Subject: Drawal of next increment under Rule 10 of Central Civil Services (Revised Pay) Rules, 2016 – regarding.

The undersigned is directed to refer to para 8(i) of the Ministry of Home Affairs U.O. No. 300/14/Pr.A.O./Admn/ MHA/23/2018-19/456 dated 29.04.2019 seeking clarifications regarding drawal of next increment, referring the instructions contained in Department of Expenditure Office Memorandum No. 4-21/2017-IC/E.IIIA dated 31.07.2018, as to whether an employee promoted or getting financial upgrdation on 01.07.2016 and granted two increments i.e. first annual increment and second promotional increment, is eligible for his next increment after completion of six months period on 01.01.2017 or after expiry of one year period on 01.07.2017.

2. The matter has been examined in this Department. In terms of the instructions contained in this Department’s above referred O.M. dated 31.07.2018, the employees who are getting promotion/financial upgradation on 1st July and receiving the benefit of two increments i.e. the first annual increment due on 1st July and the second notional increment on account of promotion, will accrue their subsequent increment on the following 1st January, after completion of six months period.

Subject:- Stepping up of pay-Consolidated guidelines-reg.

The undersigned is directed to say that the issue of anomaly relating to senior Government employees drawing less pay than their juniors due to application of provisions of FR 22(I)(a)(1) is considered on merits for allowing stepping up pay of the seniors so as to bring it at par with that of the junior in accordance with the guidelines scattered in various OMs noted in the margin. A need has been felt to consolidate guidelines on stepping up of pay at one place keeping in view the provisions of the Central Civil Services (Revised Pay) Rules, 2016, [in short CCS(RP)Rules, 2016] as the frequent references on such issues continue to be received in this Department.

2. Consequent upon implementation of CCS(RP)Rules, 2016, the President is pleased to decide the following:

(i) In order to remove the anomaly of a Government servant promoted or appointed to a higher post on or after 1-1-2016 drawing lower pay in that post than another Government servant junior to him in the lower grade and promoted or appointed subsequently to another identical post, the pay of the senior Government servant in the higher post should be stepped up to a figure equal to the pay as fixed for the junior Government servant in that higher post. The stepping up should be done with effect from the date of promotion or appointment of the junior Government servant and will be subject to the following conditions, namely:
(a) both the junior and the senior Government servants should belong to the same cadre and the posts in which they have been promoted are identical in the same cadre;

(b) the Level in the Pay Matrix of the lower and higher posts in which they are entitled to draw pay should be identical;

(c) the anomaly is directly as a result of the application of the provisions of Fundamental Rule 22(I)(a)(1) read with Rule 13 of CCS(RP)Rules, 2016. For example, if the junior officer was drawing
more pay in the existing pay structure than the senior by virtue of any advance increments granted to him, the provisions of this subrule should not be invoked to step up the pay of the senior officer.

(ii) The order relating to re-fixation of the pay of the senior officer in accordance with clause (i) shall be issued under Fundamental Rule 27 and the senior officer shall be entitled to the next increment on completion of his required qualifying service with effect from the date of re-fixation of pay.

3. The following instances/events wherein juniors draw more pay than seniors, do not constitute anomaly and, therefore, stepping up of pay will not be admissible in such events:

(a) Where a senior proceeds on Extra Ordinary Leave which results in postponement of his Date of Next Increment in the lower post and consequently he starts drawing less pay than his junior in the lower grade itself. He, therefore, cannot claim pay parity on promotion even though he may be promoted earlier to the higher grade than his junior(s);

(b) If a senior forgoes/refuses promotion leading to his junior being promoted/appointed to the higher post earlier and the junior draws higher pay than the senior.

(c) If the senior is on deputation while junior avails of the ad-hoc promotion in the cadre, the increased pay drawn by the junior due to ad-hoc/officiating and/or regular promotion following such adhoc promotion in the higher posts vis-à-vis senior, is not an anomaly in strict sense of the term;

(d) If a senior joins the higher post later than the junior, for whatsoever reasons, whereby he starts drawing less pay than the junior. In such cases, senior cannot claim stepping up of pay at par with that
of his junior.
(e) If a senior is appointed later than the junior in the lower post itself whereby he is in receipt of lesser pay than the junior, in such cases also the senior cannot claim pay parity in the higher post if he draws less pay than his junior though he may have been promoted earlier to the higher post.

(f) Where an employee is promoted from lower post to a higher post, his pay is fixed with reference to the pay drawn by him in the lower post under FR22(I)(a)(1) read with Rule 13 of CCS(RP)Rules, 2016 and due to his longer length of service in the lower grade, his pay may get fixed at a higher stage than that of a senior direct recruit appointed to the same higher grade and whose pay is fixed under different set of rules. For example a Senior Secretariat Assistant (SSA) on promotion to the post of Assistant Section Officer (ASO) gets his pay fixed under FR 22(I)(a)(1) with reference to the pay drawn in the post of SSA, whereas the pay of ASO(DR) is fixed under Rule 8 of CCS(RP)Rules, 2016 at the minimum pay or the first Cell in the Level, applicable to ASO to which he is appointed. In such a case, the senior ASO (DR) cannot claim pay parity with that of the promotee junior ASO.

(g) Where a senior is appointed in higher post on ad-hoc basis and is drawing less pay than his junior who is appointed in the same cadre and in same post on ad-hoc basis subsequently, the senior cannot claim pay parity with reference to the pay of that junior since the ad-hoc officiating service in higher post is reversible and also since full benefits of FR22(I)(a)(I) are not available on ad-hoc promotion but only on regular promotion following such ad-hoc promotion without break.

(h) Where a junior gets more pay due to additional increments earned on acquiring higher qualifications.
Note: The above instances/events are only illustrative and not exhaustive.

4. These orders shall be in supersession of D/o Expenditure’s OM No.F.2(78)-E.III(A)63 dated 2nd February, 1966 and DOP&T’s OM No.4/7/92-Estt(Pay-I) dated 4th November, 1993.

5. This OM is effective from 0 1.01.2016.

6. In so far as persons serving in the Indian Audit and Accounts Department are concerned, these orders have been issued after consultation with the Comptroller and Auditor General of India.

