Sub: Special cash package equivalent in lieu of Leave Travel Concession Fare for Central Government Employees during the Block 2018-21.

In view of Covid-19 pandemic and resultant nationwide lockdown as well as disruption of transport and hospitality sector, as also the need for observing social distancing, a number of Central Government employees are not in a position to avail themselves of LTC for travel to any place in India or their Hometowns in the current Block of 2018-21.

2. With a view to compensate and incentive consumption by Central Government employees thereby giving a boost to consumption expenditure, it has been decided that cash equivalent of LTC, comprising Leave Encashment and LTC fare of the entitled LTC may be paid by way of reimbursement, if an employee opts for this in lieu of one LTC in the Block of 2018-21 subject to the following conditions:-

a) The employee spends the money of a larger sum than the entitlement on account of LTC on actual expenditure.

b) Cash equivalent of full leave encashment will be allowed, provided the employee spends an equal sum. This will be counted towards the number of leave encashment on LTC available to an employee.

C) The deemed LTC fare for this purpose is given below :-

d) The cash equivalent may be allowed if the employee spends a sum 3 times of the value of the fare given above.

e) The amount both on account of leave encashment and fare shall be admissible if the employee spends (i) an amount equal to the value of leave encashment and; (ii) an amount 3 times of the cash equivalent of deemed fare, as given above on purchase of such items / availing of such services which carry a GST rate of not less than 12% from GST registered vendors / service providers through digital mode and obtains a voucher indicating the GST number and the amount of GST paid.

f) The admissible payment shall be restricted to the full value of the package [leave encashment as admissible for LTC and deemed fare] or depending upon the spending as per example given at Annexure-A.

g) While TDS is applicable in the case of leave encashment, since the cash reimbursement of LTC fare is in lieu of deemed actual travel, the same shall be allowed exemption on the lines of existing income-tax exemption available to LTC fare. The legislative amendment to the provisions of the Income-Tax Act, 1961 for this purpose shall be proposed in the due course. Hence, TDS shall not be required to be deducted on the reimbursement of deemed LTC fare.

3. Head of the Departments / DDOs may make reimbursement under this package as per the details given above on receipt of invoices of purchases made / services availed during the period post the issuance of this order from the employees who are desirous to avail this package. It may be noted that in order to avail this package an employee should opt for both leave encashment and LTC fare.

4. An amount upto 100% of leave encashment and 50% of the value of deemed fare may be paid as advance into the bank account of the employee which shall be settled based on production of receipts towards purchase and availing of goods and services as given in Para 2(e). The claims under this package (with or without advance) are to be made and settled within the current financial year. Non-utilization / under-utilization of advance is to be accounted for by the DDOs in accordance with the extant provisions relating to LTC advance i.e. immediate recovery of full advance in the case of non-utilisation and recovery of unutilized portion of the advance with penal interest.

5. These orders will take effect from the date of issuance of this Office Memorandum and will be in force during the current financial year till 31st March, 2021.

6. All the Ministries/ Departments are requested to bring the contents of this OM to the notice of all its Attached and Subordinate offices for their information.

Leave Encashment of Employees

As per Rule 39 of the CCS (Leave) Rules, 1972, a Central Government servant is entitled to cash equivalent of leave salary for both earned leave and half pay leave at his / her credit on the date of retirement, subject to a maximum of 300 days including the period of encashment allowed in the previous employment under the Central Government.

In case a Government servant resigns or quits service, the maximum encashment of leave allowed is 150 days.

The above information was given by the Minister Shri Jitendra Singh in a written reply in the Rajya Sabha on 5.12.2019.

Subject: Leave encashment to officers appointed on contract in various posts under Government - regarding

The undersigned is directed to say that the leave terms of the officers appointed on contract in various posts under the Government are governed by DoPT' s OM No.12016/ 3/84-Estt.(L) dated 12.04.1985 which was subsequently amended vide OMs No. 12016/1/ 90-Estt. (L) dated 05.07.1990, No.12016/ 2/ 99-Estt(L) dated 12.07.1999 and No.12016/ 5/ 2009-Estt.(L) dated 31.01.2011.

