Your kind attention is invited towards AIRF’s letter bearing number even dated 19.11.2020, addressed to Director General (Human Resources), Railway Board (photocopy enclosed for kind perusal), whereby this Federation had elaborately explained the facts necessitating in-house system of medical facilities presently available for Serving / Retired Railwaymen and their dependent family members.

As we have already explained, keeping in view the peculiar nature of duties of the Railwaymen, who work under various arduous conditions in all weathers 24X7 throughout the year for keeping the wheels of the Indian Railways moving to ensure the overall development of the country, the existing medical facilities were created for them and their dependent family members.

It would be pertinent to mention here that, even in the Colonial Days, British Rulers had recognized the need for medical facilities for Railwaymen and established many Dispensaries and Hospitals during those days. Even after the Independence, Medical System over the Indian Railways has been expanded to a greater extent to meet the medical requirements of the Railwaymen and their families.

Medical facilities, so available for the Railwaymen, have been achieved by the Organised Labour after sustained struggle and persuasions in the wake of aforementioned peculiar working conditions.

Special Casual Leave to be consider the absence during COVID-19 epidemic lockdown period – AIRF

It is a matter of concern that, Railway Board have not given any cognizance to AIRF’s viewpoint, already communicated to Railway Board vide AIRF’s letter dated 19.11.2020, addressed to D.G.(H.R.), Railway Board, and without consulting Organised Labour, who are representing more than one million Railway Employees and equal number of Retired Railway Employees(total number of beneficiaries being around one crore), Railway Board have been proceeding ahead for Medical Insurance to all the Railway Employees. This arbitrary change in the policy of medical assistance to Railway Employees is bound to create a lot of anguish in the minds of Serving as well as Retired Railway Employees.

AIRF, vide its communications No.AIRF/71 dated 06.08.2020, No.AIRF/101 dated 16.09.2020 and 19.11.2020 has already objected to the Railway Board’s proposal of Medical Insurance to all the Railway Employees, quoting various reasons, but instead of holding a discussion with the Recognised Federations, further information is being sought by the Railway Board from the Zonal Railways and Production Units, vide their letter No.E(W)2020 /Misc./ Dashboard-GIS dated 30.12.2020, with a view to proceed further in the matter.

AIRF is of the firm opinion that, Railway Administration should not compel and force Serving as well as Retired Railway Employees to accept the proposal of Medical Insurance being initiated by the Railway Board.

It would, therefore, be quite appropriate that, such type of exercises, which are bound to create avoidable discontentment and resentment among Serving as well as Retired Railway Employees, should be stalled immediately. We presume that, this exercise is being undertaken to appease some of the Corporates who are dealing in Insurance Business.

Railwaymen are already in endurance because of National Pension System(NPS), therefore, AIRF would not accept any kind of Medical Insurance to Railway Employees on Indian Railways, which would further aggravate the situation.

AIRF sincerely hope that, Railway Board will take it seriously, and stall such type of exercises, in the larger interest of Industrial Harmony, otherwise we will be forced to launch a massive agitation against anti-labour policies of the Railway Board.

This may kindly be treated as “Most Urgent”.

Sub: Regularization of absence during COVID-19 epidemic lockdown period

Ref.: Railway Board’s letters No.(EG) 2020/LE 2/1 dated 06.08.2020 and 03.09.2020

We are thankful to Railway Board for issuing instructions in the matter of treatment of absence during COVID-19 epidemic lockdown.

Many of the employees have had to remain away from their work, subsequent to the lockdown, whose absence is pending regularization. Many of the employees were forced to remain under quarantine due to various situations, which can be classified broadly as follows:-

(i) An employee was asked to remain in quarantine on return from outstation duty.
(ii) An employee remained in quarantine due to Central/ State Government instructions.
(iii) An employee was advised by Railway Medical Authority to remain in quarantine.
(iv) An employee who chose to remain in quarantine as a precaution.
(v) An employee who worked from home due to co-morbidity or underlying medical conditions as per Central/ State Government instructions.
(vi) An employee stayed at home as a precautionary measure and later found to be COVID-19 positive.

