Cabinet approves Cadre review of Posts & Telegraphs Building Works Service (P&T BWS), Group A

The Union Cabinet Chaired by the Prime Minister Shri Narendra Modi approved the Cadre Review of Posts & Telegraphs Building Works Service, Group 'A'.

The number of Duty posts was fixed as 105. The approval would result in strengthening of the cadre structure both at the headquarters and in the field units of Department of Telecommunications and Department of Posts on the basis of functional requirements. This will reduce the existing stagnation of P&T BWS officers. It was also decided that there will be no fresh recruitment into the Cadre, and the cadre will be phased out in such a manner that there is no adverse impact on the incumbents.

Background:
The Posts & Telegraphs Building Works Service (P&T BWS), Group A, was constituted in 1990 as an organized Group A service. The service comprises of three wings - Civil, Electrical and Architecture - and caters to the Department of Telecommunications (DoT) and Department of Posts (DoP). Selected through Combined Engineering Services Examination conducted by Union Public Service Commission, the officers of P&T BWS are working in management and administrative positions in the Department of Telecommunications (DoT), Department of Posts (DoP), PSUs of DoT, and also on deputation in other Central Ministries/ Departments/ Autonomous Bodies and State Governments. Since the inception of the service in 1990, no cadre review of the Service has been done so far and is long overdue.

Formation of BSNL had affected the functions as well as cadre strength of the service with absorption of various officers in BSNL. After the transfer of telecom operations, service and functions of DoT to BSNL, the P&T BWS is left with the responsibility for maintenance of assets of DoT and DoP, handling of new projects, inspection of electro mechanical installations as per Central Electricity Authority Regulations, 2010, formulation of guidelines, standards and specifications for Telecom Installations, ensuring implementation of green initiatives, monitoring of EMF radiations etc. for the entire ambit of Telecom sector, both public and private, and to meet the building infrastructure needs of Department of Telecommunications and Department of Posts.

These facts coupled with the stagnation in various grades of the service necessitated a review of the structure of P&T BWS. Accordingly, a cadre structure of P&T BWS officers was approved, which is considered essential for discharge of the role & obligations of the Department of Telecommunications and Department of Posts.

The Cadre Strength was restricted to the present working strength of the cadre, and the cadre review would entail no fresh financial commitment for Government.

Cabinet approves Cadre Review of 8 organized Group 'A' Services in Railways

The Union Cabinet, chaired by the Prime Minister Narendra Modi has approved the proposal for Cadre Review of 8 organized Group 'A' Services in Railways namely Indian Railway Accounts Service (IRAS), Indian Railway Personnel Service (IRPS), Indian Railway Traffic Service (IRTS), Indian Railway Service of Engineers (IRSE), Indian Railway Service of Electrical Engineers (IRSEE), Indian Railway Service of Mechanical Engineers (IRSME), Indian Railway Stores Service (IRSS), Indian Railway Service of Signal Engineers (IRSSE).

Cabinet has also approved encadrement of the post of Member (staff) a cadre post for IRPS and re-designation of the posts of Director General (Signal & Telecom), Director General (Stores) and Director General (Safety) as Member(S&T), Member (Materials Management) as Director General (Safety) respectively.

This Cadre Review was pending since 2012 and will benefit 900 officers of these services.

Reference is invited to MoD letter no. 76002/1St CR/BS Cadre/CSCC/23(l)/2017/D(W-II) dated 15.12.2017 and letter dated 10.05.2018.

2. During Inter Ministerial consultation regarding the Post of Joint DG (Resources), DoPT have noted some procedural and other discrepancies and stated as under
(i) The proposal of BS Cadre does not specifically mention the cadre as organised Group 'A' Cadre. However, the proposal has been finalized in a manner that it contains attributes of organised Group 'A' service such as DR element at JTS to the extent of 50%, all standard grade of Group 'A' Service upto SAG, making all the posts above JTS promotional, provision of 30% NFSG and mention of NFU, As such, the proposal tantamount to formation of an Organised Group 'A' service.

