Diwali Bonus for Tamil Nadu State Government (PSU) Public Sector Undertakings Employees 2019

By a press release dated 15 October 2019 the State Government of Tamil Nadu has confirmed the 2018-19 Diwali Bonus.

The bonus pay limit is Rs. 21000, according to the press release. The monthly incentive estimate salary limit is Rs. 7000. The maximum amount of Rs 16800 and Rs 8400 is the minimum salaries for workers in the public sector.

All qualifying PSU employees receive a 20 percent bonus and other PSU employees also receive a bonus of 10 percent. TNEB and TNSTC worker and Staff will receive a bonus of 8.33% with an ex gratia of 11.67%, a maximum bonus of 20% for 2018-19.

7th Pay Commission Latest News 2019 - In the lead of great festival season the Centre has declared ad hoc bonus to Central Para Military Forces and Armed Forces as per the recommendations of 7th Pay Commission.

In the lead of great festival season the Centre has declared Non Productivity Linked Bonus (ad hoc bonus) to all eligible Central Para Military Forces and Armed Forces and Non Gazetted Central Government Employees as per the recommendations of 7th Pay Commission.

The payment of ad-hoc Bonus under these orders will also be admissible to the eligible employees of Central Para Military Forces and Armed Forces. The orders will be deemed to be extended to the employees of Union Territory Administration which follow the Central Government pattern of emoluments and are not covered by any other bonus or ex-gratia scheme.

Bonus for Non Gazetted Central Employees

According to the notification, Non Productivity Linked Bonus (ad hoc bonus) equivalent to 30 days emoluments for the accounting year 2018-19 to all eligible Central Government employees in Group 'C' and all Group 'B' Non Gazetted Central Government Employees who are not covered by any Productivity Linked Bonus monthly emoluments of Rs. 7000 as revised with effect from 1st April 2014.

Clarification No.1
Point: Whether the employees in the following categories are eligible for the benefit of ad-hoc bonus for an accounting year

Clarification: Subject to completion of minimum six months continuous service and being in service as on 31st March, 2019.

Clarification No.2

Point: Employees appointed on purely temporary ad-hoc basis.
Clarification: Yes, if there is no break in service.

Clarification No.3:

Point: Employees who resigned, retired from service or expired before 31st March, 2019.

Clarification: As a special case only those persons who superannuated or retired on invalidation on medical grounds or died before 31st March, 2019 but after completing at least six months regular service during the year will be eligible for the ad-hoc bonus on pro rata basis in terms of nearest number of months of service.

Clarification No.4

Point: Employees on deputation/foreign service terms to state governments, U.T.Governments, Public Sector Undertakings, etc., on 31st March, 2019.
Clarification: Such employees are not eligible for the ad-hoc bonus to be paid by the lending departments. In such cases the liability to pay ad-hoc bonus lies with the borrowing organization depending upon the ad-hoc bonus/PLB/ex-gratia / incentive payment scheme, if any, in force in the borrowing organization.

Clarification No.5

Point: Employees who reverted during accounting year from deputation on foreign service with the organizations indicated in ‘C’ above.

Clarification: The total amount of bonus ex-gratia received for the accounting year from foreign employer and the ad-hoc bonus, if any, due from a central government office for the period after reversion will be restricted to the amount due under ad-hoc bonus as per these orders.

Clarification No.6

Point: Employees from state Government / U.T. Admn. / Public Sector Undertakings on reverse deputation with the Central Government.

Clarification: Yes, they are eligible for ad-hoc bonus to be paid by the borrowing departments in terms of these orders provided no additional incentive as part of terms of deputation, other than Deputation Allowance, is paid and the lending authorities have no objection.

Clarification No.7

Point: Superannuated employees who were re-employed.

Clarification: Re-employment being fresh employment eligibility period is to be worked out separately for re-employment period; the total amount admissible, if any. for prior to superannuation and that for re-employment period being restricted to the maximum admissible under ad-hoc bonus under these orders.

Clarification No.8

Point: Employees on half-Pay leave / E.O.L / Leave not due/study leave at any time during the accounting year.

