Subject : Transfer policy guidelines - clarifications.

Madam / Sir,
I am directed to refer to Directorate’s communication number 141-141/2013-SPN-II dated 17.01.2019 vide which revised ‘Guidelines for transfer’ was circulated to all Postal Circles.
  1. Para 5 (i) of ibid communication prescribes that the official having more length of service in a unit (Circle or Division, as the case may be) will be placed above the official(s) having less length of service in a unit. Accordingly, PwD officials having less service has to be placed below senior officials. As a result, PwD officials have lesser chance for getting their Rule-38 transfer despite exemption in probation period Or 2 years service. The matter has been examined by the Directorate and Competent Authority has decided as under: –
Transfer requests received from Persons with Disabilities shall be registered first in the request registers (inward & outward) above all other officials based on length of their service but below the wait listed PwD officials if any in a particular year. The officials whose transfer request could not be approved in that particular year and are in the waiting list shall be placed on the top in the request register of subsequent year. Thereafter, fresh applications received during 1st April to 30th June of current year shall be registered by giving preferences to PwD officials (based on length of their service) as previously done. Fresh transfer requests received from PwD officials for current year shall be registered above all other officials (Other than pwD) who are in waiting list Of previous year based on length of service.

Further, preference shall also be given to such officials at the time Of their posting in transferee unit subject to administrative constraints.

Illustration :- Entry in request register for a particular year (2020)

Four officials namely A, B, C (PwD) & D (PwD) have applied for their transfer under Rule 38 during 1st April to 30th June in the year 2020. A is the senior most among all, B is junior to A, D is junior to B and C is the junior most official. As such, PwD officials shall be registered first in the request register based on length of their service followed by two other officials based on length of their service as well. Accordingly, serial of officials in request register shall be as under: -

Moreover, two officials namely X and Y (PwD) are in waiting list of previous year (2019). Therefore, these two officials shall be placed in top of request register of current year (2020). However, fresh transfer requests received from PwD officials shall be placed above X and below Y (as Y is PWD). Accordingly, serial Of officials in request register for current year (2020) shall be as under :–

3.Apart from above, following has also been decided by the Competent Authority:

i. Instructions issued by Department of Personnel & Training regarding posting of husband and wife at same station shall be taken into account while considering request for transfer under Rule-38 on spouse ground.

ii. Rule-38 transfer under mutual exchange shall be considered whenever received in the office of concerned CPMG instead of following schedule prescribed in Transfer Policy Guidelines.

Sub : Forwarding of one-way own request transfer applications to other Divisions/Railways.

It has come to the notice of Board that a large number of inter-Railway/inter-Division one-way transfer requests are being forwarded by some of the Zonal Railways for NOCs without assessing the feasibility of relieving such staff on receipt of NOC.

This causes unnecessary building up of expectations regarding their imminent sparing among such employees puts avoidable pressure on the Railway administration.

2. Considering the above, Railways may ensure that henceforth only such Inter-Railway transfers requests be forwarded where there is reasonable possibility of relief in case of acceptance by the railway to which transfer is sought.

While doing so, various factors like number of staff likely to be inducted in the cadre by way of departmental promotions/Inter-Divisional/Inter-Railway Transfer from other Railways/Divisions and through RRB indents should be kept in view so that once NOC is received, the concerned employee can be relieved early.

This issues with the approval of Board (MS).

Sub: Posting of husband and wife at the same station.

Attention is invited to Board’s letter No. E(NG)I-2009!TR/29 dated 02.02.2010 which contains detailed guidelines governing the posting of spouses at the same station . Earlier, some Zonal Railways had raised doubts about the ambiguity caused by the term “all India service” appearing in parenthesis in the Sub-heading/title of Para 3(e) of Board’s letter ibid. AIRF has also recently drawn Board’s attention to this and pointed out that this is causing confusion as regards applicability of the guidelines to Railway Servants.

The matter has accordingly been carefully considered by Board. The guidelines dated 02.02.2010 were issued in the context of at least one of the spouses being a Railway Servant. To remove any ambiguity/confusion regarding its applicability, it has been decided that the phrase “all India service” appearing in parenthesis in the title of para 3(e) of Board’s letter ibid should be treated as deleted. All other content of the said letter ‘remains unchanged.

 Subject: - Considering transfer under Rule 38 against vacancies reported for filling up through Direct recruitment examination conducted by Staff Selection Commission.

