Sub : Forwarding of one-way own request transfer applications to other Divisions/Railways.

It has come to the notice of Board that a large number of inter-Railway/inter-Division one-way transfer requests are being forwarded by some of the Zonal Railways for NOCs without assessing the feasibility of relieving such staff on receipt of NOC.

This causes unnecessary building up of expectations regarding their imminent sparing among such employees puts avoidable pressure on the Railway administration.

2. Considering the above, Railways may ensure that henceforth only such Inter-Railway transfers requests be forwarded where there is reasonable possibility of relief in case of acceptance by the railway to which transfer is sought.

While doing so, various factors like number of staff likely to be inducted in the cadre by way of departmental promotions/Inter-Divisional/Inter-Railway Transfer from other Railways/Divisions and through RRB indents should be kept in view so that once NOC is received, the concerned employee can be relieved early.

This issues with the approval of Board (MS).

Sub: Posting of husband and wife at the same station.

Attention is invited to Board’s letter No. E(NG)I-2009!TR/29 dated 02.02.2010 which contains detailed guidelines governing the posting of spouses at the same station . Earlier, some Zonal Railways had raised doubts about the ambiguity caused by the term “all India service” appearing in parenthesis in the Sub-heading/title of Para 3(e) of Board’s letter ibid. AIRF has also recently drawn Board’s attention to this and pointed out that this is causing confusion as regards applicability of the guidelines to Railway Servants.

The matter has accordingly been carefully considered by Board. The guidelines dated 02.02.2010 were issued in the context of at least one of the spouses being a Railway Servant. To remove any ambiguity/confusion regarding its applicability, it has been decided that the phrase “all India service” appearing in parenthesis in the title of para 3(e) of Board’s letter ibid should be treated as deleted. All other content of the said letter ‘remains unchanged.

Sub: Availability of option for fixation of pay on promotion from the Date of Next Increment (DNI) in lower post and method of fixation of pay from DNI, if opted for, in context of RS(RP) Rules,2016.

Ref: NFIR’s letter No.1/2/Part IV dated 13.11.2018.

Please refer to NFIR’s letter quoted above requesting Board to give 90 days’ time for exercise of option for fixation of pay on DNI instead of ‘one month’ period as circulated vide Board’s letter RBE No. 142/2018 dated 20.09.2018 from the date of issue of these orders on the ground that these orders have not been circulated by the Zonal Railways and the Divisions to field units with the result that the staff are unable to exercise option in time.

With respect to above, it is stated that general instructions relating to revised pay structure which are applicable to all central government employees issued by Ministry of Finance (MoF) are adopted in Railways in mutatis mutandis manner. The letter under question was also uploaded on Board’s website on date itself and also circulated amongst all concerned including Zonal Railways/Production Units, Board’s branches, Members of the Staff Council, NFIR, AIRF and other, staff associations. Federation may appreciate that MoF’s circulars/orders already remains in circulation before adopted in Railways, as such Railway employees have even more time to go through such circulars/orders in comparison to other central government employees. Further, no Railway has made any reference bringing on record delayed circulation in this regard.

In view of the above, unilateral deviation from MoF’s stipulation is not feasible.

Revised Subscription Rates of Railway Employees Liberalized Health Scheme as per 7th CPC Pay Matrix

The Railway Board has decided to revise the subscription rates of Railway Employees Liberalized Health Scheme (RELHS) as per the Pay Matrix Level recommended by the 7th Pay Commission.
Following the subscription calculation method of CGHS for Central Government Employees and Pensioners, the Railway Board has now decided and published the revised subscription rates for all the group of Railway employees through its official portal.

On 9th January, 2017 the Health Ministry published the new rates of monthly subscription for availing the CGHS facility. The Central Government Pensioners have an option to get their CGHS Pensioners Card by either making CGHS contribution on an annual basis (12 Months) or by making contribution for 10 years for life time validity.

The rate of contribution to join RELHS shall be last month’s basic pay drawn or the subscription rate indicated in the above table at different levels as per the 7th Pay Commission whichever is lower.

Sub: Revised travel entitlements on Duty Passes, Privilege Passes and Post Retirement Complimentary Passes (PRCP).

Consequent to implementation of 7th CPC’s recommendations and notification of Railway Services (Revised Pay) Rules - 2016 (RSPR) w.e.f. 01.01.2016, the matter regarding linking of travel entitlements on Duty Passes, Privilege Passes/PTOs and PRCP with the ‘Pay Level in Pay Matrix’ (PLPM) has been examined in consultation with Commercial and Finance Dtes. The Competent Authority has accorded his approval for. the revised travel entitlements on status (i.e. Gazetted/Non-gazetted) cum PLPM basis as indicated in Annexure-I (for Duty Pass) and Annexure-II (for Privilege Pass/PRCP).