(ii) As per procedural requirements, for formation of a Service as Group 'A' Cadre/Group 'A' Service/Organised ' Service, the cadre review guidelines issued by the DoPT on 14/12/2010 are applicable. Proposals for formation of a Service as Group 'A' Cadre/Group 'A' Service/Organised Services are to be placed. before the Cadre Review Committee (CRC) headed by Cabinet Secretary with Secretary (Personnel), Secretary (Expenditure), Secretary (Administrative Department) and the Senior Most Member of the service concerned as Members. Based on the recommendations of CRC, approval of MoS (PP) and Finance Minister is obtained and subsequently the proposal is submitted for approval of the cabinet. The above, procedure has not been completed in the Cadre Review of Barracks and Store Cadre and the sanction letter has been issued only on the basis of approval of Deptt. of Expenditure.

(iii) The Cadre Review for Barrack and Stores cadre may also have serious implication on. the concept of organized Group 'A' Service/ Group 'A' Service/ NFU/NFSG etc. and various court cases on the matter of organized status/NFU/extension of 30% NFSG etc.

(iv) Accordingly, MoD's letter dated 15/ 12/2017 needs to be immediately withdrawal/kept on hold wrt Group 'A' cadre till the approval of the competent authority (i.e Cabinet) on the Cadre Review/formation of Group 'A' Cadre/Group 'A' service/organized status. The procedure as per Cadre Review guidelines issued by the DoPT on 14/12/2010 needs to be followed and proposal submitted to DoPT along with all necessary details. However, if it is intended to retain the cadre as Group 'B'/Group 'C' and not as Group 'A', the proposal may be revisited accordingly in consultation with DoE and while revisiting the provisions of DR element at JTS, 30% NFSG, NFU etc. which are characteristic/attributes of organized Group 'A' service may be withdrawn.
3. E-in-C's Branch is requested to review the Cadre Review proposal and resubmit the file in the light of DoPT instructions whether they intend to retain the cadre as Group 'B'/ Group 'C' or intend to create an Organised Group 'A' service. Based on the inputs, the proposal will be resubmitted to DoE if it is decided to retain the Cadre as Group 'B'/Group 'C' or will be taken up with DoPT as per the guidelines if the intention is to create an Organised Gr 'A' Service.

4. Further, E-in-C's Branch is requested to keep the Pay and Allowances of Barrack and Stores Cadre (BSO and above) in abeyance in light of the DoPT instructions till finalization of the case and in case pay fixation of the posts (BSO and above) have been carried out immediate steps may be taken to withdraw the same.

Sub: Calendar for Cadre Review of Central Group 'A' Services

The undersigned is directed to say that in terms of this Department's OM No. I. 11011/1/1009-CRD dated 14/12/2010 the ideal periodicity of cadre review is 5 years. Despite the said instructions and repeated reminders, it has been observed that the said periodicity is not followed. The cadre review in some cases is pending for even more than 40 years.

2. In view of the above, this Department has prepared a calendar (Annexure) for cadre review of the Central group 'A' Services, which is required to be followed by the Cadre Controlling Authorities (CCA) strictly. The months and year mentioned in the calendar is the time frame by which the cadre review proposal should be submitted by the Cadre Controlling Authorities to DoPT positively.

3. All the CCAs are therefore requested to submit cadre review proposals in accordance with the calendar without any exemption. For other service which have not been mentioned in the calendar and the cadre review is not due, the Cadre Controlling Authority concerned may submit their proposal in accordance with the Cadre Review Guidelines, as and when they feel that the cadre review is required.

4. Any proposal for addition in cadre strength of Central Group 'A' Services (Creation, encadrement, upgradation, merger etc.) must be routed through DoPT as reiterated in this Department's OM No. I. 11019/17/2016- CRD dated 15/2/2017.

(a) whether his Ministry has finalised draft rules regarding minimum standards for clinical laboratories, framed under Clinical Establishments Act, 2010, if so, the details thereof;

(b) whether his Ministry is aware that presently most of the work of clinical and research laboratories of even prestigious department i.e. ICMR and Central Government Hospitals is performed and supervised by professionally qualified and technically competent BSc, MSc, PhD medical laboratory professional in lab sciences who are not MBBS/MD, if so, the details thereof;

(c) whether the cadre review of medical laboratory staff approved earlier has not been implemented in complete manner so far and most of issues like pay fixation, DPC, MACP, revision of recruitment rules, filling of vacant promotional posts are still pending, if so, the details thereof and the reasons therefor;

(d) whether his Ministry has not issued any order till date regarding grant of Patient Care Allowance/Hospital Patient Care Allowance (PCA/HPCA) to health employees as per the accepted recommendations of Seventh Central Pay Commission and if so, the details thereof and the reasons therefor; and

(e) whether his Ministry has also approved the short term certificate courses/ programmes which are neither formal degree nor diploma in allied health sciences and run under the aegis of Ministry of Skill Development and are very contrary to the core curricula designed by his Ministry in terms of course content and duration of courses etc., if so, the reaction of the Government thereto?

