Sub: Seventh Central Pay Commissions recommendations - revision of pay scales - amendment of Service Rules/Recruitment Rules.

The undersigned is directed to refer to this Department’s OM of even number dated 9th August 2016 regarding amendment of Service Rules/ Recruitment Rules by replacing the existing Pay Band and Grade Pay with the corresponding Level in the Pay Matrix in the revised pay structure recommended by the Seventh CPC and notified in the CCS (Revised Pay) Rules, 2016.

2. In the light of above all cadre controlling authorities of Organized Group A services are hereby requested to amend the SRs as per OM dated 30.08.2016 to bring them in-conformity with 7th CPC structure. The information in this regard may also be furnished to the undersigned latest by 31st July 2018 in the format enclosed.

MEMORANDUM

Sub: Seventh Central pay Commission's recommendations - revision of pay scales - amendment or Service Rules/Recruitment Rules.

The undersigned is directed to refer to this Department's OM or even number dated 9th August. 2016 the subject mentioned above wherein it was requested that as per the CCS (Revised pay) Rules, 2016 issued by Department or Expenditure vide Notification dated 25th July, 2016, consequential amendment in the existing Service Rules.'Recruitment Rules shall be made by the Ministries/Departments by substituting the existing pay Band and Grade pay by the new pay "LEVEL in the PAY MATRIX" straightaway without making a reference 10 the Department of Personnel and Training Public Service Commission (UPSC).

2. Further, DoP&T vide of even number dated 16.02.2017 sought information with regard to implementation of OM dated 09.08,2016. The issue is being monitored by higher authorities; however, so far this Department has not received any information from Ministries/Departments even a lapse of over a year. It has been decided to hold a meeting, under the Championship or JS (E), with all Ministries/Departments on 04.01.2018 in Room No.190, North Block, New Delhi.

3. All Ministries/Departments are requested to furnish a status report regarding amendment Of Recruitment Rules in pursuance of DoP&T OM dated 09/08/2016 in the annexure-II enclosed herewith. The schedule or the meeting is as per Annexure-I.

Sub: Seventh Central Pay Commission's recommendations - revision of pay scales - amendment of Service Rules/Recruitment Rules.

The undersigned is directed to refer to this Department's OM of even number dated 9th August, 2016 regarding amendment of Service Rules/Recruitment Rules by replacing the existing Pay Band and Grade Pay with the corresponding Level in the Pay Matrix in the revised pay structure recommended by the Seventh CPC and notified in the CCS(Revised Pay) Rules, 2016.

2. Subsequently, this Department held meetings in October/November, 2016 with the administrative Ministries/Departments to review the progress in the implementation of the OM. An important suggestion made in the meetings was with respect to facilitating the process of consultation with the Legislative Department for drafting notification for amendment of RRs in accordance with OM dated 9th August, 2016 and its Hindi translation so as to expedite the issue of notification. In this regard, this Department in consultation with Legislative Department has prepared a model notification in English and Hindi for use of the Administrative

Ministries/Departments. These are annexed at Annexure I and Annexure II.

3. Another issue which came up in the meeting is with respect to retention of standard Note under Co1.11 incorporated in the Schedule of the RRs regarding the regulation of service rendered prior to implementation of 6 thCPC, in those cases where the issue of upgradation/merger of the posts were involved. The relevant Note reads as follows:
"Note: For the purpose of computing minimum qualifying service for promotion, the service rendered on a regular basis by an officer prior to 1.1.2006/the date from which the revised pay structure based on the 6th CPC recommendations has been extended, shall be deemed to be service rendered in the corresponding grade pay/pay scale extended based on the recommendations of the Commission"
and/or
"Note: For purposes of appointment on deputation/ absorption basis, the service rendered on a regular basis by an officer prior to 1.1.2006/the date from which the revised pay structure based on the 6th CPC recommendations has been extended, shall be deemed to be service rendered in the corresponding grade pay/pay scale extended based on the recommendations of the Commission except where there has been merger of more than one pre-revised scale of pay into one grade with a common grade pay/pay scale, and where this benefit will extend only for the post(s) for which that grade pay/pay scale is the normal replacement grade without any upgradation."
4. After the implementation of 7 th CPC, there are only a few cases of  merger/upgradation of pay scale. It has been decided in consultation with UPSC that in cases where merger/upgradation of pay are not involved in the recommendations of the 7th CPC, the Note as referred above is not to be prescribed in the RRs/SRs. The guidelines in this regard have also been separately issued. The model notification includes a provision for deletion of the Note.

