm opinion that, Railway Administration should not compel and force Serving as well as Retired Railway Employees to accept the proposal of Medical Insurance being initiated by the Railway Board.
It would, therefore, be quite appropriate that, such type of exercises, which are bound to create avoidable discontentment and resentment among Serving as well as Retired Railway Employees, should be stalled immediately. We presume that, this exercise is being undertaken to appease some of the Corporates who are dealing in Insurance Business.
Railwaymen are already in endurance because of National Pension System(NPS), therefore, AIRF would not accept any kind of Medical Insurance to Railway Employees on Indian Railways, which would further aggravate the situation.
AIRF sincerely hope that, Railway Board will take it seriously, and stall such type of exercises, in the larger interest of Industrial Harmony, otherwise we will be forced to launch a massive agitation against anti-labour policies of the Railway Board.
With reference to the above, it is stated that Para 9 of Annexure to
Board’s letter dated 10.06.2009 (RBE No. 101/2009) explicitly mentions
that … “Regular service for the purpose of the MACPS
shall commence from the date of joining of a post in direct entry grade
on a regular basis either on direct recruitment basis or on absorption
re-employment basis. Service rendered on ad-hoc contract basis before
regular appointment on pre-appointment training shall not be taken into
reckoning… “. As such. ad-hoc service is not to be counted
for the purpose of MACPS and, therefore. the concerned employee is
entitled for 3rd financial upgradation under MACPS wef 11.10.2012
subject to fulfillment of other terms and condition as contained in
Board’: letter dated 10-06-09 (RBE No. 101/2009).
We are thankful to Railway Board for issuing instructions in the matter of treatment of absence during COVID-19 epidemic lockdown.
Many of the employees have had to remain away from their work, subsequent to the lockdown, whose absence is pending regularization. Many of the employees were forced to remain under quarantine due to various situations, which can be classified broadly as follows:-
(i) An employee was asked to remain in quarantine on return from outstation duty. (ii) An employee remained in quarantine due to Central/ State Government instructions. (iii) An employee was advised by Railway Medical Authority to remain in quarantine. (iv) An employee who chose to remain in quarantine as a precaution. (v) An employee who worked from home due to co-morbidity or underlying medical conditions as per Central/ State Government instructions. (vi) An employee stayed at home as a precautionary measure and later found to be COVID-19 positive.
It is, therefore, requested that, necessary instructions for treating absence of an employee during aforementioned situations, as “Special Casual Leave”, may kindly be issued at the earliest. Orders issued for maximum 30 days “Special Casual Leave” should also be cancelled as these being granted in special circumstances of COVID-19 epidemic where lockdown had been for more than four months and all sorts of transport had not been under operation.

Kind attention is invited to the references cited above, on the above
subject relating to allotment of qualification based pay matrix to the
ECG Technicians in railways.
Federation once again furnishes below, the important facts relating to the demand for granting higher entry grade pay to the ECG
Technician category with appropriate cadre structure for their growth.
The ECG Technicians appointed in Dr. Ram Manohar Lohia Hospital,
New Delhi (under Ministry of Health and Family Welfare) have never been
in possession of the standard qualification relating to the job
expected from an ECG Technician, while in Railways, the ECG Technicians
possess “Diploma in ECG Lab Technology”.
ECG Technicians in
Railways have never been treated atleast equal to those working in the
Central Government Hospitals and have rather been treated inferior. This
negative situation has been prevailing since the period of 3rd CPC.
The
DR qualification prescribed for the post of Sr. ECG Technician pay
scale Rs.1400-2600 (IV CPC)/5000-8000) V CPC)/ PB-2 GP 4200 (VI CPC)/
Pay Level-6 in 7th CPC
in Dr. Ram Manohar Lohia Hospital is Bachelor’s Degree in Science with
Physics with one year experience in handling cardiological equipment or 3
years Diploma Course in Electronics/ Electrical communication
Engineering. Whereas in Railways, though the qualification for the post
of ECG Technician got revised during 6th CPC regime to Degree in Science
plus Diploma in ECG Lab Technology/ Cardiology/ Cardiology Technician/
Cardiology Techniques of reputed institution [refer Railway Board’s
letter No. E(NG)II/2001/RR/45 Pt. A dated 29/09/2015], this category has
not been treated at par with those ECG Technicians of Dr. Ram Manohar
Lohia Hospital.
NFIR therefore requests the Railway Board to take action for revising
the pay structure of ECG Technicians of railways for the purpose of
providing entry grade pay 4200/Level 6 of pay matrix with further avenue
of promotion to pay level 7, similar to the pay structure of ECG
Technicians of Dr Ram Manohar Lohia Hospital, New Delhi.