Para 2 of the OM dated 12.04.1985 prescribed the limit of encashment of earned leave upto a maximum period of 180 days during the contract period of such officers which was amended vide OMs dated 05.07.1990 and 12.07.1999 thereby increasing the maximum permissible encashment limit of earned leave upto 240 days and 300 days respectively. Para 3 of the above OM dated 12.04.1985 prescribed that the total earned leave for which encashment may be allowed together with the earned leave or full pay lave or which encashment had been allowed in previous appointments, if any, under the Government is not more than 180 days which was subsequently increased to 240 days and 300 days vide OMs dated 05.07.1990 and 12.07.1999 respectively.

It has been observed that many times the Government appoints officers on contract for a specified period in public interest keeping in view their professional or scientific/ technical expertise and this restriction of 300 days may act as a disincentive especially for those who have highly specialized professional or scientific/ technical skills to join the government in various posts on contract basis for a specified period.

Now, it has been decided in consultation with Department of Expenditure that the officers who are appointed on contract in various posts under the Central Government will be allowed encashment of earned leave at their credit on the date of termination of contract, subject to the condition that for each completed year of service put in by him in the post in such contract appointment, not more than 10 days benefit of earned leave encashment shall be permissible. While calculating the encashment of leave in such a contract appointment, the number of days of leave for which encashment had been allowed in previous appointment, if any, under the Government shall not be taken into account. The relevant provisions relating to earned leave encashment as contained in para 2 and 3 of DoPT's OM No.12016/ 3/84-Estt.(L) dated 12.04.1985 as amended vide OMs dated 05.07.1990, 12.07.1999 and 31.01.2011 stand further amended accordingly.

The above amendments will be effective with effect from the date of issue of this OM.

What is the maximum amount of study leave which can be availed?
The maximum amount of study leave for other than CHS officers is restricted to twenty four months during the entire service period and ordinarily it can be allowed for upto twelve months at a time. {Rule 51(1)). For CHS officers the ceiling is for 36 months for acquiring PG qualifications. {Rule 51(2)}.

Whether study leave can be clubbed with other leave?
Yes. Study leave may be combined with other kinds of leave, but in no case shall be grant of this leave in combination with leave, other than extraordinary leave involve a total absence of more than twenty eight months generally and thirty-six months for the courses leading to PhD. degree from the regular duties of the Government servant. (Rule 54)

Whether study leave can be clubbed with other leave?
Yes. Study leave may be combined with other kinds of leave, but in no case shall be grant of this leave in combination with leave, other than extraordinary leave involve a total absence of more than twenty eight months generally and thirty-six months for the courses leading to PhD. degree from the regular duties of the Government servant. What is the validity period of bond to be executed by the Government servant while proceeding on study leave?
Government servant is required to execute a bond to serve the Government for a period of three years after expiry of study leave. For CHS officers the period is five years. (Rule 55).

Whether a Govt. servant who has been granted study leave may be allowed to resign to take up a post in other Ministries/ Department of the Central Govt. within the bond period?
As per rule 50(5) (iii), a Govt. servant has to submit a bond to serve the Govt. for a period of 3 years. As the Govt. servant would still be serving Government in a Department other than parent Department, he may be allowed to submit his resignation to take up another post within the Central Govt. if he had applied for the post through proper channel.

Leave Encashment with LTC

Whether encashment of leave is allowed after LTC is availed?
Sanction of leave encashment should, as a practice, be done in advance, at the time of sanctioning the LTC. However, ex-postfacto sanction of leave encashment on LTC may be considered by the sanctioning authority as an exception in deserving cases within the time limit prescribed for submission of claims for LTC.

Whether encashment of leave with LTC can be availed at the time when the LTC is availed by the Government servant only or can leave be encashed at the time when LTC is availed by family members?
Yes. A Govt. servant can be permitted to encash earned leave upto 10 days either at the time of availing LTC for himself or when his family avails it provided other conditions are satisfied.

Whether leave encashment should be revised on retrospective revision of pay/D.A?
In terms of 38-A of CCS(Leave) Rules, encashment of EL alongwith LTC is to be calculated on pay admissible on the date of availing LTC and DA admissible on that date. If pay or DA admissible has been revised with retrospective effect, going by the rule the Govt. servant would be entitled to encashment of Leave on the revised rates.