5. The Ministries/Departments are requested to finalise draft notification for amendment of the SRs/RRs in line with the model notification and thereafter, refer the same to the Legislative Department for vetting. The Legislative Department may dispose of references received from the Ministries/Departments within two weeks. Any amendment which is beyond the scope of the model rules will be finalized in usual process i.e. consultation with DoPT, UPSC and Legislative Department.

6. This Department is monitoring the implementation of the OM dated 09.08.2016. All Ministries / Departments are therefore requested to furnish information as per Annexure-III at the earliest.

Autonomous bodies Employees waiting for the 7th Pay Commission benefits

All the autonomous bodes employees of central government employees are eagerly waiting for the 7th pay commission benefits, even after 4 months of 7th pay commission implementation still government not yet released the order for autonomous bodies.

Whenever government revised wages for central government employees, the same benefits was extended to the autonomous bodies employees & pensioners. During 6th pay commission implementation government released the order within one month in the year 2008, three orders released within a month after 6th pay commission implementation.
  • 30.10.2008 - Revision of Pay scales of employees of Autonomous Bodies, etc
  • 07.10.2008: Revision of Pay scales of employees of Autonomous Bodies, etc.

But after 7th Pay Commission implementation for Central Government Employees, there is no official orders for extending the benefits to autonomous bodies employees & pensioners, already 4 months had passed, but there is no symptoms of releasing the order.

In this situation, confederation union takes this issue & sent couple of letters to the Finance Minister to extend the benefits to the autonomous bodies.
  • Oct 14th : Confederation Union Secretary Mr. M.Krishnnan wrote to the Ministry of Finance to extend the 7th pay commission benefit to the employees of autonomous bodies,
  • Oct 18th : JCM Staff side Secretary Mr. Shiva Gopal Mishra wrote to the Secretary, Ministry of Finance to extend the wage revision benefits to the autonomous bodies.
This issue was raised in the JCM Standing Committee meeting held on 25.10.2016 by the staff side, but in the meeting official side not given any time frame for final decision & it’s likely to be delayed. Unions are also not happy with this kind of delay. Confederation invited employees & pensioners of autonomous bodies to join the Confederation’s agitational programme to express the discontent.

All the employees & pensioners of autonomous bodies requesting to the Finance Minister to take the decision at the earliest & release the order soon.

The undersigned is directed to refer to the OM of even number dated 03.10.2016 on the above mentioned subject informing about the meeting scheduled to be taken by Joint Secretary (Establishment) to review the position with respect to the amendment in Service Rules/Recruitment Rules for various posts.

2. In this regard it is stated that the meetings scheduled to be held on 25.10.2016 and 26.10.2016 for the Ministries starting with alphabets R-V and W-Z respectively has been postponed due to some unavoidable circumstances. The fresh date for the meeting will be communicated in due course of time.

The undersigned is directed to refer to the Office Memorandum of even number dated 9.8.2015 on the above mentioned subject wherein it was requested that as per the CCS (Revised Pay) Rules 2016 issued by Department of Expenditure vide Notification dated 25th July, 2016, consequential amendment in the existing Service Rules/Recruitment Rules shall be made by the Ministries/Departments by substituting the existing Pay Band and Grade Pay by the new pay structure i.e. "LEVEL in the PAY MATRIX" straightaway without making a reference to the Department of Personnel and Training (DOP&T)/Union Public Service Commission (UPSC).

