Sub: Calculation of monthly contribution towards cost of Pension payable during foreign service - Reg.

The undersigned is directed to invite reference to this Department’s OM No. 2/34/2008-Estt (Pay-II) dated 19th November, 2009 on the above subject and to say that according to this OM w.e.f. 01.01.2006, the pension contribution payable in respect of a Government employee during the active period of his foreign service shall be based on the existing basic pay (Pay in the Pay Band plus Grade Pay) of the post held by the Government servant at the time of proceeding on foreign service, and in case he receives Proforma promotion/ financial up-gradation while on foreign service, on the basic pay (Pay in the Pay Band plus Grade Pay) fixed on such promotion/ financial up-gradation.

2. Consequent upon implementation of the recommendations of the 7th CPC, the matter of issuing revised instructions on the above subject has been engaging the attention of the Government of India. The President is now pleased to decide that pension contribution payable in respect of a Government servant during the active period of his foreign service shall be based on the basic pay in the level (in Pay Matrix) of the post held by him/ her at the time of proceeding on foreign service; and in case of grant of Proforma promotion/financial up-gradation while on foreign service, the same shall be based on basic pay in the Level (in Pay Matrix) fixed on such Proforma promotion / financial up-gradation.

3. In respect of Government employees covered by the NPS, during the active period of foreign service w.e.f. 01.01.2016, it has been decided to fix the monthly Pension contribution @ 24% of basic pay in the level (in Pay Matrix) of the post held by him/her at the time of proceeding on foreign service plus DA admissible on such basic pay (i.e. employee’s contribution @ 10%, employer’s contribution @ 10% and contribution by employer for gratuity @ 4%). However, consequent to revision of Government’s contribution for NPS from 10 % to 14% w.e.f. 01.04.20 19 vide Department of Financial Services Notification dated 31.01.2019, the monthly Pension contribution for Government employees covered by the NPS w.e.f. 01.04.2019 will be 28% of basic pay in the level (in Pay Matrix) plus DA of the post held by him/her, which will include employee’s contribution @ 10%, employer’s contribution @ 14%, and contribution by employer for gratuity @ 4%. In case of grant of Proforma promotion/ financial up-gradation while on foreign service, the same shall be based on basic pay in the Level (in Pay Matrix) fixed on such Proforma promotion /financial up-gradation.

4. In respect of the employees covered under the Old Defined Benefit Pension Scheme, it has been decided to fix their rates of monthly contribution of pension during the active period of foreign service as 14% of basic pay in the level (in Pay Matrix) of the post held by him/her at the time of proceeding on foreign service plus DA admissible on such basic pay during foreign service w.e.f. 01.01.2016. The monthly contribution of pension during the active period of foreign service w.e.f. 01.04.2019 will be 18% of the basic pay in Pay Matrix of the post held by the officer at the time of proceeding on foreign service plus DA admissible on such basic pay.

In case of grant of Proforma promotion/ financial up-gradation while on foreign service, the same shall be based on basic pay in the Level (in Pay Matrix) fixed on such Proforma promotion/ financial up-gradation.

5. It has also been decided that these pension contributions would be in addition to the leave salary contributions for the period of foreign service, in respect of both NPS employees and the employees under Old Defined Benefit Pension Scheme.

6. In case of employees covered under NPS, during the period of active foreign service, the borrowing organisation shall make its part of contribution mandatorily to the NPS Account of the employee.

7. This OM will be effective from 01.01.2016. In respect of persons who are already on foreign service as on 01.01.2016, the pension contribution will be calculated at the above rates on the revised pay as per 7th CPC from the date which they opt to come over to the revised pay structure after implementation of 7th CPC recommendations, in their parent cadres. For the earlier period, the pension contributions will be as per extant orders i.e. the order in force during period prior to 01.01.20 16 from time to time.

8. The modalities! mechanism of payment of pension contribution during the active period of foreign service in respect of NPS subscribers will be issued separately.

9. In their application to the persons belonging to Indian Audit and Accounts Department, these orders are issued under Article 148(5) of the Constitution and after consultation with the Comptroller & Auditor General of India.

Ref: (i) Railway Board’s reply to GS/ NFIR vide letter No.PC-VII/2018/R-U/8 dated IR’s letter No.II/1/2019 dated 30th March, 2019 and 18th April, 2019 to the Railway Board.
(iii) NFIR’s PNM agenda item No.25 (sent to Railway Board on 29th May, 2019).

