Reference is invited to Govt. of India, Ministry of Finance, Department of Expenditure Office Memorandum No. 2/5/2017-E.IIB dated 05.03.2019 (copy attached) wherein the Ministry has dispensed with the condition of applying for Government Accommodation and furnishing of ‘No Accommodation Certificate’ by Central Government employees to become eligible for HRA, in respect of General Pool Residential Accommodation (GPRA) controlled by Directorate of Estate, Ministry of Housing and Urban Affairs. It has been further stipulated in the ibid Office Memorandum that Ministries/Departments having their separate pool of residential accommodation for their employees other than GPRA, have been suggested to adopt these provision, wherever feasible.
Accordingly, comments from PCDA/ CDA/ Estate Officers were called for and the matter was under consideration at this office. Now, in terms of rules contained in Allotment of DAD Pool Residential Accommodation Rules, 2019, it has been decided with the approval of Competent Authority that the provision of Govt. of India, Ministry of Finance, Department of Expenditure Office Memorandum No. 2/5/2017-E.IIB dated 05.03.2019 shall be applied to DAD Pool Residential Accommodations except Reserved or Appointment accommodation at various stations pan India with retrospective effect ie. w.e.f. 05.03.2019, the date of issue of ibid orders.
PCDA/ CDA/ Estate Officers are therefore requested to apply the ibid Office Memorandum dated 05.03.2019 on DAD Pool Residential Accommodations except Reserved or Appointment accommodation and dispense with the conditions of applying for Government Accommodation and furnishing of ‘No Accommodation Certificate’ for admissibility of House Rent Allowance w.e.f. 05.03.2019.

Several references are being received in this Department to review the condition of applying for

continuation to the OM. of even Number dated 10.4.2018 vide which the
concessional retention of General Pool Residential Accommodation at the
last place of posting by Central Government Civilian Employees,
Centrally Armed Paramilitary Forces employees and officers of All India
Services on their posting to a Non-family stations was extended up to
30.06.2021 on payment of normal rate of licence fee, it is further
clarified that the term 'Non Family station' includes:
(i) North Eastern Region, Sikkim, Andaman & Nicobar Islands and Lakshadweep, State of Jammu & Kashmir
(ii) Left Wing Extremist (LWE) areas, as declared by Ministry of Home Affairs from time to time.

who have served and are currently serving on Central
Staffing Scheme
post in Delhi for at least four years and require to
retain Government
accommodation, would be issued a certificate to the
effect that the
officer concerned has served for at least four years in

Reference: HQrs Office Important Circulars Xo.AX/XVIII/1/18001/GH dated
21.11.200 and AN/XIV/14153/III/HRA/CCA/Vol.-X dated 18.03.2011
Comprehensive
guidelines have been issued on the subject vide HQrs Office Important
Circular dated 21.11.2000, to regulate the stay of officials at Guest
Houses/transit accommodations. Further, HQrs Office Circular dated
18.03.2011 clearly stipulates that those occupying Government
accommodation are not eligible for HRA and that the officers staying in
the Inspection Quarters/Bungalow etc. in the Headquarters of their
posting will not be entitled to draw HRA for the penod during which they
stay in the Inspection Quarters/Bungalow etc.
2. Despite this, HQrs office is in receipt of reference from PCDA/CDA asking for clarification
on the subject matter.

It is therefore, reiterated that those residing in Government
accommodation be it Inspection Quarter or Transit Facility or Guest
House shall not be granted HRA as stipulated vide GOI, Ministry of
Communications, in consultation with Ministry of Finance, vide their
letter No.14-4/85-NB dated 26.11.1985. Action may be taken accordingly.

