Sub: Implementation of Government’s decision on the recommendations of the Seventh Central Pay Commission – Revision of pension of pre-2016 retired Medical Officers of Army Medical Corps/ Army Dental Corps/ Remount & Veterinary Corps-reg.

Sir,

The undersigned is directed to refer to this Ministry’s letter No. 17(01)/2017/ (02)/D(Pension/ Policy) dated 5 September 2017. In accordance with Para-4 of this letter, the revised pension/ family pension of all Armed Forces Personnel who retired/ died prior to 01.01.2016, shall be revised by notionally fixing their pay in the pay matrix recommended by the 7t CPC in the level corresponding to the pay in the pay scale/pay band and grade pay at which they retired/ died. This will be done by notional pay fixation under each intervening Pay Commissions based on the formula for revision of pay. The revised rates of Military Service Pay, Non-Practice Allowance, where applicable, and ‘X’ Group. Pay & Classification Allowance for JCO/ORs, if applicable notified in terms of 7th CPC orders, shall also be added to the amount of pay notionally arrived at under the 7th CPC pay matrix and shall be termed as notional reckonable emoluments as of 01.01.2016 while fixing pay on notional basis. It was further decided at para-6 of the letter that higher of the two formulations ice. the pension/ family pension already revised in accordance with this Ministry’s letter No. 17 (01)/ 2016-D(Pen/Pol) dated 29.10.2016 or the revised pension/family pension as worked out in accordance with Para-5 of the MoD letter dated 05.09.2017 referred above, shall be granted to pre-01.01.2016 ‘Armed Forces pensioners as revised pension/family pension w.e.f. 01.01.2016.

2. Department of Pension & Pensioners’ Welfare vide their OM No. 38/37/16-P&PW(A){iii) dated 11th September 2017 have decided that NPA at the rate as applicable as of 01.01.2016 shall be added to notional pay as of 01.01.2016 to arrive at pension/ family pension of retired medical officers w.e.f. 01.01.2016 and the pension/ family pension of retired medical officers shall be further revised w.e.f, 01.07.2017 by adding NPA @ 20% to the notional pay as on 01.01.2016, instead of NPA admissible as on 01.01.2016 subject to the condition that the notional pay as on 01.01.2016 plus NPA does not exceed the average of basic pay of the revised scale applicable to the Apex Level and the level of Cabinet Secretary.

 

3. The matter regarding revision of all kinds of pension/ family pension of medical officers of Armed Forces who have retired/ died prior to 01.01.2016 has been examined by the Govt. and it has been decided that NPA at the rate as applicable as of 01.01.2016 shall be added to notional pay worked out in terms of Para-4 of the MoD letter No. 17(01)/2017/(02)/D (Pension/ Policy) dated 5th September 2017 to arrive at notional reckonable emoluments as on 01.01.2016 for calculation of pension/ family pension of pre-01.01.2016 retired/ died Medical Officers of Armed Forces, w.e.f. 01.01.2016. All kinds of pension/ family pension of pre-01.01.2016 retired/ died medical officers of Armed Forces Pensioners/ family pensioners shall be further revised w.e.f. 01.07.2017 by adding NPA @ 20% of notional pay in VIIth CPC scale to the notional pay as on 01.01.2016, instead of NPA admissible as on 01.01.2016 (which was 25% of pre-revised scale).

4. The fixation of pension/ family pension of retired Medical officers of Armed Forces in the above manner, shall be further subject to the condition that emoluments (ie. Basic Pay + MSP + NPA) to be reckoned for pension do not exceed Rs. 2,37,500/- (Rupees two lakh thirty seven thousand five hundred only). Amount of Gratuity and CVP which has already been notified, shall remain unchanged.

5. This issues with the concurrence of the Ministry of Defence (Finance/ Pension) vide their ID No. 10(8)/2018/Fin/Pen dated 23.12.2020.

Subject: Retention in Govt. Service beyond the age of 50 years or on completion of 30 years of service- Sr.AOQs/ AOs/AD(OL)/ Sr.PS under FR-56(j) 

In terms of Para 4, Appendix of DOP&T O.M. No. 25013/1/2013-Estt. (A) dated 21.03.2014 (copy enclosed), in order to ensure that the powers vested in the appropriate authority are exercised fairly and impartially and not arbitrarily, following procedure and guidelines have been prescribed for reviewing the cases of government employees covered under the aforesaid rules:

(1) The cases of Govt. Servants covered by FR 56(j) or FR 56 (I) or Rule 48 (1)(b) of CCS (Pension) Rules should be reviewed six months before they attained the age of 50/55 years or complete 30 years’ service/30 years of qualifying service, whichever occurs earlier.