Dear Sir,

Kind attention is invited to the references cited above, on the above subject relating to allotment of qualification based pay matrix to the ECG Technicians in railways. Federation once again furnishes below, the important facts relating to the demand for granting higher entry grade pay to the ECG Technician category with appropriate cadre structure for their growth.
  • The ECG Technicians appointed in Dr. Ram Manohar Lohia Hospital, New Delhi (under Ministry of Health and Family Welfare) have never been in possession of the standard qualification relating to the job expected from an ECG Technician, while in Railways, the ECG Technicians possess “Diploma in ECG Lab Technology”.
  • ECG Technicians in Railways have never been treated atleast equal to those working in the Central Government Hospitals and have rather been treated inferior. This negative situation has been prevailing since the period of 3rd CPC.
  • The DR qualification prescribed for the post of Sr. ECG Technician pay scale Rs.1400-2600 (IV CPC)/5000-8000) V CPC)/ PB-2 GP 4200 (VI CPC)/ Pay Level-6 in 7th CPC in Dr. Ram Manohar Lohia Hospital is Bachelor’s Degree in Science with Physics with one year experience in handling cardiological equipment or 3 years Diploma Course in Electronics/ Electrical communication Engineering. Whereas in Railways, though the qualification for the post of ECG Technician got revised during 6th CPC regime to Degree in Science plus Diploma in ECG Lab Technology/ Cardiology/ Cardiology Technician/ Cardiology Techniques of reputed institution [refer Railway Board’s letter No. E(NG)II/2001/RR/45 Pt. A dated 29/09/2015], this category has not been treated at par with those ECG Technicians of Dr. Ram Manohar Lohia Hospital.
NFIR therefore requests the Railway Board to take action for revising the pay structure of ECG Technicians of railways for the purpose of providing entry grade pay 4200/Level 6 of pay matrix with further avenue of promotion to pay level 7, similar to the pay structure of ECG Technicians of Dr Ram Manohar Lohia Hospital, New Delhi.

Second National Judicial Pay Commission submits its Report

The Second National Judicial Pay Commission has filed the main part of the Report in 4 volumes covering the subject of Pay, Pension and Allowances, in the Registry of the Supreme Court on 29.01.2020. The Commission has been constituted pursuant to the Order of the Supreme Court in All India Judges Association case and the Government of India, Ministry of Law & Justice issued a Notification dated 16.11.2017 in this regard. Shri Justice P.V. Reddi, former Judge of the Supreme Court is the Chairman, Shri Justice R. Basant, former Judge of Kerala High Court is the Member and Shri Vinay Kumar Gupta, District Judge of Delhi Higher Judicial Service is the Member-Secretary of the Commission.

The Interim Report was submitted by the Commission in 2018.

The salient recommendations are:

PAY: The Commission having considered various alternative methodologies has recommended the adoption of Pay Matrix which has been drawn up by applying the multiplier of 2.81 to the existing pay, commensurate with the percentage of increase of pay of High Court Judges. @ 3% cumulative has been applied.

As per the revised pay structure evolved by the Commission, the Junior Civil Judge / First Class Magistrate whose staring pay is Rs.27,700/- will now get Rs.77,840/-. The next higher post of Senior Civil Judge starts with the pay of Rs.1,11,000/- and that of the District Judge Rs.1,44,840/-. The highest pay which a District Judge (STS) will get, is Rs.2,24,100/-.

The percentage of Selection Grade and Super Time Scale District Judges proposed to be increased by 10% and 5% respectively.

The revised pay and pension will be effective from 01.01.2016. Arrears will be paid during the Calendar year 2020 after adjusting the interim relief.

PENSION: Pension at 50% of last drawn pay worked out on the basis of proposed revised pay scales is recommended w. e. f. 1-1-2016. The family pension will be 30% of the last drawn pay. Additional quantum of pension will commence on completing the age of 75 years (instead of 80 years) and percentages at various stages thereafter are increased. The existing ceiling of retirement gratuity and death gratuity will be increased by 25% when the DA reaches 50%.

Nodal officers will be nominated by the District Judges to assist the pensioners / family pensioners.
Recommendation has been made to discontinue the New Pension Scheme (NPS) which is being applied to those entering service during or after 2004. The old pension system, which is more beneficial, will be revived.

ALLOWANCES: The existing allowances have been suitably increased and certain new features have been added. However, the CCA is proposed to be discontinued.

Recommendations are made to improve the medical facilities and to simplify the reimbursement procedure. Medical facilities will be granted to pensioners and family pensioners also.

Certain new allowances viz. children education allowance, home orderly allowances, transport allowance in lieu of pool car facility, have been proposed. HRA proposed to be increased uniformly in all States. Steps to ensure proper maintenance of official quarters recommended.

The recommendations made by the Commission are applicable to the Judicial officers throughout the country.

Supreme Court will have to issue directions regarding the implementation of recommendations after hearing the stakeholders.

Subject: Grant of Dearness Allowance to Central Government employees- Revised Rates effective from 1.7.2019.

The undersigned is directed to refer to this Ministry's Office Memorandum No, 1.11/2019-E II (B) dated 27th February, 2019 on the subject mentioned above and to say that the President is pleased to decide that the Dearness Allowance payable to Central Government employees shall be enhanced from the existing rate of 12% to 17% of the basic pay with effect from 1st July, 2019.

2. The term 'basic pay' in the revised pay structure means the pay drawn in the prescribed Level in the Pay Matrix as per 7th CPC recommendations accepted by the Government, but does not include any other type of pay like special pay, etc.

3. The Dearness Allowance will continue to be a distinct element of remuneration and will not be treated as pay within the ambit of FR 9(21).