It is, therefore, requested that, necessary instructions for treating absence of an employee during aforementioned situations, as “Special Casual Leave”, may kindly be issued at the earliest. Orders issued for maximum 30 days “Special Casual Leave” should also be cancelled as these being granted in special circumstances of COVID-19 epidemic where lockdown had been for more than four months and all sorts of transport had not been under operation.

Dear Comrades,
Observance of countrywide "Warning Week" from 16-19 September, 2019

As all of you are aware that, burning issue of Corporatization and Privatization was discussed in the meeting of the Standing Committee of AIRF held on 1st September, 2019 at New Delhi.

After long drawn deliberations it was decided to lodge strong protest against such move of the Ministry of Railways (Government of India). Accordingly, it is decided to observe "Warning Week" from 16th to 19th September, 2019, calumniating on 19th September, the "Sahidi Diwas".

All of your are requested to take appropriate action by directing Branch and Divisional Units to observe the "Warning Week" by holding massive dharna, demonstration and rallies, right from the Branch to Headquarters level.

The programme should be given wide publicity through print and electronic media and the report of the observance be sent to AIRF Office.

This may please be treated as "Most Urgent".

Subject: Withdrawal of resignation of Central Government servants appointed after 31.12.2003 covered under the National Pension System (NPS) reg.

The undersigned is directed to say that instructions on the procedure to be followed for 'Resignation from service' have been provided vide Ministry of Home Affairs O.M. No.39/6/57-Ests.(A) dated 06.05.1958, Department of Personnel & Training (DoPT) O.M. No.28034/25/87-Estt(A) dated 11 .02.1988, No.28034/4/94 - Estt.(A) dated 31 .05.1994 and No.28035/2/2007-Estt.(A) dated 04.12.2007. Para 5 of DoPT O.M. dated 11 .02.1988 referred to above, provides the procedure for withdrawal of resignation as governed by Rule 26 (4) to (6) of Central Civil Services (Pension) Rules, 1972. References are being received from Ministries/Departments on the request for withdrawal of resignation by Government servants appointed after 31 .12.2003 and for whom CCS (Pension) Rules are not applicable. The matter of withdrawal of resignation of Government servants of Central Civil Services/Posts, appointed after 31 .12.2003 who are covered under the National Pension System (NPS) and for whom CCS (Pension) Rules, 1972 is not applicable has been considered in this Department and with the approval of the competent authority, it has been decided that the following guidelines/ instructions may be followed while considering the request for withdrawal of resignation of the aforesaid Government servants.

The appointing authority may permit a person to withdraw his resignation in the public interest on the following conditions, namely:

(a) that the resignation was tendered by the Government Servant for some compelling reasons which did not involve any reflection on his integrity, efficiency, or conduct and the request for withdrawal of the resignation has been made as a result of a material change in the circumstances which originally compelled him to tender the resignation ;

(b) that during the period intervening between the date on which the resignation became effective and the date from which the request for withdrawal was made, the conduct of the person concerned was in no way improper;

(c) that the period of absence from duty between the date on which the resignation became effective and the date on which the person is allowed to resume duty as a result of permission to withdraw the resignation is not more than ninety days;

(d) that the post, which was vacated by the Government servant on the acceptance of his resignation or any other comparable post, is available.

3. Request for withdrawal of a resignation shall not be accepted by the appointing authority where a Government servant resigns his service or post with a view to taking up an appointment in or under a private commercial company or in or under a corporation or company wholly or substantially owned or controlled by the Government or in or under a body controlled or financed by the Government.

4. When an order is passed by the appointing authority allowing a person to withdraw his resignation and to resume duty, the order shall be deemed to include the condonation of interruption in service for the purpose.

5. No withdrawal from NPS corpus shall be permissible within a period of 90 days from the date on which the resignation becomes effective i.e. the resignation is accepted by the competent authority and the Government servant is relieved of his duties. However, the aforesaid condition shall not be applicable in case of death of the government servant after the resignation becomes effective.

