Representation from government servant on service matters.

Attention is invited to the instructions issued by DoPT from time to time on submission of representations by government servant on their service matters. In spite of these instructions, it has been observed that employees of this organisation or their relatives are frequently submitting the representations to Prime Minister/ Minister/Secretary directly for seeking redressal of their grievances. It is clarified that it would include all forms of communication through e-mails or public grievance portal etc. If a government servant wishes to seek redressal of a grievance, the proper course is to address his immediate official superior, or Head of Office, or such other authority at the appropriate level who is competent to deal with the matter in the organisation.

Attention is also invited to the provision of Rule 20 of CCS( Conduct) Rules, 1964 prohibiting Government servants from bringing outside influence in respect of matter pertaining to his service matters. Violation of these instructions may be treated as unbecoming conduct on the part of government servant and may attract the provision of Rule 3(1) (iii) of CCS(Conduct) Rules, 1964.

Therefore, all. Pr.CCAs/CCAs/CAs (with independent charges) are requested that these instructions may be brought to the notice of all government servants working under their administrative control. Violation of the instructions may led to disciplinary action against the government servant under relevant rules.

CORRIGENDUM

Subject: Revised terms and condition for the enrolment of retired Government officials willing to be worked as consultant

In continuation of this office OM No. G-25014/13/20 I 5- I 6/M F.CGA/IAD/250-288 dated 08.07.2015 regarding revised proforma and terms and conditions for the enrolment of retired Govt. officers willing to work as consultant, the following term s and condition may be read as

i. Serial Number 2:

“A retired official will be eligible for enrolment as consultant within one year from the date of retirement” and

ii. Serial No. 14(a)

“The consultant must not assign or sub-contract any part of the services”.

As such the retired Govt. servant has to apply for enrolment or his name as consultant within one year of his retirement failing which his request will not be considered for enrolment. However prescribed proforma and other terms & conditions envisaged in the above OM dated 08.07.2015 will remain same.

This issues with the approval of the Controller General of Accounts.

RTGS System-Increase in operating hours

Reserve Bank of India has vide its circular DPSS(CO) RTGS No.364/04.04.016/2019-20 dated August 21, 2019 decided to increase the operating hours Of RTGS and commence operations for customers and banks from 7.00 am with effect from August 26, 2019 (copy enclosed).

It is informed that, in e-Kuber QPX, a business day is divided into 12 business sessions, starting from 8.00 am up to 8.00 pm. The system-based consolidation process is executed at the end of each business session for accounting as well as generation of the Credit Notifications for e-Receipts and Return Notifications for e-Payments.

It has been decided that with effect from August 26, 2019 an additional business session starting from 7.00 am has been added in e-Kuber QPX. Accordingly all e-Receipts and e­ Payments will be processed, system-based consolidation process will be executed for accounting as well as all notifications for Government a-Receipts and e-Payments will be generated and transmitted to Government for the additional business session also.

Real Time Gross Settlement (RTGS) System - Increase in operating hours

A reference is invited to the circular DPSS / CO/RTGS No. 2488/04.04.016/2018-19 dated May 28, 2019 on 'Real Time Gross Settlement (RTGS) System - Extension of Timings for Customer Transactions'.

At present, the RTGS system is available for customer transactions from 8:00 am to 6:00 pm and for inter-bank transactions from 8:00 am to 7:45 pm. In order to increase the availability of the RTGS system, it has been decided to extend the operating hours of RTGS and commence operations for customers and banks from 7:00 am.

The RTGS time window with effect from August 26, 2019 will, therefore, be as under:

Department of Expenditure , Ministry of Finance clarifies that it's Order dated 18th June 2019 relating to the disbursal of salary for the month of June 2019 is applicable to only an attached office under the Department namely, the O/o Controller General of Accounts (CGA) and the officials working in the PFMS Project Cell and is temporary in nature to avoid exceeding the Vote on Account limit

It has been brought to notice that an internal Confidential Office Order pertaining to the Department of Expenditure, Ministry of Finance is being circulated in various social media platforms.

