Special increment to Central Government Servants for participation in sporting of national or international

[Part of the Minutes of the 47th Meeting of National Council (JCM) held on 13th April, 2019 issued by DoPT vide OM No. 3/1/2019-JCA dated 13.06.2019]

6.4 DoPT

6.4.14 Item No.29/19 /NC-47 - Revision of Sports increment
Staff Sided stated that in order to encourage sports activities, every department has been permitted to recruit sports personnel and maintain teams at the Government cost. However, presently practice of providing incentive to sports personnel varies from department to department as there are no uniform guidelines. It is necessary that some general guidelines must be issued in this regard.

Reply of the Official Side :
DoPT has issued guidelines from time to time on the issue of special increment in the form of personal pay to Central Government Servants for participation in sporting events and tournaments of national or international importance. Vide OM dated 11.06.2018, DoPT has revised the rates of these increments in the context of the 7th CPC applicable to all the Central Government Civilian Employees and posts.

Rule 10 CCS(RP) Rules, 2008 - revised pay scale and one increment may be granted on 01.01.2006, and the next increment on 01.07.2006

[Part of the Minutes of the 47th Meeting of National Council (JCM) held on 13th April, 2019 issued by DoPT vide OM No. 3/1/2019-JCA dated 13.06.2019]

6.3 D/o Expenditure, M/o Finance

6.3.5 Item No.3/19/ NC-47 - Benefit of proviso to rule 10 CCS(RP) Rules, 2008

Staff Side stated that benefit of Proviso to Rule 10 CCS (RP) Rules, 2008, to those who complete 1 year service at maximum has been sought. It has been stated that there are cases when employees drawing maximum of their Pay Scale complete one year after 01.01.2006 are denied the benefit of next increment in the revised pay structure. The pay may be fixed in the revised pay scale with effect from 01.01.2006 and one increment may be granted on 01.01.2006, and the next increment on 01.07.2006.

Reply of the Official Side:

As per Rule 10 of CCS(RP) Rules, 2008, in the 6th CPC regime, a uniform date of annual increment, viz 1st July of every year has been introduced, under which employees completing six months and above in the revised pay structure as on 1st July would be eligible for increment on 01.07.2006. OM dated 4.7.2014 has also stipulated that the increment on 01.01.2006 shall also be allowed to those who had reached the maximum of the applicable pre revised pay scale more than one year before 01.01.2006, and were in receipt of stagnation increment(s), provided the revised pay was fixed on 01.01.2006.

Therefore, the proposal/demand is not in consonance with the 1st Proviso to Rule 10 and the benefit of increment on 01.01.2006 cannot be given in these cases.

Minutes of Standing Committee Meeting held on 3.5.2017 between NC JCM and Official Side - DoPT

Minutes of Standing Committee Meeting held on 3.5.2017 between NC JCM and Official Side - DoPT

Minutes of the meeting of the Standing Committee held between the staff-side, National Council (Joint Consultative Machinery) and offical-side under the Chairmanship of Secretary(P) at 3.00 P.M. on 03.05.2017

MINUTES OF THE MEETING OF THE STANDING COMMITTEE HELD BETWEEN THE STAFF-SIDE, NATIONAL COUNCIL (JOINT CONSULTATIVE MACHINERY) AND THE OFFICIAL-SIDE UNDER THE CHAIRMANSHIP OF SECRETARY(P) AT 3.00 P.M. ON 03.05.2017

The meeting of the Standing Committee of the National Council (JCM) was held at 3.00 p.m. on 03.05.2017 under the Chairmanship of Secretary (P) at Room No. 119, North Block, New Delhi. The list of participants is at Annexure.

2. In his introductory comments, Secretary(Personnel) while welcoming the participants, mentioned that the agenda for the meeting included the action taken statement on the 31 items discussed in the last meeting held on 25.10.2016 and 26 additional items received from the Staff Side.