(ii) Committee shall be constituted in each Ministry/ Department/ Office to which all such cases shall be referred for recommendation as to whether the officer concerned should be retained in service or retired from service in the public interest.

2. In this connection, please refer to HQrs Office letter No. AN/II/02604/99 dated 13.09.1999 vide which all controllers were requested to review all cases covered under FR 56(j) at least 6 months in advance.

3. However, it has been observed that some of the controllers are not adhering the time line as stipulated in the aforesaid orders. It is found that review under FR 56(j) in respect of some SAOs/AQOs who attaining the age of 50 years between January, 2020 to June, 2020 has not been carried out by the controller’s office.

4. It is therefore, requested to adhere strictly the time line mentioned in the aforesaid DOP&T orders and review all such cases at the earliest. Reviewed cases may be forwarded to HQrs office. If already forwarded, the same may be ignored.

Sir,
I am directed to refer to this Ministry’s letter No. 1(07/2013-D(Pension/Policy) dated 15.05.2015 regarding simplification of pension process for permanently disabled children and dependent parents/ siblings for family pension. It has been noticed that name of divorced/ widowed/ unmarried daughter has not been included in MoD letter No. 1/(07)/2013/D(Pension/Policy) dated 15.05.2015 causing delay in sanctioning of family pension to such eligible members 1.e. widowed/ divorced/ unmarried daughter, although name of such eligible members was a part of DoP&PW OM No. 1/6/08-P&PW(E) dated 22.06.2010.

2. It is, therefore, decided to issue amendment to GoI MoD letter No. 1(07)/2013-D (Pension/Policy) dated 15.05.2015 as under-

(a) For “disabled children/ siblings and dependent parents” read- “permanently disabled child/ children/ siblings/ dependent parents and widowed/ divorced/ unmarried daughter,” wherever it appears in GoI MoD letter dated 15.05.2015.

(b) New clause numbered 5(iii) “To widowed/ divorced/ unmarried daughters” may be inserted below Para-5(ii) to GoI MoD letter dated 15.05.2015 as under:-

(iii) “To widowed/ divorced/ unmarried daughters”

In case the eligibility of all the above categories of claimant mentioned in para 5(i) and 5(ii) of GoI, MoD letter no. (7)/2013-D(Pension/Policy) dated 15.05.2015 ceases to be payable, the PDA will allow family pension to such widowed/divorced/ unmarried daughter in their hierarchy of DoB after production of marriage/ re- marriage/ death certificate, as the case may be, in respect of all the categories of claimants mentioned in Sub Para - i) and (i) of para 5 of GoI, MoD letter dated 15.05.2015, if any.”

(c) After inserting above clause in Gol, MoD letter dated 15.05.2015, remaining sub clauses under para -5 may be renumbered in following manner:
  • Existing Clause 5(iii) “To the dependent parents-first mother, then father” to be renumbered as 5(iv)
  • Existing Clause 5(iv) “To the permanently disabled siblings” to be renumbered as 5(v).
3. The word “Farther” in first line of para 5(iii) of GoI, MoD letter no. 1(7)/2013-D (Pension / Policy) dated 15.05.2015 may be replaced by word “Father”.

4. The renumbered para 5(iv) referred above may be amended as follows:-

For: “When claimants in (i) and (ii) die or become ineligible- on production of death certificate/ re-marriage-intimation of spouse and/ or death certificates of all permanently disabled children, family pension would be allowed by PDA to dependent parents.”

Read: “When claimants in (i), (ii) and (iii) die or become ineligible- on production of death certificate/ marriage/ re-marriage -intimation of spouse and/ or on production/ intimation of marriage/ re-marriage/ death certificates (as the case may be) of all the eligible dependent son(s) or daughter(s) including permanently disabled child/children and widowed/ divorced/ unmarried daughter, family pension would be allowed by the PDA to dependent parents.”

5. All other terms and conditions shall remain unchanged.

6. This issues with the concurrence of the finance Division of this Ministry vide their ID No 10(01)/2015/ Fin/Pen dated 18/02/2020.