It is clarified and informed that the Department of Expenditure 's Order dated 18th June 2019 relating to the disbursal of salary for the month of June 2019 is applicable to only an attached office under the Department of Expenditure namely, the O/o Controller General of Accounts (CGA) and the officials working in the PFMS Project Cell and is temporary in nature to avoid exceeding the Vote on Account limit.

The General Public is also forewarned and cautioned not to circulate the Order since it is confidential in nature and may attract punitive actions under the applicable legal provisions.

Sub: Re-imbursement of Mobile charges to non-entitled officers (Sr.AOs/AOs/AAOs posted in SPMUs.

The undersigned is directed to convey the approval of Controller General of Accounts vide diary no. 230 dated 23.05.2018 and Secretary(Expenditure), M/o Finance vide diary no. 716366 dated 13.11.2018 for re-imbursement of mobile phone charges to the non-entitled officers (Sr.AOs/AOs/AAOs) posted at various State Project Management Units(SPMUs) of PFMS across the country.

2. Mobile Phone expenses shall be reimbursed up to a maximum of Rs. 500/-plus taxes per person/month which is subject to the actual uses and the production of original receipt.

3. These instructions will be effective from 01.12.2018.

4. All such claims shall be paid from the budget of PFMS under Head "Office Expenses".

5. The approval of the aforementioned is for one year subject to the condition that the facility must be reviewed after one year based on infrastructure condition of the SPMUs.

Please refer to the communication cited under reference containing guidelines regarding representation from Government servants on service matters. As per existing instructions, wherever, in any matter connected with his service rights or conditions, a Government servant wishes to press a claim or to seek redressal of a grievance, the proper course for him is to address his immediate official superior, or Head of his office, or such other authority at the appropriate level who is competent to deal with the matter in the organization.

2. However, it has been observed that instances of bringing outside as well as political influence by the official and their close relatives in matters like transfer etc. are on the rise. Such trend has been viewed seriously and the officials concerned may be liable for disciplinary action for such transgression and violation of provisions of CCS (Conduct) Rules, 1964.

3. In this context, attention is also invited to DOP&T OM bearing F.No.11013/08/2013-Est(A-111) dated 31.08.2015.

Subject: Holding of Pension Adalats on 18th September, 2018

The undersigned is directed to refer to D.O letter No. 42/11/2018-P&PW(G) dated 1ot July, 2018 from Secretary, Ministry of Personnel, Public Grievances & Pensions to the Secretaries of all Ministries/Departments with a appeal to hold Pension Adalats on September 18, 2018 with a objective of prompt and quick redressal of pensioners’ grievances. A copy of DO letter which is self explanatory is enclosed.

2. It is needless to mention that Pay and Accounts offices and Central Pension Accounting Office have a pivotal role in pension related matters, by organising pension adalats grievances of the pensioners can be minimised.

Therefore, all the Pr.CCAs/CCAs/CAs (with independent charges) and Chief Controller ( P) are requested to extend wide publicity for Pension Adalat and suitably instruct their field PAOS/RPAOs/ZAOS to hold Pension Adalat on September 18, 2018.

Central Pension Accounting Office (CPAO) celebrated its 29th Foundation Day today in the service of the Central Civil Pensioners


Central Pension Accounting Office (CPAO) celebrated its 29th Foundation Day today in the service of the Central Civil Pensioners. 

The Central Pension Accounting Office (CPAO) celebrated  here today its 29th Foundation Day in the service of the Central (Civil) Pensioners. CPAO   (website www.cpao.nic.in) was established on 1st January, 1990; primarily to cater to the needs of central civil pensioners and other stakeholders in the Ministries/ Departments and Banks. The Central (Civil) pensions are authorized through Central Pension Accounting Office (CPAO) functioning under the Controller General of Accounts (CGA).

CPAO is administering the 'Scheme for Payment of Pensions to Central Government Civil Pensioners by Authorized Banks (both Public Sector and some Private sector Banks).  Its functions include, issue of Special Seal Authorisations (SSAs) for pension payments to Authorised Banks, preparation of budget for the Pension Grant and accounting thereof, reconciliation with and performance review of banks with respect to pension payments and disbursements & maintenance of the database of the Central Civil Pensioners etc.