ANSWER

THE MINISTER OF STATE IN THE MINISTRY OF HEALTH AND FAMILY WELFARE (SMT. ANUPRIYA PATEL)

(a): Yes. The draft notification to amend the Clinical Establishments (Central Government) Rules, 2012 regarding minimum standards of medical diagnostic laboratories is available on the website of Clinical Establishment Act <clinicalestablishments.gov.in>.

(b): As per the information received from ICMR most of the work of clinical and research laboratories is performed and supervised by professionally qualified and technically competent technical staff and Scientists having B.Sc, M.Sc, Ph.D and MBBS, MD qualification.
As far as Central Government hospitals in Delhi viz. Safdarjung Hospital and Lady Hardinge Medical College & Associated Hospitals are concerned, all the diagnostic work is performed and supervised by professionally qualified and technically competent MBBD/MD professionals.

(c): The cadre of the Medical Laboratory Staff of Central Government Hospitals in Delhi namely Safdarjung, Dr. RML and Lady Hardinge Medical College & Associated Hospitals has already been restructured and implemented by giving benefits of 7th Central Pay Commission.

(d): The order containing condition for payment of HPCA/PCA after implementation of Seventh Central Pay Commission has not been issued so far. The matter is under consideration in this Ministry in consultation with Ministry of Finance.

(e): This Ministry has developed a course curricula for short term skill training. The National Skill Qualification Framework (NSQF) level of the skill development curricula is kept lower than the level of Diploma and Degree in core allied health courses developed by this Ministry. A skilled worker will only reach the higher levels after acquiring adequate qualification (either Diploma or Degree) through an accredited institute/university. There are no contradictions in the short term courses as compared to the core curricula developed by the Ministry.

(b) if so, the details thereof;

Cabinet approves conferment of Central Group 'A' Service and Cadre Review of Group 'A' Executive Officers of Sashastra Seema Bal

The Union Cabinet chaired by Prime Minister Shri Narendra Modi has approved conferment of Central Group 'A' Service and Cadre. Review of Group 'A' Executive Officers of Sashastra Seema Bal (SSB) with net creation of 19 posts of various ranks from Assistant Commandant to Inspector General ranks to enhance the operational and administrative capabilities of SSB.

Increase of existing structure of Group 'A' posts from 1253 to 1272 posts are as follows:
  1. Increase of 2 posts of Inspector General (SAG level).  
  2. Net increase of 11 posts of DIG /Commandant (JAG level)
  3. Increase of 2 posts of DC (STS level).
  4. Increase of 4 posts of AC (JTS level).
Background:

The SSB was set up in 1963 to inculcate a sense of security, promoting national awareness and security consciousness in the border population. After transfer to MHA in 2001, it has been entrusted to guard Indo-Nepal and Indo-Bhutan Borders. SSB also deployed in LWE affected areas and Counter Intelligence/Operations duties in Jammu & Kashmir and Assam. The present sanctioned strength of the Force is 96,093 having 73 Bns (including 2 NDRF Battalions). Earlier augmentation- cum-structuring exercises were taken in 2005, 2010 and 2011.

The Union Cabinet, chaired by the Prime Minister Shri Narendra Modi, has approved the Cadre Review of Group 'A' Executive officers of BSF with net creation of 74 posts of various ranks from Assistant Commandant to Additional DG ranks to enhance the operational and administrative capabilities of BSF.

Increase of existing structure of Group 'A' posts from 4109 to 4183 posts are as follows:
1. Increase of one post of Additional DG (HAG level).
2. Net increase of 19 posts of Inspector General (SAG level).
3. Net increase of 370 posts of DIG/Commandant/2 1C (JAG level).
4. Net increase of 14 posts of Assistant Commandant (JTS level).
5. Net reduction of 330 posts of Deputy Commandant (STS level).
Background:
The BSF is the largest border guarding force established in 1965. The present sanctioned strength of the Force is 2,57,025 having 186 Battalions (including 03 NDRF Battalions). Of these the Executive Group 'A' cadre has sanctioned strength of 4065 officers (4109 including the IPS quota). About 90% of the troops are deployed in Indo-Pakistan Border, Indo-Bangladesh Border (including North East) and Left Wing Extremism (LWE) States. The last cadre review of the service was done in 1990.