3. (i) In his opening remarks, Secretary, Staff-Side thanked the Chairman for convening the meeting and urged that as per the JCM Scheme, the meetings of the National Council should be held on quarterly basis. He also pointed out that the meeting of the National Council under the Chairmanship of Cabinet Secretary has not been held since 2010 which, he emphasized, was against the spirit and the basic principle of the JCM Scheme. This view was seconded by other representatives of the Staff-Side.

(ii) Secretary (Staff-Side) further requested to know the present position on the basic demands made by the Central Government employees about minimum wages, fitment formula, reversion to the old pension scheme and the report of the Committee of Allowances. He recalled that when a notice for strike was given in 2016, the senior Cabinet Ministers in the Central Government had met the staff side representatives and assured a positive decision on the aforesaid demands. Although that strike was deferred on this assurance, the central govt. employees are still waiting. Consequently, it is getting difficult to make the central government employees understand the reasons for delay in fulfilment of the assurances then given by the Senior Cabinet Ministers.

(iii) Hence Secretary, Staff-Side requested the Chairman to convey to the Cabinet Secretary and Chairman, National Council (JCM) the duty to meet the Government employees in accordance with the JCM Scheme to avoid an atmosphere of confrontation.

(iv) He stated that a number of agenda items proposed by the Staff-Side have been deleted and no formal communication has been sent to them on the reasons for deletion. He requested that the views of official side on this may be communicated to them. This sentiment was echoed by other members of the Staff Side. He also mentioned that the senior Cabinet Ministers had issued a statement about constitution of a High Level Committee to look into the aforesaid basic demands made by the Staff Side while giving the strike notice. However, even after more than 10 months, nothing has happened and only one meeting was taken by Additional Secretary in Department of Expenditure.

(v) On allowances, he informed that there is a lot of uncertainty on whether the allowances would become admissible prospectively or from 01.01.2016 i.e., the date of implementation of 7th Central Pay Commission.

(vi) The following points were also raised by Leader JCM (Staff-Side):
(a) The assurance given by Senior Ministers on 30t h June 2016 on 7th CPC issues-mainly minimum wage and multiplying factor have not been fulfilled. Only one meeting was held by Addl. Secretary (Expenditure) with the Staff side and thereafter nothing is known with regard to progress made even though 10 months passed.

(b) On 7th CPC recommendation for revision of pension on the basis of option the contents of the Committee’s Report are not made available to the JCM (Staff Side). There is need to see that transparency is ensured for preserving healthy industrial relations.

(c) On Allowances, the Leader JCM (Staff Side) expressed disappointment as there has been no positive outcome even after lapse of several months. He requested the Chairman that the JCM (Staff Side) demand to revise the Allowances w.e.f. 01/01/2016 should be considered and Staff Side demand be taken to the level of Cabinet Secretary and the Government.

(d) Although Ministry of finance Resolution dated 25t h July 2016 stipulates that 14.29% hike in the pay of Running Staff in the Railways be ensured, unfortunately, the same has not been complied with. The said hike has not been ensured. He requested the Chairman to kindly take appropriate initiative on the proposal sent by Ministry of Railways which is pending with the Ministry of finance. He also pointed out that the references made by different ministries to the DoP&T/MoF pursuant to the discussions held by the JCM Constituents with the respective Departments/Ministries are pending. He requested that speedy response be ensured by DoP&T/MoF. While concluding, the Leader, JCM (Staff-Side) expressed confidence that the NC/JCM meeting as well Standing Committee meetings will be convened regularly in accordance with the JCM rules for paving way for healthy industrial relations”.
(vii) The Staff-Side drew attention to the fact that since 1966 Joint Committees used to be set up for discussing contentious issues which has since stopped. References from the Departments are also remaining unanswered. The members of the Staff Side requested that DOP&T should take a view on all these issues as a number of them have not been settled. The Staff Side also requested that the duration of Standing Committee meetings should be extended so that all issues can be discussed and resolved quickly and the meetings should also be held every quarter.