CPAO was created with the primary objective of simplifying procedure and reducing the number of agencies for pension payment and to expedite the process of authorization, revision and transfer of pension through Authorized Banks.  The working of CPAO is fully computerized and it maintains a database of over 12 lakh Central (Civil) pensioners through Pension Authorisation, Retrieval and Accounting System (PARAS). These pensioners are being provided pension related services by the CPAO through more than 70,788 paying bank branches all over the country.

CPAO has Pension Tracking System to check the latest status of the pension processing and SMS facility is also being provided to the pensioners at each stage. CPAO has taken many steps under Digital India Mission like e-Scroll, e-SSA, e-PPO project etc. to reduce the paper movement and creation of digital record of the Special Seal Authorities (SSAs), PPO (Pension Payment Order) etc.  CPAO is also handling the grievances of the Central (Civil) Pensioners through its Grievance Redressal Mechanism which includes Web Responsive Pensioners Service (WRPS) facilitating information to pensioners on pension payments, facility to view and download latest orders and special seal authorities (SSAs) issued by CPAO among others.

Sub: Recommendations of 7th Central Pay Commission - bunching of stages in the revised pay structure under Central Civil Services (Revised Pay) Rules, 2016.

Consequent to the issue of Implementation Cell, Department of Expenditure OM No.1-6/2016-IC dated 7th September, 2016, a number of representations have been received from AAOs under this organization through their respective Min./Deptt. regarding fixation of pay by bunching of stages in comparison with Sh.Babu Balram Jee, AAO, CPWD, IBBZ-I, Malda M/o UD in terms of the OM ibid. With a view to facilitate the accounting organisations under CGA, the service book of Sh.Babu Balram Jee, AAO duly audited has been obtained from the M/o UD. The pay details of Sh.Babu Balram Jee, AAO are as follows"
1. Basic Pay (Pay in the Pay Band plus Grade Pay) in the pre revised structure on 1.1.2016: Rs.14900/- (Rs.10100 + Rs.4800)
2. Revised Basic Pay on 1.1.2016 in terms of Revised Pay Rules, 2016: Rs.47600/- (1st Cell of 8th Level)
All respective accounting units of Ministries/Departments concerned may extend the benefit of bunching to eligible persons in adherence to the Department of Expenditure OM No.1-6/2016-IC dated 7th September, 2016. The statement of pay fixation under Central Civil Services(Revised Pay) Rules, 2016 of Sh.Babu Balram Jee, AAO is also enclosed.

Subject: One Day Strike on 16th March, 2017.

Reference is invited to this office 0M of even no.502 dated 18th January, 2017. All India Civil Accounts Employees Association has intimated that the proposed One Day Strike on 15th February, 2017 has been to 16th March, 2017.

2. Attention is invited to the provisions of Government of India (Ministry of Home Affairs) 0M No.25/23/66-Estt(A) dated 09.12.1966 (reproduced as G.l. decision No.2 below Rule 7 of CCS (Conduct) Rules, which inter-alia provides that under Rule 7 (ii) of rules ibid, a Government servant shall NOT resort to or in any way abet any form of strike in connection with any matter to his service or the service of any other Government employees. If any Government servant resorts to any action in violation of Rule 7 (ii) of CCS (Conduct) Rules, disciplinary action would have to be taken against him.

3. Attention is also invited to proviso to FR 17(I) according to which any employee(s) who is absent from duty without permission shall not be entitled to any pay and allowances during the period of absence. Further, unauthorized absence shall be deemed to cause an interruption or break in service Of the employee under FR 17(A).

4. In this regard, the following decisions of the Supreme Court may also be brought to the of the employees under your Ministry/Department. The Supreme Court has held in the Case Of T.K.Rangarajan Vs. Govt. of Tamil Nadu that no right exists with the Govt. employees to strike, whether fundamental, statutory or an equitable right. In All India Bank Employees Association Vs. National Industrial Tribunal & Ors„ (1962 (3) SCR 269) the Constitution Bench of the Suprerme Court specifically held that even very liberal interpretation of sub-clause (C) of Clause (1) of Article 19 of the Constitution cannot lead to the conclusion that the trade unions have a guaranteed right to strike, either as part of collective bargaing or otherwise. There is no statutory provision empowering the employees to go on strike. The Supreme Court also agreed that going on strike is a grave misconduct under the Conduct Rules and that misconduct by Government Employees is required to be dealt with in accordance with law. Hence, once it is proved that an employee has committed the of going on a strike in any form, the Supreme Court has held in Bank of India vs. TS Kelawala [1990 (4) SLR 249] that he will have to face the consequences which may include deduction of wages and even dismissal from service.