Clarification: Except in the case of leave without pay the period of leave of other kinds will be included for the purpose of working out eligibility period. The period of E.O.L. / dies non will be excluded from eligibility period but will not count as break in service for the purpose of ad-hoc bonus.

Clarification No.9

Point: Contract employees.

Clarification: Yes. if the employees are eligible for benefits like dearness allowance and interim relief. Categories not eligible for these benefits would be considered at par with casual labor in terms of ad-hoc bonus orders.

Clarification No.10

Point: Employees under suspension at any time during the accounting year.

Clarification: Subsistence allowance given to an employee under suspension for a period in the accounting year cannot be treated as emoluments, Such an employee becomes eligible for the benefit of ad-hoc bonus if and when reinstated with benefit of emoluments for the period of suspension, and in other cases such period will be excluded for the purpose of eligibility as in the case of employees on leave without pay.

Clarification No.11

Point: Employees transferred from one Ministry./Department/Office covered by ad-hoc bonus orders to another within the Government of India or a Union Territory Government covered by ad-hoc bonus orders and vice versa.

Clarification: Employees who are transferred from any of the Ministry/ Department/ Office covered by ad-hoc bonus orders to another such office without break in service will be eligible on the basis of combined period of service in the different organizations. Those who are nominated on the basis of a limited departmental or open competitive exam from one organization to a different organization will also be eligible for the ad-hoc bonus. The payment will be made only by the organization where he was employed as on 31st March, 2019 and no adjustments with the previous employer will be necessary.

Clarification No.12

Point: Employees who are transferred from a Government Department/ Organization covered by ad-hoc bonus orders to a Government Department/Organisation covered by productivity – Linked Bonus scheme or vice versa.

Clarification: They may be paid what would have been paid on the basis of emoluments in ad-hoc bonus covered department for the entire year less the amount due as productivity-linked bonus. The amount so calculated may be paid by Department where he was working on 31s’ March, 2019 and/or at the time of payment.

Point: Part-time employees engaged on nominal fixed payment

Clarification: Not eligible.

Clarification No.14

Point: Whether ad-hoc bonus is payable to casual labour for an accounting year in the following cases:-

(a) Those who have put in specified number of days of work in different offices during each of the three years ending with the said accounting year.

Clarification: The eligibility is to be worked out for three years from the said accounting year backwards. The period of 240 days of work in each of these years may be arrived at by combining the number of days worked in more than one offices of the government of India, for which bonus. ex-gratia or incentive payment has not been earned and received.

(b) Casual labour who were not in work on 31st March, 2019.

Clarification: The condition of being in on 31st March, 2019 employment as laid down in these orders is applicable to regular Government Employees and not to casual labour.

(c) Those who have put in at least specified number of days of work in each of two years preceding the accounting year but are short of this limit due to regularization in employment in the said accounting year.

Clarification: If a casual labour, who has been regularized in the accounting year does not fulfill the minimum continuous service of six months as on 31st March, 2018 and therefore, cannot be granted benefit as a regular employee, he may be allowed the benefit as for a casual labour provided the period of regular service in the said year if added to the period of work as casual labour works out to at least specified number of days in that accounting year.

The amount of Non-PLB (ad-hoc bonus) payable will be (Rs.1200×30/30.4 i.e.Rs.1184.21 (rounded off to Rs.1184/-).

Grant of ad-hoc bonus for 30 days to Group ‘C’ & ‘D’ RPF/RPSF Personnel for the financial year 2015-16. The calculation ceiling has been enhanced to Rs.7000 with effect from 1.4.2016.

The benefit will be admissible subject to the following and conditions:- Only those Group C & D RPF/RPSF personnel who were in service on 31.3.2011 and have rendered at least six months of continuous service during the year 2015-2016 will be eligible for payment under these orders. Pro-rata payment will be admissible to the eligible personnel for period of continuous service during the year ranging from six months to a full year, the eligibility period being taken in terms of number of months of service (rounded to the nearest number of months).