6. The provision for withdrawal of resignation shall not be applicable for temporary Government Servants.

7. Above guidelines/instructions will be applicable only for the Government servants appointed on Central Civil Service/ Posts after 31.12.2003 who are covered under the National Pension System (NPS) and for whom CCS(Pension) Rules, 1972 is not applicable. Further, these guidelines/ instructions will be applicable till the time the statutory rules regarding withdrawal of resignation for such Government servants are notified.

8. This O.M. shall be prospective and cases already settled shall not be opened.

9. This issues in consultation with the Office of Comptroller and Auditor General of India.

10. It is requested to bring it to the notice of all concerned for strict compliance.

Extending the benefit of financial upgradation under MACPS to Railway School Teachers

The issue under consideration is the issue of extending the benefit of financial upgradation under MACPS to Railway School Teachers instead of CAS (Career Advancement Scheme) presently operating for them. This issue has been raised by both the Federations (AIRF and NFIR) and IRPOF. Recently, this issue was also raised in 47th Meeting of NC/JCM held on 13-4-2019, chaired by Cabinet Secretary.

Sub: Extending the benefit of financial upgradation under MACPS to Railway School Teachers.

In the above context, it is stated that Railway School Teachers have all along been treated at par with teachers under Ministry of Human Resources and Development in every respect viz. recruitment qualification, pay structure, age of retirement etc. including Career Advancement Scheme (CAS). CAS was introduced in year 1988 based on recommendations of Dr. Chattopadhyaya Committee for the teachers under Ministry of Human Resources and the same was also adopted in respect of Railway Teachers which provides for grant of two financial upgradation on completion of 12 months 24 years of service with reference to the Recruitment Grade, in certain specified Pay Scales/ Grades called Senior Scale and Selection Scale respectively.

As Railway School Teachers are common category and their service conditions etc. are regulated as per identical terms and conditions as the teachers available under Ministry of Human Resource and Development (M/o HRD), therefore, CAS Scheme was continued in their respect instead of implementation of ACP/ MACP Scheme. On receipt of some representations / references stating that the MACP Scheme is being implemented in respect of teachers working under Ministry of Defence, Department of Space, a reference was made to M/o HRD vide Board's letter dated 18.12.2017, (followed by reminders dated 27.06.2018 and 27.01.2019) seeking clarification as to whether MACP Scheme can be implemented in respect of Railway School Teachers. M/o HRD vide their letter dated 26/11/2018 have advised that Railway Board is Competent Authority to decide the terms and conditions of service of Railway School Teachers and Department of, Personnel and Training may be approached for further clarifications on MACP provisions.

Meanwhile a copy of OM dated 26-4-2019 of Ministry of Human Resource Development enclosing a copy of Speaking Order dated 18-4-2019 passed in compliance of order dated 15-11-2018 by CAT/ Lucknow in OA No. 172/2014 for extension of MACP benefit to teachers under Kendriya Vidyalayas have been received. On perusal of the said Speaking Order it has been observed as under:

a) The Association of Kendriya Vidyalaya teachers had chosen to remain in the existing Scheme of three tier pay scales (i.e. CAS) and accordingly MHRD conveyed KVS that 'Government has decided not to extend ACP Scheme to the teachings staff of KVS and that they would continue in the existing scheme;

b) On implementation of MACP Scheme, the MHRD decided to extend the same to non-teaching staff of KVS;

c) MHRD considered the issue of extension of MACP benefit to teaching category of KVS in consultation with DOPT who in turn further consulted Department of-Expenditure  and taking note of the fact that one of the conditions for extending the benefit of MACPS was that the earlier ACP Scheme should have been adopted by the concerned authority and that the KVS itself had chosen not to opt for earlier ACP Scheme for their teaching staff, the proposal for grant of MACPS to teachers under KVS was not agreed by Deptt. of Expenditure;

d) In two cases viz. OA No. 3855/2015 before CAT/ PBNew Delhi and OA No. 515/2013 before CAT/ Ernakulam, the Tribunals have dismissed the claim for extension of MACP benefit to teachers under Kendriya Vidyalaya Sangatthan;

e) In view of the position stated in para (a) to (d) above, MHRD vide its Speaking order dated 18-4-2019 have declined the claim of KVS teachers for grant of MACP benefit.