5. In this context, it is clarified that strike means refusal of work or stoppage or slowing down of work by a group of employees acting in combination and includes:-
vii) mass abstention from work without permission which is wrongly described mass Casual Leave.
viii) refusal to work on overtime where such overtime work is necessary in public interest.
ix) resort to practice or conduct which is likely to result in or results in the cessation or substantial retardation of work in any organization. Such practice include what are ‘go-slow’, ‘sit-down’, “pen-down’, ‘stay-in’. ‘token’, ‘sympathetic’ or any other similar strike as also absence from work for participation in a ‘Bandh’ or similar movements.
6. Accordingly, Casual Leave or any other kind of leave, if applied for, should not be sanctioned to the officers and employees during the period of proposed One Day Strike on 16th March, 2017 and it should be ensured that the striking activities are not allowed inside and around the office premises. It may also be ensured that the employees, who intend to attend their office work despite the call for the strike, are not prevented from attending the office by the striking employees. Suitable contingency plan may be worked out for carrying out the various functions in field offices and Principal Accounts Offices.

7. The above instructions may be brought to the notice of staff working under your control. All the Pr. CCAs/CCAs/CAs are requested to deal with the cases in respect of employees, Who resort to action as above, in the light of above referred instructions.

Please find enclosed herewith a copy of minutes of the Meeting held on 11th November, 2016 at 11.00 AM at O/o CGA under the chairmanship of controller General of Accounts to review the various pension - related issues requiring close monitoring by Pr.CCAs/CCAs/CAs for further necessary action.

Minutes of the meeting held on 11.11.2016 under the chairmanship of Controller General of Accounts at Mahalekha Niyantrak Bhawan, INA, New Delhi.

A Meeting was held on 11.11.2016 at 11.00 AM under the Chairmanship of Controller General of Accounts in the Conference Hall 'Swasti' Mahalekha Niyantrak Bhawan, Office of CGA, Block-E, General Pool Office Complex, INA Colony, New Delhi to discuss pension related issues.

At the outset Chief Controller (Pension) welcomed all the participants. Controller General of Accounts in his opening remarks highlighted the need for quick processing of pension cases to avoid delays and prompt disposal of Pensioners’ grievances and advised all concerned CCAs/CAs that issues regarding pending grievances and delays in receipt of pension & revision cases from HOOs/DDOs should be raised in the Senior Officers’ Meetings chaired by respective Secretaries. He stressed that all Pr. CCAs/CCAs/CAs must use their dashboards provided by CPAO to monitor the disposal of grievances and uploading of lists of retiring employees and submission of pension cases.

List of participants is at Annexure-I.

Following agenda items were discussed and decisions taken:
1. Agenda Item No. 1-A: Pending cases of revision under OM dated 6th April, 2016: Delinking of revised pension from qualifying service of 33 years:
It was observed that total 88,550 cases were due for revision. Out of that 61,778 cases were already revised. However, still 26772 cases (30%) were pending for revision. Out of these cases, 2551 2 cases (95%) were pending with 9 ministries/ departments i.e. Home Affairs (23,307), Atomic Energy, Prasar Bharti, CBEC, I&B, Agriculture, HIED, Civil Aviation and Supply. Vide various OMs issued by CPAO, concerned CCAs/CAs were requested to revise pending cases urgently. CGA directed to finalize all the pending cases within one month. PAO wise pendencies were reviewed specifically for MHA & Atomic Energy and they were advised to regularly review the status with their high pendency PAOs.