The comprehensive MACP Scheme on acceptance of Seventh Central Pay
Commission recommendations has been issued vide RBE No-16/2020. In the
light of the recommendations of the 7th CPC, the Modified Assured Carrier Progression Scheme (MACPs)
will continue to be administered at 10, 20 and 30 years as before. In
order to implement a uniform policy all over ECoR, the following staff.
In terms of RBE No.-155/2016 for grant of financial up gradation
under the MACPs the prescribed Benchmark has been revised for all level
to “Very Good” w.e.f 25th July, 2016.
In compliance to RBE No-16/2020, enclosing DOPT’s O.M. No-35034/3/2015-Estt. (D) dated-22.10.2019, Para-17, (i) the revised benchmark of APARs i.e. “Very Good” shall be applicable for the year 2016-17 and subsequent years.
White
assessing the suitability of and employee for grant of MACP, the DSC
(Departmental Screening Committee) shall assess the APARs in the
reckoning period, the benchmark for the APARs for the years 2016-2017
and thereafter shall be “Very Good”.
For Example, if a

Federation invites kind attention of the Railway Board to the minutes of special meeting held between NFIR
representatives and EDPC-I, Railway Board on 04/06/2019 relating to PNM Agenda Item No. 23/2017. When
Federation explained the case and urged that the instructions issued by Northern Railway vide letter dated
16/01/2015 to its Divisions be restored and accordingly conveyed to Zonal Railways, the Official Side agreed
to consider and take action for issuing clarificatory instructions. But however, there has been no positive
action despite several months.passed.
This subject has again been discussed by NFIR with EDPC-I on 27/01/2020 and with EDFE on 05/02/2020 who
agreed to issue clarification to the General Manager, Northern Railway for restoration and implementation of
earlier instructions dated 16/11/2015. Though more than a month has passed, the clarification has not been
issued yet, while the PNM item is pending since over 2 and 1/2 years.
NFIR, once again requests the Railway Board to kindly issue clarification to the General Manager, Northern
Railway for restoration of his instructions dated 16/11/2015, duly endorsing copy to the Zonal Railways and
to the Federation.