Subject: Payment of overtime Allowance (OTA) in the revised pay to the employees of Defence Industrial Establishments governed by the Factories Act, 1948.

Consequent upon revision of pay structure as per VII CPC recommendations, the matter regarding payment of OTA, as per revised pay, to the employees of the Defence Industrial Establishments under the Factories Act, 1948 has been considered in consultation with the Ministry of Labour & Employment, Ministry of Finance and Ministry of Law & Justice.

2. It has been decided that the Overtime Allowance shall be paid to the employees of the Defence Industrial Establishment governed by the Factories Act, 1948 on the basis of revised wages with effect from the date the wages have been revised i.e. 1.1.2016. The OTA on the basis of revised wages is subject to the conditions stipulated in this Ministry's OM No. 14(1)/97/D(Civ-11) dated 1st July 1998.

3. It is further added/clarified that those categories of "workers" who come within the scope of Section 64 of the Factories Act and whose basic pay exceed the wage limit, as specified in sub-section (6) of Section (1) of the Payment of Wages Act, 1936, are entitled for payment of OTA in terms of MoD OM No. 14(2)/76/D(Civ-II) dated 25.06.1983 on the basis of wage limit notionally determined. Accordingly, OTA will be paid to them on the basis of wage limit notionally determined on the basis of old pay scales until the new wage limit is defined by the Ministry of Labour & Employment based on the consumer expenditure survey published by NSSO. Thereafter, the OTA will be paid to them on the basis of new wage limit notionally determined, if the basic pay exceeds the new wage limit.

The other conditions as laid down in this Ministry's letter No. 14(1)/97/D(Civ-II) dated 1st July. 1998 shall remain unchanged

4. This issues with the concurrence of MoD(Finance/AG/PB) vide their Dy No. 1 04/AG/PB dated 15.02.2018 and after consultation with Ministry of Labour & Employment vide their ID No. Z- 16025/09/2017-ISH-II dated 13.11.2017

MEMORANDUM

Sub: Seventh Central pay Commission's recommendations - revision of pay scales - amendment or Service Rules/Recruitment Rules.

The undersigned is directed to refer to this Department's OM or even number dated 9th August. 2016 the subject mentioned above wherein it was requested that as per the CCS (Revised pay) Rules, 2016 issued by Department or Expenditure vide Notification dated 25th July, 2016, consequential amendment in the existing Service Rules.'Recruitment Rules shall be made by the Ministries/Departments by substituting the existing pay Band and Grade pay by the new pay "LEVEL in the PAY MATRIX" straightaway without making a reference 10 the Department of Personnel and Training Public Service Commission (UPSC).

2. Further, DoP&T vide of even number dated 16.02.2017 sought information with regard to implementation of OM dated 09.08,2016. The issue is being monitored by higher authorities; however, so far this Department has not received any information from Ministries/Departments even a lapse of over a year. It has been decided to hold a meeting, under the Championship or JS (E), with all Ministries/Departments on 04.01.2018 in Room No.190, North Block, New Delhi.

3. All Ministries/Departments are requested to furnish a status report regarding amendment Of Recruitment Rules in pursuance of DoP&T OM dated 09/08/2016 in the annexure-II enclosed herewith. The schedule or the meeting is as per Annexure-I.

Sub :- Adoption of clarification issued by Ministry of Finance regarding modifications of Level-13 of Pay Matrix.

Modifications to Railway Services (Revised Pay) Rules, 2016 were notified vide Gazette Notification No. G.S.R 882(E) dated 14.07.2017 thereby making changes in Level-13 of the Pay Matrix.

2.Now, Ministry of Finance (Department of Expenditure) vide their O.M No. 4-6/2017-IC/E-III(A) dated 28.09.2107 (copy enclosed) has issued detailed clarifications addressing the following issues arising out of the modification to Level-13 of the Pay Matrix:

(i) Issue No. 1 - Whether pay in the Level-13 is to be fixed by multiplying by a factor of 2.57 or 2.67
(ii) Issue No. 2 - Pay re-fixed in the modified Level-13 working out lower than the pay fixed in the earlier Level-13.
(iii) Issue No. 3 - Re-exercise of option for coming over to the Revised pay structure in case of Level-13.

3. The clarifications issued by Ministry of Finance (Department of Expenditure) vide their O.M dated 28.09.2017 will be applicable mutatis mutundis in Railways with respect to RS(RP) Rules, 2016 and amendment notified on 14.07.2017. However, the period for any recovery or waving off recovery will be upto 31.07.2017 as the amendments to the RS(RP) Rules, 2016 were notified in July, 2017. Similarly, the time period for re-exercise of options, if any, as mentioned in para-15 of the enclosed O.M will count from the date of issue of this letter.

4.The cases of employees who retired on or after 01.01.2016 and upto 31.07.2017 and if covered under para 12 of Ministry of Finance’s OM dated 28.09.2017, shall be processed as per Rule 90 of Railway Services (Pension) Rules, 1993.

Sir/Madam,

In continuation to KVS circular of even number dated 03.08.2017 I am directed to refer to MHRD's letter No. F. 3-14/2017-UT.2 dated 31.10.2017 and to convey the approval of the Govt. of India for implementation of revised allowances based on the recommendations of the 7th CPC in KVS. The MHRD has agreed for additional funds to the extent of implementation of revised allowances in terms of Department of Expenditure (MoF) O.M. F. No. 1/1/2016-E.III(A) dated 26.07.2017.

It is further clarified that Department of Expenditure (MoF) O.M. F. No. 1/1/2016-E.III(A) dated 13.01.2017 is applicable only in case of pay scales and not in case of pension as such additional funds for the purpose of pension may not be allowed while implementing the revised pay scale and allowances in KVS.

Subject: Implementation of Government's decision on the recommendation of the VIIth Pay Commission on CCS (Extraordinary Pension) Rules, 1939 - Constant Attendant Allowance - regarding.