2. Agenda Item No. 1-B: Status of revision of pending Pre-2006 pension cases

It was observed that total 4617 cases of Pre-2006 (1,199 of Pre-2006 & 3,418 of Pre-90) were pending for revision in civil Ministries/Departments. Highest pendencies pertained to Home Affairs (963), Atomic Energy (442), CBEC, HRD, and Prasar Bharti. It was informed by the CCAs/CAs that these cases are pending due to non-availability of required information either with PAOs or with HOOs & Banks in spite of all out efforts made. Following points decisions were taken:

(i) CPAO to prepare fresh list of live pending cases on the basis of e-scrolls received which may reduce the number of pending cases. This list would be provided to the concerned Ministries/Departments to again review the pendency and check the availability of records. If records are not available even after this exercise, the certificate of non availability of records would be furnished by concerned CCAs/CAs to CPAO to enable it to take further necessary action. If any pensioner represents for revision of his/her pension in future the same would be revised on the basis of records provided by him/her subject to verification of the record.

(ii) The above list would also be provided to concerned pension disbursing banks to check the genuineness of these pensioners on the basis of KYC records available with them and get the relevant records required for revision for such pensioners. The banks will also be asked to furnish the copies of life certificates received from these pensioners to CPAO by 15th Feb, 2017.

3. Agenda Item Number-2: Delay in receipt of fresh PPOs

It was observed that only 29 percent of fresh PPOs were received in CPAO from PAOs before the date of retirement of government servants. All the CCAs/CAs present in the meeting informed that delay in finalizing fresh pension cases is because of late submission of pension papers by the HOOs to concerned PAOs. However, status of Atomic Energy was quite satisfactory where 85% fresh PPOs were received before the date of retirement. The Joint CA, Atomic Energy informed that they are regularly reviewing the status of receipt of fresh pension cases with the department and in case of any problem; they are holding the meetings with senior officers so that timely receipt of cases in PAOs may be ensured. CGA appreciated the efforts of Atomic Energy and advised other CCAs/CAs also to take up the matter regularly with concerned Administrative Authorities i.e. HODs/DOOs/DDOs for receiving the pension cases in PAOs as per prescribed time schedule and use the dashboards provided under WRPS to monitor the delays.

4. Agenda Item Number-3: Seeding of Aadhaar

Significant progress was observed in respect of Aadhaar Seeding in fresh PPOs by the Ministries/Departments as overall seeding percentage had reached 61%. Ministries/Departments where seeding percent was low were Home Affairs, PPG and Supply. In some Ministries/Departments, like Health & Family Welfare, HRD, Prasar Bharti and UD seeding was more than 90%, CCA, MHA was requested to ensure increasing the number of Aadhaar seeding in fresh PPOs as the low percentage of IVIHA had brought down overall percentage very significantly. Representative of PPG&P pointed out that low percentage of Aadhaar seeding in PPG&P was due to low Aadhaar seeding by Director of Accounts, Cabinet Secretariat (DACS) which uses PAO code of PPG&P but they are not in the administrative control of CA, PPG&P. On this issue, it was decided that while CPAO may take up the matter with DACS; PPG&P was also advised to coordinate with DACS to resolve this issue on regular basis. Most of the CCAs/CAs informed that PAOs are indicating Aadhaar numbers in fresh PPOs wherever the same is made available by the concerned HOOs and efforts are made to make it 100%.

5. Agenda Item Number-4: Web Responsive Pensioners Service:

A. Grievances: Under WRPS, total 570 grievances were received, out of that 375 pertained to the concerned 15 ministries. Out of these 375 grievances, 70 grievances were replied back by PAOs to CPAO and 56 settled. 305 grievances were still pending with PAOs. CGA advised all concerned CCAs/CAs to review the status of pending grievances through WRPS on weekly basis and settle the grievances in time bound manner. CC (P) also requested CCAs/CAs to regularly review the pending grievances available under their dashboards under WRPS and ensure not to allow any pendency beyond 30 days. All the CCAs/CAs assured to regularly review the pending grievances and take necessary action to bring down the number of pending grievances.

B. Quarterly List of retiring Employees: Lists of only 1734 retiring employees were uploaded so far by the PAOs of concerned Ministries/Departments. Since annually about 35 thousand of fresh pension cases are received in CPAO, this small number of uploading of lists showed that still either many PAOs are not uploading complete lists of retiring employees or not uploading at all.