Sir/Madam,
As per guidelines for transfer under Rule 38 of Postal Manual Volume-IV, vacancies left over after considering transfer cases are reported for filling up through Direct recruitment / LDCE. Moreover, transfer under Rule 38 is considered only against concerned mode of recruitment and category of an employee seeking transfer.

It is observed that Circles are not considering transfer requests against reported vacancies presumably for the reason that candidates in relevant category will be allocated on completion of examination process.

Examination process is a time consuming affair and the concerned unit has to wait for almost two (2) years for appointment of a candidate from the date of reporting of vacancies by Circles. Resultantly, inspite of availability of vacancies in a Circle, officials from other Circles seeking transfer are waiting for vacancy to arise in subsequent recruitment year.

Request for transfer under Rule 38 is made by an employee on personal grounds, primarily for joining their family who are away from their workplace.

The matter has been examined in detail and it has been decided as under:

a) Before consideration of transfer under Rule-38 as per the schedule for the year 2019, which will cover the vacancy to be occurred in 2020 recruitment year (01.01.2020 ta 31.12.2020), all applications pending till 31.03.2019 may be considered even if vacancy for Direct Recruitment through SSC/Examinations conducted by the Department has been reported/earmarked.

b) While considering the applications as at (a) above, the following shall be taken into consideration:-

  • Transfer against vacancy reported or earmarked for Direct Recruitment through Staff Selection Commission (SSC) can be considered if the application was received prior to end of the recruitment year for which vacancy has been reported. [E.g. Applications received till 31.03.2018 can be considered only if relevant category of vacancy has been reported for 2017-18 recruitment year or subsequent recruitment years.] As on date, vacancy has been reported to SSC for (i) CGL 2017, (ii) CGL 2018, (iii) CHSL 2017, (ii) CHSL 2018 examinations.
  • Transfer against vacancy earmarked for Limited Departmental Competitive Examination ODCE) / Competitive Examination limited to Gramin Dak Sevak (GDS) can be made only if the examination for relevant recruitment year is yet to be held by relevant Circle (s), i.e. in case of inter-Circle transfer, examination should not have been held in both Circles. Transfer against vacancy of a recruitment year can be considered only if the application was received prior to end of the relevant recruitment year as explained above.
  • Guidelines circulated vide Directorate communication No.141-141/2013- SPB II dated 31.01.2014 shall be followed for vacancy available till 31.12.2018. Guidelines circulated vide Directorate Communication No. 141- 141/2013-SPB II dated 31.07.2018 shall be followed for vacancy available during 2019 recruitment year (01.01.2019 to 31.12.2019).
  • Since transfer under Rule 38 is permissible against relevant category of vacancy, (“e.g. SC/ST/ OBC/UR candidate against SC/ST/ OBC/UR vacancy respectively), instructions issued by the Government for appropriate representation of SC/ST/OBC, etc. should be followed.
  • An official belonging to a particular category in Circle-X can be transferred to CircIe-X only if Circle-Y has reported vacancy for that category in the relevant recruitment year and after approval of the transfer under Rule-38, relevant category of vacancy of Circle-Y will be transferred to Circle-X for allocation of relevant category of candidate. [E.g. An OBC candidate of Circle-X applied for transfer in July 2018 can be transferred to Circle-Y only if Circle-Y has reported OBC vacancy for 2018 or 2019 recruitment year. After approval of the transfer of the official under Rule-38, one (1) OBC category of vacancy will be reduced from the total number of OBC vacancy reported by Circle- Y and consequently one (t) OBC category of vacancy will be added to the total number of OBC vacancy reported by Circle-Y for allocation of candidate.
  • (vi) This will be a one time exercise to be completed by Circles by 15.05.2019. After completion of the exercise, Circles shall inform the details of inter Circle transfer made, category-wise, against vacancy reported for Direct Recruitment through SSC. For vacancy earmarked for examinations conducted by Directorate, revised vacancy status shall be communicated to DE Section of the Directorate. For examination conducted at Circle level, concerned Circle will take appropriate action.

Subject:- Regularisation of allotment on re-transfer to the last place of posting.