Licence Fee to be recovered from the allottee of the Government
accommodation, who own house(s) at the place of his duties – Reg.
The
undersigned is directed to refer to this Directorate’s OM No.
12035/11/99-Pol.II, dated 24.7.2003 (copy enclosed) on the above
mentioned subject and to say that as per the provisions of SR –
317-B-3(2) of the Allotment of Government Residences (General Pool in
Delhi) Rules, 1963, an allottee, owning a house at the time of allotment
either in his own name or in the name of any members of his family at
the place of posting or in an adjoining municipality, shall notify the
fact to the Directorate of Estates within a period of one month from the
date of the house is let out. As per the provisions of SR-317-B-3(3)
ibid, when after a Govt. accommodation has been allotted, the allottee
or any member of his family become owner of a house at the place of his
duty or in an adjoining municipality, shall notify the fact to the
Directorate of Estates within a period of one month from the date of
house is let out.

However, it is noticed from the records received from concerned
administrative divisions of Ministries/Departments that declaration of
house owning is received only at the time of application for allotment
of accommodation, whereas, the same under the provisions SR-317-B-3(3)
received is very negligible as compared to allotment made. In order to
streamline the already laid down procedure, it is requested that the
administrative authority of the concerned Ministries/Departments, etc.
to ensure that the provisions Sr-317-B-3(2) as well as 3(3) are followed
strictly. In this regard, it is pertinent to mention here that from
1.3.2015 onwards, concerned Ministries/Departments of the applicant for
GPRA are advised to ensure that the particulars/details furnished by the
applicant in the online DE-2 Form and the Acceptance Form are true and
correct. It is thus requested now that the administrative authority of
the concerned Ministries/Departments should ensure that the entries made
by the applicant in DE-2 Form as well as the Acceptance Form with
regard to owning of house, at the time of forwarding the same to this
Directorate is as per the latest Immovable Property Return (IPR) filed
by the applicant.

Further, they should also instruct all allottees in their
Ministry/Department to intimate the Directorate of Estates regarding
rental income, if any, from the house owned at the time of
allotment/acquired after the allotment of Govt. accommodation either in
his own name or in the name of any members of his family at the place of
posting or in an adjoining municipality, and whenever any change in
rental income, which affect the rate of prescribed licence fee as per OM
No. 12035/11/99-Pol.II, dated 24.7.2003, so as to levy the prescribed
rate of licence fee in this regard, to avoid any loss to Govt.
exchequer. In case the details of rental income furnished by any
allottee is found false at any later stage, the licence fee of the
particular accommodation will be enhanced to the maximum as per OM dated
24.7.2003 w.e.f the date of increase, by the Directorate of Estates suo
motu.

Recovery of Special Licence Fee under FR-45-B in respect of General
Pool Accommodation including Hostel Accommodation, Servant Quarters.

This is
in supersession of this Directorates order of even No. dated 11th March
2015, wherein the revised Special Licence Fees under FR-45-B for various
types of General Pool Govt. Accommodations w.e.f 1.7.2013 were
notified. it has been decided to simplify the procedure of revising the
Special Licence Fee under FR-45-B to be charged from allottees i.e..
Govt. servants and other ineligible offices/organization for short
period/temporary allotment of General Pool Residential accommodation on
special purposes. The Special Licence Fee is practically applied where
flat rate of licence fee under FR-45-A is not applicable. Accordingly.
it has been decided to charge the Special Licence Fee uniformly in
multiples of flat rate of licence fee. as prescribed for damages. The
revised Special Licence Fees for various types of General Pool Govt.
Accommodations are as follows:

This issues with the concurrence of Integrated Finance Wing of the
Ministry of Urban Development vide its Diary No. 262/Dy.FA/FD/14, dt.
6/8/2014 and with the approval of Hon’ble UDM.
Efforts to improve better living, working and service condition for CAPF Personnel
The
Government keeps on making efforts to improve better living, working
and service condition for force personnel. The following measures have
been taken in this regard:-
i) Implementing a transparent, rational and fair leave policy;
ii) Grant of leave to the force personnel to attend to their urgent domestic issues and social commitments;
iii)
Regular interaction, both formal and informal, among Commanders,
officers and troops to find out and address their problems;
iv) Revamping of grievances redressal machinery;
v) Regulating duty hours to ensure adequate rest and relief;
vi) Improving living conditions through provision of basic amenities/facilities for troops and their families;
vii)
Government has approved extensionof the facility of retention of
Government accommodation at the last place of posting for CAPF personnel
deployed/posted in Left Wing Extremism affected areas/ districts
(except State capitals), as notified by the Government of India from
time to time, on payment of flat rate/normal license fee. This facility
is already being given to the Force personnel in case of posting to NE
States and J&K State.
viii) Motivating the forces through
increased risk/hardship and other allowances such as Detachment
Allowance, Kit Maintenance Allowance, Washing Allowance, Ration Money
Allowance, MARCOS etc;
ix) Provision of STD telephone facilities
to the troops to facilitate being in touch with their family members
and to reduce tension in the remote locations;
x) Officers and
Jawans serving in hard area are being given preference for posting to
soft/static locations as per their choice to the extent possible;
xi)
Better medical facilities for troop and their families including
introduction of Composite Hospitals with specialized facilities;
xii) Organising talks by doctors and other specialists to address their personal and psychological concerns;
xiii) Yoga and meditation classes for better stress management;
xiv)
Treating the hospitalization period due to injury suffered by CRPF
personnel during the course of duty to be treated as duty.
xv)
Adequate steps have been taken in all establishments to provide and
upkeep the recreational and sport facilities. Force personnel are
encouraged constantly to actively participate in sports and games;
xvi)
Providing welfare measures like Central Police canteen facility to the
troops and their families, scholarships to their wards, etc;
xvii)
Giving status of ex-CAPF personnel to the retired personnel of CAPF,
which is expected to boost the morale of the existing CAPFs personnel
and also expected to provide better identity, community recognition and
thus higher esteem and pride in the society to the Ex-CAPF personnel;
xviii)
CRPF campus at various locations are renewed and upgraded according to
present scenario. Adequate basic amenities like toilets, bathrooms,
drinking water points, messing for both male and female are available.
Mobile toilets are also provided to troops for use during operational
duty.
xix) Force campuses are kept clean and sanitation rounds
are done by medical officers to monitor and keep up the hygiene status
of the campus.
xx) Schemes have been implemented for
facilitating the women personnel i.e. Gender Sensitization, Health care
Centre, improvised service, nutritional care centre etc;
xxi) in addition to the above, the female personnel are liberally given Child Care Leave (CCL);
xxii) Crèche is also established at various group Centres/Units locations to facilitate the female employees;
xxiii)
The air courier service facility has been extended to CAPF personnel
deployed in remote areas of North east and Jammu & Kashmir region
including Leh as a welfare measure;
xxiv) Promotions are being released regularly to the eligible personnel as and when vacancies arise in the next higher rank;
xxv)
To increase the promotional avenues for CRPF Jawans. CRPF has been
instructed to carry out Cadre Reviews regularly as per the DoP&T
guidelines.
xxvi) The financial benefits under Modified Assured
Career Progression (MACP) Scheme and Senior Time Scale (STS) Scheme are
given in time as per the rules to the eligible personnel in case they do
not get promotion for want of vacancies;
xxvii) Relaxations are
considered in residency/qualifying service, where there exist vacancies
but the personnel in feeder grade are short of meeting the eligibility
condition;
xxviii) The doctors are given time bound promotion
upto the rank of Commandant (Grade Pay of Rs. 8,700/-) and time bound
financial up-gradation to the further two ranks i.e. to Deputy Inspector
General (Grade Pay Rs. 8,900/-) and Inspector General (Grade Pay Rs.
10,000/-).
xxix) On the recommendations of the 6th CPC,
Government has introduced ASI rank in the General Duty of CAPFs
including CRPF. This has reduced the stagnation in the rank of Head
Constable.

in high intensity conflict areas is forcing the jawans and officers to
suffer from large scale `Social Ostracism`;
(b) if so, the details thereof and the corrective steps taken/being taken by the Government in this regard;
(c)
whether there are reports that the youths are reluctant to join CRPF
and if so, the details thereof and the reaction of the Government
thereto; and
(d) the comprehensive measures being taken by the
Government for ensuring better living and working conditions of both
male/female personnel, bringing more promotional avenues for CRPF
jawans, boosting the morale of the personnel and to facilitate their
involvement in society?