The quantum of ad-hoc bonus will be worked out on the basis of average emoluments/calculation ceiling whichever is lower. To calculate ad-hoc bonus for one day, the average emoluments in a year will be divided by 30.4 (average number of days in a month). This will there after be multiplied by the number of days of bonus granted. To illustrate, taking the calculation ceiling of Rs.7000/- (where actual average emoluments exceed 7000), ad-hoc bonus for thirty days would work out to 7000x30/30.4 = Rs.6907.89 (rounded off to Rs.6908/-).

All payments under these orders will be rounded off to the nearest rupee.

In the matter where the aforesaid provisions are silent, clarificatory orders issued vide this Ministry’s letter No.E(P&A)II-88/Bonus-3 dated 29.12.1988, as amended from time totime, would hold good.

All the Group C & D RPF/RPSF personnel. regardless of whether they are in uniform or out of uniform and regardless of place of their posting, shall be eligible only for ad-hoc bonus in terms of these orders.

We invite your kind reference to the above cited letter granting Non PLB to Central Govt employees & casual/ contingent workers. Similar orders have also been issued for the personnel in Railways, Defence and Postal Establishments etc where PLB is applicable.

While in the cam of regular employees - both PLB & Non PLB - the calculation ceiling for payment of Bonus was raised to Rs 7000/- for the years 2014/15 & 2015.16. In the case of Casual Labourers and casual labourers with temporary status, the said ceiling continues to be pegged down at Rs 1,200/-. It may kindly be noted that the said ceiling of Rs 1,200/- in the case of Casual Workers end casual workers with temporary status was determined in the yew 1999 when the ceiling for regular employees was Rs 2500/-
In the case of regular employees the said ceiling was raised to Rs 3.500/- in the year 2006 and again to Rs 7,000/- in 2016 (retrospectively from 2014-15) whereas for casual workers and Casual workers with temporary status it remained at Rs 1.200/- all along slaw 1999-2000. The emoluments of Casual Workers and Casual workers with temporary status is now proportionate to the wages of regular employees.

We request you to kindly get the matter examined and explore the possibilities of raising the ceiling limit to Rs 7000/- for casual workers and casual workers with temporary status on par with the regular employees.

Subject: Grant of Non-Productivity Linked Bonus (ad-hoc bonus) to Central Government Employees for the year 2015-16.

The undersigned is directed to convey the sanction of the President to the grant of Non-Productivity Linked Bonus (Ad-hoc Bonus) equivalent to 30 days emoluments for the accounting year 2015-16 to the Central Government employees in Groups 'C' and 'D' and all non-gazetted employees in Group 'B', who are not covered by any Productivity Linked Bonus Scheme. The calculation ceiling for payment of ad-hoc Bonus under these orders shall be monthly emoluments of Rs. 7000/-, as revised w.e.f 01/04/2014 vide OM No.7/4/2014-E.III(A), dated 29th August, 2016. The payment of ad-hoc Bonus under these orders will also be admissible to the eligible employees of Central Para Military Forces and Armed Forces. The orders will be deemed to be extended to the employees of Union Territory Administration which follow the Central Government pattern of emoluments and are not covered by any other bonus or ex-gratia scheme.
2. The benefit will be admissible subject to the following terms and conditions:-

(i) Only those employees who were in service as on 31.3.2016 and have rendered at least six months of continuous service during the year 2015-16 will be eligible for payment under these orders. Pro-rata payment will be admissible to the eligible employees for period of continuous service during the year from six months to a full year, the eligibility period being taken in terms of number of months of service (rounded off to the nearest number of months);

(iii) The casual labour who have worked in offices following a 6 days week for at least 240 days for each year for 3 years or more (206 days in each year for 3 years or more in the case of offices observing 5 day week), will be eligible for this Non-PLB (Ad-hoc Bonus) Payment. The amount of Non-PLB (ad-hoc bonus) payable will be (Rs.1200×30/30.4 i.e.Rs.1184.21 (rounded off to Rs.1184/-). In cases where the actual emoluments fall below RS.1200/- p.m., the amount will be calculated on actual monthly emoluments.

(iv) All payments under these orders will be rounded off to the nearest rupee.

(v) The clarificatory orders issued vide this Ministry’s OM No.F.14 (10)-E.Coord/88 dated 4.10.1988, as amended from time to time, would hold good.