It has come to the notice of this Directorate that some allottees of General Pool Residential Accommodation (GPRA) have retained their accommodation at their last place of posting in contravention of the extant guidelines and instructions on the subject. In this regard, reference is invited to the Rule 54 of Central Government General Pool Residential Accommodation Rules, 2017(CGGPRA Rules, 2017) and it is reiterated that the allottees who have retained General Pool Residential Accommodation (GPRA) at their last place of posting due to their transfer/ posting at non-family stations in violation of the provision of the CGGPRA Rules, 2017 or the extant guidelines, shall not be considered for regularisation of GPRA at their last place of posting.

2. This issues with the approval of the competent authority.

(ii) Railway Board’s letter No. E (NG)I-2005/TR/20 dated 10/02/2017.
(iii) NFIR’s letter No. II/14/Part VII dated 21st Feb, 2017, 23/02/2017 and 12/04/2017.
(iv) NFIR’s letter No. II/14/Part VIII dated 15/05/2017 & 04/12/2017.
(v) Railway Board’s letter No. E(NG)I-2015/TR/20 dated 17/01/2017.
(vi) NFIR’s letter No. II/14/Part VIII dated 30/01/2018.

Federation is disappointed to note that despite justification given by the NFIR time and again to the Railway Board at the highest level (Hon’ble MR & CRB), instructions for relaxation from the minimum service condition in the case of re-employed former Defence Forces Personnel to facilitate them to reach their places on inter railway transfer have not been issued. Federation feels sad to mention that through the Action Taken Statement provided during NFIR’s PNM meeting conveys as follows.

"Necessary instructions have been issued vide Railway Board’s letter No. E(NG)I/2015/TR/20 dated 10/02/2017 exempting certain categories of transfer from the minimum 5 years service condition. As decided in the meeting, the case for ex-servicemen was put up to competent authority who has not agreed to the proposal".

2. In this connection, Federation invites kind attention of the Board (CRB) to the discussion held by GS/NFIR on 06/06/2018 and again on 13/07/2018 wherein the Federation had again sought intervention of CRB on the subject matter, who in fact agreed and advised officials to process the case for granting relaxation to the former Defence Personnel re-employed in Railways who seek inter railway transfer. But, there has been no progress on the subject.

NFIR, therefore, once again requests the Board (CRB) to kindly see that relaxation to 5 years service condition is granted in the cade of inter railway transfer requests of former Defence personnel re-employed in Railways as a special case.

In terms of instructions issued by Department of Personnel & Training (DoPT) on transfer/posting of Government employees, all Ministries/Departments of Government of India are required to have their own guidelines for transfer/posting of their employees providing for the following -
i. minimum tenure;
ii. have a mechanism akin to Civil Services Board for recommending transfer; and
Respective Ministries/Departments are also required to place the transfer policy in public domain.
There is no proposal to formulate single transfer policy for the Government employees as guidelines for transfer/posting of employees depend on the specific requirement of individual Ministries/ Departments. Moreover, the State Public Services are under State List for which the State Governments are competent to make rules and policies. Accordingly, there is no proposal to constitute any commission for single transfer policy for both Central & State employees.

This information was provided by the Union Minister of State (Independent Charge) Development of North-Eastern Region (DoNER), MoS PMO, Personnel, Public Grievances & Pensions, Atomic Energy and Space, Dr Jitendra Singh in written reply to a question in Lok Sabha today.

Concerning the posting at the same place of husband and wife who are working in Government service, the transfer issues have been raised in Parliament on several occasions. In 1980's these demands began to show its seriousness, because the percentage of women employees were increased in joining the Government services. The Central Government also observed this issue from various forums, a circular had been issued by the Department of Social Welfare in Feb 1976 to all Head of Departments to give serious consideration to the requests of posting of husband and wife at the same station. In order to that order, lot of women employees started to send their request to transfer at the place where their husbands are posted.

The Central Government gave its utmost importance to this issue and as far as possible and within the constraints of administrative feasibility, the husband and wife should be posted at the same station to enable them to lead a normal family life and to ensure the education and welfare of their children. The Department of Personnel and Training issued an OM on 3.4.86, in accordance with the guidelines and instructions in the order given by the Government, all cadre controlling authorities should consider such requests with the utmost sympathy.

