Clarifications have been sought by some of the Zonal Railways regarding minimum pay applicable on promotion of running staff in the 6th CPC pay structure. A detailed clarification in this regard had been issued to Western Railway and North Western Railway vide Board’s letter of even no. dated 28/08/2018 clarifying the position in terms of various provisions of RS(RP) Rules. 2008. A copy of Board’s above letter dated 28/08/2018 is being forwarded to all zonal Railways/ Production units to be read along with Board’s letter No. PCVI/2018/I/ RSRP/ l dated 12/10/2018 (RBE No.158/2018) for information and necessary action.

This office is in receipt of NFIR’s letter dated 23/07/2018 (copy enclosed). wherein it has stated that there has been discrepancy in fixation of pay of Running Staff promoted on or after 01/01/2006 in Rajkot/ Jodhpur Division under Western Railway /North Western Railway respectively. In support of this, they have relied upon Rajkot/ Jodhpur Division’s letter dated 12.01.2018/29.06.2018 respectively (copy enclosed).

2. Prima facie observation of the concerned Division’s letter indicates there exists some confusion in the methodology of pay fixation of Running Staff promoted on or after 01/01/2006. As.the Railways are aware, the pay fixation of existing staff, already in service on the date of effect of RS(RP) Rules, 2008 viz. 01/01/2006, in the revised pay structure is governed by Rule 7 of above rules notified vide Gazette Notification No. GSR 643 (E) dated 04/09/2008 (RBE No.103/2008). For the above purpose, fitment tables were issued vide Board’s letter No. PCVI/2008/I/RSRP /1 dated 11/09/2008 (R.BE No. 108/2008) which are applicable to non­ running Staff. Since existing running Staff (already in service as on 01/01/2006) was in receipt of Dearness Allowance on Pay Element, separate fixation table were issued for fixation of their pay in revised pay structure in terms of Rule 7 of RS(RP) Rules. 2008 vide Board’s letter No. PCVI/2008/I/RSRP/1 dated 12/09/2008 (RBE No. 109/2008). As prescribed in Rule 7 of RS(RP) Rules, 2008, if fixation of pay as per Rule 7( 1)(A)(i) is short of minimum of applicable revised pay band (viz .Minimum of PB- 1 to PB-4 as applicable to the employee) or pay scale (applicable to HAG & higher grades), such minimum would be allowed , as laid down Rule 7(1)(ii). The provisions of Rule 7(1)(A)(ii) have already been taken care of while issuing fitment tables vide Board’s letter dated 11/09/2008 & 12/09/2008. The fitment tables are also applicable in the cases where an existing employee (already in service as on 01/01/2006 opts to have his pay fixation from a date later than 01/01 /2006, in terms of Rule 5 ,6 & 11 of RS(RP) Rules, 2008 as clarified vide Clarification No.3 of Board’s letter No. PCVI/2008/I/ RSRP/ dated 25/09/2008 (RBE No. 132/2008).

3. There is no prescribed minimum, other than minimum of the applicable pay band in the case of those promoted on or after 01/01/2006, where an employee is fixed in any of the applicable pay bands. The minimum pay in pay band as prescribed in First Schedule Part A, Section II of RS(RP) Rules, 2008 and corresponding stipulation in first schedules annexed with Board’s letter dated 11/09/2008 (RBE No. 108/2008) is applicable only for direct recruits appointed on or after 01/01/2006 belonging to Running as well as non running categories. The position has been clarified in detail in Board’s letter No. PCVI/2010/I/ RSRP/1 dated 17/02/2010 (RBE No. 28/2010). As such once the pay of any existing employee (already in service as on 01/01/2006) is fixed in revised pay structure in the applicable pay band as per the provisions of Rule 7 or 11 and he is subsequently promoted to a post in same or other pay band, his fixation has tp be made as per Rule 13 Even at this stage, the minimum of applicable pay band (PB-1 to PB-4) or scale (HAG or above) as applicable is to be ensured.