2. In all other respects, the extant provisions of Railway Servants (Pass) Rules, 1986 (Second Edition-1993) will continue to apply.

3. The revised travel entitlements would take effect from 01.01.2016. Accordingly, PRCP/Widow Pass travel entitlement of the railway servants retired/deceased in the interregnum shall be re-fixed by the Pass Issuing Authorities.

4. This issues with the concurrence of the Finance Directorate of Ministry of Railways.

Sub: Issuance of Special Passes on Medical grounds for follow-up medical treatment in outstation Hospitals.

It has been brought to the notice of Board that difficulties are being faced by serving/retired railway employees & their family members due to the present practice or issuing of Special Passes on medical grounds for follow-up medical treatment. Such passes are being issued just a few days before the due date of visit to specialized hospitals located in outstations. Due to this practice, the beneficiaries of such Special Passes are unable to secure confirmed advance reservation.

2. The matter has been examined in consultation with Health Dte. of the Ministry of Railways. Keeping in view the fact that the beneficiaries of such passes are normally those who are suffering from serious ailments like cancer, renal failure, heart ailments, etc. and in order to facilitate securing of advance reservation for them, it has been decided to stipulate the following procedure for issuing of Special Passes [under Schedule VII of Railway Servants (Pass) Rules, 1986 (Second Edition 1993) for follow-up medical treatment:-
(i) The Competent Medical Officer in the Railway Hospital will issue necessary prescription on the basis of follow-up visit advice recorded by the outstation Hospital, as and when approached by the beneficiary, without waiting for the due date for follow-up visit to come nearer. In the said prescription, the period of travel validity (which is to be endorsed on the pass) must be indicated clearly, which shall be one week i.e. 7 days before and 21 days after the clue date of visit. For example, If a beneficiary has to reach a Hospital in Mumbai for follow-up treatment on 8th December 2018, the Medical Officer concerned should write in the prescription: "Special Pass valid for travel from 1st Dec, 2018 to 29th Dcc, 2018 may be issued."

(ii) The PASS Issuing Authorities, on the basis of Aforementioned prescription and recommendation will issue Special Pass upto 5 months in advance endorsing thereon the travel validity period as "Valid for travel from __/__/_____ to __/__/_____" (i.e. the dates as recommended in the prescription).
3. Moreover, representations are also being received in Board's office. from the beneficiaries of Special Passes issued on medical grounds complaining of delays in issue of such passes. In this context, the Railways are directed to sensitize the concerned pass issuing officials to issue the Special Passes on medical grounds on the very same day of receipt-of the application in case of serious ailments and at the most, next day in all other cases.

Sub: Reiteration of GP 4800/5400 (level-8/level-9) as apex promotional grade in stenographers cadre in Field offices (including Zonal Railways) as per extant provisions.

Proposals are being received from Railways/ Production Units for upgradation of Stenographers cadre by granting GP 6600/- in PB-3 (6th CPC scales) to senior PSs-I in the Railway/ Unit.
2. In above context, it is hereby clarified that in terms of the extant rules/position such a grade in GP Rs.6600/- is not available/ sanctioned in the category of Stenographers on zonal Railways (Field Offices). Further, based on the recommendations of Pay Commissions and decisions of the Government/Railway Board, there is no provision for a grade in pay structure higher than GP Rs.4800/5400 (Level 8/Level 9) in field offices including zonal Railways. Any local Office Order wherever issued by any Railway contrary to this established position is irregular and is to be withdrawn immediately under intimation to this office.

Consequent to implementation of recommendations of 7th CPC, various references have been received from Zonal Railways regarding admissibility of Charge Allowance in the CPC pay structure and grant of benefits like DA, HRA etc. on the same.

2. In this context, it is informed that the issue of admissibility of Charge Allowance in 7th CPC pay structure is presently under examination in Department of Personnel and Training.

3. In view of the same, it is informed that any clarifications regarding Charge Allowance can only be issued by Board's office once guidelines in this matter are issued by DoPT.

Sub: Issue of 2 sets of Post Retirement Complimentary Passes (PRCP) to Group 'D' employees retired on or after 01.01.2006.