In continuation of this Department's OM No.1/4/2017-P&PW(F) dated 2nd August 2017, revising the Constant Attendant Allowance from the existing Rs.4500/- p.m to Rs.6750/- p.m, it has also been decided that the rate of Constance Attendant Allowance payable to the Civilian pensioners shall be increased by 25% every time the dearness allowance on the revised Pay in the Pay Matrix increases by 50%.

2.All other terms and conditions of this Department's OM NO. 1/4/2017-P&PW(F) dated 2nd August 2017 will remain the same.

3.In so far as persons belonging to Indian Audit and Accounts Department, these orders issue after consultation with the Comptroller & Auditor General of India.

Further, Implementation Cell, 7th CPC, Department of Expenditure, Ministry of Finance has issued clarifications in this regard vide OM No.1-6/2016-IC dated 3rd August, 2017 (copy enclosed).

All respective accounting units of Ministries/ Departments concerned are advised to review all cases wherein benefit on account of bunching has been extended in terms of this office OM dated 23rd February, 2017 and in adherence to DoE OM No. 1-6/2016-lC dated 7th September, 2016 and to re-fix the pay in terms of Implementation Cell, 7th CPC, Department of Expenditure, Ministry of Finance OM No.1-6/2016-lC dated 3 rd August, 2017.

Accordingly, clarifications sought in this regard from various accounting units of Ministries/Departments concerned may be treated as disposed of.

This issues with the approval of the competent authority.

Sub : Pay revision of employees of Kendriya Vidyalaya Sangathan in terms of Central Civil Services (Revised Pay), Rules, 2016-Reg.

Sir/Madam,
I am directed to convey the approval of the competent authority for the adoption of the revised Pay Scales as per the 7th Central Pay Commission (CPC) to the employees of Kendriya Vidyalaya Sarigathan (both teaching and non­ teaching) as per the Pay Matrix as contained in Part-A of the schedule of Central Civil Services (Revised Pay) Rules, 2016 as well as the principle of pay fixation as contained in the said rules as notified by Ministry of Finance, Government of India vide their notification dated 25.07.2016 in respect of Central Government employees. The post wise details of the revised pay scales are given in Annexure-I.

The following conditions are to be taken care of while implementing the 7th CPC in KVS :-
a) The revised pay structure shall be admissible to those employees who opt for the same in accordance with the extent Rules.
b) Deductions on account of Provident Fund, Contributory Provident Fund or National Pension Scheme, as may be applicable, will have to be made on the basis of the revised pay w.e.f. the date an employee opts to elect the revised pay structure.
c) Until further orders the existing allowances in KVS shall continue to be admissible as per the existing terms and conditions irrespective of the revised pay scales adopted.
d) There will be no payment of arrears to the employees which will accrue to them on account of the revision of pay as the same has been put on hold by Ministry till additional budget allocation on this account is made available
2. A copy of Gazette Notification No.1-2/2016-IC dated 25.07.2016 issued by Ministry of Finance Department of Expenditure as Central Civil Services (Revised Pay) Rules 2016, Memorandum No. 1-5/2016-IC dated 29.07.2016 and OM No.1- 5/2016-IC dated 01.08.2016 are forwarded for necessary information and guidance as (Annexure-II, III & IV) respectively.

3. Copy of Form of Option is attached as Annexure-V. The Option shall be obtained from the employees within 03 months from the date of issue of this letter, in duplicate. The statement of fixation of pay under Central Civil Services (Revised Pay) Rules, 2016 is attached as Annexure-VI. The same may be prepared with reference to the pre-revised scale and the corresponding revised Pay Matrix level as per 7thCPC, in duplicate. Each employee has to submit an undertaking. A copy of undertaking is attached as Annexure-VII.

4. The option for revised pay scales may be obtained in prescribed proforma in duplicate. A copy of the same may be pasted in the service book of the employee concerned while the other copy along with a statement of fixation of pay as per Annexure-VI ibid may be sent to the Finance Officer of the Region in case of Kendriya Vidyalayas and Regional Offices for verification and approval. The Finance Officer shall retain the copy of the option exercised by the employee along with one copy of the statement of fixation of pay for record in his office, while the second copy of the statement will be returned to the Vidyalaya concerned after approval. On receipt of the statement of fixation of pay duly verified and approved from the Finance Officer, the Principal/ Deputy Commissioner will paste the same in the service book of the employee concerned.

5. Options in respect of Deputy Commissioners / Assistant Commissioners and Administrative Officers of Regional Offices, whose service books are maintained in the Headquarters will be sent to Assistant Commissioner (Establishment-f) KVS Hqrs along with the statement of fixation of pay.

6. The pay can be drawn as per revised scale for all the teaching" and non­ teaching staff of KVS on the basis of pay fixation statement without awaiting approval of the Finance Officer of Regional Office concerned /KVS (Hqrs) in view of specific undertaking in Annexure-VII ibid. Similar action can also be taken in case of staff of Regional Offices.

7. Copy of this circular may be sent to all Kendriya Vidyalayas functioning under your administrative jurisdiction for implementation immediately under intimation to KVS (Hqrs).The nomenclature of posts mentioned at Sr. No. 19, 20, 23 & 27 is that of Assistant Section Officer, Senior Secretariat Assistant and Junior Secretariat Assistant as already notified vide KVS circular dated 26.12.2016. However, while issuing orders of pay fixation, the’ nomenclatures such as Assistant, UDC, LDC only may be used as the matter of change of nomenclature of these posts is under examination.This issues with the approval of competent authority.Hindi version of this letter will follow

Subject: Recommendations of the 7th Central Pay Commission (CPC) - bunching of stages in the revised pay structure under Central Civil Services (Revised Pay) Rules, 2016.

With reference to the subject mentioned above and in continuation of this Department's OM of even number dated 07.09.2016 and 13.06.2017, detailed instructions are hereby being issued on the application of the benefit on account of bunching of stages while fixing the pay in the revised pay structure as a response to a large number of references received from Ministries/Departments.

2. The provisions giving effect to the recommendations of the 7th CPC on extending the benefit on account of bunching were notified vide DoE OM. dated 07.09.2016. Benefits on account of bunching have been extended during the initial fixation of pay in the revised pay structure while implementing the recommendations of earlier CPCs also. Bunching occurs in the fixation of pay when the pay at two or more consecutive stages in a Pay Scale/ Grade Pay in the pre revised scale get fixed at the same stage in the corresponding Pay Scale/ Level in the revised pay structure.