4. In view of this. it is requested that the Rajkot / Jodhpur Division’s letter dated 12-01-2018/ 29-06-2018 respectively be examined in light of relevant instructions and the necessary corrective action taken and thereafter, the position be advised to this office. Further if any specific point of doubt arises, the same may be referred to this office for clarification along with the views of PFA of the Railways.

Federation invites kind attention of the Railway Board to the references cited above relating to payment of Leave Salary to the Running Staff pursuant to the implementation of the recommendations of 7th Central Pay Commission. Federation once again reiterates that though the Railway Board have issued orders vide RBE No. 204/2018 dated 28/12/2018 but, however, there is no clarity in the said orders regarding date of effect i.e. from 01/01/2016, consequently in the provision in IPAS, date of effect has been taken as 01/07/2017 and the Running Staff have been put to recurring financial loss for 18 months (from 01/01/2016 to 30/06/2017) leave salary. Though the Federation has been making efforts to persuade the Railway Board to set right the technical snag but however action to correct/up-date IPAS has no been taken yet with the result Federation continues to receive grievances from the Running Staff from Zonal Railways.

NFIR, therefore, once again urges upon the Railway Board to kindly intervene and issue suitable instructions to all concerned to rectify/up-date the IPAS giving effect to the instructions vide RBE No. 204/2018 dated 28/12/2018 from 01/01/2016 repeat from 01/01/2016 and not from 01/07/2017.
Action taken in the matter may kindly be apprised to the Federation.

Federation vide its letter dated 15-01-2018 provided to the Railway Board sample concordance tables for revision of pension cases of pre-01-01-2016 retired Running Staff. Railway Board vide letter dated 24-01-2018 have however issued instructions for revision of pension of pre-2016 retired Running Staff. The Federation vide its letter dated 26-02-2018 had pointed they be withdrawn as the same do not ensure correct revising of pension fixation of pre-2016 retired Running Staff. Federation also cited various provisions of DoP&PW and also those contained in IREM. Consequently, Railway Board vide O.M.dated 23-05-2018 sought clarification from DoP&PW to which the DoP&PW vide O.M.dated 01st June 2018 wanted few illustrations of the formulation so as to compare the pay/pension as on 01-01-2016 as per Railway Board’s instructions dated 24-01-2018 with pay and payable pension as suggested by our Unions.

Federation has come to know that the detailed information sought for by the DoP&PW has since been conveyed by the Railway Ministry vide OM dated 16-08-2018, but however progress in the matter is yet to be apprised to the Federation.

In this connection, NFIR also invites kind attention of the Railway Board to PNM Agenda item No.9 (sent to Railway Board on 26-06-2018) discussions on which are yet to take place. Federation however gives below additional points for consideration:-

• Pay of General Category staff in Grade 5500-9000 on 31-05-2015 with 3 stagnation increments (i.e 9525/- Rs.56900) as on 01-01-2016
• Likewise the Notional Pay of Running Should be fixed as Rs.56900 + 30% i.e. Rs.73,970. Thus, retirement benefit of Running Staff would then be calculated on Notional pay i.e. Rs.73,970 + 55% – Rs.1,14,659 and payable pension comes to Rs.57329.50
• whereas, as per Railway Board’s order 30% pay element is not to be added on Rs.56900 and retirement benefit calculated on Rs.56900 + 55% divided by 2 i.e. Rs.56900 + 31295 = 88195 divided by 2 i.e. Rs.44090 hence a loss of Rs.13,229 in pension.

NFIR, therefore, once again requests the Railway Board to furnish proper illustrations to the DoP&PW for obtaining clear clarification for arriving at actual entitled pension to the retired Running Staff. A copy of the reference made to the DoP&Pw may also be provided to the Federation.

Ministry of Railways (Railway Board) have decided to constitute a Committee to examine the demand for consideration of Ticket Checking Staff as Running Staff. The Committee will consist of the following:-

i. AM/Commercial, Railway Board - Convener
ii. AM/Staff, Railway Board Member - Member
iii.PED/Finance, Railway Board Member - Member
2. The Terms of Reference of the Committee will be as under:‑

a. Grant of Running allowance to Ticket Checking staff on the lines of Loco-Pilots and Guards.
b.  Creation of posts of Ticket Checking Staff in the same manner as that of Running Staff.