(viii) The Staff-Side also pointed out that items of agenda sent by them are to be included, if it is found to be appropriate to be discussed. Since there had been permanent subcommittees under the Chairmanship of Secretary (Health) and (Pension), the agenda items pertaining to those two ministries can be referred to those two sub-committees. The sub-committees are to deliberate and report back to the Standing Committee for a final decision. They wanted the said procedure to be followed as the items sent by the Staff Side to the meeting contained many Pension and Health related issues.

(ix) Referring to the convening of the Departmental Council, the Staff Side said that the situation has not registered any significant improvement. They also pointed out that in the details provided; no dates of the last meeting held had been indicated. They pleaded that the Department of Personnel has to evolve a mechanism to monitor the functioning of the Departmental council.”

(x) In view of the ongoing ban on recruitment imposed by the Department of Expenditure, the staff are having to work long hours. This is despite the Task Force, set up by Ministry of Railways on safety-related matters, having suggested that additional staff be mobilized to ensure safety. Even the Hon’ble Prime Minister in his speeches has stressed the need for safety; but the Ministry of Railways have chosen to ignore.

(xi) Another point raised was about the instructions issued by the DOP&T following the assurance given to the Hon’ble Supreme Court in a contempt case which was said to have created a situation where the DPCs are not being held and the employees are retiring without getting promotion. It was stated that UPSC is also refusing to accept DPC proposals and insists that clarification from DOP&T may first be obtained. As a result promotions are not taking place and many officers have retired without promotion. The Staff-Side requested that necessary clarifications may be issued by DOP&T urgently so that DPCs can be held in the Departments.

4. Chairman, in his reply, said that no agenda points had been deleted and, in order to ensure that discussions are complete in a meeting, it was decided in consultation with the Secretary(Staff-Side) to limit the number of agenda points for today’s meeting. He further stated that if the Staff-Side insists that the remaining points which have been left out should also be taken up for discussion, they would need to be circulated to the concerned Departments in advance for their comments. He emphasized that the Government attaches the highest priority to the Staff-Side and the concerns expressed over the assurance given after the strike call would be conveyed to the concerned authority. On the issue of the Allowances Committee’s report not being shared with the Staff Side, the Chairman stated that the sentiment would also be conveyed to Ministry of Finance along with the concerns over pay revision etc.

5. After these opening remarks the Action-Taken-Note on the minutes of the last meeting held on 25.10.2016 was taken up for discussion.

New Delhi-110001

Dear Sir,
Sub: Grant of increment for those who have completed one year on the day of superannuation

We solicit your kind reference to item No.14 of the 43rd Meeting of the National Council, demanding grant of one increment in the case of those persons who complete one year on the day of their superannuation. The issue was discussed several occasions, but was not agreed upon by the Official Side. The Official Side took the stand that the completion of the stipulated one year being the day on which the official retires, he cannot be granted one increment for having completed one year only the next day and for doing so, one has to be on duty. The fact that the official has completed the requisite one year for earning an increment was unfortunately glossed over. The Staff Side was also told later that the case filed by one of the officials in the Central Administrative Tribunal against denial of increment was turned by the Court. No doubt, grant of increment in a deserving case is an executive decision and no court will be able to compel the Executive to exercise their powers in a particular manner. In fact, the Government ought to have appreciated the fact that the demand is on justified ground and the technicalities should not have come in the way to deny justice.
We now send you a copy of the GO issued by the Government of Tamilnadu, granting one increment on the date of superannuation in the case of those personnel who have completed one year of service. In the light of the decision of the Government of India that the grant of increment can be resorted to even in the case of a person who has completed at least six months in order to bring in uniformity in the date of increment of all Government employees as per the recommendation of the 6th CPC, earlier stand of the Official Side is not at all tenable. Since there had been no meeting of the National Council for the past five years, this matter could not be pursued through discussions.