We have been directed to refer our letter No: AICAEA/HQ/A-2/2016/417 dated 17th April, 2016 on the subject mentioned above and state that the employees are totally aggrieved for non-settlement of their grievances for more than one and a half years.

Moreover, large numbers of the issues that were discussed in the meeting held between the official side of CGA office and the National Executive of All India Civil Accounts employees Association under your Chairpersonship on 6th November 2015 are yet to be settled. Further, it was stated in the said meeting that the

“Ministry of Finance, Department of Expenditure has returned the Cadre Review proposal of Group ‘B’ & ‘C’ cadres of CCAS with the remarks that proposal may be re-examined in terms of instructions contained in their O.M. NO. 5(3)/E.III/97 dated 07.01.1999 and No. 7(1)/E.Coord/2014 dated 29.10.2014. DoE has also informed that the revision of pay in respect of Civil Accounts Employees will not be done in isolation and the same may be viewed and examined in the larger context of Organized Accounts Service as a whole. Therefore, the matter will be examined by DoE, MoF, in a holistic manner keeping in view the recommendations of 7th Pay Commission as well. The Association was therefore asked to wait for the 7th Pay Commission recommendation and the decision of the Government.”


But, we would like to bring the following facts to your kind information –

1. Pending implementation of 7CPC recommendations, the Ministry of Finance has accorded approval to the Cadre Review proposals of the Department of Posts.

2. The C&AG has made his recommendations to the Government for cadre review/ cadre restructuring/ amendments in the Recruitment Rules.

Hence, in view of these facts and as per the DOPT instructions, cadre review of the Gr. B & C employees of Civil Accounts Employees, which should have been done much earlier and before the cadre review of the Gr “A” cadres of Civil Accounts organization was done in 2012-13, needs to be initiated immediately in consultation with the Associations.

Apart from the above, the employees and officers of Civil Accounts organization are yet to learn about the recommendations given by the Controller General of Accounts to the Empowered Committee constituted by the Government for implementing the recommendations of 7CPC.

Therefore, for the purpose of review of the status of the issues discussed on 6th November 20159 (including the issue of Cadre Review) and to be appraised about the recommendations given by the Controller General of Accounts to the Empowered Committee constituted, our National Executive Members wish to meet you on 10th June 2016. We shall be thankful if you kindly accept our proposal and make it convenient to meet us on the proposed date. Time of the meeting may kindly be intimated to us at an early date please.

It may kindly be noted that the issues for discussion in the meeting will be the items forwarded by us through our letter dated 17th April, 2016.

Cabinet gives ex-post facto approval to the cadre review of Indian Postal Service (IPoS)

The Union Cabinet chaired by the Prime Minister Shri Narendra Modi today granted ex-post facto approval to the proposal for undertaking cadre review of the Indian Postal Service.

The cadre review will enable the Department of Posts to meet the functional requirements and strengthening the cadre structure both in the headquarters and in the field on the basis of functional requirement, which will provide more avenues to earn review and respond effectively to the customer needs, reduce the existing stagnation and improve the career prospects of Indian Postal Service officers.

The proposal will be implemented through measures that include creation of a post of DG(Postal Operations) in the Apex scale, creation of post of Additional DG(Coordination) in the HAG+ scale, one post in HAG level, 5 posts in SAG level and 4 posts at the JAG level, and also increase of 84 posts at JTS level by down-grading from STS and overall decreasing STS posts by 96 for adjustment of new posts proposed to be created, without any overall change in the total number of posts in the cadre.

For undertaking the above exercise, necessary consultations on the CRC recommendations with Ministry of Finance and the Ministry of Personnel, Public Grievances & Pensions have been duly completed. The Department of Expenditure have conveyed their ‘no objection’ to the proposal.

22. Central Engineering Service (Roads) The Proposal was received on 24.04.2014 but lacked many essential information. Clarifications were sought from MoRTH, and based on reply received on 16.10.2014 a revised structure was proposed and sent to MoRTH for their comments. Reply from MoRTH is awaited.