3. The Committee should submit its report within three months from the date of its constitution.

4. The Headquarters of the Committee will be at Railway Board, New Delhi.

5. TG-V branch, Railway Board will be the Nodal branch for functioning of the Committee. Therefore, submission of report of the Committee for consideration of Railway Board, implementation of its recommendations and all related issues including Parl. Questions, RTI cases and other formalities with regard to the Committee, shall be dealt with by TG-V branch of Railway Board.

6. The Convener and Members of the Committee Will draw TA/DA as per extant rules.

Ref.: Railway Board's letters No.E(LL)/2009/HER/1 dated 17.07.2018 and 02.08.2018

Pursuant to discussions held with AIRF, during the last PNM Meeting, held on 21-22 June, 2018, Railway Board vide their letter No.E(LL)/2009/HER/1 dated 17.07.2018 had issued instructions that, Call Books on Running Staff should be served upon only after completion of 16 hours rest at Headquarters and after completion of 8 hours at outstation.

It is, however, quite unfortunate that, Railway Board vide their subsequent letter dated 02.08.2018 have pended the said instructions till adequate number of Running Staff becomes available to fill-up large-number of existing vacancies. This is gross violation of bilateral negotiated settlement with the federation.

AIRF, therefore, desires that, orders of pending the instructions, issued vide Railway Board’s letter dated ibid dated 17.07.2018 be withdrawn immediately in the larger interest of industrial harmony.

This may be treated as "Most Urgent".

You also know that AIRF has been making all out sincere efforts with the Railway Board to get the rates of Running Allowance and other allowances related to Running Staff revised, but till date no fruitful outcome has emerged.

It has, therefore, been decided that, while celebrating New Year on 1st January, 2018, a "Protest Day" would simultaneously be observed by holding mass meetings, dharnas, rallies at all the Branches, Installations and Divisional levels to lodge our strong anguish against the dillydallying attitude of the Ministry of Railways on the subject.

Sub: Clarification regarding calculation of quantum of Annual Increment in pay in case of Running Staff.

Ref.: M/o Finance's OM No. 332469/2016-E IIIA dated 01.02.2017;

The undersigned is directed to refer to this Ministry's OM of even no. dated 30.08.2016 wherein an issue raised by one of the Staff Federations vide PNM Agenda Item No.10/2016 was referred to M/o Finance for examination. The Federation had demanded that the basic pay for the purpose of calculation of increment in the 6th CPC should include Pay element of Running Allowance for the Running staff. This meant that increment of Running Staff should be calculated @3 % of {Basic pay + pay element (presently 30% of Basic Pay)}.

2. This issue was examined in Pay Commission Dte. of Railway Board and a copy of reply sent to one of the Zonal Railways is enclosed as Annex-I.

3. As regards the queries raised by M/o Finance vide 011/1 dated 01.02.2017, it is clarified that a portion of Basic Pay of the Running Staff is treated as a “Pay element of running allowance” which itself falls outside the definition. of Basic Pay as defined in FR(9) (21)(a)(i) but falls in the broader definition of the term "pay" as in FR(9) (21)(a)(iii). The pay element at specified rates is counted for specified purposes only. As per Rule No. 25 of "The Rules for payment of Running and other Allowances to the Running Staff on Railways, 1981" read with para 3.23 of Railway Board’s letter No.E(P&A)II-80/RS- 10 dated 17.07.1981 (Annex-11), the pay element i.e. 30% of the Basic Pay of Running Staff will be reckoned as pay for specified purposes (not for all) such as Dearness Allowances, House Rent Allowance, entitlement to Passes, PTOs etc. It is pertinent to mention here that pay element is not reckoned as pay for Transport Allowance, Night Duty Allowance etc.