The Department of Personnel and Training issued various office memorandums regarding this matter from time to time. The motive of the Government on the petitioners, said in the orders repeatedly, to give utmost importance attached to the enhancement of women's status in all walks of life and to enable them to lead a normal family life as also to ensure the education and welfare of the children.
Till recently, the persmin has issued total of six orders pertaining the above subject on its website. After implementation of the 6th CPC, the last order has been issued on 30.09.2009. The order said that "On the basis of the 6th CPC reprot, Government servants have already been allowed the facility of Child Care Leave which is admissible till the children attain 18 years of age". The consolidated guidelines concerened this subject has been provided in the OM dated 12.06.1997. The consolidated guidelines has been amended and published in the last order after implementation of 6th CPC.
In the main guidelines, "The husband & wife, if working in the same Department and if the required level of post is available, should invariably be posted together in order to enable them to lead a normal family life and look after the welfare of their children especially till the children attain 18 years of age. This will not apply on appointment under the central Staffing Scheme. Where only wife is a Govt. servant, the above concessions would be applicable to the Govt. servant. Complaints are sometimes received that even if posts are available in the station of posting of the spouse, the administrative authorities do not accommodate the employees citing administrative reasons. In all such cases, the cadre controlling authority should strive to post the employee at the station of the spouse and in case of inability to do so, specific reasons, therefor, may be communicated to the employee".

Subject: Transfer Policy: Sports quota recruits and sports personnel of national and international repute.

Transfer Policy guidelines for sports quota recruits have been circulated through HQrs office letter dated 11/8/2015. It states that as teams are not participating in many tournaments, players can be considered for posting to their home States/choice stations. For individual games, sports persons can participate at national/international events as and when organized. The circular further states that sports quota recruits may be considered for posting to their home States/choice stations as per rules and administrative feasibility. All transfer requests of these personnel are allowed to be routed through Volunteer list/normal channel on completion of the prescribed tenure.

2. Since then, various references have been received from individuals who are sports quota appointees. In the meeting of DASCB held on 23/02/17, it has been decided that consultation of DASCB may be obtained for transfer of Sports quota recruits and also other sportsmen of National level and above.

3. Keeping in view the administrative constraints vis-a-vis general transfer policy as well as consultation of DASCB prior to processing transfer requests of sports quota recruits, a need is felt to review the guidelines relating to the- stay at a station by the sports quota individuals and following guideline is framed:
i. Sports quota recruit and sportsperson of national and international repute may be recommended by the DASCB for posting to their home State they representing at national or international level for a period of ten years from their date of appointment or till they attain the age of 35, years’ subject to administrative feasibility. However, they have to [submit a duly authenticated certificate from the state sports authority concerned to their controlling authority, on annual basis, in support of their sporting activities undertaken by them during the year and same will be examined by the DASCB for their recommendation for retention at the same state or transfer to any other place at par with others. Similarly, if a sports person becomes coach of national or international level team after active sport age, his/her transfer request will also be examined in a similar manner.

ii. After completion of above stipulated period, the sports quota recruits/other sportsmen of National/International level, will be treated at par with other employees of the Department in the matter of transfers.

iii. The cases of these sports personnel who are presently serving at stations other than the state whom they are representing in their sporting career, may also be considered, in terms of above guidelines subject to administrative feasibility.

iv. It has also been decided that the PCsDA/CsDA will be assigned the teams of a particular sport/discipline. The PCsDA/CsDA will be responsible for nurturing and grooming of their respective teams.

v. Further, the performance of sports persons will also be closely monitored on quarterly basis to ensure that there is no dip in their performance. The recommendation will be sent to DASCB periodically for monitoring purpose at their level.

vi. These individuals will also have to participate / represent team DAD as and when called for doing so including attending of training/preparatory camp for duration/location as fixed by the "DASCB: or PCDA/CDA concerned.

vii. The transfer request forwarded to HQrs office on sports ground must be supported with annual certificate as mentioned in. para 3 (i) and quarterly report as mentioned in para 3 (v) above. These requests are to be examined by DASCB and forwarded to Admin Section concerned with their recommendations.
4. The guidelines contained in para 3 above are meant; to guide the exercise of transfer of sports quota recruits and sports personnel of national and international level to the extent administratively feasible. These guidelines are not intended to create any entitlement of any kind.

The Indian Defence Accounts Service has a cadre composed of directly recruited officers inducted through the UPSC Civil Services Examination as well as officers promoted from within the Department. Officers appointed to the Service have an all India liability including field service in or out of India. To achieve professionalism in the organizational goals, there is need to ensure career progression opportunities and individual growth and satisfaction to the officers.