4. The payment on account of Dearness Allowance involving fractions of 50 paise and above may be rounded to the next higher rupee and the fractions of less than 50 paise may be ignored.

5. These orders shall also apply to the civilian employees paid from the Defence Services Estimates and the expenditure will be chargeable to the relevant head of the Defence Services Estimates. In respect of Armed Forces personnel and Railway employees, separate orders will be issued by the Ministry of Defence and Ministry of ( Railways, respectively.

6. In so far as the employees working in the Indian Audit and Accounts Department are concerned, these orders are issued with the concurrence of the Comptroller and Auditor General of India.

Sub: Reckoning Grade Pay Rs.4200/- Level 6 of 7th CPC Pay Matrix as entry Grade Pay for granting financial upgradation under MACPS to the Station Master category in Railways - reg.

Federation feels disappointed that despite the above subject was listed in the PNM Agenda two years ago, there has been no decision from Railway Board till date.

Vide NFIR's letter of even no. dated 09/04/2019, merits of the case have been adequately explained besides extract of Item No. 31 of Railway Board's letter PC-V/99/1/1/1 dated 19/02/2002 has also been furnished. In terms of item No. 31 of Board's letter dated 19/02/2002, the Station Masters are entitled for 3rd financial upgradation under MACPS in GP 5400/ Level-9 (7th CPC). In this connection, Railway Board's letter No. PC- V/2019/ CC/7/WCR dated 05/04/2019 addressed to General Manager (P), W.C. Railway, Jabalpur allowing 3rd financial upgradation in terms of Board's letter dated 19th February,2002 (para 1.4) may be connected. It is however unfortunate that although the case of Station Master category gets covered by Railway Board's letter dated 19th February, 2002 for the purpose of entitlement of 3rd financial upgradation (GP 5400/Level-9) under MACPS, the Railway Board have not responded to Federation's PNM Item No. 15/2017 even after lapse of two years.

Attention is also invited to 7th CPC recommendation contained in para 11.40.55 of the report, relevant extract of which is placed below:-

"Keeping in mind the identical educational qualifications required for the posts of ASM and SM, with practically no difference in the functions performed by .them, and the historical importance of the post, it is recommended that the ASMs in GP 2800 should first be upgraded to GP 4200 and then fitted in the revised Pay Matrix. The cadre will then have 60 percent posts in Level 60 and 40 percent in Level 7. The designation of ASM may be abolished".

Federation once again urges upon the Railway Board to expedite action and decision, granting 3rd financial upgradation under MACPS to Station Master category in GP 5400/ Level-9.

Directorate General of Civil Aviation (DGCA) intends to fill up the 01 Post of Accounts Officer (General Central Service Group 'A', Gazetted, Non-Ministerial) in Level - 10, Rs, 56,100- 1,77,500/- of the pay matrix on Deputation (including short-term contract) basis. 

(i) Eligibility:

(a) (i) holding analogous posts on regular basis in the parent cadre or department; or
(ii) with two year's regular service in the grade rendered after appointment there to on a regular basis in Level-8 (Rs. 47600-151100) in the Pay Matrix or equivalent or
(iii) with three year's service in the grade rendered after appointment thereto on a regular basis in Level-7 (Rs. 44900-142,00) in the Pay Matrix or equivalent; or
(iv) with eight years of service in the grade rendered after appointment thereto on a regular basis in Level-6 (Rs. 35400-112400) in the Pay Matrix or equivalent; and

(b) Qualified in Subordinate Accounts Service or equivalent of any of the organized Accounts Service; or

Successful completion of training in the Cash and Accounts Work in the institute of Secretariat Training and Management or equivalent and a minimum of five years experience in Cash, Accounts and Budget Work.

(ii) Age:
The officers should not have crossed the age of 56 years as on the closing date of receipt of applications.

(iii) Scale:- Level - 10, Rs.56,100 - 1,77,500/- of the pay matrix as per the recommendations of 7th CPC.

2. Period of deputation (including short term contract) including period of deputation (including short term contract) in another ex-cadre post held immediately preceding this appointment in the same or some other organization or Department of the Central Government shall not exceed Three years.

3. The terms & conditions and Pay & allowances of the officers selected for appointment on deputation basis will be governed as per the provisions contained in Government of India, DoP&T's OM No. 6/08/2009 0 Estt. (Pay,II) dated 17.06.2010, as amended from time to time.

4. While forwarding the applications in the prescribed format (Annexure) in respect of eligible officers who are interested and can be spared in the event of their selection, the following documents may also be sent alongwith the application:-
(i) Application in the prescribed pro-forma (Annexure)
(ii) Copies of upto-date and complete Annual Performance Appraisal Report / Annual Confidential Report (APAR/ ACR Dossiers) of the last five years, which should be certified by the officer not below the rank of Under Secretary.
(iii) Integrity Certificate
(iv) Vigilance Clearance including certification that no Disciplinary Proceedings / Criminal Proceedings are either pending or contemplated against the applicant.
(v) List of minor/major penalty, if any, imposed on the applicant during last 10 years.
5. Complete application with the above documents, duly signed by the authorized officer, should be forwarded through proper channel to the undersigned within 60 days from the date of advertisement in Employment News.