3.1   In accordance with para 2 of Board’s letter No. E(P&A) II-2005/RS-34 dated 26.12.2008 (RBE No.202/2008) (Annex-III}, pay element in the Running n Allowance for running staff would be 30% of the basic pay under Railway Service (Revised Pay) Rules,2008 for computation of specified benefits excluding retirement benefits. For the purpose of computation of retirement benefits of running staff, an additional quantum of 55% of the basic pay under RS(RP) Rules,2008 would be reckoned.

Sub : Pay element relating to Running Staff/Loco Inspectors after the recommendations of Seventh CPC.

Please refer to your letter no. MRTS/E.345/0/12/Pt.IV/Misc dt. 05.05.2017 requesting a clarification about the percentage of pay element to be reckoned for the purpose of computation of pensionary benefits in respect of Loco Inspectors. This issue has also been raised by GS/NFIR in his letter no. IV/RSAC/Conf/Pt. VIII dt. 15.09.2017.

2. Loco Inspectors are entitled to 30% add-on pay element for retirement benefits as per paragraph no. 5.5 of Board’s letter no. E(P&A)II/83/RS-10(iv) dt. 25.11.1992 which has not been amended as yet. It is clarified that the pay element (presently 30% until further orders) has to be reckoned in the revised pay structure of Seventh CPC for calculation of pensionary benefits of Loco Inspectors.

3. In this connection it is noted that many retired Loco Inspectors, even after getting the benefit of 30% add-on pay element at the time of pay fixation as Loco Inspectors, have gone to Courts of Law claiming 55% pay element for pensionary benefits equating themselves to the running staff. It is reiterated that Loco Inspectors are not classified as running staff and therefore are not entitled to 55% pay element for pensionary benefits. This fact may be conveyed to such Loco Inspectors while calculating their pensionary benefits.

4.This issues with the concurrence of the Finance Directorate of the Ministry of Railways.

(ii) GS/NFIR's letter No. IV/NFIR/7th CPC/Corres/Pt. V dated 15/04/2015 to Railway Board.
NFIR at the outset, conveys to Railway Board that the delay in granting upward revision of Kilometrage rates for Running staff has been causing serious disappointment and resentment among the entire category.

In this connection, NFIR invites the attention of Railway Board to the discussions held between the Federation and Board on 24th June 2015 on the issue relating to enhancement of Kilometrage Allowance rates (on the basis of Running Allowance Committee Formula) demanded by NFIR with effect from 01/01/2006. A note sheet was also given by the Railway Board to the Federation during discussion and according to the said note sheet, the Kilometrage rates were to be revised with effect from 01/01/2006, adding Rs.72.44 to the rate then existed. It was also discussed on the need for further revision of the said Kilometrage rates w.e.f. 01/09/2008, 01/01/2011 and 01/01/2014 (in view of DA factor). These matters are yet to be satisfactorily finalized inspite of discussions held on 24th June 2015.

NFIR gives again the valid points as listed below for the purpose of revising the kilometrage rates without delay:-

It is a known fact to the Railway Board that the TA factor needs to be taken into account for revising rates of Kilometrage Allowance in the case of Running Staff as per RAC formula.
The TA rate was fixed at Rs. 340/- in the year 2008 as a result of implementation of 6th CPC recommendation and the said TA was raised to Rs. 510/- due to DA linkage and now with the recommendations of 7th CPC, the TA rate has been revised to Rs. 800/-. with effect from 01.07.2017.
But the Kilometrage Allowance rate for Running Staff was fixed at Rs.169/- in the year 2008 assuming TA rate as Rs.210/- and not with the TA rate of Rs.340/- as recommended by 6th CPC, It needs to be admitted that the assumed TA rate Rs.210/- has now been raised to Rs.800/-, which works out to 3.8 times. Therefore the rate fixed in 2009 at Rs.169 should be revised by 3.8 times which works out to Rs.642/-.

