OFFICE MEMORANDUM

Subject: Grant of disability pension, comprising service element and disability clement to pre-2006 disability pensioners, who were boarded out from service, with less than 10 years of qualifying service, due to an injury/ disability, attributable to Govt. service – regarding.

The undersigned is directed to say that, considering the hardship being faced by the disabled Government servants, covered under the provisions of CCS (EOP) Rules, the Government had decided to dispense with the minimum service required for earning service element of disability pension, with effect from 01.01.2006 and orders were issued vide OM No.33/5/2009-P&PW (F). dated 10th December 2010.

Also check: 7th CPC Concordance Table – Revision of pension pre-2016 pensioners/family pensioners
  1. A doubt has been raised whether the provision of the aforesaid OM, dated 10.12.2010, would be applicable to the Government servants who were boarded out of service, prior to 01.01.2006, with a qualifying service of less than ten years.
  2. The matter has been examined and it is clarified that Central Civil Government servants who were boarded out, prior to 01.01.2006, with a qualifying service of less than ten years and were in receipt of only the disability element of disability pension, would also be eligible for the service element of disability pension, w.e.f. 01.01.2006, in addition to the disability clement.
  3. For calculating the disability pension w.e.f. 01.01.2006, the disability pension comprising, both the service element and the disability clement, will be notionally fixed from the date of boarding out and the same will be notionally revised in accordance with the orders tor revision of disability pension. issued from time to time. The actual payment of such revised disability pension would be payable only w.e.f. 01.01.2006, No arrears on account of grant of service element, for the period prior to 01.01.2006, would be admissible. The amount of service gratuity, if any paid, to the Government servant at the time of boarding out would be adjusted from the arrears of pension accruing as a result of these orders.
  4. This issues with the concurrence of the Ministry of Finance, Department of Expenditure, vide their ILD. Note No. 1(9)/EV/2019 dated 25/06/2020.
  5. In their application to the persons belonging to Indian Audit and Accounts Department, these orders are issued under Article 148(5) of the Constitution and after consultation with the Comptroller and Auditor General of India.
  6. The Administrative Divisions of all Ministries / Department & attached / subordinate offices are requested to bring the contents of these instructions to the notice of all concerned for compliance.

  9. The DPDO…………
  10. The Post Master………….. Sub: Payment of Additional Quantum of Pension to old pensioner. Representations are being received from various Pension Disbursing Agencies(PDAs) seeking clarification as to from which date payment of additional quantum of pension to the armed forces service pensioners on attaining age of 80 years and above will be paid in cases where age shown in the PPO varies with the exact date of birth mentioned in the office records (i.e original discharge certificate).
The issue has been examined and it is noticed that in all old cases, there was a practice of mentioning the age of armed forces personnel instead of date of birth (though the date of birth was mentioned in LPC cum data sheet provided by the records offices). It is also noticed in some cases that age mentioned in the PPO differs from the date of birth/age mentioned in the LPC cum data sheet due to late submission of claim by ROs/HOOs and late notification of PPO as well.

Accordingly, it has been decided that in all such cases where pensioner is not satisfied or PDA is not sure regarding date of commencement of additional pension, the cases may be referred to this office through ROs/HOOs' concerned for issuing Corr. PPO for making necessary amendment.

PIL seeks review of One Rank One Pension (OROP) scheme

PIL seeks review of One Rank One Pension (OROP) scheme

A plea filed in the Delhi High Court has asked for the ‘One Rank, One Pension’ scheme to be reviewed and a public hearing to take note of the grievances of ex-servicemen.

Chief Justice G. Rohini and Justice Jayant Nath have now ordered for the PIL to be listed before another Bench on Thursday.

The PIL has also sought extension of the term of the one-man commission of L. Narasimha Reddy, who was former Chief Justice of the Patna High Court. The Commission was instituted to review the ‘One Rank, One Pension’ scheme after several veterans of the Army objected to it.

Filed by ex-serviceman S.P. Singh, the PIL sought directions to the Ministry of Defence (MoD) and the Commission “to give an effective public hearing to those affected or aggrieved by implementation of One Rank One Pension (OROP)”.

According to the petition, a letter from the Ministry of Defence dated April 13, 2016, said: “Defence Forces pensioners/family pensioners, Defence Pensioners’ Associations can submit their representation, suggestions/views on the revised pension as notified, to the MoD, through post or by email within 15 days i.e. by April 29, 2016”.