ORDER

The Ministry of HRD vide its letter No. F.3-14/2017-UT.2 dated 26.07.2017 had conveyed the approval for:the adoption of the revised pay scales as per 7th CPC for the employees of Kendriya Vidyalaya Sangathan. The pay scales for the post of Assistant Editor (mentioned at S.No. 14) in which the Pay Matrix Level has been shown as Level-6 in place of the correct replacement scale of pay i.e. Pay Matrix Level-7. The matter was taken up with Ministry of HRD.


 Now, the Ministry of HRD after taking concurrence of the D/o Expenditure, Ministry of Finance [(U.O No. 21 (4}/E.III.B/2018 dated 19.6.2019], has conveyed the ex-post facto approval of the Govt. of India to revise the pay scale to the post of Assistant Editor in the PB-2 with Grade Pay of Rs. 4600/- w.e.f. 1.1.2006 and subsequently Pay Matrix Level - 7 w.ef. 1.1.2016 corresponding to the replacement of G.P of Rs. 4600/-. Accordingly the same is adopted by Kendriya Vidyalaya Sangathan.

The central government is mulling not to form any Pay Commission for increasing salaries and allowances of central government employees and and pensioners in future.

No new commission may be formed in future for increasing salaries of central government employees, a reliable source from Finance Ministry on condition of anonymity.

“The government is going to take a policy decision in this regard,” the source told our reporters.

Presenting an idea about the alternative arrangement, he said that the 7th Pay Commission recommended that the pay matrix may be reviewed periodically without waiting for the long period of ten years. It can be reviewed and revised on the basis of the Aykroyd formula which takes into consideration the changes prices of the commodities that constitute a common man’s basket, which the Labour Bureau at Shimla reviews periodically.

The Pay Commission also suggested that this should be made the basis for revision of that pay matrix periodically without waiting for another Pay Commission.

So, it will not be necessary to form a new pay Commission after every 10 years for central government employees and pensioners and whether any change is required regarding pay and allowances would be made considering inflation.

Food and Agriculture Organisation (FAO)’s first director and Nutritionist Wallace Rudel Aykroyd has formulated his recommendations on the basis of requirements of foods and clothes for a person. He took into consideration the factor related to price changes in commodities affecting the living of common man.

Subject: Revision of pension of pre 2016 pensioners after implementation of seventh Central pay Commissions recommendations-anomaly in determining notional pay.

Sir,
I am directed to refer to various communications from State Governments on the above subject and to state that the matter raised in various representations of the pensioners seeking revision of their pension after implementation of 7th CPC recommendations, has been examined in this Department in consultation with Department of Pensions and Pensioner’s Welfare.

The basis for the re-fixation of the pension of pre-2016 pensioners are DoPT OM No.14021/4/2016-AIS-1I dated 19th May, 2017 (mutatis-mutandis based on DoP&PW OM dated 38/37/2018-P&PW(A) dated 12th May,2017) and the Concordance Tables issued by DoP&PW vide OM dated 38/37/2018-P&PW(A) dated 6th July,2017.

Prior to re-fixation of the pension of pre-2016 pensioners / family pensioners etc., following instructions/ pension may be followed:-

   " (a) Para 4 of the OM dated 12th May, 2017 provides inter alia that the “revised pension / family pension w.e.f 01.01.2016 in respect of all Central Civil pensioners retired prior to 01.01.2016, may be revised by notionally fixing their pay in pay matrix recommended by the 7th CPC in the level corresponding to the pay in the pay scale/pay band and grade pay at which they retired. This will be done by notional pay fixation under each intervening Pay Commission based on the Formula for revision of pay. While fixing pay on notional basis, the pay fixation formulas approved by the Government and other relevant instructions on the subject in force at the relevant time shall be strictly followed. Further, para 7 of the OM provides inter alia that in case of those Government servants who retired or died on or after 01.01.1986 but before 1.1.2016, the actual pay and the pay scale from which they retired or died would be taken into consideration for the purpose of calculation of the notional pay as on 01.01.2016 in accordance with para 4 above.

    (b) Accordingly, the pay of pre-2016 pensioners was notionally fixed in relevant cell of pay matrix of 7th CPC as per the formula of pay fixation approved by the Government. The pay of the serving IAS officers (including of Selection Grade officers) is also fixed in relevant cell of Pay Matrix of 7th CPC as per the formula of pay revision from 6th CPC to 7th CPC as approved by the Government. Also, the pay of serving officers who had been promoted on 1.1.2016 in JAG or Selection Grade is first fixed in the relevant cell of Pay Matrix of 7th CPC as per the formula of pay revision approved by the Government. Thereafter, they had to be promoted in next scale and their pay fixed in that level as per IAS Pay Rules 2016, granting them two increment in the promotion level.