Apart from the above, the rise in pay element quantum on implementation of new pay matrix needs to be reflected in the Running Allowance rate, as 30% of Pay element its also a component to decide the rate. When the 30% pay element was calculated at the minimum of pay level-6 i.e 35400, it works out to Rs.10620/-. The 30% pay element calculated on the 6th CPC minimum pay of Rs.9300 + GP 4200 works out to Rs.4050 i.e. 30% pay element component has risen to Rs.6570/-. This amount has to be divided by average KM 5100 (National Average of LP/Passenger as assumed by Railway Board) and it comes to Rs.129. So the amount Rs.642 on account of TA raise and Rs.129/- on account of raising 30% pay element – taken together, the rates comes to Rs.771/-.

NFIR however conveys that the National Average Kilometrage for Loco pilot (Passenger) recommended by the Running Allowance committee, 1980 was 3950 which was revised arbitrarily by Railway Board to 5100 to deny the benefit to Running Staff at that point of time. The Running Allowance Committee, 1980 had also recommended that TA of 21 days must be factored in. As per our statistics, at present, the National Average kilometrage of Loco Pilot (Passenger) stands at 4000 KM, that of passenger Guard at 4600 KM & and that of Assistant Loco pilot at 4000 KM.
Had the Running Allowance rate arrived at in the year 2008 been based on the recommended TA rate of Rs.340, there is some meaning on the argument of multiplying the present rate by a factor of 1.5 (as per the VII CPC recommendations)

In any case, the 7th CPC as well the Government have left this issue to the Railway Board to discuss with the Federations for reaching an agreement for revision of Kilometrage Allowance rates, therefore the 7th CPC recommendation to multiply with 1.5 or 2.25 is not at all relevant, with regard to Running Staff Kilometrage Allowance rates.

Hence, Federation gives the calculation as below:-

KMA rates of LP/Passenger
Mean Pay of L6- (35400+112400)/2 = 73900
30% of Mean Pay = 22170
21 days TA i.e, 800 x 21 = 16800
As per the RAC formula
[(30% Mean Pay + 21 days TA)/Average KM)] x 100 = [(22170 + 16800)/4000)]x100 = Rs.974/- per 100 kms.

KMA rates of Passenger Guard
Mean Pay of L6- (35400+112400)/2 = 73900
30% of Mean Pay = 22170
21 days Ta i.e, 800 x 21 = 16800
As per the RAC formula
[(30% Mean Pay + 21 days TA)/Average KM)] x 100 = [(22170 + 16800)/4600)]x100 = Rs.847/- per 100 kms.

KMA rates of Assistant Loco Pilot
Mean Pay of L2- (19900+63200)/2 = 41550
30% of Mean Pay = 12465
21 days Ta i.e, 800 x 21 = 16800
As per the RAC formula
[(30% Mean Pay + 21 days TA)/Average KM)] x 100 = [(12465 + 16800)/4000)]x100 = Rs.731/- per 100 kms.

Taking the factors as explained above, the NFIR urges that the kilometrage rate for Running Staff (Loco pilot/passenger) should be revised to not less than Rs.974/-. that of passenger Guard to Rs.847/- & that of ALP to Rs.731/- duly retaining the pay element of 55 & 30% (as has been continued since the last more than three decades when the pay scales of 4th, 5th, 6th and 7th CPC have been implemented).

Federation therefore, requests the Railways Boards to take action to revise the kilometrage rates as suggested above with retrospective effect.

Reference is invited to Railway Services (Revised Pay) Rules,2016 notified vide G.S.R. No. 746 (E) dated 28.07.2016, forwarded with Railway Board Endorsement No. PC-VII/2016/RSRP/I dated 28.07.2016 (RBE No. 90/2016) and Railway Board's Letter dated PC-VII/2016/RSRP/2 dated 02.08.2016 (RBE No. 93/2016) detailing the methodology for fixation of pay in the revised pay structure in respect of  existing Running Staff as on 01.01.2016.

2. It was observed that the pay fixed in 7th CPC pay structure as per the methodology laid down in Board's letter dated 02.08.2016 is coming out to be less than 14.29% increase of pay prescribed by 7th CPC, in certain cases of Running Staff.