I) In view of announcement of confirmed Corona Cases officially in
different places in our country, the railway employees and their
families are worried a lot about their safety. The running staff and
other frontline categories staff with public interface are more
vulnerable under the present circumstances. In the case of running
staff, they have to mandatorily go through the Breath Analyser Test, by
which, there are chances of quick spread of Corona Virus. If such
unfortunate development takes place, the entire running staff will be
affected adversely which may lead to disruption of train services on all
zonal railways.
In view of the above critical scenario, NFIR requests the Railway
Board (CRE) to consider that the staff who are supposed to undergo the
Breath Analyser Test are not forced to take the test till such time
Corona Virus is brought under control in India. While suspending Breath
Analyser Test, the administration may make alternative mechanism for
conducting checks.
II) The staff working in different public interface categories like
commercial, operating etc., and also in the field are required to be
provided masks to enable them wear while on duty and perform duties with
self-confidence. Besides face masks, it may also be ensured to supply
alcoholic soap/hand sanitizers at work-places to facilitate the staff to
wash their hands very frequently.
III) The present system of Bio-metric Attendance would lead to
spreading of virus from one person to another, in view of touching the
machine to give attendance by large number of employees. In view of the
risk involved, many Corporate Institutions have already suspended the
system of Biometric Attendance to its employees. Similar action is also
warranted in all the Railway Establishments/Workshops etc., till the
period, the Corona Virus is fully controlled.
The Federation (NFIR), therefore, requests the Chairman, Railway
Board to kindly arrange to issue instructions to the General Managers of
Zonal Railways/Production Units for:
deferring Breath Analyser Tests on Running Staff
supplying face masks, hand sanitizers / alcoholic soaps at work places and;
suspending the Bio-Metric Attendance System in all all the Railway Establishments / Workshops etc.,
immediately.
“The issue regarding grant of financial ungradation under MACPS to Jr. cashier by not reckoning their appointment / promotion from Sr.Shroff/ JAA/ Sr. Clerk to Jr. Cashier’s post has been under consideration. Since appointment / promotion from Sr. Shroff / JAA / Sr. Clerk to Jr. Cashier post involves promotion from one cadre to another cadre carrying same payscale / Grade Pay wihout benefit of pay fixation, it has now been decided in consultation with Finance Directorate and Establishment Directorate of Railway Board that regulating MACP benefits to such staff, the appointment from the post of Sr. Shroff / JAA / Sr. Clerk to the post of Jr. Cashier should not be constructed as promotion and, therfore, may not be reckoned for the purpose of grant of financial upgradation under MACPS”

This office is in receipt of NFIR’s letter dated 23/07/2018 (copy enclosed). wherein it has stated that there
has been discrepancy in fixation of pay of Running Staff promoted on or after 01/01/2006 in Rajkot/ Jodhpur
Division under Western Railway /North Western Railway respectively. In support of this, they have relied upon Rajkot/ Jodhpur
Division’s letter dated 12.01.2018/29.06.2018 respectively (copy enclosed).
2. Prima facie observation of the concerned Division’s letter indicates there exists some confusion in the
methodology of pay fixation of Running Staff promoted on or after 01/01/2006. As.the Railways are aware, the
pay fixation of existing staff, already in service on the date of effect of RS(RP) Rules, 2008 viz.
01/01/2006, in the revised pay structure is governed by Rule 7 of above rules notified vide Gazette
Notification No. GSR 643 (E) dated 04/09/2008 (RBE No.103/2008). For the above purpose, fitment tables were
issued vide Board’s letter No. PCVI/2008/I/RSRP /1 dated 11/09/2008 (R.BE No. 108/2008) which are applicable
to non running Staff. Since existing running Staff (already in service as on 01/01/2006) was in receipt of
Dearness Allowance on Pay Element, separate fixation table were issued for fixation of their pay in revised
pay structure in terms of Rule 7 of RS(RP) Rules. 2008 vide Board’s letter No. PCVI/2008/I/RSRP/1 dated
12/09/2008 (RBE No. 109/2008). As prescribed in Rule 7 of RS(RP) Rules, 2008, if fixation of pay as per Rule
7( 1)(A)(i) is short of minimum of applicable revised pay band (viz .Minimum of PB- 1 to PB-4 as applicable
to the employee) or pay scale (applicable to HAG & higher grades), such minimum would be allowed , as
laid down Rule 7(1)(ii). The provisions of Rule 7(1)(A)(ii) have already been taken care of while issuing
fitment tables vide Board’s letter dated 11/09/2008 & 12/09/2008. The fitment tables are also applicable
in the cases where an existing employee (already in service as on 01/01/2006 opts to have his pay fixation
from a date later than 01/01 /2006, in terms of Rule 5 ,6 & 11 of RS(RP) Rules, 2008 as clarified vide
Clarification No.3 of Board’s letter No. PCVI/2008/I/ RSRP/ dated 25/09/2008 (RBE No. 132/2008).
3. There is no prescribed minimum, other than minimum of the applicable pay band in the case of those
promoted on or after 01/01/2006, where an employee is fixed in any of the applicable pay bands. The minimum
pay in pay band as prescribed in First Schedule Part A, Section II of RS(RP) Rules, 2008 and corresponding
stipulation in first schedules annexed with Board’s letter dated 11/09/2008 (RBE No. 108/2008) is applicable
only for direct recruits appointed on or after 01/01/2006 belonging to Running as well as non running
categories. The position has been clarified in detail in Board’s letter No. PCVI/2010/I/ RSRP/1 dated
17/02/2010 (RBE No. 28/2010). As such once the pay of any existing employee (already in service as on
01/01/2006) is fixed in revised pay structure in the applicable pay band as per the provisions of Rule 7 or
11 and he is subsequently promoted to a post in same or other pay band, his fixation has tp be made as per
Rule 13 Even at this stage, the minimum of applicable pay band (PB-1 to PB-4) or scale (HAG or above) as
applicable is to be ensured.
4. In view of this. it is requested that the Rajkot / Jodhpur Division’s letter dated 12-01-2018/ 29-06-2018
respectively be examined in light of relevant instructions and the necessary corrective action taken and
thereafter, the position be advised to this office. Further if any specific point of doubt arises, the same
may be referred to this office for clarification along with the views of PFA of the Railways.