Sub: Rotation of Officials working in sensitive posts – Reg.
Attention is invited to Central vigilance Commission’s Circular No. 03/09/2013 issued under file No 004/VGL/ 090/ 225553 dated 11.09.2015 on the subject mentioned above. As per Commission’s instructions issued vide letter Nos 98/VGL/60/dated l5/4/l999. 02/11/2001 and 004/VGL/90 dated 1/5/2008 on the issue. it is prescribed that Ministries/Departments and CVOs are to identify the sensitive poets and staff working in these posts and also ensure that they are strictly rotated alter every two/three years to avoid developing vested interests.

It has also been observed in the Circular that such rotational transfers are not effected in many organisations due to which officials continue to remain in the same posts for long periods. Such overstay and continuous postings afford scope for indulging in corrupt activities. developing vested interests etc. which may not be in the interest of the organisation. The Commission had therefore emphasised for periodical rotation of officials holding sensitive posts/jobs.

In order to implement the guidelines of CVC’s circular; the following sections in the various Pay and Account Office: under the administrative control of Pr. CCAs/CCAs/CAs have been identified as sensitive:

l. Administration including Cash.
2. Pro Check.
3. Procurement/Paradise.
4. Sections dealing with banks.
5. Loans and Grants.
6. Any other section (as decided by respective Pr. CCAs/CCAs/CAs)

Further. the tenure of Sr. AOs/AOs/AAOs posted in these sections has been fixed as two years and the tenure for Sr. Accountants/Accounants has been fixed as three Years.

Rotation/transfers of all officers/officials who hove completed their tenures as per above cited guidelines they be considered. Also, while considering rotation/transfer of officials who have completed their tenures in the sensitive sections it may be ensured that they an posted to other sensitive sections only after a gap of minimum of two years. While considering rotation/transfer of officials posted in sensitive posts. officials working in non sensitive posts may also he considered for rotation/transfers after completion of six years on regular basis to improve overall efficiency of the organisation.

In cases. where AAOs are considered for promotion as AOs in the same office/Department due to administrative reasons. their services rendered in sensitive sections may be taken in to account while posting them as AOs.

All Pr. CCAs/CCAs/CAs are advised to amuse strict compliance of the Commission’s guidelines and implement me some in letter and spirit. A list of official rotated/transferred out of sensitive posts may be furnished to this office latest by 31/01/2016

A Comprehensive Transfer Policy for Railway Officers have been formulated and issued on 31.08.2015. The Policy lays down a general Policy framework for transfer and reiterates various existing rules and guidelines with regard to posting under Spouse rules, competence of General Managers to make rules in respect of Non-Gazetted staff under their control, transfer of RPF/RPSF personnel and special consideration for care of disabled children etc. It also prescribes minimum and maximum tenures on a job and at a place as also guidelines regarding timing of transfers and relieving of officers.

This information was given by the Minister of State for Railways Shri Manoj Sinha in a written reply to a question in Lok Sabha today.

While reviewing the transfer policy and issuing comprehensive guidelines on the subject, Railway Board under Para .(xi) of their aforementioned letter dated 31.08.2015, have also directed the following in case of non-gazetted staff:
''In case of non-gazetted Railway employees, no inter-Railway transfer request will be considered till completion of 05 years of joining Railway.”

2. Furthermore, it is also desired that, on Divn/Unit two separate priority registers should be maintained, one for registering requests for transfer within the Northern Railway and another for Inter - Railway transfer to other Zones/PUs etc.
The'aforesaid instructions may be adhered to strictly while dealing with transfer request cases.

Sir,

The present KVS transfer guidelines for teachers upto PGT and Non-teaching staff Upto Assistant are effective from 01.04.2011 as amended from time to time. It has been decided to seek suggestions/comments on the guidelines from all stakeholders to make the guidelines more transparent and employee welfare oriented. All DCs are therefore directed to send the comments/suggestions to KVS(hqrs.) as per following Schedule:-

I. A copy of this Circular be circulated to all the teaching and non-teaching staff of all KVS/ROS on 28/10/2015. The principals are directed to discuss the issue and receive the suggestions/comments in writing from the desirous staff in the staff meeting to be held on 31.10.2015 (last working day) . The suggestions/comments may be compiled at KV level and mailed to the DC, KVS concerned on or before 2.11.2015.