We request you to kindly consider the matter afresh, especially in the background of the GO. of the Government of Tamilnadu and issue orders to settle the justified demand.
Yours faithfully,
(Shiva Gopal Mishra)

ABSTRACT

1. G.O.Ms.No.234, Finance (PC) Department, dated: 1-6-2009.
2. G.O.Ms.No.123, Finance (PC) Department, dated: 10-4-2012.

ORDER:

As per the provisions under Fundamental Rules 26 (a), the annual increments of the Government Servants are regulated in four quarters viz. 15th January, 15th April, 1st July and 1st October. However, there is no provision in the Fundamental Rules to sanction annual increments in the case of the Government Servants who have rendered one full year of service and retires on superannuation on the last date of completion of one year and their increment due date falls on the next day of superannuation. As such an anomalous situation arises in the case of those Government Servants who retires on the 31st March, 30th June, 30th September and 31st December, as the case may be, inspite of the fact that they have completed one full year of service which are countable for increment as per Fundamental Rules 26(a), (b), (bb), (c) and (d) as the case may be, and on the date ‘of retirement.

2) The above issue was-brought to the notice of Pay Grievance Redressal Cell constituted in the Government Order second read above by several Employees Association for due rectification. The Pay Grievance Redressal Cell, among others, has recommended that “when date of increment of a Government Servant falls due on the day following superannuation on completion of one full year of service, such service may be considered for the benefit of a notional increment purely for the purpose of pensionary benefits and not for any other purpose. Such concession may be made applicable prospectively”.

3) After careful consideration, the Government have decided to accept the above recommendation of Pay Grievance Redressal Cell. Accordingly, the Government direct that a Government Servant whose increment falls due on the day following superannuation, on completion of one full year of service which are countable for increment under Fundamental Rules 26, be sanctioned with one notional increment at the rate as described under rule 6 of Tamil Nadu Revised Scales of Pay Rules, 2009, purely for the purpose of pensionery benefits and not for any other purpose. The above concession of sanction of notional increment shall take prospective effect from the date of issue of this order.

4) Necessary amendment to the Fundamental Rules shall be issued by Personnel and Administrative Reforms Department separately.
(BY ORDER OF THE GOVERNOR)
K.SHANMUGAM,
PRINCIPAL SECRETARY TO GOVERNMENT.

Demand of staff side to increase the subscription and the insurance coverage – NC JCM

Demand of staff side to increase the subscription and the insurance coverage – NC JCM

“The Staff Side recalled the assurance held out by the Commission earlier to have the actuarial assessed by an expert agency to accede to the demand of the staff side to increase the subscription and the insurance coverage. The Staff Side was of the opinion that their suggestion to share the subscription in the ratio of 3:7 was reasonable but in the absence of an expert study, the Government might not accept the same. The commission said that they would explore the possibility of such an assessment by the LIC before finalization of the report.”

Dated: June 15, 2015
All Constituent Organisations of National Council(JCM)
Dear Comrades,
As indicated in our last circular letter, the final meeting with the 7th CPC was hled on 9.6.2015. Earlier on 8th afternoon, the Staff side had met separately to chalk out the course of negotiations. The National JCA also met on the same day. The National Anomaly Committee met on 9th June, 2015 at 3.00 pm under the Chairmanship of Joint Secretary (E) Department of Personnel at Room No. 72 North Block, New Delhi. We give hereunder a brief synopsis of the discussions at all the meetings.