3. The modalities of determining the extent of bunching and the nature of benefits to be extended on account thereof, based on the recommendations of the CPCs, have differed across different Pay Commission periods. While the 5th CPC recommended that benefits be extended when more than four stages get bunched, the 6th CPC recommended that benefits be extended when two or more stages get bunched. The fitment tables drawn by the 6th CPC and notified by the Government subsequently provided for the benefit of bunching only when more than two stages were bunched. As regards the benefits to be extended on account of bunching, the 5th CPC recommended benefit of one increment for every four consecutive stages bunched, the 6th CPC recommended benefit of one increment for every two consecutive pay stages bunched. For HAG scales, however, benefit of one increment was given at each of the pay stages in the 6th CPC pay structure.

4. In terms of the DoE OM. dated 07.09.2016 based on the 7th CPC recommendations, bunching occurs when two or more stages get bunched and benefit of one increment is to be given for every two stages bunched. These provisions are to be applied while revising the pay from the 6th CPC regime to the 7th CPC regime. In the 6th CPC pay structure, about 35 pay scales existing in the 5th CPC pay structure were replaced by a system of running pay bands recommended by the 6th CPC. The 6th CPC pay structure consisted of 19 grades spread across four distinct pay bands and 4 distinct scales including two fixed scales. The 6th pay structure being replaced by the 7th CPC recommended Pay Matrix, thus, consists of 4 Pay Bands with 15 levels of Grade Pay, along with 4 standalone scales, viz., HAG scale, HAG+ scale, Apex scale (fixed) and the scale of Cabinet Secretary (fixed).

5. While in the 5th CPC structure, the stages in every pay scale were well defined, the stages were not well defined in the 6th CPC structure. The pay was to be fixed in the running Pay Band by rounding off to the next higher multiple of 10. Every multiple of 10 was a pay stage in the 6th CPC regime. However, all consecutive 10 rupee stages for any Grade Pay cannot be taken as consecutive stages for the purpose of bunching in reference to the 7th CPC recommendations as is also clear from the illustration contained in para 5.1.37 of the 7th CPC Report. Based on the illustration contained in para 5.1.37 of the 7th CPC Report, Department of Expenditure’s OM. dated 07.09.2016 provided that a difference of at least 3%, the rate of annual increment, in the 6th CPC pay structure was essential for counting of two stages. The 6th CPC had replaced the system of equidistant pay stages in a pay scale based on equal annual increments in the 5th CPC regime by a system of annual increment of 3% on the sum of pay in the running pay band and the Grade Pay which was to be added to the running pay as increment. Therefore, the pay stages in any given Grade Pay were specific to an employee and depended upon the initial fixation of pay in that Grade Pay. As a result, the amount of increment earned in the same Grade Pay would differ in the same Pay Scale/ Grade Pay not only between different employees but also across years for the same employee. To illustrate, an employee whose pay was fixed at Rs 46,100 in GP of 8700 in PB-4 would have the first annual increment of Rs 1390 which would be added to his running pay in the Pay Band, another employee whose pay initially was fixed at Rs 46,400 in the same Grade Pay would have the first annual increment of Rs 1400. In such a scenario where the pay stages are specific to the employee, it is not possible to arrive at universal pay stages for the purpose of determining the extent of bunching. Therefore, for the purpose of determining the extent of bunching in a system of running pay bands, the consecutive pay stages that need to be considered are the pay stages which are specific to the employee.


6. In the 5th CPC structure, the maximum and the minimum of every pay scale were well defined. In the 6th CPC structure, Entry Pay was separately notified for most Grade Pay levels to govern the entry pay of direct recruits in that level. The pay of those moving from a lower grade to a higher one on promotion was regulated in terms of provisions contained in Rule 13 of CCS (RP) Rules, 2008. As such, the Entry Pay notified for a given Pay Scale/ Grade Pay is the effective minimum of that Grade Pay for direct recruits. For an employee getting promoted, the sum of the minimum of the relevant Pay Band and the Grade Pay is the effective minimum pay. The 7th CPC, in its Report, has commented that this led to many situations where direct recruits drew higher pay as compared to personnel who reached that stage through promotion. Demands were received by the 7th CPC from many staff associations and employees for removal of this disparity which the 7th CPC refers to as differential entry pay.

7. In the revised dispensation for pay fixation in the New Pay Structure as recommended by the 7th CPC, direct recruits shall start at the minimum pay corresponding to the level to which recruitment is made, which will be the first cell of each level. For those promoted from the previous level, the fixation of pay in the new level will depend on the pay they were already drawing in the previous level. The pay, however, cannot be less than the first stage of the relevant level. While enumerating the benefits of migrating to the new system at para 5.1.47 of the 7th CPC Report, it has been stated that ‘the issue of differential entry pay has been resolved’. At para 5.1.36 of the 7th CPC Report it has also been mentioned that rationalization has been done with utmost care to ensure minimum bunching at most levels. Rationalization has been done by the 7th CPC through the Index of Rationalisation (IoR) which has been multiplied with the Entry Pay in the 6th CPC regime to arrive at the first cell of each level. With the Entry Pay along with IOR being used as the determiner of the first cell, pay stages below the Entry Pay have been consciously brought up to the level of Entry Pay and its corresponding pay stage in the revised pay structure. As a result, all pay stages below the Entry Pay in any Level will, on re-fixation, converge to the first pay stage in that level. As this convergence takes place on account of a conscious decision of the 7th CPC intrinsic to the architecture of the Pay Matrix by indicating the Entry Pay as the starting point of each Level, benefit on account of bunching cannot be extended with reference to pay stages lower than the Entry Pay indicated by the 7th CPC for that level in the Pay Matrix. Extending the benefit of bunching with reference to pay stages below the entry pay will perpetuate the difference in pay on account of differential Entry Pay which was addressed by the 7th CPC.