3. The matter was, therefore, examined in Board's office in consultation with the Ministry,of Finance and it has now been decided that for fixation of pay for Running Staff category, in cases where the actual rise in pay at the time of initial fixation works out to be less than 14.29%, the initial pay in such cases shall be fixed at the next higher cell of the relevant Level in the Pay Matrix. Illustrations in this regard are enclosed as Annexure 'A'. It may be noted that there is no other change in the fixation methodology as circulated vide Railway Board's Letter No. PC-VII/2016/RSRP/2 dated 02.08.2016 (RBE No.93/2016).

The issue has been under consideration in this office and it has been decided to clarify that the provisions regarding fixation of pay of running staff in stationary posts contained in Rule 25 (i)(d) of 'The Rules for the payment of running and other allowances to the Running staff on the Railways 1981' and paragraph 924 (i) (d) of IREM-I would also apply in the case of fixation of pay of running staff posted on promotion to the stationary posts in Group 'B' also.

Sub: Non-payment of retirement benefits to the Running Staff retired on or after 01/01/2016-reg.
Complaints are being received quite frequently from the Zonal Railways that the Running Staff retired on or after 01/01/2016 have not yet been paid pensionary dues duly adding 55% to their 7th CPC Pay Matrix. It is further learnt that due to IPAS problems, almost on all the Zonal Railways, revised pensionary benefits have not been paid and the Administration has also not taken initiatives to solve the technical problem in co-ordination with the CRIS.

NFIR requests kind intervention in the matter so as to see that the retired Running Staff (from 01/01/2016 onwards) are paid retiral benefits duly reckoning 55% of pay as part of 7th CPC pay. Incidentally, Federation also conveys that all those retired Running Staff are entitled for pension arrears on revision of their present pension with the 55% addition of pay element.

NFIR, therefore, requests the Board (MS & FC) to take immediate action in resolving this issue in co-ordination with CRIS.

Action taken in the matter may kindly be advised to the Federation in due course.

Vide DC/JCM item no. 25/2004, PNM/NFIR Item No. 8/2015 and PNM/AIRF Item No. 46/2012, recognised staff Federations have demanded that 55% of Pay Element be reckoned for computing retirement benefit for those running staff who have been medically decategorised and decide to take Voluntary Retirement instead of opting for redeployment in an alternative stationary post.

2. The issue has been examined in Board’s office, and it is observed that the issue is governed under the provisions contained in Board’s letter referred to above. To address the specific aspect brought out by Federations, it has been decided that whenever a medically decategorised running staff governed by RS(PR)1993. who has rendered the prescribed qualifying service opts for Voluntary Retirement either on his own or within a period of one month from the date of offer of the first alternative post, his pension may be computed with addition of 55% Pay Element. This 55% benefit will be reckoned after deducting the 30% Pay Element fixation benefit if granted already as per Board’s letter dated 05-10-2011 referred to above.

3. In case such staff does not give option of Voluntary Retirement within the outer limit period of one month specified herein above. it will be deemed that the staff has accepted the alternative appointment offered and in this case, retirement benefits will be governed by extant instruction on the issue whenever he superannuates or opts for Voluntary Retirement thereafter.

4. The period of one month to opt for Voluntary Retirement for those medically decategorised running staff, who have already been offered the alternative posts, will start from the date of issue of this letter.

5. The above clarification shall take effect from the date of issue of this letter.

6. This issues with the concurrence of the Finance Directorate of the Ministry of Railways.

The High Power Committee, constituted to review the duty hours of running staff and other safety related categories made its recommendations on various aspects related to working hours of these categories. The recommendations have been duly considered by the Board and the following decisions relating to Breach of Rest Allowance have been made:

(i) The provisions contained in Rule 10 regarding Breach of Rest Allowance in the "The Rules for the Payments of Running and other Allowances to the Running Staff on Railways, 1981" are reiterated. Breach of rest whether at Headquarters or at outstation should be permitted only in emergent situations like accidents, natural calamities and national emergencies subject to operational exigencies.