1. Meeting with 7thCPC
The following Staff Side members were present at the Meeting:- Com. M. Raghavaiah(Leader Staff Side – NFIR), Com. Shiva Gopal Mishra(Secretary, Staff Side-AIRF), Com. Guman Singh, Com. R.P. Bhatnagar and Com. B.C. Sharma(all from NFIR), Com. Rakhal Dasgupta, Com. J.R. Bhosale (AIRF), Com. KKN Kutty, Com. M.S. Raja and Com. M. Krishnan (from Confederation and NFPE), Com. Srikumar and Com. R.N. Pathak(from AIDEF) Com. Srinivasan and Com. Surjeet Singh( From INDWF).
(a) Date of Effect – The Chairman has made it clear that the Commission would recommend 1.1.2016 as the date of effect of their recommendations. The Commission would finalise its report by end of August and would submit the same to the Government thereafter. They would adopt Dr. Aykroyd formula for the computation of the Minmum wage. To the specific query made by the Staff Side, the Commission said that they would factor the probable increase In the rate of retail prices of the commodities and would arrive at the minimum wage as on 1.1.2016. There had been no reply to the loss of wages to the employees due to the erosion of the real value of wages as there was no interim relief or benefit accrued from the merger of DA. These demands, therefore, stand rejected.

(b) Increase in the insurance coverage in cases of death in harness – The Staff Side recalled the assurance held out by the Commission earlier to have the actuarial assessed by an expert agency to accede to the demand of the staff side to increase the subscription and the insurance coverage. The Staff Side was of the opinion that their suggestion to share the subscription in the ratio of 3:7 was reasonable but in the absence of an expert study, the Government might not accept the same. The commission said that they would explore the possibility of such an assessment by the LIC before finalization of the report.

(c) Fitment Formula – The Commission might accept the suggestion made by the Staff Side in respect of fitment formula with requisite change in the ratio on the basis of the quantum of minimum wage determined.

(d) In the matters of rate of increment, quantum of allowances etc. – The Commission did not come out clearly of their thinking in the matter.

(e) Parity in Pension entitlement of the past and present pensioners – The Commission is yet to make up its mind on the suggestion made by the staff side in the matter. They however said that almost all the Pensioners organizations which met the Commission had pleaded for this and the same is linked with the one rank one pension demand of the Armed forces personnel.

(f) MACP Scheme – The difficulties and anomalies pointed out by the Staff Side and various other organizations have been taken note of by the Commission. The Commission assured to evolve a methodology to resolve the problem.

(g) Opposition to the induction of casual/daily rated workers and contractorisation – The Commission said that they were opposed to the unfair practice of exploitation of labour. For jobs which are of perennial and permanent character, regular workers must be recruited, the Commission added and that would obviate the need for outsourcing and contractorisation. Since most of the outsourced jobs do not require any academic qualification, the Commission was of the opinion that the revival of Group D cadre would help to address the issue. However, the Commission stated that if only the staff side sends in a communication in writing, the Commission would be able to make any recommendation in the matter. The Staff Side reiterated that they are totally opposed to outsourcing, induction of casual workers and contractorisation and the same has been made explicit in their memorandum.

(h) Parity in the pay scales between the personnel in the Central Sectt and those in the subordinate establishments – The Commission stated that they have appreciated the stand taken by the Staff Side in the matter. The Commission was non committal on other issues raised by the Staff Side members.
2. National Anomaly Committee meeting
The meeting was held at Room No. 72 North Block, under the Chairmanship of J.S(E) Department of Personnel and Training. In the initial remarks, the Staff side raised the following issues.
(a) Though the official side had promised to provide an action taken statement on all issues in the National Council, the same has not been supplied;

(b) No date for the National Council is indicated.

(c) No indication of the steps taken to convene the Departmental Councils. The official side had assured of the convening of the Departmental Council of the Ministry of Finance in the last meeting. However, the staff side has not been apprised of any date so far.

(d) Abnormal delay in replying to the references made to the Ministry of Finance, Department of Personnel from the Railways and other Ministries.

(e) The necessity to increase the ceiling limit of the rebate in Incometax for the allowances given to the Loco Pilots.