Attention is invited to Board’s letter No. 2008/AC-II/21/19 dated 29.05.2009 vide which instructions were
issued providing for additional relief on death/disability of Government servants covered by New Defined
Contribution Pension System (NPS). Instructions issued vide letter ibid will be applicable to those
Government Servants who joined Government Service on or after 01.01.2004 and will take effect from the same
date i.e. 01.01.2004. Further, attention is invited to the letter No. 2016/F(E)III/1(1)/3 dated 27.05.2016
vide which Pension Fund Regulatory and Development Authority (Exits and Withdrawals under NPS) Regulation,
2015 notified vide Gazette notification dated 11.05.2015 was adopted and circulated on Railways. It is
prescribed in these regulations that if the subscriber or the family members of the deceased subscriber, upon
his death, avails the option of additional relief on seek transfer of the entire accumulated pension wealth
of subscriber to itself.
2. References were received in this office seeking clarification whether the rule allowing option for drawl
of pension/ family pension, instead of NPS corpus, is also applicable retrospectively for the cases where
corpus of NPS has already been paid to the deceased employee’s legal heirs before issue of board’s letter No.
2008/AC-II/21/19 dated 29.05.2009. If the date of application of additional benefit is retrospective, whether
it is from the date the employee deceased or from the date of issue of Board’s letter dated 29.05.2009. Also,
whether the arrears of pension/family pension is to be paid (upon surrender of NPS Corpus) or not, and the
amount is likely to be huge which would impact the Railway Finances. Clarification was, also, sought whether
the interest on the corpus is to be charged from the date of payment of corpus amount till the date of is
surrender and if so, at what rate.
3. The above issue has been examined in consultation with Department of Pension and Pensioners’ Welfare
(DOP&PW), the nodal Department of pensioner matters. DOP&PW has clarified that Railway servant/
family member in the case of death of railway servant of his discharge from service on account of
invalidation/ disability, is entitled to pension/ family pension under old pension scheme under Railway
Services (Pension) Rules, 1993, if the Railway servant/ Family wants to. DOP&PW have, further, clarified
that the entire accumulated pension funds under NPS may be recovered from him/family with interest for the
period from the date of receipt of entire accumulated pension wealth to the subscriber under NPS to the date
of refund to the Government at the rate and manner applicable to GPF deposits from time to time.

System (NPS).