8. Based on the above, it is clarified that the following shall be kept in view while determining the extent of bunching as also the benefits to be extended on account of bunching at the time of initial fixation of pay in the 7th CPC pay structure:
(i) Benefit on account of bunching is to be extended when two or more stages get bunched.

(ii) Benefit of one increment is to be extended on account of bunching of every two consecutive stages.

(iii) As stipulated in MoF OM dated 07.09.2016, a difference of 3% to be reckoned for determination of consecutive pay stages, specific to each employee.

(iv) All pay stages lower than the Entry Pay in the 6th CPC pay structure as indicated in the Pay Matrix contained in the 7th CPC Report are not to be taken into account for determining the extent of bunching.
9. All Ministries/ Departments are advised to review all cases wherein benefit on account of bunching has been extended in terms of this Department's OM dated 07.09.2016 and to re-fix the pay in terms of the instructions contained herein.

Following the notification of Railway Services (Revised Pay) Rules, 2016, Railway Board has received references seeking clarifications regarding various aspects of fixation of pay in the revised pay structure as also pay fixation and grant of increment in future under revised pay structure. These matters have been considered by Ministry of Finance and the paints of doubts are clarified as under:

Consequent upon notification of RS(RP) Rules, 2016 i.e. 28th July, 2016, the option submitted by such employees has now turned out to be disadvantageous.Whether such employee may be allowed to revise their option under FR 22(I)(a)(1) at this stage.
Whether employees appointed/promoted/granted financial upgradation during 02.01.2015 and 01.07.2015 will be entitled to grant of one increment on 01.01.2016
Under the changed circumstances after notification of RS(RP) Rules, 2016, the employee may be allowed to exercise revised option for fixation of pay under FR 22(I)(a)(1). Such revised option shall be exercised’ within one month of issue of this letter. Option so revised shall be final.Since, the provisions of RS(RP) Rules, 2016 are effective from 01.01.2016, no increment shall be allowed on 01.01.2016 at the time of fixation of pay in the revised pay structure.

According to Para 2 of Ministry of Finance, Department of Expenditure (Implementation Cell, 7th CPC)’s OM No. No.1-5/2016-IC dated 29-07-2016, in pursuance of the CCS (RP) Rules, 2016, appropriate necessary action to fix the pay of the employees covered thereunder in the revised pay structure needs to be carried out forthwith in accordance with the provisions contained therein.The statement of fixation of pay in revised pay structure as per CCS (RP) Rules, 2016 be prepared in triplicate and one copy thereof be placed in the Service Book of the employee concerned and another copy made available to the concerned accounting authorities [Chief Controller of Accounts/Controller of Accounts/Accounts Officer] for post-check

Ref: (i) NFIR’s PNM Item No. 1/2013.
(ii) GS/NFIR’s letter No. II/35/Part 12 dated 04/01/2016 and 02/02/2016 addressed to Secretary (E), Railway Board.

Attention is invited to the discussions held in the NFIR’s PNM meeting with the Railway Board on the subject and also illustrations given vide letters dated 04/01/2016 and 02/02/2016 with regard to Pay Fixation for ex-servicemen re-employed in Railways.

The General Manager, Western Railway has since written to the Railway Board justifying the pay fixation already done on Western Railway and in support of the same, the Zonal Railway has cited the Judgement given by Hon’ble CAT Chandigarh. A copy of the CAT Chandigarh Judgement is enclosed to enable the affiliates to examine in consultation with the ex- servicemen Railway employees on their respective Zonal Railways etc., and furnish comments early for taking further action.

NOTIFICATION

G.S.R. 746(E).— In exercise of the powers conferred by the proviso to article 309 of the Constitution, the President hereby makes the following rules, namely:-
1. Short title and commencement : – 
(1) These rules may be called the Railway Services (Revised Pay) Rules, 2016.
(2) They shall be deemed to have come into force on the 1st day of January, 2016.
2. Categories of Railway servants to whom the rules apply: – 
(1) Save as otherwise provided by or under these rules, these rules shall apply to persons appointed to Railway services.
(2) These rules shall not apply to : –
(i) Permanent employees of former Indian States absorbed in Railway Services so long as such persons continue to be governed by the pre-absorption conditions of service under the Railway Services;
(ii) persons locally recruited for services in Diplomatic, Consular or other Indian establishments in foreign countries;
(iii) persons not in whole-time employment;
(iv) persons paid out of contingencies;
(v) persons paid otherwise than on a monthly basis including those paid only on a piece-rate basis;
(vi) persons employed on contract except where the contract provides otherwise;
(vii) persons re-employed in Railway service after retirement;
(viii) any other class or category of persons whom the President may, by order, specifically exclude from the operation of all or any of the provisions contained in these rules.
3. Definitions: – In these rules, unless the context otherwise requires: –
(i) “existing basic pay” means pay drawn in the prescribed existing Pay Band and Grade Pay or pay in the existing scale;
(ii) “existing Pay Band and Grade Pay” in relation to a Railway servant means the Pay Band and the Grade Pay applicable to the post held by the Railway servant as on the date immediately before the notification of these Rules whether in a substantive capacity or in officiating capacity;
(iii) “existing scale” in relation to a Railway servant means the pay scale applicable to the post held by the Railway Servant as on the date immediately before the notification of these Rules in the Higher Administrative Grade, Higher Administrative Grade + and the Apex scale whether in a substantive or officiating capacity;
(iv) “existing pay structure” in relation to a Railway Servant means the present system of Pay Band and Grade Pay or the Pay Scale applicable to the post held by the Railway Servant as on the date immediately before the coming into force of these Rules whether in a substantive or officiating capacity.
Explanation- The expressions “existing basic pay”, “existing P ay Band and Grade Pay” and “existing scale”, in respect of a Railway Servant w ho on the 1st day of January, 2016 was on deputation out of India or on leave or on foreign service, or who would have on that date officiated in one or more lower posts but for his officiating in a higher post, shall mean such basic pay, Pay Band and Grade Pay or scale in relation to the post which he would have held but for his being on deputation out of India or on leave or on foreign service or officiating in higher post, as the case may be;