(f) Non-adherence to the GOI instructions by the Defence Ministry in certain matters.
The Official Side stated that the Action taken Statement was almost ready but for certain comments from Certain departments. The same would be sent to the staff Side and another meeting held to discuss the course of action required on items where no agreement could be reached. The JS (per) stated that some of the references received from the Railways had been sent back to them for clarification before a final decision is taken. Regarding increase in the rebate ceiling under the Income tax Act, the matter would be referred to the revenue department and requested the staff side to appreciate that the same has to be considered in a wider perspective. Thereafter the agenda items, which had not been discussed even once were taken up.
(i) Anomaly in the Pay Band and Grade Pay assigned to the Group B Officers of the Audit, Income Tax, Accounts, Central Excise and Customs and Postal Departments. (Agenda Item No. 1 and 8 taken together.) Despite agreeing that there existed an anomaly in the matter, the official side expressed their inability to proceed further in the matter as the Group B Officers were beyond the ambit of the JCM scheme. However, they agreed that the Govt. would submit take up the issue specifically with the 7th CPC. Com. Shiva Gopal Mishra said that the Govt. must consider a JCM set up for the promote officers as their cases are not heard or discussed at any other forum. Com. Kutty said that the items were introduced as early as in 2009 and it was not correct on the part of the official side to state that the same would be referred to the 7th CPC. Normally the Pay Commission would not entertain to consider the anomalies of the earlier Commissions. However, after some discussions, it was concluded that the Govt. must take up the issue with the 7th CPC, in spite of the fact that the Commission has almost reached its concluding stage.

(ii) Anomaly in the pay and Grade Pay of Data Processing Assistants Grade A.. The official side did not agree with the contention that the assigning of higher grade pay to certain categories of officers (7450-11500 and Grade Pay4600) was arbitrary. The Government, they added, had acted upon the recommendation of the 6th CPC. They also said that only in those cases where the pre-revised pay scales were in 6500-10500 such up-gradation had been made. In the case of DPA Grade A, they were in the pre revised scale of pay of Rs. 5500-9000.

(iii) Item No.3. Grant of Grade pay of Rs. 4200 to Lab Technicians. The official side said that the orders have been issued in the matter.

(iv) Item No.4. Up-gradation of Pay Band and Grade pay of LDCs and UDCs.
The Staff Side made the following points in support of the item:-
(a) The Grade pay of Rs. 1900 assigned to LDCs by the 6th CPC was without any logic and without appreciating the existing vertical relativity between Group D and LDCs and LDCs and UDCs.

(b) While creating the non functional grade in the grade pay of Rs. 4200 in the Central Secretariat, the Department of Personnel, which is the nodal department for all matters concerning the common categories, did not extend the benefit to the UDCs in the Subordinate offices.

(c) The Staff side also pointed out the Department while restructuring the cadre of stenographers in the Central Sectt. earlier, had extended the benefit to all Stenographers in the subordinate offices.
The official side stated that it was not possible for them to address the issue, whatever may be its justification in the background of the setting up of the 7th CPC. They however, assured to make a reference specifically to the Commission.

(v) Item No.5. Senior Clerks in DMS to be assigned grade pay of Rs. 4200. The matter was stated to be sub-judice. Staff Side, however, stated that, with the change in Recruitment Rules, they should brought at par with the Railways.

(vi) Item No. 6 and 12. The two agenda items being identical were take up together. The Staff side pointed out the glaring discrimination in the matter. They also stated that the number of employees involved is very small. On behalf of the Postal Department it was stated that the recruitment qualification in the
Postal Department was VIII Standard and ITI whereas in other establishment, the academic qualification stipulated was X Standard. The Staff side contested the same pointing out that no person is entitled to be admitted to ITI without having X standard qualification. They pointed out that the merger of Artisan Grade I and Charge hand was the root cause of the problem. The official side took the stand that in any case the anomaly cannot be removed at this stage and have to wait till the 7th CPC recommendations are made.