    (c) The pay of only those officers who were promoted on or after 1.1.2016 is to be fixed in 3rd cell of level-13. The pay of the officers who were already in selection grade i.e. level-13 as on 1.1.2016 is fixed as per the formula of pay revision from 6th to 7th Central Pay Commission (CPC). The notional pay of the officers who had retired before 01.01.2016 has to be similarly fixed. Therefore, the contention of any pensioner that his/her notional pay cannot be in any case less than the lowest level at which the pay of a serving officer of the Selection Grade of IAS can be fixed, is not tenable. Their pay is to be notionally arrived at by the formula of pay revision from 6th CPC to 7th CPC at par with other serving IAS officers."


Pension of pre-2016 pensioners/ family pensioner may be revised w.e.f 1.1.2016 in accordance with the instructions contained in D/o P&PW OM dated 12.5.2017.

Accordingly, the representations of pre-2016 pensioners may be examined by the State Government and the concerned pensioner(s) may be informed.

This issues is with the approval of the competent authority.

Sub: Engagement of a consultant in the Department of Pension & Pensioners Welfare
The Department of Pension & Pensioners' Welfare intends to engage a consultant to assist the Department for undertaking comprehensive review/revision of CCS (Pension) Rules and orders issued by the Government on the subject of pensionary benefits and other important issues requiring immediate attention. The revision and review of the rules etc. is being undertaken by the Department in compliance with recommendation of the Hon'ble Supreme Court in the matter of UoI Vs. R. Sethumadhavan and Other. In addition, the Department may also assign the consultant any other work related to this Department.

Accordingly, applications are invited from retired Central Government Employees having been retired from the post of Deputy Secretary/ Director or equivalent i.e., to say from any-post carrying the following Pay Band / Pay Matrix:

i. Rs.15600 - 39100 + 7600 Grade Pay;. or
ii. Rs.37400 - 67000 + 8700 Grade Pay; or
iii. Pay Matrix 12 or 13 under 7th CPC


MANDATORY SERVICE EXPERIENCE
The applicant should have a minimum of 3 years experience in dealing with
pension cases and pension related court cases of Central Government Employees.

Age
Age should not be more than 65 years on the date of advertisement.

REMUNERATION
On selection, the consultant will be paid consolidated remuneration equivalent to his last pay drawn minus pension. He will also be paid Dearness Allowance on the 'remuneration amount' at the rates applicable for Central Government Employees on the date of engagement. No other allowance such as HRA / Transport Allowance etc. will be payable to the consultant.
The consultant may be required to undertake outstation visits also for which he will be paid Travelling Allowance/ hotel/ guest-house reimbursement as per rules applicable to equivalent scales.

DURATION OF ENGAGEMENT
The duration of engagement will be one year from the date of initial engagement which period may be curtailed or extended at the sole discretion of the Department and the same will be binding on the consultant.

The appointment of consultants would be on full-time basis and he will not be permitted to take up any other assignrnent during the period of Consultancy with the DoP&PW.

The appointment of consultant is of a temporary (non - official) nature and the appointment can be cancelled at any time by the Department without assigning any reason.

Retired central government officers desirous of consideration for the above assignment may submit their application in the prescribed proforma (Annexure-I), to Shri AshokKumar Singh, Under Secretary (Admn.I), Department of Pension & Pensioners Welfare, 3rd Floor, Lok Nayak Bhawan, Khan Market, New Delhi - 110 003 latest by 7th June, 2019 either in person or through post.

Sir,
I am directed to refer to your letter No.SG/AIAIASP/03/2018 on the above mentioned subject and to inform that the issue of granting NFSG in pre­ revised GP Rs. 5400/- in PB-2 corresponding to Level 9 to Asstt. Superintendent Posts on completion of four years of service in the pre-revised GP Rs. 4800/- (Level 8 in Pay Matrix) has been examined with following observations:-

i. The NFSG Scale is given to AAOs in P&T Accounts vide MoF OM No. 25-2/2017- IC/E.III (A) dated 18.06.2018 as per recommendations of 7th CPC in Para 11.12.140 of the report whereas there is no such recommendation for ASP cadre. Moreover, AAOs in P&T Accounts are having all India Transfer Liability and on contrast, the ASP is a Circle level cadre. Further, ASPs are enjoying Rule 38 transfer from one Circle to other whereas there is no such provision for AAOs. As such, the plea for granting NSFG to ASP cadre in line of AAO cadre as mentioned in the representation is not tenable.

ii. There is different time span in promoting IPs to ASPs in Circles as ASP is a Circle level cadre. In some Circles IPs get promotion in ASPs cadre immediately after completion of minimum qualifying years of service in IP cadre viz 3 years (now 5 years) whereas in some Circles IPs are waiting their hierarchical promotion in ASP cadre even after regular service of 10-13 years in the cadre. The NSFG Scale would not only make a huge disparity in pay among ASPs who are originally entered in IP cadre on the basis of same examination and are borne on the same IP gradation list.

Therefore, the proposal to grant NSFG to Asstt. Superintendent Posts on completion of four years of service cannot be recommended.