Whether encashment of Earned Leave and Half Pay Leave is admissible to industrial employees?
The industrial employees, other than those under the cadre control of the Ministry of Railways, are entitled to encash both Earned Leave and Half Pay Leave, subject to overall limit of 300. The cash equivalent of Half Pay Leave shall be equal to leave salary admissible for Half Pay Leave plus Dearness Allowance admissible on the leave salary without any reduction being made on account of pension and pension equivalent of other retirement benefits payable. But no commutation of Half Pay Leave shall be allowed to make up for the shortfall in Earned Leave and these orders are effective from 07-11-2006.{0M No. 12012/3/2009- Estt.(L) dated 28-12-2012}

Subject:- Clarification in respect of encashment of Earned Leave to reemployed pensioners- Reg.

This Department has been receiving several references requesting for clarification relating to CCS (Leave) Rules, 1972 regarding eligibility for leave encashment to Government servants who are re- employed after retirement.

2. In this regard, it is clarified that persons re-employed after retirement may be governed by rule 39(6) (a)(iii) of the said Rules and they may be granted leave encashment up to a maximum of 300 days including the period for which encashment was allowed at the time of retirement. The cases already decided otherwise in consultation with this Department need not be reopened.

3. This issues with the approval of JS(E).

Cabinet approved leave encashment up to 180 days in respect of those Defence personnel who died or were invalidated out of service between 30.12.1991 to 29.11.1999 with less than 15 years of service

Cabinet approves encashment of accumulated leave to certain Defence Services Personnel who died or were invalidated out while in service between 30 December 1991 to 29 November 1999 with less than 15 years of service

The Union Cabinet chaired by the Prime Minister Shri Narendra Modi has approved leave encashment up to 180 days in respect of those Defence personnel who died or were invalidated out of service between 30.12.1991 to 29.11.1999 with less than 15 years of service.

The decision will benefit the families of 9777 Officers and other personnel of Defence Services who died or were invalidated out of service during this period. This period is very significant as a large number of casualities took place during the Kargil conflict ("Operation Vijay") and in counter insurgency operation in J&K and North East during the period.

Sub: Reckoning of 30% pay element for the purpose of payment towards leave encashment upto 10 days to running staff.
Board have issued instructions vide letter No. F(E)III/2008/LE-I/I dated 29-10-2008 on encashment of leave while in service.

2. Some of the Zonal Railways had sought clarification whether 30% pay element is to be reckoned for the purpose of leave encashment upto 10 days of LAP to the running staff.

 3. The matter has been considered by the Board and it is clarified that in the case of Running Staff, the calculation of leave encashment upto 10 days wil be done in the same manner as in the case of leave salary in terms of Rule 25(i)(k) of “The Rules for the payment of Running and other Allowances to the Running staff on Railways, 1981″

4. An illustration of the above is shown below:
(i) Basic Pay in general = Basic in Pay Band + Grade Pay = BP
(ii) Basic Pay of running staff = 130% of BP = (A)
(iii) DA rate in general = DA%
(iv) DA for running staff = DA% of (A) =(B)
(v) Leave encashment for 1 day = (A + B)/30
5. Other terms and conditions on encashment of leave will remain the same.

6. This issues with the concurrence of the Finance Directorate of the Ministry of Railways.

Representations have been received in this office to allow leave encashment to Railway employees who have failed to avail the benefit during the previous blocks despite availing Pass/PTO and leave during a block on the ground that the concept of block period was new for the Railway employees and it Introduced during the 2nd block period resulting in some of the employees failing to apply for the same due to various reasons

2. The matter has been sympathetically considered by Board and it has been agreed to allow leave encashment to the employees who have failed to avail the same during the previous block period (first three block periods) despite fulfilling the condition of availing of Pass/PTO and leave during the block, as one time exemption, with the condition that leave encashment will be made at the rate of pay applicable at the time of availing of leave, subject to fulfillment of the conditions as laid down in Railway Boards letter of even No’s dated 29.10.2008 and 11.06.2009, as applicable on the day of leave availed, with the approval of leave sanctioning authority

3. The above relaxation Is made as one time measure and the employees have to apply for the same along with the proof of grant of leave and pass during the block period within four months from the date of issue of this letter.

4. It is reiterated that it is a one-time relaxation and in future including the current block no claim from a retrospective date shall be entertained. All the claims for leave encashment should be done with prior approval of the competent authority as per the block system of Leave encashment

5. This issues-with the approval of Board (MS & FC).