The demand for issuance of 2 sets of PRCPs to the staff retired as Group 'D' before their reclassification as Group 'C' was raised by staff side in the DC/JCM Meeting (Item No.18/2012) and also by AIRF in PNM Meeting (Item No.38/2016) with Board.

2. The issue has been examined in detail and in order to bring uniformity in cases of all those employees who retired on or after 01.01 .2006 i.e. whether classified as Group 'C' or retired as Group 'D', it has been decided with the approval of the Competent Authority to amend the relevant provisions of extant Pass Rules. Accordingly, PRCP entitlement stipulated under Columns 1 and 2 of Schedule-IV (Post Retirement Complimentary Passes) of the Railway Servants (Pass) Rules, 1986 (Second Edition -1993) is amended as follows:-

3. Accordingly, PRCPs/Widow Passes, as per revised entitlement, shall be admissible to the employees retired/deceased on or after 01 .01.2006. However, higher number of PRCPs/Widow Passes, as per revised entitlement, will be issued from the current calendar year only. The number of sets of PRCP/Widow Passes in case of employees retired/deceased before 01.01.2006 shall continue to be the same as prevalent at that time.

2. Now Ministry of personnel, Public Grievances and Pensions, Department of personnel & Training vide their 0M No.13/02/2017-Estt.(Pay-I) dated 28.08.2018 has clarified various aspects of their earlier 0M. The clarifications issued by DoP&T shall be applicable mutatis mutandis in Railways with respect to RS(RP) Rules, 2016.

3. The 'one month' period mentioned in the aforesaid 0M of DoP&T dated 28.08.2018 under clarification to point of doubt at Sl No.2 shall be month from the date of issue of these instructions.

Railway Board vide their letter cited, have advised to encourage the Railway Employees to enrol themselves for Insurance coverage under Pradhan Mantri Suraksha BimaYojna (PMSBY) and Pradhan Mantri Jeevan Jyoti Bima Yojna Bima Yojna (PMJJBY) to move towards creating a universal social system. The following are the brief details of the Schemes:-

Ref.: Railway Board's letters No.E(LL)/2009/HER/1 dated 17.07.2018 and 02.08.2018

Pursuant to discussions held with AIRF, during the last PNM Meeting, held on 21-22 June, 2018, Railway Board vide their letter No.E(LL)/2009/HER/1 dated 17.07.2018 had issued instructions that, Call Books on Running Staff should be served upon only after completion of 16 hours rest at Headquarters and after completion of 8 hours at outstation.

It is, however, quite unfortunate that, Railway Board vide their subsequent letter dated 02.08.2018 have pended the said instructions till adequate number of Running Staff becomes available to fill-up large-number of existing vacancies. This is gross violation of bilateral negotiated settlement with the federation.

AIRF, therefore, desires that, orders of pending the instructions, issued vide Railway Board’s letter dated ibid dated 17.07.2018 be withdrawn immediately in the larger interest of industrial harmony.

This may be treated as "Most Urgent".

Sub: Direct recruitment from open market in Level-1 (7th CPC pay matrix) - Procedure-regarding.

The non-materialization of full panel despite all out efforts made by the Railway recruiting agencies has been engaging the attention of the Board. Accordingly, the procedure for recruitment from open market in Level-1 was reviewed and following decisions taken with respect to different instructions issued from time to time:-

i) Para I (ii) of instructions contained under RBE No. 138/2014 dated 10.12.2014 lays down that "the number of candidates called for Physical Efficiency Test (PET) should be 02 (two) times the number vacancies".

In modification of above, the number of candidates to be called for PET should now be 03 (three) times the number notified vacancies.

ii) Para 3 of instructions contained in RBE No. 73/2008 dated 17.06.2008 lays down that "the number of candidates called for Document Verification (DV) shall be 20% over & above the number of vacancies".
In modification of above, henceforth, the number of candidates to be called for DV shall be twice the number of notified vacancies.

iii) Para 2 of instructions contained in RBE No. 06/2014 dated 10.01.2014 stipulates that "no replacement panels are to be given against non-joining of selected candidates".

In modification of the above, it has been decided that the panel will now be formed to the extent of the notified vacancies with a standby panel of 50% of the notified vacancies. In case the main panel plus stand-by is also exhausted and still there is a shortfall vis-a-vis notified vacancies, the recruiting agency may further go down in the list of candidates which meet the requirement of minimum qualifying marks in their respective community for conducting PET(If needed) and DV/ME to the extent of shortfall community-wise. This may be done till the demand from the concerned Railway administration w.r.t indent placed and vacancies notified is fully met. These provisions shall be subject to currency of the panel.