Sub : Preventive Measures to contain the spread of (COVID-19).

As per directions issued by the Govt. of India, Ministry of Home Affairs (MHA), New Delhi Order
No.40-3/2020-DM-l(A) dated 15.04.2020: and Ministry of Defence, Office Order F.No.A-50024/01/2020-D (Estt.I/Gp.1) dated 15.04.2020, the CGDA I- IQrs Office, Delhi has issued guidelines vide their letter No.AN/III/3012/ Circular No.VIII dated 16.04.2020 (available on the CGDA website) for strict implementation of the revised consolidated guidelines during the lockdown period which will continue to be remain in force upto 3rd May 2020.

2. In view of the above, the Office will remain open without any restriction during the lockdown period w.e.f. 20.04.2020 subject to compliance of all instructions contained in the said Order of the MHA. All the Group Officers and Officer in Charge of Sections will ensure that the above instructions are followed scrupulously. In this regard necessary instructions in addition to the above guidelines are enclosed as Annexure-I.

3. While opening the Office w.e.f. 20.04.2020, it may be ensured that working hours for all employees who attend office should be staggered, therefore, suggested that two rosters of employees may be formed and asked to attend office as per the following timings in such a manner that 50% of employees attend office in 1st Shift and 50% in 2nd Shift:- a. 9.00 a.m. to 5.30 p.m. b. 10.30 a.m. to 7.00 p.m.

Necessary precautionary arrangements for disinfection of office premises, availability of sanitizers etc have been made for employees.

NECESSARY INSTRUCTIONS

  1. Large gathering or meeting i.e. more than 3-4 persons even during tea break must be avoided.
  2. Work places shall have a gap of one hour and will stagger the lunch breaks of staff to ensure social distancing.
  3. Pan Masala, Gutkha and Spitting at work place and in office premises is strictly banned and Rs.500/- fine will be imposed if anyone found doing so.
  4. In case any employee is unwell, has dry cough, difficulty in breathing etc, he/ she or his/ her colleagues should immediately bring it to the notice of administration through Welfare Section.
  5. All the Officers and Staff are advised to download the Arogya Setu App.
  6. Sections are advised to ensure seating at least 6 feet away from each other.
  7. It is advised to use staircases in place of lifts.
  8. Norms of social distancing as issued by the Govt. of India may be followed.
  9. All the officers and staff are requested to co-operate with thermal scanning arrangement at entry points of the office of the PCDA(P) and follow social distancing norms during thermal scanning process.

Sub:- Submission of pension claim during lock-down in respect of Defence civilian

Government of India has declared lock-down as a precautionary measure in view of COVID-19. Some Head of office have expressed their inability in forwarding of pension claim in hard copy due to lockdown. Matter has been considered by the competent authority and it has been decided that till then lockdown, superannuation/retiring pension claim whose date of retirement is on or before 30.04.2020 and all death cases pension claim may also be forwarded as a soft copy i.e. scanned copy to PCDA (Pension) Allahabad email address cda-albd@nic.in. This arrangement is optional for those HOO who are not in position to forward pension claim in hard copy. Subject of email should be "Pension claim- G1/Civil".

2. In view of the above, you are requested to issue suitable instructions (along with copy of this circular) to all the head of the Offices under your administrative control to ensure the submission of pension claim as stated above.

Ordnance Factory Board earmarks 285 beds for COVID-19 isolation wards

Ordnance Factory Board (OFB) has designated 285 beds for isolation wards in handling Coronavirus (COVID-19) cases. Forty beds have been earmarked in hospitals at Vehicle Factory Jabalpur, thirty beds each at Metal and Steel Factory Ishapore, Gun and Shell Factory Cossipore, Ammunition Factory Khadki, Ordnance Factory Kanpur, Ordnance Factory Khamaria, Ordnance Factory Ambajhari, 25 beds at Ordnance Factory Ambernath and twenty beds each at Heavy Vehicle Factory Avadi and Ordnance Factory Medak.

Functioning of Central Govt Office – Operation to prevent the COVID-19

Setting up of Isolation ward and corresponding number of beds in OFB hospitals. This has been done by Chairman OFB as per Ministry of Health and Family Welfare (MoHFW) instructions in the Cabinet Secretary’s meeting yesterday. The OFB is also trying to produce personal protection equipment and face masks as per pilot order quantity placed by HLL Lifecare Limited (HLL), a PSU under MoHFW.