2. In this regard, a confirmation meeting is scheduled to be taken by Joint Secretary (Establishment) to take stock of the latest position of amendment in Service Rules/Recruitment Rules. Joint Secretary (Administration/Establishment) of all Ministries/Departments along with the cadre controlling officers is requested to attend the meeting as per the schedule Annexed or depute a senior officer conversant with the matter to brief the progress.

Subject:- Seventh Central Pay Commission’s recommendations — revision of pay scales- amendment of Service Rules/Recruitment Rules

The recommendations of 7th CPC have been considered by the Government and the CCS (Revised Pay) Rules 2016 have been issued by Department of Expenditure vide Notification dated 25th July, 2016. Consequently, in place of the Pay Band and Grade Pay, the revised pay structure comprising the “LEVEL in the PAY MATRIX has come into effect. In the light of this, it has now been decided that the existing Service Rules/Recruitment Rules shall be amended by the Ministries/Departments by substituting the existing Pay Band and Grade Pay by the new pay structure i.e. “LEVEL in the PAY MATRIX” straightaway without making a reference to the Department of Personnel and Training (DOP&T)/Union Public Service Commission (UPSC). The heading of column No.4 of the Schedule in RRs may be modified to “LEVEL in the PAY MATRIX”. Similarly, in column 11 of Recruitment Rules, for promotion the corresponding “Pay Band and Grade Pay” needs to be replaced with corresponding “LEVEL in the PAY MATRIX”. In cases where deputation is also one of the methods of recruitment, the field of selection for deputation which includes various grades should also reflect the corresponding “LEVEL in the PAY MATRIX”.

2. The above amendments may be carried out by 30th September, 2016.

ORDER:

In the Government Order second read above, orders were issued revising the scales of pay of employees/ teachers on a ” pay scale to pay scale basis” notionally with effect from 1-1-2006 with monetary benefit from 1-1-2007 based on the recommendations of the Official Committee. Subsequently, One Man Commission was constituted to examine the anomalies, consequent on the implementation of the revised scales of pay and more specifically to examine the representations of the teachers associations to extend Central Scales of pay. The recommendation of the One Man Commission was accepted by Government in toto and 87 Government Orders were issued department-wise revising the pay scales of various categories.

2) As per the orders of the Hon’ble High Court, dated:OS-03-2012 in W.P.No.7006 of 2011, the Government constituted “Pay Grievance Redressal Cell” (PGRC) to examine the representations received from the employees associations / Heads of Department / individual employees including the aggrieved petitioners in Writ Petitions filed challenging the G.O.Ms.No.71, Finance (Pay Cell) Department, dated:26-02-2011. An elaborate exercise was done by the PGRC on 4376 representations received from various associations / individuals / Writ Petitioners and heard their grievances in person before arriving at conclusions. Based on the recommendations of the PGRC, 89 Government Orders were issued benefitting around two lakhs employees.

3) In spite of further revision in pay scales as indicated above, several court cases have been filed by individual employees /associations, seeking further pay revision. Further a number of requests are being made by individual employees /associations and information on present their request are sought under Right to Information Act 2005, which has resulted in voluminous work in Finance Department. Further, nine years has already lapsed since the implementation of revised pay scales· and therefore requests for further pay revisions cannot be entertained at this juncture with retrospective effect.

4) The Government after careful consideration has decided to examine the anomalies /requests for further pay revision at the time of general pay revision by constituting Commission /Committee. Accordingly, Government direct that the representations received from the associations /individual employees requesting for further revision of Pay Band /Grade Pay be deferred till a Commission /Committee is constituted for general pay revision. The Principal Secretaries /Secretaries to Government shall issue necessary instructions in this regard to the Heads of Department under their administrative control for strict adherence.