2. The above guidelines will also be applicable to recruitment notification published under centralized Employment Notice No. 02/2018, issued by Railway Recruitment Boards.

Sub: Granting promotion opportunity as JE against 25% intermediate Apprentice Quota to those Technicians initially appointed as Technician-III on compassionate grounds - (PNM/ AIRF Item No.25/2011 and PNM/NFIR Item No.38/2015- agenda sent to Railway Board on 11.06.2015) - reg.

The undersigned is directed to refer to Item No.25/2011 of PNMI AIRF and Item N0.38/2015 of PNM/NFIR on the above subject and to state that the matter has been further deliberated upon in the light of the last round of discussion with both the Federations in the respective PNMs. It may be recollected that while AIRF have expressed their reservation on Board's proposal sent to both the Federations for comments vide letter of even number dated 16.03.2015, NFIR have completely rejected the same. In view of this, it was decided that Board's proposal referred to above may be dropped and status-quo may be maintained. The Federation were informed accordingly vide letter of even number dated 28.03.2016.

It is felt that both the Federations should encourage those who are appointed on Compassionate Grounds as Trainee Artisans to appear in RDAT, so that they have a formal qualification, which would be better for their own future also.

Sub: Promotional Avenue of ESMs in S&T Department.
The issue regarding promotional avenue of ESMs in the S&T Department has been under consideration of the Railway Board. The matter has been examined in detail in consultation with the concerned technical directorate and both the Federations, and it has been decided as under:
i) Direct Recruitment to the extent of 33-1 / 3% in Signal Maintainer Grade-II to be discontinued subject to 15% Direct Recruitment quota to be introduced in Signal Maintainer Grade-l. The remaining 85% vacancies in Signal Maintainer Grade I is to be filled by promotion·
ii) The revised qualification for ESM Grade-III should be either (a) Matriculation (i.e. 10th Class) and ITI Certificate in Electronic/ Electrical Fitter/ Wireman Trade or (b) Pass in Plus Two stage with Physics and Maths in Higher Secondary or equivalent.
iii) The educational qualification of direct recruiters at Signal maintainer Grade I level should be pass in B.Sc. ·
iv) On one tlme basis to fill up vacancies of Signal Maintainer Grade-III, the residency period for LDCE should be reduced from 3 years to 2 years.
v) The vacancies in Signal Maintainer Grade-Til may be calculated by taking resultant vacancies of higher grade posts of Signal Maintaner.

Sub: Appointment on compassionate grounds.

The issue of considering appointment of compassionate grounds(CG) to sons/daughters, born through other than first legally married wife has been engaging the attention of this Ministry for quite some time, in the backdrop of partial quashing of CG related instructions contained in this Ministry’s letter dated 02.01.1992 regarding such appointments, by the Hon'ble High Court/Calcutta in the case (WPCT 20 of 2009) Namita Goldar & Ors. Vs UOI & Others.

2. In this reard, Railway Board has taken into account following observations of the Hon'ble Supreme Court, on the subject of CG appointment, in the case of State Bank of India & another Vs Rajkumar, (Civil appeal No. 1641 of 2010):

"it is now well settled that appointment on compassionate grounds is not a source of recruitment. On the other hand it is an exception to the general rule that recruitment to public services should be on the basis of merit, by an open invitation providing equal opportunity to all eligible persons to participate in the selection process. The dependants of employees, who die in harness, do not have any special claim or right to employment, except by way of the concession that may be extended by the employer under the Rules or by a separate scheme, to enable the family of the deceased to get over the sudden financial crisis. The claim for compassionate appointment is, therefore, traceable only to the scheme framed by the employer for such employment and there is no right whatsoever out side such scheme…"

3. Railway Board has also taken into account following observation of Hon'ble High Court of Jharkhand (Ranchi) in writ petition No. WP(S) 16 of 2014 (pronounced on 24.07.2014) "Compassionate appointment is a matter of policy of the employer and the employer cannot be compelled to provide compassionate appointment contrary to its policy/scheme. When there is specific circular which clearly provides that the children of second marriage of the employee shall not be eligible for compassionate appointment, no direction can be issued to the respondents to consider the case of the petitioner"

4. The matter has been examined and in supersession of this Ministry's letter dated 02.01.1992 issued under RBE No. 01/1992 and No. E(NG)II/2012/RC-1/21 dated 03.04.2013, it has been decided that the first right of being considered for compassionate grounds appointment is vested, in cases of death of Railway servants while in service, with the legally wedded surviving widow provided she has not remarried at the time of making request for appointments on compassionate grounds. It is clarified that in cases of those Railway Servants who are governed by the Hindu Marriage Act, 1955, there can only be one one legally wedded wife/widow, as second marriage, while spouse is living, is void/voidable in view of the Section 5(1) read with Section 11 of the Act. In this respect, Railway Board’s letter No. E(D&A) 92 GS 1-1 dated 10.04.1992 connects.