(ii) There should be no Breach of Rest Allowance for breach of rest at Outstations. It will, however, continue to be admissible for breach of rest at Headquarters.

(iii) There should be no Breach of Rest Allowance for breach in periodical rest. However, if need does arise for curtailment of periodical rest, it should be permitted only if the running staff has availed a complete night in bed during the periodical rest.

(iv) The present rates for payment of Breach of Rest Allowance will continue.

(v) Cases of breach of rest should be regularly monitored at a sufficiently high level in divisional offices and zonal offices.

2. This issues with the concurrence of the Finance Directorate of the Ministry of Railways.

The undersigned is directed to refer to the above mentioned subject and to the letter dt. 05.08.2016 of GS/AIRF and letters dt. 04.08.2016 & 23.08.2016 of GS/NFIR.

2. In this connection, it is stated that unlike during the Sixth CPC where there were separate fitment tables for pay fixation, in the Seventh CPC only a single multiplication factor of 2.57 and a single Pay Matrix table has been recommended and accepted. Paragraph 2 of the Resolution dt. 25.07.2016 refers. Therefore, no other multiplication factor or Pay Matrix/ Fitment table can be used for pay fixation for any category of staff.

3. Further, as brought out in para 12 of the Resolution dt. 25.07.2016 pay fixation of running staff (who draw Running Allowance) has been clubbed with fixation pay of Doctors (who draw NPA). The methodology and illustration for computing revised basic pay in the case of Doctors have been clearly brought out in para 7 (B) (ii) of the Notification dt. 25.07.2016 of Ministry of Finance. It may be observed that the rate of increase. in the illustration in the case of Doctors is also not exactly 14.29%. in fact, para 12 of the Resolution mentioned that actual raise in pay at the time of initial fixation is to be ensured at about 14.29%. The figure therefore is not an absolute percentage of raise which has to be ensured, A similar methodology of pay fixation for running staff (keeping the basic multiplication factor at 2.57) has been applied in consultation with and approval of Ministry of Finance.

4. lt may also be seen that while fixing the pay after revision in the appropriate cell of the applicable level in the Pay Matrix the actual increase in pay works out practically to around three times the pre-revised basic pay of the running staff.

5. Therefore, pay revision for Running Staff has been done in terms of approved formulation and no separate fitment table can be issued in this connection, as brought out above.

In continuation to NFIR’s letter of even number dated 04/08/2016, Federation desires to highlight some facts as mentioned below:-

• The Fitment table issued by the Railway Board vide letter No. PC-VI/2008/1/RSRP/1 dated 12/09/2008 was very clear, consequently correct pay fixation was done in favour of Running Staff with effect from 01/01/2006.
  This time, no fitment table has been issued resulting disappointment among Loco and Traffic Running Staff in Railways.
•  A statement showing the revised pay fixation on the 7th CPC Pay Matrices is enclosed. The statement shows that 14.29% hike is not ensured.
•  According to the notification issued by Ministry of Finance (Department of Expenditure vide Para 12 of Resolution No. 1-2/2016-IC dated 25th July 2016, while revising the Pay of Running Staff it should be ensured that actual raise in Pay at the time of initial fixation of pay should be 14.29% as recommended by the 7th CPC. It is however, disappointing to note that the Railway Board’s decision communicated vide letter No. PC-VII/2016/ RSRP/2 dated 02/08/2016 (Annexure C) has not ensured Pay raise of 14.29%, consequently each Running Staff is deprived of more than Rs. 2000 p.m.

NFIR, therefore, requests the Railway Board to review and ensure pay raise of not less than 14.29% for the Running Staff while revising the pay in the 7th CPC Pay Matrices. Federation also urges the Railway Board to issue the revised fitment table duly ensuring 14.29% hike as was done on 12th September 2008 when 6th CPC Grade Pay/Pay Band was given effect from 01/01/2006.