(v) “existing emoluments” mean the sum of (i) existing basic pay and (ii) existing dearness allowance at index average as on 1st day of January, 2016;
(vi) “Pay Matrix” means Matrix specified in Part A of th e Schedule, with Levels of pay arranged in vertical cells as assigned to corresponding existing Pay Band and Grade Pay or scale;
(vii) “Level” in the Pay Matrix shall mean the Level corr esponding to the existing Pay Band and Grade Pay or scale specified in Part A of the Schedule;
(viii) “pay in the Level” means pay drawn in the appropri ate Cell of the level as specified in Part A of the Schedule;
(ix) “revised pay structure” in relation to a post mea ns the Pay Matrix and the Levels specified therein corresponding to the existing Pay Band and Grade Pay or scale of the post unless a different revised Level is notified separately for that post;
(x) “basic pay” in the revised pay structure means the pay drawn in the prescribed Level in the pay matrix;
(xi) “revised emoluments” means the pay in the Level of a Railway servant in the revised pay structure; and
(xii) “Schedule” means a schedule appended to these Rules .
4. Level of posts: – The Level of posts shall be determined in accord ance with the various Levels as assigned to the corresponding existing Pay Band and Grade Pay or scale as specified in the Pay Matrix.
5. Drawal of pay in the revised pay structure: – Save as otherwise provided in these rules, a Railway servant shall draw pay in the Level in the revised pay structure applicable to the post to which he is appointed:
Provided that a Railway servant may elect to continue to draw pay in the existing pay structure until the date on which he earns his next or any subsequent increment in the existing pay structure or until he vacates his post or ceases to draw pay in the existing pay structure:
Provided further that in cases where a Railway servant has been placed in a higher grade pay or scale between 1st day of January, 2016 and the date of notification of these Rules on account of promotion or upgradation, the Railway servant may elect to switch over to the revised pay structure from the date of such promotion or upgradation, as the case may be.
Explanation 1 – The option to retain the existing pay structure under the provisos to this rule shall be admissible only in respect of one existing Pay Band and Grade Pay or scale.
Explanation 2 – The aforesaid option shall not be admissible to any person appointed to a post for the first time in Railway Service or by transfer from another post on or after the 1st day of January, 2016, and he shall be allowed pay only in the revised pay structure.
Explanation 3 – Where a Railway servant exercises the option under the provisos to this rule to retain the existing pay structure of a post held by him in an officiating capacity on a regular basis for the purpose of regulation of pay in that Pay Structure under Rule 1313 (FR 22) of Indian Railway Establishment Code, Volume II, or under any other rule or order applicable to that post, his substantive pay shall be substantive pay which he would have drawn had he retained the existing pay structure in respect of the permanent post on which he holds a lien or would have held a lien had his lien not been suspended or the pay of the officiating post which has acquired the character of substantive pay in accordance with any order for the time being in force, whichever is higher.
6. Exercise of Option: – 
(1) The option under the provisos to Rule 5 shall be exercised in writing in the form appended to these Rules so as to reach the authority mentioned in sub- rule (2) within three months of the date of notification of these rules or where any revision in the existing pay structure is made by any order subsequent to the date of notification of these rules, within three months of the date of such order:
Provided that – 
(i) In the case of a Railway servant who is, on the date of such notification or, as the case may be, date of such order, out of India on leave or deputation or foreign service or active service, the said option shall be exercised in writing so as to reach the said authority within three months of the date of his taking charge of his post in India; and
(ii) where a Railway servant is under suspension on the 1st day of January, 2016, the option may be exercised within three months of the date of his return to his duty if that date is later than the date prescribed in this sub-rule.
(2) The option shall be intimated by the Railway servant to the Head of his Office along with an undertaking, in the form appended to these rules.
(3) If the intimation regarding option is not received by the authority within the time specified in sub-rule (1), the Railway servant shall be deemed to have elected to be governed by the revised pay structure with effect from the 1st day of January, 2016.
(4) The option once exercised shall be final.
Note 1 – Persons whose services were terminated on or after 1st January, 2016 and who could not exercise the option within the prescribed time limit, on account of discharge on the expiry of the sanctioned posts, resignation, dismissal or discharge on disciplinary grounds, shall be entitled to exercise option under sub-rule (1).
Note 2 – Persons who have died on or after the 1st day of January, 2016 and could not exercise the option within prescribed time limit are deemed to have opted for the revised pay structure on and from the 1st day of January, 2016 or such later date as is most beneficial to their dependents if the revised pay structure is more favourable and in such cases, necessary action for payment of arrears shall be taken by the Head of Office.
Note 3 – Persons who were on earned leave or any other leave on 1st day of January, 2016 which entitled them to leave salary shall be entitled to exercise option under sub-rule (1).
7. Fixation of pay in the revised pay structure:- 
(1) The pay of a Railway servant who elects, or is deemed to have elected under rule 6 to be governed by the revised pay structure on and from the 1st day of January, 2016, shall, unless in any case the President by special order otherwise directs, be fixed separately in respect of his substantive pay in the permanent post on which he holds a lien or would have held a lien if such lien had not been suspended, and in respect of his pay in the officiating post held by him, in the following manner, namely : –
(A) in the case of all employees: –
(i) the pay in the applicable Level in the Pay Matrix shall be the pay obtained by multiplying the existing basic pay by a factor of 2.57, rounded off to the nearest rupee and the figure so arrived at will be located in that Level in the Pay Matrix and if such an identical figure corresponds to any Cell in the applicable Level of the Pay Matrix, the same shall be the pay, and if no such Cell is available in the applicable Level, the pay shall be fixed at the immediate next higher Cell in that applicable Level of the Pay Matrix.