Pursuant to the issue of the Master Circular No. 7190 dated 22.10.1990, instructions have been amended and
new orders issued on the policy regarding recruitment against Cultural/ Scouts and Guides Quota. Instructions
issued from time to time on the above subject have now been consolidated below for the information and
guidance of all concerned.
2. Recruitment against Scouts & Guides Quota in Level - 1
and Level - 2 of 7th CPC Pay Matrix.
(i) The annual quota for recruitment on Scouts and Guides has been fixed by this Ministry on the Zonal
Railways and Production Units as below:
Note: Northern Railway will recruit additional 1 per year in Level -2 of 6th CPC Pay Matrix (6th CPC
GP 1900) and 2 per year in Level-1 (6th
CPC GP 1800) who will be posted in Research Designs & Standards Organisation (ROSO), not to be
utilized elsewhere.
(ii) Recruitment should be done at the Zonal Administrative For this, each Zone should conduct the
recruitment by clubbing the requirement/ quota fixed for all their respective divisions as well as Production
Units (which are also districts under their respective zones), falling within their territorial jurisdiction.
This should be done by way of open advertisement following the procedure laid down vide this Ministry’s
letter No. E(NG)II/96/RR-1/62 dated 17.09.98.
(iii) The recruitment will be done only in Level -2 of 7th CPC Pay Matrix (6th CPC GP 1900/-) and Level -1 of 7th CPC of Pay Matrix
(6th CPC GP 1800/-).
(iv) The educational qualification and age limit for consideration for appointment against the quota will be
the same as applicable for direct recruitment to Level -2 & Level-1 Examination Fee may be charged @
Rs.500/- (Rupees Five Hundred) per candidate with the provision for refunding Rs.400/- to candidates actually
appearing in the written examination. However, for candidates belonging to SC/ ST/ Ex-Serviceman/ Persons
with Benchmark Disabilities (PwBDs), Women, Minorities and Economic Backward Classes Rs.250/- will be charged
, with a provision for refunding the same to those who appear in the written examination.
(v) Power for Recruitment of Scouts and Guides quota shall lie with the General Application shall be called
separately for Level-2 (6th CPC GP Rs.1900/-) and Level-1 (6th CPC GP 1800/-). The selection shall also be
conducted separately . A candidate may apply both for Level-2 and Level-1.
(vi) The following qualification would apply for the recruitment of Scouts & Guides to posts in Level-2
and Level-1.
A President Scout/ Guide/ Rover/ Ranger Or Himalayan Wood Badge (HWB) holder in any section;
Should have been an active member of Scouts Organization for the last 5 years. The 'Certificate of
Activeness' should be as per Annexure-1; and
Should have attended two events at National level OR All Indian Railways' level AND Two
events at State
(vii) The candidate , who apply in response to the notification and are found eligible for consideration for
appointment against Scout & Guides quota, should be assessed on the basis of following criteria :

(viii) For selection in Level-2, the recruitment committee shall consist of three Senior Administrative Grade
(SAG) officers to b nominated by the General Manage For the selection in Level-1, the General Manager of
Zonal Railways/ PUs may re-delegate the power for nomination of Junior Administrative Grade (JAG) Committee
and acceptance of recommendation/ approval of panel for recruitment against Scouts & Guides Quota for the
Post of Level-1 of 7th CPC Pay Matrix (erstwhile Group ‘D’ posts) to PCPO of Zonal Railways/ PUS. For
selection in Level-1, the committee shall consist of three Junior Administrative Grade officers. One of them
should be an officer holding honorary post of Commissioner in Scouting/ Guiding organization in the committee
of a Zone/ Division/ unit other than the one conducting the recruitment. One of the three members should be
necessarily be from the Personnel department.
(ix) A written declaration will be obtained from all the candidates who finally qualify for appointment as
per Annexure-III. If the candidate violates any of the said declarations furnished by him/ her, he/ she
should be taken up for D&AR by the concerned CPO/ Senior DPO on the recommendation of State Chief
Commissioner/ District Chief Commissioner, as the case may
(x) Higher fixation of pay will not be admissible to a person appointed against Scouts & Guides Quota
(xi) The persons appointed against Scouts & Guides quota to the category of Clerks will be required to
possess proficiency in typing within a period of two years from the date of their appointment, and their
appointment will be provisional subject to the prescribed typing qualification within the stipulated In case
of non acquisition of typing skills within the prescribed period, no additional time will be given and
services of such candidate will be summarily terminated.
(xii) The Candidates selected for appointment under the Scout & Guide quota should be posted by the
competent authority in consultation with the concerned State Chief Commissioner/ District Chief
(xiii) It may be noted that instead of notifying the posts against this quota as unreserved (UR), this should
be mentioned as open to all candidates and candidates belonging to SC/ ST/ OBC Categories who apply against
notification published for this quota be extended relaxation in age limit as admissible in a general open
market recruitment. However, in case of being selected with any relaxation on account of being a candidate
from the above categories, he/she will be taken against reserved roster point.
(xiv) The field units are directed that they should finalize and fill up the posts against this quota during
the respective financial year without fail.
(ii) Recruitment should be done by the Railway Administration themselves
(iii) The recruitment against the quota should be done by open advertisement, following the procedure laid
down in this Ministry's letter N E(NG)II 96/ RR-1/62 dated 17.09.98.
(iv) The educational qualifications for consideration for appointment against the quota will be the same as
applicable for recruitment to 'Level 2' categories .
(v) The recruitment will be done only in the Level 2 of 7th CPC Pay Matrix.
(vi) Age limit as applicable for recruitment to other equivalent categories shall be follow