3. It is pertinent to mention that benefit of financial upgradation accruing under CAS viz- a-viz MACP was examined in detail and it has been observed that MACP Scheme is broadly beneficial than the CAS presently being implemented for the Railway School Teachers as at the time of grant of financial upgradation under CAS, benefit of pay fixation is not allowed whereas in case of MACP, benefit of pay fixation is allowed an admissible in cases of normal promotion.

4. In view of the above and in terms of para 13 of DOP&T's OM dated 19-5-2009 it is proposed that CAS may be replaced by MACPS for grant of financial upgradation to the Railway School teachers.

Technical Staff(Helpers, Technicians, JEs and SSEs) of all Engineering Disciplines(Civil, Electrical, Mechanical and S&T Deptts.), staff engaged in train operation, sanitation and many staff of Medical Department are prone to Risk and Hardship. Consequent upon change of nomenclature of the posts of Senior Translator and Junior Translator of Central Secretariat Official Language Service (CSOLS) vide Dept. of Official Language, MHA’s Order No. 16/24/2018//O.L. (Service) dated 11.02.2019, The Competent Authority has decided to adopt the same nomenclature in the Ministry of Railways (Railway Board) also as under:

Sub: Grant of Qualification Pay to the Nursing Personnel

Ref.: MoH&FW's F.No.Z.28015/53/2017-N dated 28.09.2018

The Nursing Staff who have been in possession of BSc. Degree were being paid "Qualification Pay" (two additional increments) even after implementation of recommendations of the VII CPC. However, after implementation of VII CPC recommendations, no revision of additional increment, as mentioned-above, being paid to the Nursing Staff, as has been done so far. This is causing heart burning to the said category of staff.

It is understood that, the issue is already being taken-up by the Ministry of Health & Family Welfare(Government of India) for the Nursing Staff working in other than Railway Hospitals.
It is, therefore, requested that, the matter may be looked into on priority for revision of additional increments in consonance with the recommendation of the VII CPC in case of Nursing Staff, working in Railway Hospitals, as "Qualification Pay".

An early action in the matter shall be highly appreciated.

Sub: Brief of the meeting held today with Hon'ble Minister for Railways on the burning issues of the Railwaymen

Today I had detailed discussions on the pending major issues in a meeting with Hon'ble Minister for Railways in the presence of CRB and Member Staff. The meeting was held in a very cordial atmosphere and I noticed quite positive attitude of Hon'ble MR on almost all the major issues. Brief details of the discussions held is as under:-

(i) Revision of rates of Running Allowances and other allowances related to Running Staff - This issue was discussed threadbare and Hon'ble MR had reservations about the proposed rates on the plea that, it will result in further increase in operating ratio. He also said that, according to Finance it comes to Rs.398/-. I explained the matter in detail and also advised him about the formula, on the basis of which it comes out to Rs.648/-. Finally, he agreed to further process the case file to MoF for Rs.525/- and advised the CRB and MS accordingly. It is expected that the case will be sent to MoF shortly.

(ii) Four-grade structure(in the ratio of 10:20:20:50) to Track Maintainers - This issue was also discussed in details and it was explained to Hon'ble MR that; the entire process is financially neutral. He directed the MS to issue orders immediately, because it has been already agreed with the AIRF in previous negotiations.

(iii) Restructuring of IT Cadre - I explained that, all the Cadre Restructuring have always been based on the sanctioned strength of the cadre and not on roll as also entire process of Cadre Restructuring is always with financial neutrality, as such, same principle should be applied in case of Cadre Restructuring of IT Cadre also. I also reminded him that, this issue has been agreed by the FC in his chamber during discussions. Hon'ble MR agreed to it and advised the MS to take action accordingly.