II. The DCs also may give their suggestions/comments on this issue and also take from their staff members.

III. The Dy. Commissioners shall compile the suggestions/comments they receive from the KVs of their region/Ro and send the same to KVS(hqrs.) on or before 6.11.2015 by e-mail - kvs.newtgs@gmail.com for further necessary action.
IV. All the three service associations i.e. AIKVTA, KVPSS and KEVINSTA have also been requested to send their comments/suggestions on the issue vide KVS(hqrs) letter no. F.11029-16/2015-KVS(Admn-I)/3762 dated 30.9.2015.

1. The transfer policy for Railway Officers has been reviewed by the Ministry of Railways. In supersession of all existing instructions, Ministry of Railways have now decided to formulate a Comprehensive Transfer Policy for Railway Officers. The salient features of the Comprehensive Transfer Policy are given in the succeeding paragraphs:
 
(i) Ordinarily a Group ‘A’ officer will not be transferred out of his allotted Zone/Unit till Selection Grade.
On empanelment to Group ‘A’, there may be inter-Zonal transfer of a Group ‘B’ officer with residual service of more than 3 years.
(ii) Officers, will be considered for posting to Railway Board/RDSO/CTIs/PUs/Other Units in'administrative interest after completion of minimum of 5 years in allotted zone.
(iii) No request for transfer will be considered till completion of 5 years in assigned zone.
 
(iv) Transfers and postings will be done against clear vacancy of a sanctioned post. The present policy of posting officers to the Eastern Region on return from deputation abroad will continue to be followed.
 
(v) Posting in Railway Board/CTl/RDSO/RRB is tenure posting having maximum tenure of 5 years and not a deputation post. Hence, normal procedure for inter Railway/Unit transfers be followed.
 
(vi) A cooling off period of minimum 3 years between two tenures in Railway Board/RDSO will be required.
 
(vii) Normally, minimum tenure on a particular post at a time will be 2 years and maximum tenure will be 5 years. For sensitive posts, maximum tenure will be 4 years. Minimum tenure will not be applicable for Junior Scale/Senior Scale officers of Group A. However, in administrative exigencies, relaxation may be granted by cadre controlling officer.
 
(viii) Total stay at a stretch at a particular station should not be more than 10 years and the total cumulative stay (in broken spells) should not be more than 15 years. Deputation to PSUS and other Ministries will not be counted for this purpose. This will be implemented in a phased manner.
 
(ix) In case of IRMS doctors (including Dental Cadre) in Railways, the proposed policy will be as per following guidelines
 
    (a) The transfer of doctors within and outside the zone should be decided by the Railways/Board at appropriate level on case-to-case basis, keeping in view the administrative interest. Total stay at a stretch/cumulative stay (inbroken spells in a particular station) be limited to 15&20 years respectively. However, while issuing such transfer orders the following guidelines should be observed.
    (1) Super specialist doctors can only be transferred from one super speciality centre to another super specialty center of same specialities.
    (2) Senior specialist of Central Hospital of the Zone or Division should be transferred to another Divisional or Zonal Centre of equal status.
    (3) General Duty Medical Officers and Dental Surgeon can be shifted from one such post to equivalent post in other places.
 
Note : The idea behind these guidelines is that specialist services are not disturbed while keeping the administrative interest in mind.
 
(x) Transfer of RPF/RPSF personnel will be in terms of Railway Board Standing Order No.102 and 110 issued by DG/RPF. Total stay at a stretch at a particular station should not be more than 10 years and the total cumulative stay (in broken spells) should not be more than 15 years.
 
(xi) In terms of para 124 of IREC, Vol.1, GMs have full powers to make rules, with regard to non-gazetted Railway Servants. No change is recommended. Maximum tenure on sensitive posts will however be 4 years. In case of non-gazetted Railway employees, no inter railway transfer request will be considered till completion of 5 years of joining Railway.
 
(xii) Deputation of Railway Officers will be governed by DOP&T’s guidelines as adopted by Ministry of Railways vide letter No.2010/F(E)Il/1(1)/1 dated 28.07.2010.
 
(xiii) Transfers other than those caused due to promotion, deputation/return from deputation, retirements etc. will be generally issued from January to March. However, in administrative exigencies, transfer orders may be issued as and when required.
 