Essentials:

Vide Board’s letter referred above, it was clarified that the Accident Free Service Award to the staff retired after 01.01.2016 shall be paid as per the salary structure of 7th CPC and no arrears shall be admissible to whom the award is already disbursed.
Various Railways have brought out that some of the staff that had retired between 01.01.2016 & 28.11.2018 have been paid Accident Free Service Award as per 6th CPC pay structure while some of them have still not been paid the award due to various reasons and would therefore, be eligible for award as per 7th CPC pay structure. This would lead to different treatment meted out to two sets of staff retired during the same period.
In this respect, Board has examined the matter and it has been decided that the Accident Free Service Award will be paid as per 7th CPC pay structure w.e.f. 01.07.2017, the date on which revised rate of allowances as per the 7th CPC came into effect. Therefore, the staff who have retired between 01.07.2017 & 28.11.2018 and have been paid as per 6th CPC pay structure will be eligible for payment of arrears of the Accident Free Service Award as per 7th CPC pay structure.
This issues with the concurrence of Finance Directorate of Ministry of Railways.

Federation invites kind attention of the Railway Board to the
references cited above relating to payment of Leave Salary to the
Running Staff pursuant to the implementation of the recommendations of 7th Central Pay Commission.
Federation once again reiterates that though the Railway Board have
issued orders vide RBE No. 204/2018 dated 28/12/2018 but, however, there
is no clarity in the said orders regarding date of effect i.e. from
01/01/2016, consequently in the provision in IPAS, date of effect has
been taken as 01/07/2017 and the Running Staff have been put to
recurring financial loss for 18 months (from 01/01/2016 to 30/06/2017)
leave salary. Though the Federation has been making efforts to persuade
the Railway Board to set right the technical snag but however action to
correct/up-date IPAS has no been taken yet with the result Federation
continues to receive grievances from the Running Staff from Zonal
Railways.
NFIR, therefore, once again urges upon the Railway
Board to kindly intervene and issue suitable instructions to all
concerned to rectify/up-date the IPAS giving effect to the instructions
vide RBE No. 204/2018 dated 28/12/2018 from 01/01/2016 repeat from
01/01/2016 and not from 01/07/2017.
Action taken in the matter may kindly be apprised to the Federation.