To ensure the timely submission of list of retirees by the HOOs to the concerned PAOs the CCAs/CAs present in the meeting were advised to take up the matter with their HODs on regular basis to get the complete list of retiring employees wherever the same is not being provided by the HOOs. CGA advised CCAs/CAs to pay special attention to those PAOs where details of not even single employee has been uploaded so far.

6. Agenda Item Number-5: Discrepancies in the bookie of Expenditure under Pension grant:

It was observed that there were many discrepancies in the booking of expenditure under pension grant No.35 in the year-2016-17 (up to 2nd quarter) by many Ministries/Departments i.e. expenditure in excess of budget, expenditure without budget, misclassification between charged and voted expenditure, expenditure booked in minus etc. An OM dated 11.11.2016 with details of discrepancies had already been issued to CCAs/CAs. All concerned CCAs/CAs were advised to regularly review the booking of expenditure under various heads of pension grant in their Ministries/Departments with the help of reports available under e-lekha/PFMS and ensure to avoid any discrepancies in booking under pension grant.

7. During the meeting, CCA, Home Affairs and CA, Agriculture requested CC (P) to organize workshop for their pension processing PAOs in CPAO on WRPS and various pension related issues. It was agreed that workshop for PAOs of Ministry of Agriculture would be organized on 18th November, 2016 and for MHA on 1st December, 2016 at CPAO. Other Ministries were also requested to work out schedule of workshop for their PAOs in consultation with CPAO.

11. Grant Pay Scale of Rs. 1350-2200 from 01.01.86 to DEOs as has been granted by the Defence Accounts Department as well as in terms of the CAT judgments.

12. Removal of injustice to newly recruited Accountant in the matter of granting 1st increment through rectification of the procedure of Departmental Confirmatory test and also imparting training to the candidates.

13. Grant of two financial up gradation to MTS under ACP scheme who had completed 24 years of service before implementation of MACP Scheme as has done by the O/o the Pr. of Audit and Director, Economic service Ministries, Delhi vide order No:- AMG.I/Admn-1/32 dated 24.06.2014 .

14. Grant of Headquarter allowance to Sr.PS/PS/Stenos posted in office of CGA.

15. Removal of anomaly in grade pay arisen in PAO, CRPF after amalgamation of the office in Civil Accounts Organization.

16. As per decision of Supreme Court, payment of arrears in cash from 01.01.1996 to 18-02-2003 to Sr. Accountants due to upgradation of pay scale from 1-1-1996 .

17. Decentralization of CPAO and formation of regional offices to make the very purpose of operation of Pension Accounting Offices effective and conveniently accessible to old aged Pensioners.

18. Relaxation for revision of option for fixation of pay in the revised pay structure for persons promoted to the grade of Asstt. Accounts Officer (AAO) after 01.01.2006.

19. As has been done in earlier occasions and granted by Defence Accounts Department, Grant of honorarium for checking of pay fixation cases and pension cases after implementation of 6th CPC recommendations.

20.  No redeployment of retired officers and employees in the Civil Accounts Organization.

Subject: – Settlement of the problems referred by the PAO, Ministry of Health & Family Welfare, Kolkata Unit.
Reference: – This Association’s letter No. AICAEA/HQ/C-1/2014/2252-54 dated 26-02-2014.

Madam,
With reference to the above and in pursuance of the discussion held with the Controller of Accounts, Ministry of Health and Family Welfare on 10th February 2015, I would like to draw your kind attention to the following few lines –

1. Payment of Minimum wages to DEOs engaged in PAO, Ministry of Health and Family Welfare, Kolkata:-
Through the letter dated 1st September 2014, the Unit Association of PAO, Ministry of Health and Family Welfare, Kolkata had brought it to your kind notice that the outsourced employees engaged in the PAO, Ministry of Health & Family Welfare, Kolkata as Data Entry Operators have not only been receiving less pay then the rate prescribed by the Ministry of Labour but also lesser than their counterparts working in the Ministry of Health & Family Welfare itself. Alongwith its letter, the Unit Association had also forwarded a detailed note analyzing the entire fact for your perusal and favorable action.