(iv) Promotional prospects of educated staff working in lower grades in GP Rs.1800(Level-1 of VII CPC) - I mentioned that, a large-number of highly educated people are available now in the lowest grade, who are very much curious for their career advancement. I further mentioned that, AIRF has already proposed the Railway Board to divert 10% posts, earmarked for Direct Recruitment, to LDCE open to all, so that, qualified Track Maintainers and staff of all departments and categories, who are having academic qualification, prescribed for Direct Recruitment on these higher grade posts, can be considered for promotion, which will definitely give some relief to such staff. Hon'ble MR was in an agreement with this proposal and asked the CRB and MS to take necessary action in the matter.

(v) Advancement prospects for the staff in erstwhile GP Rs.1800 and GP Rs.4600 - I explained to Hon'ble MR that, in view of poor prospects of advancement, there is serious discontentment amongst the staff working in the said two grade pay. AIRF has, therefore, proposed that, 50% posts in GP Rs.1800, i.e. Level-1 of VII CPC, be upgraded to GP Rs.1900, i.e. Level-2 of VII CPC, with financial neutrality. Hon'ble MR also agreed to this proposal and advised the CRB and MS to take necessary action in the matter.
So far as promotional prospects of the staff in GP Rs.4600 is concerned, it was informed that, Board is working out some solution to convert some posts of GP Rs.4600 to Gazetted Cadre.

(vi) LARSGESS - On the issue of LARSGESS, Hon'ble MR said, that, the Attorney General has very clearly written that, this scheme is unconstitutional, hence will not sustain before the Hon'ble Supreme Court. In the wake of this, we are proceeding to Hon'ble Supreme Court with those cases who have completed all formalities. On the issue of LARSGESS, AIRF is also likely to file a petition in the Hon'ble Supreme Court, and for that we are in consultation with the eminent lawyer.

Apart from the above, I also discussed the issues of Guaranteed Pension to NPS covered employees and improvement in Minimum Wage and Fitment Formula and requested Hon'ble MR to convene a meeting with Hon'ble Prime Minister on these significant issues. He assured that he would take these issues with all seriousness and would try to arrange a meeting with Hon'ble Prime Minister.

Sub:- Reduction in the residency period for promotion from Grade Pay Rs.1800/- (level-1) to Grade Pay Rs.1900/- (Level-2)

In terms of Para 189 (ii) of IREM Vol. I, employees in Level-1, to be eligible for promotion to Level-2, should have put a minimum of 3 years of continuous service except in the case of promotion of Scheduled Caste and Schedule Tribe.

The matter regarding reduction in the residency period for promotion from Level-1 to Level-2 in respect of all departments, has been under consideration of the Board, consequent to a demand to this effect having been raised by both the Federations i.e. AIRF and NFIR.

Keeping in view, the fact that younger and better qualified and talented employees are now available in Level-1 of all the departments, it has been decided that the residency period for promotion from Level-1 to Level-2 in all departments may be reduced from the existing 3 years where ever prescribed, to 2 years. However, in cases where higher incumbency is prescribed, the same shall continue.

SC/ST employees possessing requisite educational qualification can be considered for promotion to the posts of Skilled Artisan against the 25% qualified staff quota on completion of one year regular service.

Para 189 (ii) of IREM, Vol.I 2009, Reprint Edition is accordingly amended as per ACS No. 260 enclosed herewith.

It has been observed that due to vacancies in ticket checking cadre, zonal Railways are facing problems in ensuring manning of reserved coaches, leaving a scope for leakage of revenue of Indian Railway and also causing inconvenience to the passengers.

1.1 Further, it has been observed that more than 65% of reserved tickets are now being booked through internet which has resulted in reduction in requirement of ECRC staff.

2. In order to optimize the human resource available in the Commercial Department, Board (CRB,FC,MS and MT) have decided that, as a temporary measure, wherever possible the ECRC staff may be engaged in stationary ticket checking activities and the stationary ticket checking staff may be entrusted with on board ticket checking activities. Necessary training must be imparted to the ECRC staff before being utilized for ticket checking duties.