3. The expenditure on this account will be debilable to the respective Heads to which the pay and allowances of these employees are debited.

4. The expenditure to be incurred on account of Non-PLB (Ad-hoc Bonus) is to be met from within the sanctioned budget provision of concerned Ministries/Departments for the current year.

5. In so far as the persons serving in the Indian Audit and Accounts Department are concerned, these orders are issued in consultation with the Comptroller and Auditor General of India.

Sub.: Grant of ad-hoc bonus for 30 days to the Group 'C' & 'D' RPF/RPSF personnel for the financial year 2014- 2015.

Ad-hoc bonus for 30 days without any ceiling on wages for eligibility to all eligible Group 'C' & 'D' RPF/RPSF personnel for the financial year 2014-15 was sanctioned vide Board's letter of even no. dt. 02.11.2015 with the wage calculation ceiling of Rs. 3500 p.m

2. The President has now decided that the calculation ceiling of monthly emoluments for the purpose of payment of ad-hoc bonus shall be revised to Rs. 7000/- w.e.f. 01.04.2014 i.e. for the accounting year 2014-15. Therefore, payment of ad-hoc bonus for the financial year 2014-15 to all eligible Group 'C' & 'D' RPF/RPSF personnel would be based on the wage calculation ceiling of’ Rs. 7000  per month.

3. Accordingly, ad-hoc bonus to eligible Group 'C' & 'D' RPF/RPSF personnel for the financial year 2014-15 may be re-worked and the difference may be paid on priority in the same mode as payment of salary. All the other terms and conditions under which the payment was made shall remain unchanged.

The Government of India, Ministry of Finance issued order on revised ceiling limit of PLB from Rs.3500- to Rs.7000- from the year 2014-15 (OM No. 7/4/2014-E-III A dated 29-08-2016) to all Central Govt. Employees. It is apparent to note that the calculation of Productivity Linked Bonus for the year 2014-15 with revised ceiling limit @ Rs.7000-to regular departmental employees in the Department of Posts has been granted vide letter No. .26-01/2015-PAP dated 02-09-2016 and the arrears have also been drawn in favour of the regular employees.

The case of 3 lakh GDS employees regarding applicability of revised ceiling limit @Rs.7000- is yet to be finalized by the Department.

Therefore, it is requested to kindly expedite the grant of Bonus to 3 lakh Gramin Dak Sevaks at the revised ceiling @ Rs.7000- from 2014-15 prospectively.

Subject: Grant of Productivity Linked Bonus (PLB) and non-productivity Linked Bonus (Ad-hoc bonus) in case of Central Government employees for the accounting year 2014-15 – enhancement of the calculation ceiling- Regarding.

The undersigned is directed to invite attention to this Ministry’s 0M No.7/24/2007/E-lll.A dated regarding grant of non-productivity Linked Bonus (Ad-hoc Bonus) to the Central Government employees for the accounting year 2014-2015, whereby the calculation ceiling for the purpose of payment of ad-hoc bonus was monthly emoluments of Rs.3500. The Productivity Linked Bonus (PLB) in case of Central Government employees working under certain Ministries/Departments, where such PLB was in operation in 2014-15, was also paid by the respective Ministries/Departments for the accounting year 2014-15 based on the concurrence of this Ministry with the calculation ceiling at monthly emoluments of Rs. 3500.

2. The question of enhancement of the calculation ceiling for the purpose of payment of PLB and non-PLB (ad-hoc bonus), as the case may be, to the Central Government employees has been considered and the President is pleased to decide that the calculation ceiling of monthly emoluments for the purpose of payment of PLB and ad-hoc bonus, as the case may be, shall be revised to Rs.7000 w.e.f. 01.04.2014, i.e., for the accounting year 2014-15.

3. Accordingly, the PLB or ad-hoc bonus, as the case may be, as already paid to the eligible Central Government employees for the accounting year 2014-15 in terms of the above 0M dated 16.10.2015 pertaining to ad-hoc bonus and the respective sanctions issued by the concerned Ministries/Departments in respect of PLB under the respective schemes in operation during 2014-15 based on the specific concurrence of this Ministry, shall be re-worked out based on the calculation ceiling of monthly emoluments of Rs.7000 instead of Rs.3500.