‘Notice not published’

The petitioner also claimed that the notice was not published in newspapers, as a result of which most people did not know about it. It also said that the time given to submit grievances and suggestions was very little, and that asking those the scheme will affect to forward their grievances to the Ministry was “unfair and in violation of principles of natural justice”.

It also said that the mechanism for consultation only allowed written representations, which violated “the basic concept of effective hearing”.

The petition also said that the Central government did not provide the address and contact information of the Commission despite “repeated requests”, due to which those affected by the scheme would not be able to put their objections before it ahead of the mid-June deadline.

————————
Sub: Delay in preferment of pension claims in respect of normal discharge PBOR of Army, Navy and Air Force.

Ref: This office circular No. 540 dated 11/05/2015.

Under the existing orders, claims for service pension in respect of personnel below officer rank are required to be submitted to the pension sanctioning authority concerned, viz. PCDA (P), Allahabad in respect of Army, PCDA (N), Mumbai in respect of Navy and JCDA (AF), New Delhi in respect of Air Force, at least four months in advance of their retirement from service. This arrangement has been made with a view to ensure that the pensionary awards in respect of the personnel are notified in the PPO well before their discharge/retirement and the pension certificates are handed over to them before they are discharged.

It has been observed that above time schedule is not being adhered to by ROs resulting in delay in finalization of pensionary awards in respect of PBORs. Higher authorities have taken a serious view on the matter.

It is, therefore, requested that time frame for submission of pension claims to this office may strictly be followed in order to avoid delay in finalization of pensionary awards to the retiring personnel. This would definitely help in reducing the CAT/Court cases, interest payment etc at a later stage.
Please acknowledge receipt.

One Rank One Pension: Group of ex-servicemen decides to boycott government functions

One Rank One Pension: Group of ex-servicemen decides to boycott government functions

A group of ex-servicemen on Monday announced that they will boycott all official functions, including ongoing 50th anniversary celebrations of the victory in 1965 war, in protest against delay over implementation of “One Rank One Pension” by the government.

A group of ex-servicemen on Monday announced that they will boycott all official functions, including ongoing 50th anniversary celebrations of the victory in 1965 war, in protest against delay over implementation of “One Rank One Pension” by the government.

Protesting against the delay in implementation of OROP, the ex-servicemen in various cities across the country are holding relay hunger-strike, which entered the eighth day on Monday. “Our protest will continue till our legitimate dues of OROP is met by the government. We have decided to boycott all official functions including the ongoing commemoration of the victory of 1965 War and the upcoming Independence day celebrations,” Chairman of Indian Ex-Servicemen Movement (IESM) Major General (Retd) Satbir Singh told PTI here.

Hitting out at the government over non-implementation of their long-pending demand of OROP, Singh, who is also Convenor of the United Front of Ex-Servicemen (UFESM) said, “The widows of 1965 war are not getting their dues and nor the soldiers who fought the war. What the government is commemorating?” India had defeated Pakistan in 1965 war.

The Narendra Modi government has said it was committed to OROP, a key promise made during Lok Sabha polls. It is, however, yet to implement the scheme. Around 22 lakh ex-servicemen and over six lakh war widows stand to be the immediate beneficiaries of the OROP scheme, which envisages a uniform pension for defence personnel who retire in the same rank with the same length of service, irrespective of their date of retirement.

Currently, the pension for ex-servicemen is based on the recommendations of the Pay Commission of that time when they had retired.

So, a Major General who retired in 1996 draws a lower pension than a Lieutenant Colonel who retired after 1996. Meanwhile, asked about indications that the government might extend OROP to Jawans and other ranks, another official of the group termed it as “tragic”.

“It would be a real tragic as the government is trying to divide us. We stand united in demanding OROP for all,” Colonel (Retd) Anil Kaul, Media Advisor to IESM said. The ex-servicemen said they were considering taking help from opposition parties, especially in Bihar, to push for their demand.

Assembly elections in Bihar are likely to be held in September or October this year. BJP has a tough fight on hand against the JD(U)-RJD-Congress-NCP combine. Besides Bihar, they think they are a strong constituency also in Punjab where the Assembly elections are due in early 2017.