2. The addressee officers are requested to furnish details of Reporting / Reviewing Officers for the year 2019-2020 for creation of their APAR workflow in SPARROW system. In case an officer is required to submit more than one APAR for the year 2019-20, the details of periods of annexed proforma.

3. The information sought above may please be forwarded within a week to enable this section to ensure timely generation of APARs in r/o the officers concerned and forwarding the same to them.

Instructions exist on the need for periodical review of performance of Government servants with a view to ascertain whether the Government servant should be retained in service or retired service in the public interest. Provisions in this regard are contained in FR 56(j), FR 56(l) and Rule 48(1) (b) of CCS (Pension) Rules, 1972. Besides, the detailed guidelines on the above subject are already in public domain at http://dopt.gov.in under 'Notification' -'OM & Orders'- Establishment- Premature Retirement. However, copies of DOP&T O.M. No 25013/1/2013-Estt (A) dated 21.03.2014, No.25013/01/2013-Estt.A-IV dated 11.09.2015 and MOD, D (lab) Branch ID No 26(1)/2015-D (Lab) dated 30.05.2016 are enclosed herewith for guidance and taking an appropriate action with reference to orders on the subject.

Subject:- Re-classification of Mathura-Vrindavan Municipal Corporation as 'Y' class city for the purpose of grant of House Rent Allowance (HRA) - regarding.

The undersigned is directed to invite. attention to this Ministry’s O.M. No.2/5/2014-E.II(B) dated 21.07.2015 regarding re-classification /upgradation of cities on the basis of the population figures of 2011 census for the purpose of House Rent Allowance to the Central Government employees and to say that consequent upon combining of Municipal Council of Mathura and Municipal Council of Vrindavan and constitution of Mathura - Vrindavan Municipal Corporation vide Notification No.1799/9-7-17- 8(Seema Vistar)/ 2016 dated 12.05.2017 of the Government of Uttar Pradesh, resulted in increase In population and hence, Mathura- Vrindavan Municipal Corporation qualifies for classification as ‘Y’ class city/ town for the purpose of grant of House Rent Allowance to the Central Government employees.

2. It has been decided that Mathura-Vrindavan Municipal Corporation shall stand classified as ‘Y’ class city/town for the purpose of grant of House Rent Allowance to the Central Government employees posted there,

3. These orders shall be effective from 1st March, 2020.

7TH PAY COMMISSION House Rent Allowance (HRA)

4. The orders will apply to all civilian employees of the Central Government. The orders will also be applicable to the civilian employees paid from the Defence Services Estimates. In respect of Armed Forces personnel and Railway employees, separate orders will be issued by the Ministry of Defence and the Ministry of Railways, respectively.

5. In so far as the persons serving in the Indian Audit and Accounts Department are concerned, these orders are issued after consultation with the Comptroller & Auditor General of India, as mandated under Article 148(5) of the Constitution.

CIRCULAR

It is proposed to engage retired personnel at the level of Section Officer and Private Secretary as Consultant in the Ministry of Defence (Sectt.) purely on temporary basis, as per Ministry's guidelines dated 12.09.2012 and as amended from time to time. Officers retired from Ministry of Defence will be given preference.

Personnel engaged as Consultant will be paid a monthly remuneration of Rs.28,000/- in case of officers retired in the Grade Pay of Rs. 4,800 (pre-revised) / Level 8 and Rs. 31,500/- in the case of officers retired in the Grade Pay of Rs. 5,400 (pre-revised)/ Level-10.

Subject : Completion of APARs in “SPARROW”

In the recent times, it is observed that the APARs are not completed by the officers as per the laid down DoPT timelines. APARs in respect of few IDAS officers for the FY 2018-19 have been closed by the system – “Pending with Officer Reported upon for self appraisal” stage. This has been viewed seriously by the competent authority.

2. In this regard it is stated that the PAR managers are responsible to send alert message to the officer reported upon (preferably a week before the prescribed timeline for submitting self appraisal). On failure of an officer to submit self-appraisal as per DoPT timelines to the Reporting Officer, the PAR Manager shall “Force Forward” the same to the Reporting Officer without self appraisal.

3. The Reporting officers should also keep a watch on the movement of APARs of officers working under them and ensure that the APARs are written timely. In case, the self appraisal is not submitted timely, then the force forwarded APAR without self appraisal shall be written by the Reporting officer.