Dear Sir,
As I have discussed this issue personally with your goodself and tried to get resolved the issue regarding career progression of the staff working in GP Rs.1800; because in many departments; the employees working in GP Rs.1800 are stagnating in GP Rs.1800 for 15 years and even 20 years, and these are the staff those who are working in GP Rs.1800 are virtually doing the job of skilled nature, in almost all the departments, including Technical and Non-Technical.

It would be in all fairness if 50% posts of GP Rs.1800 should be upgraded to GP Rs.1900, which will resolve the problems of the Railway Industry as well as the employees.

In this connection, it is worth-mentioning that, we have also requested your goodself for reduction in the Direct Recruitment Quota, and the employees having qualification of RRB should be given benefit for their selection against those vacancies through "LDCE open to all" policy, to facilitate the highly educated staff available over the Indian Railways.

Yesterday I met Hon'ble Minister for Railways and shown our anguish against the inordinate delay in resolving the problems of the Railwaymen at an earliest. We have also mentioned about the discussions held with the Railway Board on 4-5 December, 2018 and our decision of "Work To Rule".

He had given positive response and called the Member Staff and Financial Commissioner(Railways), Railway Board, telling them to resolve the problems of the Railwaymen at an earliest, including implementation of four grade structure, in the ratio of 10:20:20:50, in case of Trackmen/Track Maintainers, revision of the rates of Running Allowance and other allowances related to Running Staff, Restructuring of the IT Cadre, etc. etc. The meeting was held in a very cordial atmosphere and Hon’ble MR had appreciated the sentiments of the Railwaymen organized under AIRF.

Pending burning issues of the Railwaymen

The undernoted burning issues have been time and again brought to your kind notice for early redressal thereof because non-redressal of these issue is causing serious deep sense of discontentment among the Railway Staff……

1.Implementation of four grade structure in the ratio of 10:20:20:50 in case of Trackmen/Track Maintainers - As you are very well aware that, the Joint Committee on Package and Career Progression of Trackmen had, unanimously recommended to grant four grade structure to the category of Trackmen/Track Maintainers in the ratio of 10:20:20:50 with a view to facilitate advancement prospects to this ever neglected category of the staff who are directly involved in safe train operation by maintaining railway track. Despite assurance given by the Railway Board, during the course of discussions in Railway Board PNM with AIRF, that, orders would be issued within a couple of days to implement the said four grade structure, final outcome is still awaited, due to which serious resentment is brewing among the Trackmen/Track Maintainers.

2.Revision of the rates of Running Allowance and other allowances related to Running Staff - This issue has also been deliberated at length at several occasions, but unfortunately, Railway Board’s instructions to this effect are yet to be issued. The Running Staff, both Loco & Traffic, are seriously concerned due to inordinate delay in revision of the rates of Running Allowance and other allowances related to Running Staff because on previous occasions the revision used to be done just after implementation of recommendations of the successive Central Pay Commissions.

I would, therefore, seek your personal intervene, so that, revision of the rates of the aforesaid allowances is done without any further delay.

3.Restructuring of the IT Cadre - Information Technology has gained paramount importance in all walks of the life. While IT Cadre was formed in the Indian Railways more than a decade ago, but there is still some confusion in regard to dysfunction and Human Resource Management. Railway Board had issued instructions for Cadre Restructuring of IT Cadre (Ref.No.2016/AC-II(CC)/37/9 dated 18.04.2017(RBA No.45/2017), No.2017/AC-II(CC)/37/7 dated 29.06.2017 and No.2017/AC-II/37/9 dated 29.12.2017), but unfortunately, an impracticable condition was imposed to surrender all the vacant posts in the cadre, whereas, in Cadre Restructuring of other categories, only number of posts of Matching Money Value were surrendered and not the entire vacant posts. We have been regularly pursuing this issue, and the present Financial Commissioner, Railway Board, also assured to take necessary action in the matter, but final outcome is still awaited.

I would, therefore, request that, this issue should also be looked into on priority and revised orders issued early.

I sincerely hope that, the above issues would definitely be given due attention and necessary instructions shall be issued without any further delay, keeping in view the discontentment brewing among these vulnerable categories of the Railwaymen.