Sub: Relieving of Railway employees in time after order of transfer in cases of request transfer.
As the Railway administrations are aware, instructions already exist which provide that in cases of request transfer, the requests should be dealt with in an organized and expeditious manner so that there is no occasion for any grievance in the mind of the staff in regard to the handling of their request.
It has been observed that despite the existence of such instruction, due to administrative exigencies,it sometimes becomes difficult to relieve the transferred employee a within a reasonable time, which results in loss of seniority to the employee in his new place of posting. The loss is even greater when he goes to posts one grade below, and new recruits from subsequent batches join before him.
The loss in seniority in such cases resulting from delayed relieving of the emproyee often leads to litigation, and structures passed by Hon’able Courts.
In one such case recently, the Hon’ble CAT/Chennai in OAs, No.751/2019 and other similar OAs, vide their common order dated 05.07.2019, inter-alia observed as under:
Since it is submitted by the applicants that IREC is silent on the above issue and accordingly there is a void in this regard in the policy, we deem it appropriate to direct the first respondent to consider the concerned raised in the OAs as a policy issue and take an appropriate decision on whether and if so, how the interests of such transferred employees should be protected in regard to their seniority at-least from the date from which they where approved for IRT, if they could not be relieved soon thereafter in public interest. Such policy decision may be taken and orders issued within a period of six month from the date of receipt of a copy of this order.”
The matter has accordingly been considered in the Board. while it may not be desirable / feasible to assign seniority to transferred employee of approval of in the new unit from the date of approval of the transfer, when the employees is still actually working in the parent unit, every effort should be made to relieve her/him at an early date. Where delay in relieving of the employees after orders are issued exceeds is likely to exceed 3 months, the case should be put up by Sr.DPO/ WPO to DRM/ CWM as the case may be giving specific reasons for the delay and likely date of relief.

While enclosing copy of NFIR’s letter No.IV/NFIR/ 7 CPC (Imp)/2016/Allowance/Part II dated 24/12/2018 on the subject, the
Federation expresses its disappointment over continued denial of Risk & Hardship Allowance to the Track Maintainers
working in Construction Organizations on Indian Railways. The Federation in its letter dated 24/12/2018 had elaborately
explained the merits, justifying payment of Risk & Hardship Allowance to the Track Maintainers of Construction
Organizations also. Sadly, due to Railway Board’s clarification issued to the General Manager (P), E.C. Railway vide letter
dated 25th October, 2018, the payment of Risk and Hardship Allowance to the Construction Organizations Track Maintainers has
been denied and wherever paid for the previous period, the same is being recovered.
Though nearly ten months passed from the date of letter of Federation, there has been no reply indicating action taken on
this issue. This has compelled the Federation to seek intervention of Railway Board (ME & MS) for reviewing the case and
allowing payment of Risk and Hardship Allowance to the Track Maintainers working in the Construction Organizations.
NFIR, therefore, requests the Railway Board (ME & MS) to kindly consider the matter objectively and accord approval for
payment of Risk & Hardship Allowance to those Track Maintainers working in Construction Organizations over Indian
Railways. It may kindly be appreciated that this issue deserves to be settled immediately without waiting for the report of
EDs Committee in view of the merits involved for payment.

no reply has since been received from Ministry of Finance so far.

Federation brings to the kind notice of the Railway Board (CRB) that NFIR’s PNM Agenda Item No. 18/2016 relating to relaxation of service condition of minimum five years service in the case of re-employed Defence Forces Personnel seeking inter Railway transfer on request has been pending since the last three years. During NFIR’s PNM meeting held with the Railway Board on 25/26-04-2019, the Official Side conveyed through Action Taken Statement as under:-
“The matter is presently under consideration. Feedback has been called for, from all the Zonal Railways. Responses from some of them are still awaited.”
Federation feels sad to state that though a period of over six months passed, progress made into the matter is yet to be conveyed.
In this connection, Federation also brings to the notice of the Board (CRB) that the NFIR General Secretary held discussions at the level of CRB more than once (last discussions held on 22/11/2018), when the CRB gave assurance that the relaxation has been processed and the final orders would be issued very shortly, but unfortunately relaxation decision has not been issued so far.
May I once again seek the intervention of CRB to kindly see that order issued granted relaxation to five years service condition in favour of former Defence Personnel re-employed in Railways, facilitating their inter Railway transfer requests soon.