(ii) if the minimum pay or the first Cell in the applicable Level is more than the amount arrived at as per sub-clause (i) above the pay shall be fixed at minimum pay or the first Cell of that applicable Level.
(B) In the case of medical officers in respect of whom Non Practicing Allowance (NPA) is admissible, the pay in the revised pay structure shall be fixed in the following manner :
(i) the existing basic pay shall be multiplied by a factor of 2.57 and the figure so arrived at shall be added to by an amount equivalent to Dearness Allowance on the pre-revised Non-Practicing Allowance admissible as on 1st day of January, 2016. The figure so arrived at will be located in that Level in the Pay Matrix and if such an identical figure corresponds to any Cell in the applicable Level of the Pay Matrix, the same shall be the pay, and if no such Cell is available in the applicable Level, the pay shall be fixed at the immediate next higher Cell in that applicable Level of the Pay Matrix.
(ii) The pay so fixed under sub-clause (i) shall be added by the pre-revised Non Practicing Allowance admissible on the existing basic pay until further decision on the revised rates of Non Practicing Allowance.

(2)  Where a post has been upgraded as a result of the recommendations of the Seventh Central Pay Commission, the existing basic pay will be arrived at by adding the Pay drawn by the concerned employee in the existing Pay Band plus the Grade Pay corresponding to the Level to which the post has been upgraded and, the fixation of pay shall be done in the manner prescribed in accordance with Clause (A) of sub rule (1).

(3)   A Railway Servant who is on leave on the 1st day of January, 2016 and is entitled to leave salary shall be entitled to pay in the revised pay structure from 1st day of January, 2016 or the date of option for the revised pay structure.
(4)   A Railway servant who is on study leave on the 1st day of January, 2016 shall be entitled to the pay in the revised pay structure from 1st day of January, 2016 or  the date of option.
(5) A Railway servant under suspension, shall continue to draw subsistence allowance based on existing pay structure and his pay in the revised pay structure shall be subject to the final order on the pending disciplinary proceedings.
(6) Where a Railway servant holding a permanent post is officiating in a higher post on a regular basis and the pay structure applicable to these two posts are merged into one Level, the pay shall be fixed under sub-rule  (1) with reference to the officiating post only and the pay so fixed shall be treated as substantive pay.
(7) Where the existing emoluments exceed the revised emoluments in the case of any Railway servant, the difference shall be allowed as personal pay to be absorbed in future increases in pay.
(8) Where in the fixation of pay under sub-rule (1), the pay of a Railway servant, who, in the existing pay structure,  was  drawing immediately before the 1st  day of January, 2016  more pay than another Railway servant junior to him in the same cadre, gets fixed in the revised pay structure in a Cell lower than that of such junior, his pay shall be stepped up to the same Cell in the revised pay structure as that of the junior.
(9) Where a Railway servant is in receipt of personal pay immediately before the date of notification of these rules, which together with his existing emoluments exceed the revised emoluments, then the difference representing such excess shall be allowed to such Railway servant as personal pay to be absorbed in future increase in pay.
(10) (i)  In cases where a senior Railway servant promoted to a higher post before the 1st day of January, 2016 draws less pay in the revised pay structure than his junior who is promoted to the higher post on or after the 1st day of January, 2016, the pay of senior Railway servant in the revised pay structure shall be stepped up to an amount equal to the pay as fixed for his junior in that higher post and such stepping up shall be done with effect from the date of promotion of the junior Railway servant subject to the fulfilment of the following conditions, namely: –
(a) Both the junior and the senior Railway servant belong to the same cadre and the posts in which they have been promoted are identical in the same cadre;
(b) the existing pay structure and the revised pay structure of the lower and higher posts in which they are entitled to draw pay are identical;
(c) the senior Railway servants at the time of promotion are drawing equal or more pay than the junior;
(d) the anomaly is directly as a result of the application of the provisions of Rule 1313 (FR 22) of Indian Railway Establishment Code, Volume II or any other rule or order regulating pay fixation on such promotion in the revised pay structure :
Provided that if the junior officer was drawing more pay in the existing pay structure than the senior by virtue of any advance increments granted to him, the provisions of this sub-rule shall not be invoked to step up the pay of the senior officer.
(ii) The order relating to re-fixation of the pay of the senior officer in accordance with clause (i) shall be issued under Rule 1321 (FR 27) of Indian Railway Establishment Code, Volume II and the senior officer shall be entitled to the next increment on completion of his required qualifying service with effect from the date of re-fixation of pay.
(11) Subject to the provisions of rule 5, if the pay as fixed in the officiating post under sub-rule (1) is lower than the pay fixed in the substantive post, the former shall be fixed at the same stage as the substantive pay.
8. Fixation of pay of employees appointed by direct recruitment on or after 1st day of January, 2016: – The pay of employees appointed by direct recruitment on or after 1st day of January, 2016 shall be fixed at the minimum pay or the first Cell in the Level, applicable to the post to which such employees are appointed :
Provided that where the existing pay of such employee appointed on or after 1st day of January, 2016 and before the date of notification of these rules, has already been fixed in the existing pay structure and if his existing emoluments happen to exceed the minimum pay or the first Cell in the Level, as applicable to the post to which he is appointed on or after 1st day of January, 2016, such difference shall be paid as personal pay to be absorbed in future increments in pay.
9. Increments in Pay Matrix: – The increment shall be as specified in the vertical Cells of the applicable Level in the Pay Matrix.
Illustration:
An employee in the Basic Pay of 32300 in Level 4 will move vertically down the same Level in the cells and on grant of increment, his basic pay will be 33300.

10. Date of next increment in the revised pay structure: – (1) There shall be two dates for grant of increment namely, 1st January and 1st July of every year, instead of existing date of 1st July:Provided that an employee shall be entitled to only one annual increment either on 1st January or 1st July depending on the date of his appointment, promotion or grant of financial upgradation.

(2) The increment in respect of an employee appointed or promoted or granted financial upgradation including upgradation under Modified Assured Career Progression Scheme (MACPS) during the period between the 2nd day of January and 1st day of July (both inclusive) shall be granted on 1st day of January and the increment in respect of an employee appointed or promoted or granted financial upgradation including upgradation under MACPS during the period between the 2nd day of July and 1st day of January (both inclusive) shall be granted on 1st day of July.

Illustration:

(a) In case of an employee appointed or promoted in the normal hierarchy or under MACPS during the period between the 2nd day of July, 2016 and the 1st day of January, 2017, the first increment shall accrue on the 1st day of July, 2017 and thereafter it shall accrue after one year on annual basis.