Kind attention is invited to the comments of Railway Board vide Annexure OA of Board's reply dated 14/03/2019, not agreeing for providing cadre structure for ECG Technicians with apex Grade Pay 4200/pay Level-6, on the ground that no specific recommendations have been made by the Pay
commission in favour of ECG Technicians of Railways, the parity between various categories of para- medical staff working in Railway Hospitals/Health Units cannot be made with para-medical or para- medical staff of specified Central Government Hospitals due to functional requirements. These views of the Railway Ministry have been disputed by the Federation earlier, due to being incorrect & unjust and urged upon the Railway Board to take judicious decision to render justice to the ECG Technicians working in Railway Hospitals/Health Units. In this context, Federation's letter dated 26/09/2016 and 30th July, 2018 may kindly be referred to.

Railway Board may also appreciate that the Railway Hospitals mainly Zonal and Divisional Hospitals have been functioning on at Zones and the Divisions. These Railway Hospitals have been providing Cardiac and other important treatments to ailing Railway employees and their family members as indoor patients located in all big cities in the Zones/Divisions. Besides this, job contents of the ECG Technicians and their role/service conditions in these Railway Hospitals is in no way less than the Medical Institutions of National Eminence. It is also relevant to appreciate that most of these Railway Hospitals are having 100 plus bed strength giving all types of treatment to the patients, therefore, the ECG Technicians working in Railway Hospitals cannot be rated inferior to those ECG Technicians working in other National Medical Institutions but rather deserve to be considered atleast on par if not more so far as their pay structure is concerned. In this connection, Railway Board may kindly consider Federation's proposal dated 26/09/2016 & 30/07/2018 (copies enclosed) and take the issue to the nodal Ministry i.e. Ministry of Health and Family welfare with justification for allotment of Pay Level-6 at apex level to the ECG Technician category already placed in the NFIR PNM Agenda Item No. 60/2012.

Another fact which cannot be ignored is that at present the Central Hospitals working on each Zonal Railway have been functioning as Educational Institutions also as the Graduate/Post Graduate Doctors are undergoing DNB, internship etc., and other types of courses before they being awarded Degree. These Railway Hospitals cannot be under-rated in so far as their work culture and responsibilities shouldered by staff are concerned. While several cadres in Railways where entry Grade Pay is 1800/- and 1900/- with direct recruitment qualification being lower than "Graduation" are provided cadre structure upto GP 4200 and in some cases GP 4600, in the case of ECG Technicians where entry qualification is "Graduation in Science plus Diploma/experience" apex Grade Pay 4200/- has not been provided in the existing cadre structure. This is unique case of injustice meted out to the category despite V CPC had given general recommendation for allotment of "qualification based pay scale". The case of ECG Technicians therefore stands on merit for providing improved cadre structure with atleast GP 4200/ Level-6 at apex level of the cadre.

NFIR, therefore, once again requests the Railway Board to kindly review and make out a proposal for obtaining the approval of Ministry of Health & Family Welfare and MoF as suggested above.

G.S.R…- In exercise of the powers conferred by the proviso to article 309 of the Constitution, the President hereby makes the following rules regulating the method of recruitment to the posts of Assistant Director in the Ministry of Personnel, Public Grievances and Pensions, Department of Personnel and Training, Lal Bahadur Shastri National Academy of Administration, Mussoorie, namely: -
  1. Short title and commencement - (1) These rules may be called the Ministry of Personnel, Public Grievances and Pensions, Department of Personnel and Training, Lal Bahadur Shastri National Academy of Administration, Mussoorie, Assistant Director, Group 'A' Posts, Recruitment Rules, 2019.
    (2) They shall come into force on the date of their publication in the Official Gazette.
  2. Number of posts, classification and level in pay matrix- The number of the said posts, its classification and the level in the pay matrix attached thereto, shall be as specified in columns (2) to (4) of the Schedule annexed to these rules.
  3. Method of recruitment, age limit, qualifications, etc. - The method of recruitment, age limit, qualifications and other matters relating to the said posts shall be as specified in columns (5) to (13) of the said Schedule.
  4. Disqualifications - No person,-
    (a) who has entered into or contracted a marriage with a person having a spouse living; or
    (b) who having a spouse living, has entered into or contracted a marriage with any person,
shall be eligible for appointment to the said post:
Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of this rule.
  1. Power to relax - Where the Central Government is of the opinion that it is necessary or expedient so to do, it may, by order, for reasons to be recorded in writing and in consultation with the Union Public Service Commission, relax any of the provisions of these rules with respect to any class or category of persons.
  2. Saving - Nothing in these rules shall affect reservation, relaxation of age limit and other concessions required to be provided for the Scheduled Castes, the Scheduled Tribes, exServicemen and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard.