There are no such reports. However, as per the information received
from the Central Reserve Police Force (CRPF), only about 6% of

The question of allowing house retention in case of postings to USBRL
project in Jammu and Kashmir and the postings to the difficult projects
(National) in N.F.Railway (as per annexure) have been considered by the
Ministry of Railways (Railway Board) following the recommendations on
the subject by the committee on incentives formed for the purpose. The
Board has agreed to allow the following incentives;
Incentives proposed for USBRL Project:
For officers and staff, posted in J&K (USBRL project) permission
to retain Railway accommodation at previous place of posting as per
Railway Board’s guidelines
Incentives proposed for identified “Difficult Projects” of N.F. Railway.
For officers and staff, posted on “Difficult Projects” of N.F. Railway
to retain Railway accommodation at previous placeof posting as per
Railway Board’s guidelines.
4. The above incentives will be limited to the project construction phase only and are effective from 01-04-2012 till reviewed.
5. This issues with the concurrence of the Finance Directorate of the Ministry of Railways.

Minister asks CPWD to get efficient, transparent and accountable
Urban Development Minister Shri
M.Venkaiah Naidu today inaugurated 400 quarters in Dev Nagar, Karol
Bagh, New Delhi, for immediate allocation to the keenly awaiting central
government employees. Central Public Works Department (CPWD) built
these Type-III quarters at a cost of Rs.83 cr.
Speaking on the occasion, Shri Naidu
said, the availability of housing stock in General Pool Residential
Accommodation, under which houses are provided to central government
employees, senior officials, Judiciary, Members of Parliament, Ministers
etc., in the national capital is 59,293 as against the requirement of
over one lakh dwelling units. The Minister informed that Urban
Development Ministry will enable construction of over 37,000 houses in
the next four years at a cost of about Rs.15,000 cr to meet the
shortfall. He said, to address the shortfall in accommodation for
members of Lok Sabha, 52 flats are being constructed on Dr.Bishamber Das
Marg, and on their completion soon, housing needs of Lok Sabha members
will be fully met.
Shri Venkaiah Naidu informed that under
‘Housing for All by 2022’ initiative of the government, about 30 million
houses will be built in the urban areas of the country at a cost of
about Rs.22.50 lakh crores, mostly through large scale private sector
participation. He said, this is a challenging task, but not difficult.
Shri Venkaiah Naidu inspected another
block of 384 houses under construction and instructed CPWD to make
mandatory provision of solar heating panels, LED lighting, rain water
harvesting, green belt and Green Building Code for all new construction
projects.
Stating that CPWD is currently handling
over 7,000 projects at a cost of over Rs.40,000 cr, Shri Venkaiah Naidu
asked the construction major to get more efficient, transparent and
accountable in its functioning, with emphasis on quality, timely
completion of projects and proper utilization of its large manpower. He
informed that under his direction, CPWD placed all information about
7,000 projects in public domain by posting them on its website so that
public can scrutinize and monitor execution of projects. CPWD’s website
enables public to post comments, complaints and photos for taking
appropriate action.
Shri Venkaiah Naidu lamented that
intervention at his level was required to get water supply to the large
number of houses meant for government employees, whose construction was
completed last year and were inaugurated today, after substantial delay.
The Minister informed that within five
weeks of launching of Prime Minister’s Jan Dhan Yojana, over 6 crore new
bank accounts were opened and this goes to prove that ‘if there is
will, things will fall in place.’