The Member Staff, Railway Board, had persistently requested us and also sent us a communication (Railway Board's letter No.2018/E(LR)II/NM 1-9 dated 05.12.2018) in writing that the items raised by AIRF are under very active consideration of the Railway Board, but need some time, therefore, we should withdraw our call of "Work To Rule", scheduled from 11th December, 2018.

After prolonged discussions, between the Railway Board as well as with the Zonal General Secretaries, and in consultation with the President AIRF, it has been decided that, the proposed call of "Work To Rule", scheduled from 11th December, 2018, should be deferred for the time being and we should wait for some time for the outcome of the assurances given by the Railway Board.

I know that, all of you had worked round-the-clock for mobilizing the Railwaymen to prepare them for “Work To Rule”. Now, it has become more important to reach each and every Railwayman for thanking them for creating the tempo as well as we should also inform them about the assurances given by the Railway Board, based on the brief of 4-5 December, 2018, sent to you.

Sub: Brief of the meeting held today with the Member Staff, Railway Board, to discuss the important issues raised by AIRF with the Railway Board

A meeting was held today with the Member Staff, Railway Board, to discuss the vital issues raised by AIRF with the Railway Board, wherein the following deliberations took place:-

Implementation of four grade structure, in the ratio of 10:20:20:50, in the case of Trackmen/ Track Maintainers - Member Staff informed that, four grade structure, in the ratio of 10:20:20:50, is approved by the Full Board, and the file was put-up to Hon'ble MR for his approval. Hon'ble MR wanted certain clarifications from the Engineering Directorate, and the same was submitted by the said Directorate. This will be finalized after arrival of Hon'ble MR who is busy in the state elections.
Revision of the rates of Running Allowance and other Allowances related to Running Staff - After lengthy discussions; the Member Staff informed that, the file is put-up to Hon'ble MR for his approval, and after his approval, the file would be sent to the MoF. The Member Staff further informed that, the matter is vigorously pursued by him with the MoF.

Continuance of the LARSGESS - The Official Side informed that, after consultation with the Solicitor General, original scheme would be implemented after submitting it to the court. The court has given time for submitting the final result.

Advancement of prospects of the staff working in erstwhile GP Rs.1800 and GP Rs.4600 - After prolonged discussion, the Member Staff agreed that, there is stagnation of the staff working in erstwhile GP Rs.1800. Federation (AIRF) pointed out that, due to various surrenders in Grade III Technicians as well as other cadres, the present incumbents working in erstwhile GP Rs.1800 are not getting promotions. Due to direct recruitment in GP Rs.4600, people are not having any promotional prospects as there are no grades in GP Rs.4800 and GP Rs.5400. Federation(AIRF) wanted that, as was done on previous occasion, 50% of Direct Recruitment vacancies should be thrown open for promotion for the staff working in erstwhile GP Rs.1800, and also GP Rs.4800 and GP Rs.5400 SSEs and Sr. Supervisors should be made Gazetted.

Non-revision of rates of Incentive Bonus/Bonus Factor and PCO Allowance paid to Technical Staff and Supervisors of the PUs and Maintenance Workshops - The Committee appointed by the Railway Board is expected to submit its report within a month's time, and then only; the item will be finalized.
Upgradation of the Apex level of Group 'C' to Group 'B' - AIRF insisted that, powers are vested with the Railway Board to grant upgradation for the apex grade Supervisors to Group 'B'. This was also confirmed by the Finance Secretary(Exp.) on the previous occasion, and the minutes of the said meeting given to the Railway Board. In spite of that, the matter is dragged by the Railway Board by sending proposal to the MoF. The Federation(AIRF) insisted that, decision should be taken at the Railway Board level itself. Member Staff directed the AM(S) to put-up all the particulars, including minutes of the Cabinet Secretary, for taking a decision. The Federation(AIRF) insisted that, as per the Act and Codal Provisions as well as Business Rules, the powers are vested in the Railway Ministry and they should not run to the DoP&T and MoF.