4. The Reporting/ Reviewing/ Accepting officers are also requested to complete the APARs as per DoPT timelines in future. The online recording of APARs on SPARROW system close on 31st December after which it will not be possible to take any action on the APARs.

5. APARs of officers posted on deputation to various Ministries /Departments (other than those posted in Ministry of Defence , UPSC and OFB) are generated centrally in this HQrs office. These officers are request ed to provide the details as mentioned in the table below latest by first week of the next financial year so that the APARs could be initiated timely. Officers posted in Ministry of Defence, UPSC and OFB may forward the details to concerned PAR Managers of MoD, UPSC and PCA (Fys) Kolkata respectively.

6. Officers posted on deputation/ IPA/ Ordinance factories setup, where officers of other services/ Ministers/ Executive authorities are involved are requested to track the movement of their APARs using the tracking activity on SPARROW and if necessary request their Reporting/ Reviewing/ Accepting officers for timely completion of their APARs.

The Department of Ex-Servicemen Welfare was created in the Ministry of Defence on 22nd September, 2004 in order to pay focused attention to the welfare and resettlement of Ex-Servicemen (ESM). It has 3 Attached offices namely, Kendriya Sainik Board Secretariat (KSB Sectt.), Directorate General of Resettlement, (DGR) and Central Organisation, Ex-servicemen Contributory Health Scheme (CO, ECHS).

KSB Sectt. is responsible for the welfare of Ex-Servicemen and their dependents and also for the administration of various welfare schemes for them.

The office of Directorate General of Resettlement implements various Policies / Schemes / Programmes for pre and post retirement training, re-employment and self- employment of ex-servicemen.

Central Organisation, Ex-Servicemen Contributory Health Scheme takes care of the healthcare and medical needs of Ex-servicemen and their dependents through a network of various polyclinics across the Country.

The Service Headquarters for Army, Air Force and Navy also have dedicated Directorates i.e. Directorate of Indian Army Veterans (DIAV), Directorate of Air Veterans (DAV) and Directorate of Ex-Servicemen Affairs (DESA) respectively to assist veterans in resolving their Pension and welfare issues.

Service HQs organize Veteran’s Day on 14th January every year.

Events are organized by State / UTs at State and District level in form of ‘Sainik Adalat’ to redress their grievances.

DGR Ex-Servicemen Seminar cum Job fairs are organized pan India. Approximately 8 job fairs are organized in a year.

Regular interaction during visit of DGR / DRZ (Directorate of Re-settlement Zone) officials in their Area of Responsibility (AoR).

Veteran personnel are also invited at ‘At Home’ functions during Army/Air Force/Navy Day celebrations.

A single window online grievance redressal mechanism (CPGRAMS) is already in place by the Department of Administrative Reforms and Public Grievances in which any citizen can lodge their grievances online and get response from the concerned department.

The link of CPGRAMS /CPENGRAMS website has also been given in the website of Department of Ex-Servicemen Welfare, CGDA and all Pension Sanctioning Authorities so that ex-servicemen can lodge their grievances in any websites from their home by clicking on the pgportal.gov.in and get their grievances redressed speedily.

The Union budget for the 2020-21 financial year, presented to Parliament on February 01, 2020 by Finance Minister Smt Nirmala Sitharaman, envisaged a total outlay of Rs 30,42,230 crore. Rs 3,37,553 crore (excluding Defence Pension) has been allocated for Defence. A amount of Rs 1,33,825 crore was provided for Defence Pension in Budget Estimates 2020-21.

There is an increase in total Defence allocations (Rs 4,71,378 crore) of Rs 40,367.21 crore including Defence Pension over the 2019-20 fiscal year. Total defence budget accounts for 15.49 per cent of total central government spending for the 2020-21 fiscal year.

The allocation of Rs 4,71,378 crore reflects a 9.37 per cent increase over Budget Estimates (Rs 4,31,010,79 crore) for the 2019-20 financial year.

Of the Rs 3,37,553 crore allocated for the 2020-21 financial year, Rs 2,18,998 crore is for revenue (Net) expenditure and Rs 1,18,555 crore is for capital expenditure for Defence Services and Ministry of Defense organizations / departments. The total of Rs 1,18,555 crore allocated for capital spending includes expenditure related to modernisation.