As 10 posts of Accountant/Senior Accountant, 4 posts of LDCs and 4 posts of MTS were vacant in PAO, Ministry Of Health and Family Welfare, Kolkata , it was decided by the CCA, Ministry of Health and Family Welfare to recruit 5(Five) Data Entry Operators through third party (Contractor) to meet the shortfall. These DEOs were granted Rs. 339/- per day in spite of the fact that being Graduates and Computer trained, they fall under the category of “Highly Skilled” and they had been engaged against regular works being performed by the Accountant, Senior Accountant and LDC.

Data Entry Operators engaged in the Central Drug Laboratory, Ministry of Health and Family Welfare, Kolkata have been receiving daily wages @ Rs. 405/- and the Pay Accounts Office, Ministry of Health and Family Welfare, Kolkata is making payment of the Bills preferred by DDO concerned. The Copies of the Bills are enclosed herewith for your ready reference. Therefore, the DEOs working PAO, Ministry of Health and Family Welfare, Kolkata are being paid less than their counterparts.

Moreover, the explanations below Part II of the Schedule of Government of India extra ordinary Gazette Notification No. 800 dated May 20th, 2009(copy enclosed) stipulated that-
(a) If there are two rates for the Highly Skilled category, the higher rate is to be protected (Explanation No. 2 below Part II of the Schedule). This fact has further been clarified vide Note of the order No. B-27(1)/2013 dated 1-4-2013 issued by the Dy. Chief Labour Commissioner (Central), Mumbai (copy enclosed).
(b) The minimum wage of DEO is to be determined after allowing Variable Dearness Allowances (explanation No. 7, below Part II of the Schedule).

(c) The minimum rates of wage include also the wage for weekly day of rest (explanation No.3 below Part II of the Schedule) which implies that pay is to be given for 26days and not 22days.
Further, the Ministry of Labour, Government of India vide OM No. 14(113)Misc. RLC (coord)/ 2012 dated 23rd January 2014 provided the detailed guidelines regarding engagement of workers through Contractors by the Ministries and Departments of Central Government (Copy enclosed).

In view of the above we request the following-
1. Wage to DEOs may be given for 26days instead of 22 days.

2. Discrimination in wages of DEO may be removed by granting the wage equal to the wage being paid to the DEOs of Central Drugs Laboratory, O/o the DDC (I) of ADC (I).

3. Variable Dearness Allowance may be given to DEOs twice in a year.

4. Higher rate of wage may be protected in r/o DEOs to determine the minimum wage.

5. The Ministry of Labour order No. 14(113)Misc.RLC(coord)/2012 dated 23rd January 2014 may be implemented in the matter of engagement of DEOs.
2. Filling up of vacant posts:-

In the year 2011, the office of the Controller General of Accounts issued orders directing the heads of the Civil Accounts organization to upload the data relating to vacancy to website of Staff Selection Commission within stipulated time. The arrangement was in operation in the years 2012, 2013 and 2014 also. Various Ministries and Departments of Civil Accounts organizations which had taken action promptly could fill up large number of vacancies as they were allotted candidates by the Staff selection Commission from among the qualified candidates of examinations of 2012 and 2013.

But the office of the CCA, Ministry of Health and family Welfare did not send its requirement to the Staff Selection Commission at that time and due to this the posts have been left vacant in this organization.
Therefore, we request you to kindly initiate steps for filling up of vacant posts immediately as the office is suffering from huge shortage of staff.

The PAO, Ministry of Health and Family Welfare, Kolkata Unit alongwith the West Bengal Branches of All India Civil Accounts Employees Association and All India Civil Accounts Employees Association Category II have been agitating for settlement of above demands. However, responding to an assurance of the authority, the Unit Association and the aforementioned Branch Associations had suspended their agitational programmes after holding three days continuous Dharna in January 2015. But it is nearly two months they have not yet received any favourable response from the authorities.

It will therefore, be highly appreciable, if you kindly intervene into the state of affairs and settle above issues at the earliest.