Regularization of the Act Apprentices in Railways - AIRF demanded that, all the Act Apprentices imparted training in the Railways should be absorbed in the Railways. It was explained to the Member Staff that the orders were available previously, but unfortunately, Board have issued orders and implemented the orders with back date, depriving the Act Apprentices from the absorption in the Railways. The Federation demanded that, new Apprentices Act, passed by the Parliament, has given full powers to decide procedure for absorption of these Act Apprentices. Federation demanded that, Screening Type system should be adopted for absorption of the Act Apprentices. Member Staff agreed to study the problem after finalization of the present RRC examination.

It is worth-mentioning here that, there will also be another round of discussions with the Member Staff, Railway Board, tomorrow, i.e. on 5th December, 2018, and the outcome of the said meeting shall also be communicated to all of you.

Sub: Meeting of AIRF to discuss promotional prospects of staff, particularly in GP Rs.1800 and Rs.4600

Meeting on the subject cited above was held in the chamber of DG(Personal), Railway Board, today.

After detailed deliberations; the following decisions were arrived:-

(a) There will not be any recruitment in GP Rs.4600 in any category except Medical Department.

(b) The condition of direct recruitment to at least 25% or more in respective categories for holding GDCE will be done away.

(c) Board orders permitting GMs to hold GDCEs up to 50% of DR Quota will be further enhanced up to 75%, keeping in view the serious frustrations in serving employees having higher academic/technical qualifications so as to enhance their promotional prospects on similar parameters of Direct Recruitment in higher categories.

(d) On the issue of career progression of the SSEs, though AIRF insisted for timebound promotion for JEs and SSEs, the administration agreed to pursue the matter, providing 75% upgradation of staff in GP Rs.4600 to Rs. 4800.

Sub: Appointment on compassionate grounds - Relaxation in upper age limit regarding.

Attention is invited to para IX (Authority competent to make appointments on compassionate grounds) and para VI(a) (Qualification and conditions to be fulfilled) Board’s letter dated 12.12.1990 which lays down that normally the persons seeking appointment on compassionate grounds should fulfil the conditions of eligibility regarding age and educational qualifications prescribed for appointment to the posts or grade concerned. However, the upper age limit may be freely relaxed on merits of the cases.

The lower age limit of 18 years normally required for appointment in Government may also be relaxed upto one year with the personal approval of the General Manager. Relaxation of the lower age limit beyond one year will require the approval of the Ministry of Railways. In making appointments on compassionate grounds, Divisional Railway Managers may relax age limit in the case of appointment to Group 'D' posts.

The issue of delegation of power to DRM/CWM regarding relaxation of upper age limit in making compassionate grounds appointment was under consideration in this office. It has now been decided by the Board that wherever DRM/CWM is competent to make the appointment on compassionate grounds, they may grant relaxation in upper age limit also.

Sub: Wrong Analysis and recommendations about NDA under 7th CPC report

Board's attention is invited towards this federation's letter of even number dated 2nd April, 2018 (copy enclosed), vide which it was pointed out that, on implementation of new formula, recommended by the VII CPC, rates of Night Duty Allowance get reduced rather than any improvement therein.

A calculation table was also appended in our letter referred to above, explaining the actual reduction in Night Duty Allowance on implementation of current formula, recommended by the VII CPC, which we are again quoting hereunder for ready reference:-

Rates of Night Duty Allowance, as per 6th CPC formula (mean value of Pay Band + GP) + DA)/215, changed by the 7th CPC, i.e. (Basic Pay + DA)/200, will decline by 20% to 40% from the existing, i.e.

Also rates of the NDA were not declared by the Railway Board on 01.07.2016 and 01.01.2017 as per 6th CPC.

It is, therefore, reiterated that, the issue may be looked into afresh in the light of the foregoing, and improvement in the formula, recommended by the VII CPC, may be done, so that, rates of Night Duty Allowance get improved rather than any reduction therein.

This may kindly be treated as "Most Urgent" as there is serious discontentment brewing among the staff, particularly Running and Traffic Staff and other Safety Categories Staff who have to invariably perform night duty.