(b) In case of an employee appointed or promoted in the normal hierarchy or under MACPS during the period between 2nd day of January, 2016 and 1st day of July, 2016, who did not draw any increment on 1st day of July, 2016, the next increment shall accrue on 1st day of January, 2017 and thereafter it shall accrue after one year on annual basis:

Provided that in the case of employees whose pay in the revised pay structure has been fixed as on 1st day of January, 2016 the next increment in the Level in which the pay was so fixed as on 1st day of January, 2016 shall accrue on 1st day of July, 2016:
Provided further that the next increment after drawal of increment on 1st day of July, 2016 shall accrue on 1st day of July, 2017.

(3) Where two existing Grades in hierarchy are merged and the junior Railway servant in the lower Grade happens to draw more pay in the corresponding Level in the revised pay structure than the pay of the senior Railway servant, the pay of the senior Railway servant shall be stepped up to that of his junior from the same date and he shall draw next increment in accordance with this rule.
11. Revision of pay from a date subsequent to 1st day of January, 2016:– Where a Railway servant who continues to draw his pay in the existing pay structure is brought over to the revised pay structure from a date later than 1st day of January, 2016, his pay in the revised pay structure shall be fixed in the manner prescribed in accordance with clause (A) of sub-rule (1) of rule 7.
12. Pay protection to officers on Central deputation under Central Staffing Scheme:-If the pay of the officers posted on deputation to the Central Government under Central Staffing Scheme, after fixation in the revised pay structure either under these rules or as per the instructions regulating such fixation of pay on the post to which they are appointed on deputation, happens to be lower than the pay these officers would have been entitled to, had they been in their parent cadre and would have drawn that pay but for the Central deputation, such difference in the pay shall be protected in the form of Personal Pay with effect from the date of notification of these rules.
13. Fixation of pay on promotion on or after 1st day of January, 2016.-The fixation of pay in case of promotion from one Level to another in the revised pay structure shall be made in the following manner, namely:-
(i) One increment shall be given in the Level from which the employee is promoted and he shall be placed at a Cell equal to the figure so arrived at in the Level of the post to which promoted and if no such Cell is available in the Level to which promoted, he shall be placed at the next higher Cell in that Level.

(ii) In the case of Railway servants receiving Non Practicing Allowance, their basic pay plus Non Practicing Allowance shall not exceed the average of basic pay of the revised scale applicable to the Apex Level and the level of the Cabinet Secretary.

14. Mode of payment of arrears of pay:-The arrears shall be paid during the Financial Year 2016-2017.
Explanation.-For the purpose of this rule, “arrears of pay” in r elation to a Railway servant, means the difference between-
(i) the aggregate of the pay and dearness allowance to which he is entitled on account of the revision of his pay under these rules for the period effective from the 1st day of January, 2016; and
(ii) the aggregate of the pay and dearness allowance to which he would have been entitled (whether such pay and dearness allowance had been received or not) for that period had his pay and allowances not been so revised.

15. Overriding effect of Rules.-The provisions of the Railway Fundamental Rules, the Railway Services (Revision of Pay) Rules, 1947, the Railway Services (Authorised Pay) Rules, 1960, the Railway Services (Revised Pay) Rules, 1973, the Railway Services (Revised Pay) Rules, 1986, the Railway Services (Revised Pay) Rules, 1997 and the Railway Services (Revised Pay) Rules, 2008 shall not save as otherwise provided in these rules, apply to cases where pay is regulated under these rules, to the extent they are inconsistent with these rules.
16. Power to relax.-Where the President is satisfied that the operation of all or any of the provisions of these rules causes undue hardship in any particular case, he may, by order, dispense with or relax the requirements of that rule to such extent and subject to such conditions as he may consider necessary for dealing with the case in a just and equitable manner.

17. Interpretation.– If any question arises relating to the interpretation of any of the provisions of these Rules, it shall be referred to the Railway Board for decision.

MEMORANDUM EXPLANATORY TO THE RAILWAY SERVICES (REVISED PAY) RULES, 2016
Rule 1 – This rule is self-explanatory.
Rule 2 – This rule lays down the categories of employees to whom the rules apply. Except for the categories excluded under sub-rule (2), the rules are applicable to all persons under the rule making control of the President serving under the administrative control of the Railway Board.
Rule 3 & 4 – These rules are self-explanatory.
Rule 5– The intention is that all Railway servants should be brought over to the revised pay structure except those who elect existing pay structure. The Railway Servants who exercise the option to continue in the existing pay structure will continue to draw the dearness allowance at the rates in force on 1st January, 2016. If a Railway servant is holding permanent post in a substantive capacity and officiating in a higher post, or would have officiated in one or more posts but for his being on deputation etc., he has the option to retain the existing pay structure only in respect of one scale. Such a Railway servant may retain the existing scale applicable to a permanent post or any one of the officiating posts. In respect of the remaining posts he will necessarily have to be brought over to the revised pay structure.
Rule 6 – This rule prescribes the manner in which option has to be exercised and also the authority who shall be apprised of such option. The option has to be exercised in the form appended to the rules. It should be noted that it is not sufficient for a Railway servant to exercise the option within the specified time limit but also to ensure that it reaches the prescribed authority within the time limit. In the case of persons who are outside India at the time of notification of these rules, the period within which the option has to be exercised is three months from the date they take over charge of the post in India. In the case of Railway servants the revised pay structure of whose posts are announced subsequent to the date of issue of these rules, the period of three months will run from the date of such announcement.
Persons who have retired between 1st January, 2016 and the date of notification of these rules are also eligible to exercise option.
Rule 7 – This rule deals with the actual fixation of pay in the revised pay structure on 1st January, 2016 and is self explanatory. The benefit of this rule is not admissible in cases where a Railway servant has elected the revised pay structure in respect of his substantive post, but has retained the existing scale in respect of an officiating post.
Rule 8 – This Rule prescribes the method of fixation of pay of employees appointed on direct recruitment on or after 1st day of January, 2016.
Rule 9 & 10 – These rules prescribe the manner in which the next increment in the new pay structure shall be regulated.
Rule 11 to 17 – These rules are self-explanatory.