4. While re-working out payment of PLB or ad-hoc orders, as the case  may be, under these orders for the accounting year 2014-15, all the other terms and conditions under which the payment was made shall remain unchanged.

5.  In respect of their application to the employees working in the Indian  Audit and Accounts Departments, these orders are issued in consultation with the office of the Comptroller and Auditor General of India.

While thanking the Railway Ministry for its prompt reply to NFIR under reference No. E(P&A)II-2014/PLB-8 dated 16/02/2016, the Federation re-iterates the following facts for taking appropriate steps by the Government.
(i) The chronological developments since decades need to be taken into account for processing the case for payment of PL Bonus to the Railway employees at the revised wage calculation ceiling limit i.e. Rs. 7000/- p.m. w.e.f. 01/04/2014.
(ii) When the Bonus Act was amended, raising the wage calculation ceiling from Rs. 750 to 1600, the Railway employees were paid PL Bonus at the revised wage calculation ceiling limit. Subsequently, when the Bonus Act was amended, revising the wage calculation limit from Rs. 1600/- to Rs. 2500/-, the said rate was adopted by the Railway Ministry and PL Bonus paid to the Railway employees at the revised rates.
(iii) When the wage calculation ceiling was again revised to Rs. 3500/- w.e.f. 1st April 2006, the Federation took up the issue and explained the merits of the case for adopting the rate of Rs. 3500/- w.e.f. 01/04/2006 for ensuring payment of PL Bonus. The Railway Ministry had processed the case and obtained Union Cabinet’s approval and issued orders vide letter No. E(P&A)II-2008/PLB-10 dated 03/10/2008, duly revising the wage calculation ceiling to Rs. 3500/- with retrospective effect i.e, from 01/04/2006, consequently, PLB arrears for the year 2006-07 were paid to the Railway employees in October 2008.
From the above facts, it could be seen that the payment of P.L. Bonus has been ensured commensurating with the revision of wage calculation ceiling limit made through amendments to Bonus Act, 1965 without any deviation. Similarly when the wage calculation ceiling limit has been raised to Rs. 7000/- p.m., the Railway Employees are entitled for payment of P.L. Bonus at revised rates for the year 2014-15.

NFIR, therefore, requests the Hon’ble Railway Minister to kindly arrange to process the case on top priority for obtaining the approval of the Union Cabinet for making payment of PL Bonus arrears pertaining to the year 2014-15 to the Railway employees at the earliest.

Sir,
I am directed to refer to your L.No. NC-JCM-2015-S.C dated 11.1.2016 on the subject mentioned above and to say that the issue raised therein has been considered.

2. At the outset, till now there has not been a complete parity between Payment of Bonus Act, 1965 and the bonus for Central Government employees in regard to the two different ceilings, one relating to the calculation and the other relating to eligibility. While the calculation ceiling has been the same, the eligibility ceiling has been different and even the revised eligibility ceiling of Rs. 21,000 under the amended Payment of Bonus Act, 1965 is not higher than that in case of the Central Government employees where all non-gazetted employees are eligible for bonus. This being so, a complete parity for the purpose of calculation ceiling of Rs. 7000 p.m., that too, from 1.1.2014, is not justifiable.

3. Most importantly, the 7th Central Pay Commission, which has gone into the issue of bonus scheme in detail in respect of the Central Government employees, has felt that instead of bonus, there should be introduced the Performance related Pay (PRP) for all categories of Government employees and this PRP should subsume the existing bonus scheme.

The Commission has further recommended that since there would be a time log in implementing the PRP, the existing scheme should be reviewed and linked with increased profitability/productivity under the well-defined parameters. The recommendations of the Commission are separately being examined and an appropriate view would be taken as and when the Government decision on the recommendations of the 7th Central Pay Commission is known. Till such time, therefore, it may not be possible to revisit the issue of calculation ceiling in case of Central Government employees for the purpose of PLB/ad-hoc bonus.