NOTIFICATION

New Delhi, the 28th December, 2019

S.R.O. 17(E). In exercise of the powers conferred by section 191 of the Army Act, 1950 (46 of 1950), the Central Government hereby makes the following rules further to amend the Army Rules, 1954, namely :-

(1) These rules may be called the Army (Amendment) Rules, 2019.
(2) They shall come into force on the date of their publication in the Official Gazette.
After rule 15 A of the Army Rules, 1954 (hereinafter referred to as the said rules), the following rule shall be inserted, namely:-

“15 B. Certain rules not to apply.-Without prejudice to the provisions contained in section 19 of the Act, nothing contained in rules 14, 15 and 15 A shall apply to the office of the Chief of Defence Staff.”

In rule 16 A of the said rules,-

(i) in sub-rule (4), the following proviso shall be inserted, namely :-
“Provided that the Central Government may, if considered necessary, in public interest, so to do, give extension of service to the Chief of Defence Staff, referred to in the Explanation to clause (a) of sub-rule (5), for such period or periods as it may deem necessary subject to maximum age of 65 years.”;

(ii) in sub-rule (5), in clause (a), the following Explanation shall be inserted, namely :-

Explanation. – For the purposes of this clause, the expression “General” includes the Chief of Defence Staff or the Chief of the Army Staff, as the case may be.”;

(iii) in sub-rule (6), for clause (a), the following clause shall be substituted, namely :-

“(a) the tenure of the Chief of the Army Staff shall be three years or up to the age of retirement, whichever is earlier;”.

(2) They shall come into force on the date of their publication in the Official Gazette.
In the Navy (Discipline and Miscellaneous Provisions) Regulations, 1965, after regulation 218, the following regulation shall be inserted, namely :-

218A. Certain regulations not to apply. Without prejudice to the provisions contained in section 15 of the Act, nothing contained in regulations 216, 217 and 218 shall apply to the office of the Chief of Defence Staff.”.

(1) These regulations may be called the Naval Ceremonial, Conditions of Service and Miscellaneous (Amendment) Regulations, 2019.

(2) They shall come into force on the date of their publication in the Official Gazette.
In regulation 179 of the Naval Ceremonial, Conditions of Service and Miscellaneous Regulations, 1963 (hereinafter referred to as the principal regulations),-

(i) in sub-regulation (1), the following Explanation shall be inserted, namely :-

Explanation. For the purposes of this sub-regulation, the expression “Admiral” includes the Chief of Defence Staff or the Chief of the Naval Staff, as the case may be;

(ii) after sub-regulation (2), the following sub-regulation, shall be inserted, namely :-

“(3) An officer who has attained the age of retirement or has become due for such retirement on completion of his tenure, may be retained in the service for a further period as may be determined by the Central Government, if the exigencies of the service so require:

Provided that the Central Government may, if considered necessary, in public interest, so to do, give extension of service to the Chief of Defence Staff, referred to in the Explanation to sub-regulation (1), for such period as it may deem necessary subject to maximum age of 65 years.”.

(2) They shall come into force on the date of their publication in the Official Gazette.

In the Air Force Regulations, 1964, (hereinafter referred to as the said regulations), in regulation 213,-

(i) for the words “appointment in the ranks of Air Chief Marshal”, the words “Chief of the Air Staff in the rank of Air Chief Marshal”, shall be substituted;

(ii) the following Explanation shall be inserted, namely:-

Explanation.- For the purposes of this regulation, the expression “Air Chief Marshal”, includes the Chief of Defence Staff or the Chief of Air Staff, as the case may be.

In the said regulations, after regulation 213, the following regulation, shall be inserted, namely :

213A. Extension of service.- An officer who has attained the age of retirement or has become due for such retirement on completion of his tenure, may be retained in the service for such further period as may be determined by the Central Government, if the exigencies of the service so require:

Provided that the Central Government may, if considered necessary, in public interest, so to do, give extension of service to the Chief of Defence Staff, referred to in the Explanation to regulation 213, for such period or periods as it may deem necessary subject to maximum age of 65 years.”.