Application of only such officers will be considered as are routed through proper channel and are accompanied with (i) bio-data in the proforma at AnnexureII; (ii) clear photocopies of the up-to-date APAR dossier of the officer containing APARs of at least last five years, duly attested by a Group 'A' officer (if original APAR could not be sent); (iii) An attested Statement indicating the grading in the APAR during the last five years (iv) cadre clearance; (v) clearance from vigilance and disciplinary angle; and (vi) statement giving details of major or minor penalties, if any, imposed on the officer during the last ten years.
  2. All Ministries/Departments and the State Governments/UTs are requested to forward the applications of willing and eligible officers in the prescribed proforma to :- Section Officer (Estt-B-l), Ministry of Personnel, Public Grievances and Pensions (Department of Personnel and Training), Room No. 215-C, North Block, New Delhi-110001, so as to reach this Office, on or before IS /04/2019.
  3. The applications of only those officers may be forwarded who, in the event of their selection, would immediately join the duties of the post, and whom the concerned authorities would be in a position to relieve immediately. The application once forwarded would not be allowed to be withdrawn. Applications received after the prescribed date or not accompanied with the required certificates/documents will not be entertained.

Eligibility Criterion for the post of Chairman, Staff Selection Commission, New Delhi.

1.Name of Post: Chairman, Staff Selection Commission, New Delhi.
2. Scale of pay: Level 15 of the pay matrix Rs. 1,82,200-2,24,100/-.
3. Eligibility: Officers of the Central Government (including officers of the All

India Services and Central Group 'A' Services) :-

(a) (i) Holding analogous post on regular basis in the parent Cadre or Department;
or
(ii) with three years' service in the grade rendered after appointment thereto on a regular basis in the Level 14 in the pay-matrix (Rs.1,44,200-2,18,200) or equivalent in the parent cadre or Department; and

(b) Possessing the following educational qualifications and experience, namely:-
(i) Post Graduate Degree in any discipline from a recognized University or Institution; and
(ii) fifteen years' experience in dealing with Service, Administrative, Vigilance, Establishment and Financial matters.

4. Period of Deputation: The person appointed as Chairman of Staff Selection Commission shall hold office for a period of five years or till he/she attains the age of 65 years, whichever is earlier, provided that in case a serving officer appointed as Chairman, Staff Selection Commission retires on superannuation before completing the tenure of five years, he may be considered for appointment on re-employment terms for the remaining period of tenure subject to the upper age limit for 65 years.

5. Age Limit:- The maximum age limit for appointment by deputation shall not be exceeding 59 years on 15/04/2019.

Attention is invited to instructions under reference prescribing, inter-alia, minimum educational qualification for open market recruitment to the post of Technician Grade-III in Level -2 of Pay Matrix of 7th CPC as under:

"Act Apprenticeship/ITI in relevant trade".

Diploma in Engineering should not be considered as an alternative higher qualification. Act Apprenticeship/ITI in relevant trade is the only qualification and no other qualification including Diploma in Engineering should be accepted as an alternative qualification on the ground of being a higher qualification in the same line of training.

2. The inclusion of the Trade of Operator Advanced Machine Tool as an eligibility qualification for the post of Technician Grade III has been under consideration of this Ministry. Accordingly, it has been examined in consultation with the technical directorates of this Ministry and it has been decided by the Board to include the Trade of Operator Advanced Machine Tool as eligibility qualification for the posts as identified and mentioned below:
(a) Tech Gr IT (EMU)
(b) Tech Gr.III Machinist (C&W)
(c) Tech Gr.III Machinist (Workshop)
(d) Tech Gr.III Mechanical (PUs)
(e) Tech Gr.III Turner (Workshop)
3. These instructions will be applicable from the date of issue of this letter. Cases already under process will continue to be dealt in terms of earlier instructions.

On behalf of members of this Association I am to submit herewith following facts for your kind consideration and early favourable action.
  1. The Ministry of Personnel, Public Grievances and Pension under O.M. No. 38/86/03- P&PW(A) dated 26-04-2004 has granted parity of Pay Scales in organized Accounts cadre w.e.f. 01-01-1996 notionally and actually from 19-02-2003 as shown below:

3. The 6th Central Pay Commission has merged the post of Section Officer with Assistant Accounts Officer from 01-01-2006. The 6th Pay Commission has recommended the Pay Band 2 in the Pay Scale of Rs. 9300-34800 Plus Grade Pay of Rs. 4200/- to the Senior Accountant. The Asst. Accounts Officer were also given the Pay Band No. 2 but they were given the Grade Pay of Rs. 4800/-.

4. The Government of India, Ministry of Personnel, Public Grievances and Pensions under O.M. No. 35034/3/2008-Estt (D) dated 19-05-2009 has introduced the Scheme of Modified Career Progression Scheme (for brevity M.A.C.P.) which is the modified version of earlier A.C.P. Scheme. As per the Scheme the Government Servants will be granted 3 financial upgradations after completion of 10, 20 and 30 years of service if they have not received any regular Promotion. The condition No. 2 read with 6.2 of the Annexure 1 of the OM. laid down that:

"….financial upgradations under the Scheme should be done strictly in accordance with the hierarchy of grade pays in pay bands as notified vide CCS (Revised Pay) Rules, 2008"

According to the information available to this Association, the Senior Accountants are being granted Grade Pay of Rs. 4600 /-(level 7 of pay matrix) on grant of benefits under M.A.C.P.