1. In all the remaining cadres, letters have been written to the Cadre Controlling Authorities to send the cadre review proposals for the services/cadres pertaining to their departments.
2. By letter dated 20th April 2015 suggestions have been invited from the cadre Controlling Authorities on Cadre Review on email id singh.mona@nic.in

1.   Cadre Review

Cadre Review in the Civil Accounts Organization on functional requirements and grant of appropriate Pay & Grade pay to different cadres.

a.     Accounts Assistant (by upgradation of post of LDCs ) – Grade Pay Rs. 2400/- PB 1

b.     Staff Car Driver Gr. II – Grade Pay Rs. 2400/- PB 1

c.       Stenographer Gr. III  –  Grade Pay Rs. 2800/- PB 1

d.     Accountant -20%, DEO Grade A and Junior Hindi Translator (converting as Accountant) –  Grade Pay Rs. 4200/- PB 2

e.     Sr. Accountant – 80%, Data Entry Operator Grade B/ Hindi Translator (Converting as Sr. Accountant) Stenographer Gr. I (Merged post of Gr.II & I) –  Grade Pay Rs. 4600/-PB 2

f.       Sr. Accountant- on completion of 4 years/Computer Operator –  Grade Pay Rs. 4800/-PB 2

have been allocated against Joint Secretaries and equivalent level officers in different Ministries/Departments participating in CSSS on functional jurisdiction

j. Restoration of 5% promotional quota to the post of LDC for Gr-D/MTS and clearing of backlog by promoting all eligible MTS to the grade of Accounts Assistant as a onetime measure.

2.  Formation of independent Department Of Accounts under CGA.

3. Filling up of vacant posts – regularization of contract /outsourced workers as per orders dated 23-01-2013 issued by Ministry of Labour – grant of minimum wage to those who are working against regular posts.

4. Grant of recognition to AICAEA CAT-II, NFCAA and implementation of check-off-system as per Government instructions.

5. Adoption of mutually agreed transfer policy for AAOs and implementation of the policy transparently and filling up of vacant posts by providing promotions to Civil Accounts Employees.

6. Provision of alternative accommodation and amenities to the Central Office of AICAEA.

7.  Imparting training and grant of incentive for implementation of e-payment system.

8. Removal of discrimination in the date of effect of Promotion and grant of date of effect of promotion from 1st January of the year to all cadres.

9. Allotment of one seat in the National Council,(JCM) and 2nd seat in Departmental Council(JCM) to All India Civil Accounts Employees Association.

10. Counting of service for Grant of benefit of II ACP to Sr. Accountant appointed as Accountant-
(a)  from the date passing departmental competitive examination conducted by SSC.
(b) from  the 1st July of the next year of passing open examination conducted by SSC as per orders of DOPT and MHA

11. Grant Pay Scale of Rs. 1350-2200 from 01.01.86 to DEOs as has been granted by the Defence Accounts Department as well as in terms of the CAT judgments.

12. Removal of injustice to newly recruited Accountant in the matter of granting 1st increment through rectification of the procedure of Departmental Confirmatory test and also imparting training to the candidates.

13. Grant of two financial up gradation to MTS under ACP scheme who had completed 24 years of service before implementation of MACP Scheme as has done by the O/o the Pr. of Audit and Director, Economic service Ministries, Delhi vide order No:- AMG.I/Admn-1/32 dated 24.06.2014 .

14. Grant of Headquarter allowance to Sr.PS/PS/Stenos posted in office of CGA.

15. Removal of anomaly in grade pay arisen in PAO, CRPF after amalgamation of the office in Civil Accounts Organization.

16. As per decision of Supreme Court, payment of arrears in cash from 01.01.1996 to 18-02-2003 to Sr. Accountants due to upgradation of pay scale from 1-1-1996 .

17. Decentralization of CPAO and formation of regional offices to make the very purpose of operation of Pension Accounting Offices effective and conveniently accessible to old aged Pensioners.

18. Relaxation for revision of option for fixation of pay in the revised pay structure for persons promoted to the grade of Asstt. Accounts Officer (AAO) after 01.01.2006.

19. As has been done in earlier occasions and granted by Defence Accounts Department, Grant of honorarium for checking of pay fixation cases and pension cases after implementation of 6th CPC recommendations.

20.  No redeployment of retired officers and employees in the Civil Accounts Organization.

4. Indian Statistical Service Approval of MoS (PP) and FM has been conveyed to Ministry of Statistics & Programme Implementation for taking Cabinet approval.