Subject: Retention of General Pool Residential Accommodation
by Central Government Civilian Employees and Officers of All India
Services posted to North Eastern Region, Sikkim, Andaman & Nicobar
Islands and Lakshadweep – extension upto 30.6.2015.
Reference is invited to this Directorate O.M.No.12035f31/96-Pol.II
dated 7.9.1998 and subsequent instructions dated 30.9.1999, 30.4.2002,
15.7.2005, 1.7.2008 and 3.6.2011 regarding retention of General Pool
Residential Accommodation at the last place of posting by Central
Government Civilian Employees and Officers of All India Services on
posting to North Eastern Region, Sikkim, Andaman 8. Nicobar Islands and
Lakshadweep. The existing orders on the subject are valid up to 306.2014
and further extension beyond 30.5.2014 has been considered by the
competent authority. It has now been decided to further extend allowing
retention of General Pool Residential Accommodation at the last place of
posting by Central Government Civilian Employees and Officers of All
India Services on their posting to North Eastern Region, Sikkim, Andaman
& Nicobar Islands and Lakshadweep for a period of one year i.e. up
to 30.06.2015. The concession of retention of GPRA would also be
admissible if a Government servant is transferred from one place to
another in the North Eastern Region.
2. Since the retention I allotment of Government accommodation is
allowed for bonafide use of the dependent family of the transferred
government servant, he/she will furnish a certificate on 1st July and
15‘ January of every year, stating that his/her dependent family members
are actually residing in the Government accommodation at the last place
of posting. Such a certificate will also have to be furnished at the
time of
seeking retention. In case no such certificate is received by 31st
January and 31 July every year this Directorate will be constrained to
cancel the allotment of the residence in question.
3. The request for retention of entitled type of accommodation should
be received within a period of one month from the date of relinquishing
the charge at the 1st place of posting so that further necessary action
could be initiated by the Directorate of Estates in Time.

The undersigned is directed to say that the matter of retention of Govt. accommodation in case of death by the allottees, who are not regular Govt. Servants viz consultant / Contractual appointee coterminous staff etc. has been considered by the competent authority and it has been decided that in case of death of the consultants / contractual appointees, co-terminus appointees in the personal staff of Ministers/other dignitaries etc. who are not regular government servants, six months retention will be allowed for the existing accommodation by the family of deceased allottee on payment of normal licence fee.

Sub: Revision of guidelines for allotment of government accommodation from General Pool to the Political Parties.
The
Directorate of Estates, Ministry of Urban Development had issued the
revised guidelines for allotment of government accommodation from
general pool to Political parties vide O.M.No.12014/2/96-pol.II dated
20.7.2000. These guidelines have been reviewed by the competent
authority and it has been decided to modify para 1 (iii) of the
aforesaid O.M. dated 20.7.2000. After modification the revised
guidelines shall be as under:
i. The National Political Parties,
which have been recognised as such by the Election Commission of India,
shall be allowed to retain/secure allotment of one housing unit from
General Pool in Delhi for their office use on payment of licence fee
under FR 45A i.e. the normal licence fee.
ii. The said
accommodation will be provided for a period three years during which the
party would acquire a plot of land in an institutional area and will
construct its own accommodation for party office.
iii. One
residential accommodation would be allotted/allowed to be retained by
the Party President of a recognized National Party provided that no
other accommodation has been allotted to him / her in another capacity.
iv.
The facility of office accommodation will also be given to the State
level parties recognised by the Election Commission of India provided it
has in the opinion of the Accommodation Committee of Cabinet, adequate
representation in Parliament and its case for allotment is approved by
the CCA on its merit.
v. The other buildings allotted or in
occupation of any political party stand cancelled. However, a period of
six months or upto the time the allotment has been made, whichever is
earlier would be given to the party to make alternate arrangement and
vacate the Government accommodation.
2. This O.M. supersedes the Directorate of Estates O.M.No.12014/2/96-Pol.II dated 20.7.2000.