(xiv) The controlling officer will ensure that the officer transferred will be relieved within a maximum period of one month.
 
(xv) A government servant who is also a care giver of disabled child may be exempted from the routine exercise of transfer/rotational transfer subject to administrative constraints as per OM No.42011/3/2014-Estt.(Rs.) dated 6.6.2014
 
(xvi) Every effort will be made to post the husband and wife at the same station as detailed in DOP&T’s Circular No. F.No.28034/9/2009-Estt(A) dated 30th September 2009.
 
(xvii) All fresh transfer orders will be governed by this policy.
 
(xviii) In future, requests for inter railway transfers from officers will be done online for which a system will be developed separately and circulated.

The undersigned is directed to refer to the OMs of even number dated 13thJune, 2014, and 3 July, 2015 wherein all the Ministries/Departments were requested to (i) prescribe Minimum Tenure, (ii) set up a mechanism akin to Civil Services Board for recommending transfer, and (iii) place in public domain the transfer policy.

2. The Rotational Transfer Policy should aim to harmonise objectives of institutional memory, avoid development of vested interests, and provide exposure to the employees of working in different organisations, inter alia ensuring overall growth of an officer. The Transfer Policy should provide for both a minimum as well as maximum tenure. Any transfer before completing the minimum prescribed tenure or stay beyond the maximum tenure should be with the approval of the Committee constituted for the purpose, for reasons to be recorded in writing.

3. The draft Rotational Transfer Policy for the Central Secretariat ServiceNavailable on the website of Department of Personnel and Training at www.persmin.nic.in (Annexure). It lays down guidelines on tenures, postings on promotion, posting on return from leave/deputation, outstation postings, mutual transfers etc. Appropriate provisions on these aspects may be made in the Rotational Transfer Policy in each cadre that will best serve public interest.

4. In addition, instructions of Central Vigilance Commission in the Circular No. 03/09/13 (No.004/VGL/090/225553 dated 11.9.2013) reiterate that sensitive posts should be identified and staff working in these posts strictly rotated after every two/three years to avoid developing vested interests. The OMs of this Department also lay down guidelines on postings of spouse at the same station, and postings of disabled Government servants/ parents of disabled children.

4. The Ministries/Departments/Cadre Authorities may communicate action taken report on the following latest by 10.7.2015, (i) framing of Rotational Transfer Policy and putting up in public domain (ii) Identification of sensitive posts (iii) rotation of officers from sensitive posts in true spirit of the provision.

It is to bring to the notice of all employees concerned that Annual Transfer of teaching/non-teaching employee is in process as per Transfer Guidelines. Grievance related to transfer (below Vice-Principal and section Officer) for modification, cancellation etc. are to be sent through controlling officer through E-mail address. i.e. kvstransfer@gmail.com.

Accordingly, employees concerned are advised to send their grievances through controlling officer i.e. KV/ RO/ ZIET via E-mail only. Grievances received other than E-mail from KV/ RO/ ZIET will not be entertained.

The following instructions are placed hereunder for perusal by D.Cs KVS, RO. Concerned.

1. All grievances/ representations are to be sent after scanning through their respective controlling officers of RO/ ZIET/ KV within 07 days from the date of issue of Transfer Orders through E-mail address only i.e. kvstransfer@gmail.com

2. The controlling officers must ensure before sending the grievances/representations that content given therein is correct, genuine and not contrary to the KVS Transfer Guidelines. Efforts should be made to redress the grievance/ representation by the controlling officer then and there, if possible to avoid unwanted correspondence

3. After compliance as above, at Serial No. 2, the representations/grievances are to be sent to KVS HQ through RO/ ZIET/KV via E-mail and facts must be verified on the face of the representation.

4. The employees visiting to KVS (HQ) will be allowed only with prior permission of his/her controlling officer. He/ She should bring the copy of representation sent through E-mail to the KVS (HQ)

5. The visit of the employee concerned without permission will not be entertained by KVS (HQ).

6. Application forwarded directly to KVS (HQ)/ advance copies other than the KVS employee will not be entertained except in exceptional cases.

All the DCs KVS, RO/Directions, ZIET, KVS are advised to bring this notice to their staff members and to all the KV concerned running under their jurisdiction with the instructions to the Principal of the KV concerned to bring this notice to all staff members of KV under limitation to this office.