Highly disappointing Rail Budget
 
The National Federation of Indian Railwaymen (NFIR) expresses its serious disappointment over the Rail Budget (2016-17) presented by Shri Suresh Prabhu, Railway Minister in the Parliament on 25th February 2016. According to the President and General Secretary NFIR Shri Guman Singh and Raghavaiah, the Rail Budget document is “towards journey for privatization of Indian Railways in the name of transformation”. It is sad to note that the Railway Minister has not given due recognition to the dedicated services being rendered by various categories of Railway employees who toil hard day and night.
NFIR leaders said that the Rail Budget is totally uninspiring and on the contrary generating resentment among Railway employees as the aim of the Budget is to “aggressively implement privatization, outsourcing” of regular Railway activities.
NFIR expressed its unhappiness as the commitments given by the previous Railway Ministers thro’ Budget announcements have not been fulfilled notably: Free Medical treatment to the dependant parents of Railway employees and construction of New Railway quarters under the corporate welfare plan drawn up years back by the Railway Ministry. The announcement of previous Railway Ministers on the floor of the Parliament that “House for all” has unfortunately been forgotten.
It is quite disappointing that although the Bonus Act has been amended w.e.f. 01.10.4.2014 for calculation of Bonus rates to Rs. 7000/- p.m., the Railway Minster did not make any announcement for making payment of PL Bonus to Railway employees at revised rate of Rs. 7000/- p.m. for the year 2014-15.
NFIR said that the condition of Railway colonies and Railway quarters are totally deteriorated. The Rail Budget has not addressed this welfare aspect adequately.
The Federation expresses its anguish over the failure of Railway Ministry in filling up vacancies of 2.5 lakh vacancies in Railways, out of which over 1.5 lakh vacancies belong to safety categories.
The Federation also expresses its unhappiness over the non-allocation of adequate resources for improving the Railway Hospitals, Health Units and creating Super Specialty facilities atleast in the Zonal Railway Hospitals. The long pending demand of NFIR for making provision of Road Mobile Medical Vans for ensuring Medical treatment to the Railway employees working at remote places, jungle areas, has not been given due priority in the Rail Budget.
NFIR is also of the view that the Rail Budget has not satisfied any section of people.

The Payment of Bonus (Amendment) Bill 2015 was passed by both the houses of the Parliament. The amendment provides that the existing Ceiling limit of Bonus for 30 days Rs. 3,500/- is enhanced to Rs. 7,000/- for 30 days. This amendment will take effect from 01.04.2014 (A copy of the Bill passed in the Parliament is enclosed for your kind ready reference).
You are aware that any change in Bonus Act would be an indicator while deciding the Payment of Bonus to the Central Government Employees. Accordingly, every time when Bonus Act is amended raising the payment ceiling limit, it is extended to Central Government Employees also. This issue was also raised by the Staff Side in the Standing Committee Meeting of National Council (JCM) held on 09th October, 2015.
It is therefore requested that steps may be taken for issuing Government Orders for enhancing the Bonus Payment Ceiling limit of Central Government Employees both PLB and Adhoc Bonus to Rs. 7,000/- w.e.f 01.04.2014 and arrears of PLB and Adhoc Bonus for the year 2014-2015 may be paid to the employees.
An earlier and favorable action is solicited.

Changes in the Payment of Bonus Act will benefit thousands of CG employees

The Payment of Bonus (Amendment) Bill, 2015 notified:Increase in the Eligibility Limit under clause (13) of Section 2 and Calculation Ceiling under Section 12 of the Payment of Bonus Act, 2015

The Payment of Bonus (Amendment) Bill, 2015 was passed by the Parliament in the just concluded Winter Session of the Parliament. The Payment of Bonus (Amendment) Act, 2015 has been published in the Gazette of India, Extraordinary on 1st January, 2016 as Act No. 6 of 2016. The provisions of the Payment of Bonus (Amendment) Act, 2015 shall be deemed to have come into force on the 1st day of April, 2014.

The Payment of Bonus (Amendment) Act, 2015 envisages enhancement of eligibility limit under section 2(13) from Rs.10,000/- per month to Rs.21,000/- per month and Calculation Ceiling under section 12 from Rs. 3500 to Rs.7000 or the minimum wage for the scheduled employment, as fixed by the appropriate Government, whichever is higher. The Payment of Bonus (Amendment) Act, 2015 also mandates previous publication of draft subordinate legislations, framed under the enabling provisions under the said Act, in the Official Gazette for inviting objections and suggestions before their final notification.