In this connection, your kind attention is invited to the following orders/Judgments of the various Tribunals/ High Courts/Supreme Court wherein the Tribunals/ High Courts have held that the Grade Pay of hierarchical Promotion Post has to be given on grant of financial benefits under M.A.C.P.

1. Central Administrative Tribunal (C.A.T.) Ernakulam Order dated 27-09-2011 in T.P.Leena Vs. Union of India.

The Tribunal has granted the Grade Pay of Rs. 4800/- on grant of 1st Financial Benefit under M.A.C.P. from Rs. 4200/-

2. The High Court of Ernakulam has by Judgment dated 21-06-2012 in the case of Union of India Vs. T.P.Leena has upheld the Order of CAT. and Hon’ble Supreme Court has dismissed the S.L.P. by Judgment dated 15-10-2012 holding that there is no reason to interfere with Impugned Order.

3. CAT New-Delhi by Order dated 26-11-2012 in Sanjay Kumar & others Vs. Ministry of Defence & others has granted the Grade Pay of Promotion Post (Copy enclosed).

Sir, it would not be out of place to submit that the Controller of Accounts C.B.D.T. Mumbai in compliance of C.A.T. Mumbai order has by order No. ZAO/MACP/ADMN/12015-16 dated 01-02-2016 has granted Grade Pay of Rs. 4800[- (level 8 of Pay Matrix] to 13 Senior Accountants on grant of benefits of 2“d M.A.C.P. The copy of the Order is enclosed as Annexure ‘B’ for your perusal.

It is further submitted that the Principal Chief Controller of Accounts. Zonal Accounts Office, CBDT, Mumbai has, while quoting Principal Chief Controller of Accounts C.B.D.T. New- Delhi letter No. -PCCA/CBDT/Estt/Rep/2018-381-382 dated 01-08-2018 has granted benefits of 3rd M.A.C.P. to 16 Senior Accountants under order No. ZAO/CBDT/MUM/ADMN/MACPS/2018-191 742 dated 04-09-2018 [Copy enclosed]. The perusal of the order would exhibit that all the Senior Accountants were in receipt of Grade Pay of Rs. 4800/- (level 8 ef Pay Matrix] on grant of benefits of 2nd M.A.C.P. and they have been granted Grade Pay of Rs. 5400/-[level 9 of Pay Matrix) which is the Grade Pay of hierarchical Post of Asstt. Accounts Officer.

In View of submission made in the letter, it is clear that the members of our Association are meted out with discrimination as far as grant of Grade Pay of Rs. 4800/-[level 8 of Pay Matrix) on grant of benefits of M.A.C.P. to Senior Accountants are concerned. They are given the Grade Pay of Rs. 4600/- [level 7 of Pay Matrix). This amounts to discrimination and violative of Article 14 and 16 of the Constitution of India. It is therefore requested that the Grade Pay of Rs. 4800/-(level 8 of Pay Matrix) may please be granted to all the Senior Accountants who have been granted benefits of M.A.C.P. A comprehensive review may please be taken and set right the grave injustice caused to our members.

In this context the observation of Principal Bench New Delhi in the case of All India Defence Civilian Clerks Association of ADC and Records Office and another Vs. The Secretary, Ministry of Defence and others in order dated 01-02-2012 (Copy enclosed) assumes importance.

We do not understand the logic of the Ministry of Defence, D.0.P & T. Ministry of Finance or even the Ministry of Law as to how the aforesaid directions as upheld by Hon'ble High Court of Delhi and the Apex Court cannot be made applicable to the Applicants who are admittedly similarly placed. In our considered opinion the Respondents/Departments should desist from rejecting the genuine request of the employees and force them to knock the door of Courts unnecessarily without any justifiable grounds.

In view of above observation of Hon'ble Principal Bench 1 request you to consider our request positively and arrange to do justice by removing the discrimination between the two set of similarly situated employees.

Subject: Payment of Dearness Allowance to Armed Forces Officers and Personnel Below Officer Rank including NCs(E) - Revised rates effective from 01.07.2018.

Sir,
I am directed to refer to this Ministry's letter No. 1(2)/2004- D(Pay/Services) dated 28th March 2018, on the subject cited above and to say that the President is pleased to decide that the Dearness Allowance payable to Armed Forces Officers and Personnel Below Officer Rank, including Non-Combatants (Enrolled), shall be enhanced from the existing rate of 7% to 9% with effect from 01.07.2018.

2. The term ‘basic pay’ in the revised pay structure means the pay drawn in the prescribed Level in the Pay Matrix as per 7th CPC recommendations accepted by the Government, but does not include any other type of pay like special pay, etc.

3. The Dearness Allowance will continue to be a distinct element of remuneration and will not be treated as pay within the ambit of Pay rules of Defence Force Personnel.

4. The payment on account of Dearness Allowance involving fractions of 50 paise and above may be rounded to the next higher rupee and the fractions of less than 50 paise may be ignored.

5. This letter issues with the concurrence of Finance Division of this Ministry vide their Dy. No. 257-PA dated 17.09.2018 based on Ministry of Finance (Department of Expenditure) O.M. No. 1/2/2018-E.II(B), dated 7th September 2018.