The Federation vide its letter dated 13/07/2016 requested the Railway Board that in view of 30% pay element of Running Staff needed to be taken for arriving at the “multiplier factor”, it was suggested to maintain the same at “3” instead of “2.57”. Federation is however disappointed to note that the Railway Board instead of following the simple procedure has complicated and mutilated the pay fixation formula/procedure of Running Staff as per illustration given in Annexure ‘C’ of Board’s letter No. PC-VII/2016/RSRP/2 dated 02/08/2016 (RBE No. 93/2016).

In this connection, the Federation brings to the notice of the Railway Board that in the Resolution circulated by the Ministry of Finance (Department of Expenditure) vide No. 1-2/2016-IC on 25th July 2016 in Para 12, it has been mentioned that in respect of Railway employees to whom Running Allowance is admissible, it will be ensured that the actual rise in pay at the time of initial fixation is about 14.29% as recommended by the Pay Commission. Federation feels sad to convey that the said decision of the Ministry of Finance has not been complied with by the Railway Ministry particularly in respect of Running Staff.

In case of Running Staff with Rs.1000/- Basic Pay, he will get Dearness Allowance Rs.1,625/-, thus, the total would be Rs.2,625/-. In terms of Gazette Para 12, minimum benefit 14.29% should be given to Running Staff. 14.29% of Rs.2,625/- is Rs.375/-. Thus Basic Pay + Dearness Allowance + Minimum Guaranteed Benefit = 1000 + 1625 + 375 = Rs.3,000/-. From this, it is clear that the Running Staff having Basic Pay of Rs.1000/- should be fixed at Rs.3000/-. But in the illustration given in RBE 93/2016, Running Staff with Basic Pay of Rs.19,930/- is fixed at Rs.58,694/-, which works out 12.19% which is clear violation of Para 12 of Gazette Notification.

In view of the above, the Annexure of Board’s letter dated 02/08/2016 is needed to be redrawn to ensure justice to the Running Staff. NFIR, therefore, requests the Railway Board to consider the above points and issue modification immediately duly endorsing copy to the Federation.

The Railway Board is aware that the Union Cabinet has decided on 29th June 2016 for implementation of revised Pay Matrices of the 7th Central Pay Commission w.e.f. 01/01/2016 duly applying 2.57 multiplier factor. The notification, in this regard, is expected from the Ministry of Finance in due course.

In this connection, the NFIR invites Railway Board’s attention to letter No. PC- VI/2008/1/RSRP/1 dated 12/09/2008 relating to Pay Fixation tables for Running Staff which were given effect from 01/01/2006 and wherein the Fitment Factor was 2.118 for Running Staff (in view of pay element) instead of 1.86.
Considering the 30% pay element of Running Stuff which is needed to be taken for arriving at multiplier factor, the Federation is of the view that the Fitment Factor for Pay Fixation of Running Staff in the 7th CPC Pay Matrix shall be “3” instead of “2.57”.

NFIR, therefore, urges upon the Railway Board to take the above points into consideration for the purpose of determining the Fitment Factor as “3” in the case of Running Staff for granting 7th CPC Pay Fixation w.e.f. 01/01/2016.

Sub: Reckoning of 30% pay element for the purpose of payment towards leave encashment upto 10 days to running staff.

Board have issued instructions vide letter No. F(E)III/2008/LE-I/I dated 29-10-2008 on encashment of leave while in service.

2. Some of the Zonal Railways had sought clarification whether 30% pay element is to be reckoned for the purpose of leave encashment upto 10 days of LAP to the running staff.

 3. The matter has been considered by the Board and it is clarified that in the case of Running Staff, the calculation of leave encashment upto 10 days wil be done in the same manner as in the case of leave salary in terms of Rule 25(i)(k) of “The Rules for the payment of Running and other Allowances to the Running staff on Railways, 1981″

4. An illustration of the above is shown below:

(i) Basic Pay in general = Basic in Pay Band + Grade Pay = BP

(ii) Basic Pay of running staff = 130% of BP = (A)

(iii) DA rate in general = DA%

(iv) DA for running staff = DA% of (A) =(B)

(v) Leave encashment for 1 day = (A + B)/30