Sub: Information regarding over payments made to DAD employees on account of wrong pay fixation granting the benefit of financial up gradation under ACP/ MACP scheme

Recently Hqr office has intimated that it has received a case where a clerk appointed in the DAD on Inter Departmental Transfer basis was granted financial up gradation under ACP scheme of 1999 in the pay scale of Rs.4000-100-6000 in his erstwhile department . Although he was appointed in the DAD as clerk in the pay scale of Rs.3050- 75- 3950- 80-4590 still his pay was erroneously fixed in the pay scale of Rs.4500-125-7000 (granting him financial up gradation in the hierarchy of post in the DAD ie., pay scale applicable to Auditor) instead of granting him pay protection in the pay scale applicable to the post of clerk in the DAD ie 3050- 75-3950- 80-4590 . This pay fixation is not as per rules/
orders.

2. Hqr has already issued a clarification on the issue of MACP to the employees appointed in DAD through Inter Departmental Transfer vide letter no. AN/Xl/11051/ MACP/2010 v.11-1 dated 25.2 .2010 and AN/Xl/ 11051/MACP/ 2011/ID dated 04.06.2012.

3. It is therefore, requested to confirm that no such cases are there in your office where over payments have been made to any employee due to wrong pay fixation or erroneous grant of financial upgradation under ACP/ MACP scheme.

The government has amended rules putting the maximum age limit of 65 years (retirement age 65) for the Chief of Defence Staff (CDS) to serve in the post.

The changes were made in the Rules of the Army, 1954, according to a defense ministry notification.


In a landmark decision, Tuesday (31st December 2019) Cabinet Committee on Security approved the formation of the CDS, which will serve as the defense minister’s principal military advisor on all tri-service issues.

The service chiefs can serve for a maximum duration of three years or until they reach the age of 62, depending on the early age.

The undersigned is directed to say that one (01) post of Staff Car Driver(Ordinary Grade) in the Ministry of Defence carrying pay in Level 2 (Rs.19900 - Rs.63200) of Pay Matrix is proposed to be filled up by:

Deputation/ Absorption/ Re-employment

From amongst the regular Despatch Rider (Group-C) and Group C employees in Level 1 (Rs.18000 - Rs.56900) in the Ministry of Defence (Secretariat) who possess valid driving license for motor cars on the basis of a driving test conducted by Transport Company, Army Headquarters, Ministry of Defence to assess the competence to drive motor cars failing which from officials holding the post of Despatch Rider in other Ministries of the Central Government who fulfill the necessary qualifications, as mentioned below:

For Ex- Servicemen: Deputation/ Re-employment

The Armed Forces personnel due to retire or who are to be transferred to reserve within a period of one year and having the requisite experience and qualifications prescribed below shall also be considered. Such persons would be given deputation terms upto the date on which they, are due for release from the Armed Forces, thereafter, they may be continued on re- employment.

Essential education / technical qualification

Essential

  • A pass in the 10th standard or equivalent from a recognized Board or Institution;
  • Must possess a valid driving license for motor car issued by the competent authority;
  • Knowledge of motor mechanism (the candidate should be able to remove minor defects in vehicles);
  • Experience of driving a motor car for at least three years from reputed organisation.

Desirable:

Three years service as Home Guard or Civil volunteers.

Note 1: The qualifications regarding experience are relaxable at the discretion of the Competent Authority in the case of candidate otherwise well qualified.

Note 2: The qualifications regarding experience is relaxable at the discretion of the Competent Authority, in the case of candidates belonging to Scheduled Castes or Scheduled Tribes if at any stage of selection the competent authority is of the opinion that sufficient number of candidates with requisite experience are likely to be available to fill up the vacancy reserved for them.

2. In addition to the above, it may be noted that the period of deputation including the period of deputation in another ex-cadre post held immediately preceding this appointment in the same or some other organisation Department of the Central Government shall ordinarily not exceed 3 years. The maximum age limit for appointment by deputation / absorption shall not exceed 56 years as on the closing date of receipt of applications.

3. In the event of selection, appointment will be subject to passing of driving skill test.

4. Applications in the attached proforma (Annexure-I) from willing and eligible persons and whose services can be spared, shall be forwarded by the Employer/Cadre Controlling Authority along with duly filled-in certification (Annexure-II) to this office within six weeks from the date of publication of the advertisement in Employment News along with the following documents:
  1. Matriculation certificate
  2. Driving License
  3. NOC from record office (in case of Armed forces personnel)
  4. APAR dossiers for the last five years
  5. Vigilance certificate
  6. Experience certificate & Commendation certificate (if any)