Interactive Awareness Workshop Under Pensioners Portal

The Department of Pension and Pensioners Welfare, Ministry of Personnel, Public Grievances and Pensions is implementing a web based mission mode project on pensions namely Pensioner’s Portal under the National e-Governance Plan. The Department has also started initiative called SANKALP for channelizing the experience and skill of Pensioners towards meaningful social activities.

The Department is proposing to conduct the next such Awareness Programme for Pensioners at Assam Rifles Garrison, Near D.C. Office, Kohima (Nagaland) on 25.03.2015. The meeting will be chaired by Secretary (P,AR&PG).

The basic objective of the project is to facilitate redressal of Pensioners’ Grievances as also to provide information and guidance to pensioners on various pension and retirement related matters. User Ministries/Departments, Pensioners, Banks, Controller General of Accounts (CGA), Central Pension Accounting Office (CPAO), Post Offices etc. are the stakeholders in this venture aimed at welfare of the Pensioners.

With a view to providing know how about the operational aspects of this Portal and the Grievances Redressal Mechanism in particular, the Department of Pensions is conducting Awareness Programmes at different locations in the country.

Upgradation of LDC as Accounts Assistant, Merger of Accounts/Sr. Accountant, GP 5400 to AAO and Projected 7th CPC Pay by NFCCA.  

Following is the extract of Brief Resume and Decisions of extended Federal Executive Meeting held on 17th & 18th July, 2014 of National Federation of Civil Accounts Association :-

            Initiating the discussion, Secretary General reported about the pay scales devised and recommended by the staff side National Council (JCM) to the 7th CPC. Further,  he stated that as per the demand adopted by the apex JAC necessary documents had been placed before CGA.

The demands are:- 
1. Upgradation LDC as Accounts Assistant with grant of Grade Pay of Rs: 2400/-.
2. Merger of Accountant/Sr. Accountant and grantof Grade Pay of Rs: 4600/-.
3. Grant of Grade Pay of Rs: 5400/- to AAOs.

Accordingly CGA vide letter dated 14.07.2014 recommended to Ministry of Finance to Grade Pay of Rs:- 4600/- to Sr.Accountant and Rs:- 5400/- to AAO with effect from 1.1.2006. 

The apex JAC meeting held on 28th May 2014 reversed its earlier stand and decided to demand following Pay Scales to different categories before the 7th CPC.

It was also reported by the Secretary General to the house that the representatives of NFCAA held repeated dialogue over this matter with the leaders of other constituent of apex JAC, but there could not be any common understanding.
 
            On this agenda item, 26 (twenty six) Federal Executive members took part in the discussion. 25 members were of the opinion that the earlier stand of merger of Accountant and Senior Accountant was most justified and reasonable. Merger would be more beneficial and carrer boosting for all cadres of Civil Accounts Organization as a whole.
 
            However, after hours long discussion, following decisions were taken by the meeting
 
1. A resolution shall be forwarded to CGA conveying the resentment against forwarding the half hearted proposal of cadre restructuring to Ministry of Finance and that too without taking the Associations into confidence. In the same resolution it shall also be demanded to make suitable recommendations for rest of the cadres.
 
2. In the National Convention of Accounts and Audit Employees on 19th July 2014, the representatives of AICAEA and AICAEA Cat-II would unitedly place their views with regard to merger of Accountant and Senior Accountant and also plead for taking this approach before 7th CPC by the apex level JAC. 
 
However, in case the proposal is not accepted in the convention, the AICAEA and AICAEA Cat-II shall obey the majority decision of the National convention so that total unity among the officers and employees and officers of Accounts and Audit departments is maintained.
 
            Secretary General informed that, so far as departmental memorandum for submission to 7CPC in concerned, draft of the same was circulated to all seeking suggestions and proposals from Federal Executive members, Branches and even individuals. Further, Presidents and Secretary General of both Associations and President NFCAA are Co-ordinating among each other on this matter.
 
            The meeting observed that the discussion on this item of agenda had already taken place while discussing the previous agenda. It was therefore decided that, the memorandum shall be finalized after finalization of the approach taken by the National Convention of Accounts and Audit Employees and Officers Organization on 19thJuly 2014. The meeting also directed Presidents and Secretary Generals of both AICAEA and AICEA Cat-II to finalize the memorandum.