5. If aforementioned legally wedded suriving widow does not want herself to be considered for compassionate grounds appointment, she can nominate, for CG appointment, a "bread winner" for the family from amongst the following"

(a) In cases of those Railway Servants who are governed by the Hindu Marriage Act, 1955 : Son (including adopted son); or daughter(including widowed/ adopted/married/divorced daughter). However, if such Railway Servant has left sons/daughters, who have been treated as legitimate or deemed to be legitimate, under Section 16 of Hindu Marriage Act, 1955, neither widow can nominate them as bread winner for CG appointment nor such sons/daughters can claim CG appointment.

(b) In cases of those Railway Servants who are governed by their respective Personal Laws: Son(including adopted son); or daughter(including widowed/ adopted/married/divorced daughter). However, if such Railway Servant has left sons/daughters through second/subsequent legally valid marriages, i.e. other than through first wife and deceased Railway Servant have failed to obtain requisite permission for such second/subsequent marriage as required under section 21 (relating to restrictions regarding marriage) of the Railway Services (Conduct) Rules, 1966, neither first widow/second/subsequent widow can nominate such sons/daughters as bread winner for CG appointment nor such sons/daughters can claim CG appointment. Moreover, such second/subsequent widow also would not have any right to seek compassionate grounds appointment.

6. All Zonal Railway/PUs/Units are directed to decide cases accordingly.

G.S.R. 210(E).-In exercise of the powers conferred by the proviso of Article 309 of the Constitution, the President hereby makes the following amendment in Railway Services (Revised Pay) Rules, 2016 namely :-

1. These Rules may be called Railway Services (Revised Pay) Amendment Rules, 2018.
2. Below Note 2 of the Schedule to Railway Services (Revised Pay) Rules, 2016, Note 3 may be inserted as under :-
"In supersession of the existing conditions regarding grant of Level 10 to 80% of Group 'B' Officers of all Organised Services including Accounts Department after 3 years regular service, for Group 'B' Officers of all Organised Services other than Accounts Department, the revised scale of Level 10 will now be granted after completion of four years regular service in the grade of Level 8. For Group 'B' Officers of Accounts Department, the revised scale of Level 10 will now be granted after completion of four years service in the grade of Level-9.
The revised scale of Level 10 may be operated to the extent of 100% of the Group 'B' Officers on roll including Group 'B' Officers officiating in the revised scale Level 11 on ad-hoc basis (subject to fulfilment of eligibility conditions) in respect of all organised services, with effect from the date of publication of these rules and thereafter with effect from 1st January and 1st July of subsequent years".
Explanatory Memorandum
The amendment to the Railway Services (Revised Pay) Rules, 2016 has been necessitated by the Government's acceptance of 7th CPC recommendations modifying the 80:20 distribution within Group 'B' as provided in Railway Services (Revised Pay) Rules vide notification dated 05.02.1998 and 25.04.2003.

Ref: This office letter No. E(NG)ll/2012/RR-1/14 elated 12.11.2012 (RBE No. 126/2012)

Attention is invited to Board letter under reference prescribing criteria for Physical Efficiency Test (PET) for recruitment of staff for all categories in Level - 1 of 7th CPC Pay Matrix (earlier Grade Pay 1800/-) on Indian Railways.

2. The matter has further been reviewed, keeping in view the requirement of the job and it has been decided by Ministry of Railways (Railway Board) to amend the existing criteria for recruitment from open market in all categories in Level-1 , as per norms prescribed below:

Male Candidates
(i) Should be able to lift and carry 35 kg of weight for a distance of 100 metres in 2 minutes in one chance without putting the weight the weight down;
(ii) Should be able to run for a distance of 1000 metres in 4 minute and 15 seconds 5 minutes and 40 second
Female Candidates
(i) Should be able to lift and carry 35 kg of weight for a distance of 100 metres in 2 minutes in one chance without putting the weight the weight down;
(ii) Should be able to run for a distance of 1000 metres in 5 minutes and 40 second
3. The above norms will be applicable in all future recruitment from open market in Level-1. Notification, 1f any, issued may please be amended,Suitably by issuing a corrigendum.