The Government has been receiving representations from trade unions for removal of all ceilings under the Payment of Bonus Act, 1965. It is also one of the demands made by them during the country-wide General Strike held in February, 2013 and September, 2015. As the last revision in these two ceilings were made in the year 2007 and was made effective from the 1st April, 2006, it was decided by the Government to make appropriate amendments to the Payment of Bonus Act, 1965.

These changes in the Payment of Bonus Act, 1965 will benefit thousands of work force.

An Act further to amend the Payment of Bonus Act, 1965.
BE it enacted by Parliament in the Sixty-sixth Year of the Republic of India as follows:—

1. (1) This Act may be called the Payment of Bonus (Amendment) Act, 2015.
(2) It shall be deemed to have come into force on the 1st day of April, 2014.

2. In section 2 of the Payment of Bonus Act, 1965 (hereinafter referred to as the principal Act), in clause (13), for the words ‘‘ten thousand rupees’’, the words ‘‘twenty-one thousand rupees’’ shall be substituted.

3. In section 12 of the principal Act,—
(i) for the words ‘‘three thousand and five hundred rupees’’ at both the places where they occur, the words ‘‘seven thousand rupees or the minimum wage for the scheduled employment, as fixed by the appropriate Government, whichever is higher’’ shall respectively be substituted;
(ii) the following Explanation shall be inserted at the end, namely:—
‘Explanation.—For the purposes of this section, the expression ‘‘scheduled employment’’ shall have the same meaning as assigned to it in clause (g) of section 2 of the Minimum Wages Act, 1948.’.

4. In section 38 of the principal Act, for sub-section (1), the following sub-section shall be substituted, namely:—

‘‘(1) The Central Government may, subject to the condition of previous publication, by notification in the Official Gazette, make rules to carry out the provisions of this Act.’’.

Pongal Bonus for Tamilnadu State Government Employees

The State government of Tamil Nadu on Sunday announced Pongal bonus for its employees, teachers and pensioners. This will incur an additional expense of Rs. 326.85 crore to the government.

According to the announcement made by the Chief Minister J. Jayalalithaa, government employees and teachers in ‘C’ and ‘D’ Groups will get bonus equal to 30 days salary with a ceiling of Rs. 3,000.

The officers and teachers belonging to the ‘A’ and ‘B’ categories, will receive a special bonus of Rs. 1,000. Pensioners, family pensioners and retired village officers will get Rs. 500 as Pongal gift.

The Payment of Bonus (Amendment) Bill, 2015 was introduced in Lok Sabha by the Minister of State for Labour and Employment, Mr. Bandaru Dattatreya, on December 7, 2015. The Bill seeks to amend the Payment of Bonus Act, 1965. AIRF has demanded an Arrear on PLB for FY 2014-15.

(Amendment) Bill 2015 has been passed by parliament

The Payment of Bonus (Amendment) Bill, 2015 was introduced in Lok Sabha by the Minister of State for Labour and Employment, Mr. Bandaru Dattatreya, on December 7, 2015. The Bill seeks to amend the Payment of Bonus Act, 1965.

The Act provides for the annual payment of bonus to employees of certain establishments (including factories and establishments employing 20 or more persons). Under the Act, bonus is calculated on the basis of the employee’s salary and the profits of the establishment.

Employees eligible for bonus: The Act mandates payment of bonus to employees’ whose salary or wage is up to Rs 10,000 per month. The Bill seeks to increase this eligibility limit to Rs 21,000 per month.
Calculation of bonus: The Act provides that the bonus payable to an employee will be in proportion to his or her salary or wage. However, if an employee’s salary is more than Rs 3,500 per month, for the purposes of calculation of bonus, the salary will be assumed to be Rs 3,500 per month. The Bill seeks to raise this calculation ceiling to Rs 7,000 per month or the minimum wage notified for the employment under the Minimum Wages Act, 1948 (whichever is higher).