(vii) Item No. 7. Parity in pay scales between the Central Sectt. and subordinate offices. The official side said that the up-gradation of the pay scale of Central Sectt. Assistants were on well found grounds. The Government had considered the repercussion of the said decision and therefore, the decision is not possible to be either reversed or extended to any other category of employees. They added that perhaps the 7th CPC before whom the matter is already agitated by the employees organizations of the subordinate offices might take a decision in the matter.

(viii) Item No. 9 and 10. Higher grade pay for Medical Assistants and Store keepers. The Defence Ministry was asked to submit a detailed note to the Ministry of Finance indicating the duties and responsibilities assigned as also the recruitment qualifications stipulated in the RR to enable them to reconsider the issue.

(ix) Children Educational Allowance for any two children. The official side stated that the deviation made in identifying the eldest two children was consciously done taking into account the National Population policy and various other factors and is not likely to be changed. Regarding the claim for reimbursement of expenses incurred in the nursery class, as such institutions or classes are not linked to any Educational Boards, the official side said that they would look into the matter with a view to find a solution thereof.

No.CONF/2015
Date : 12-06-2015
Dear Comrade,
As indicated in our last circular letter, the final meeting with the 7th CPC was held on 9.6.2015.

The following Staff Side members were present at the Meeting:

Coms. M. Raghavaiah (Leader Staff Side – NFIR), Shiv Gopal Mishra (Secretary, Staff Side-AIRF), Com. Guman Singh, R.P. Bhatnagar and Com.Sharma (all from NFIR), Com. Rakhal Dasgupta, Com. J.R Bhosale (AIRF) Com. KKN Kutty, M.S. Raja and Com. M. Krishnan (from Confederation and NFPE) Com. Srikumar and Com. R.N. Pathak (from AIDEF) Com. Srinivasan and Com. Surjeet Singh ( From INDWF)
(a) Date of effect: The Chairman has made it clear that the Commission would recommend 1.1.2016 as the date of implementation of their recommendations. The Commission would finalise its report by end of August and would submit the same to the Government thereafter. They would adopt Dr. Aykroyd formula for the computation of the Minimum wage.

(b) Increase in the insurance coverage in cases of death in harness: The Staff Side recalled the assurance held out by the Commission earlier to have the actuarial assessed by an expert agency to accede to the demand of the staff side to increase the subscription and the insurance coverage. The Staff Side was of the opinion that their suggestion to share the subscription in the ratio of 3:7 was reasonable but in the absence of an expert study, the Government might not accept the same. The commission said that they would explore the possibility of such an assessment by the LIC before finalization of the report.

(c) Fitment formula. The Commission might accept the suggestion made by the Staff Side in respect of fitment formula with requisite change in the ratio on the basis of the quantum of minimum wage determined.

(d) Open ended pay scales: The Commission would recommend open ended pay scales as suggested by the Staff Side.

(e) In the matters of rate of increment, quantum of allowances etc, the Commission did not come out clearly of their thinking in the matter.

(f) Parity in pension entitlement of the past and present pensioners. The Commission is yet to make up its mind on the suggestion made by the staff side in the matter. They however said that almost all the Pensioners organizations which met the Commission had pleaded for this and the same is linked with the one rank one pension demand of the Armed forces personnel.
(g) MACP scheme: The difficulties and anomalies pointed out by the Staff Side and various other organizations have been taken note of by the Commission. The Commission assured to evolve a methodology to resolve the problem.

(h) Opposition to the induction of casual/daily rated workers and contractorisation. The Commission said that they were opposed to the unfair practice of exploitation of labour.
(i) Parity in the pay scales between the personnel in the Central Sectt and those in the subordinate establishments.
The Commission stated that they have appreciated the stand taken by the Staff Side in the matter.
(a) Though the official side had promised to provide an action taken statement on all issues in the National Council, the same has not been supplied;

(b)No date for the National Council is indicated.

(ii) Anomaly in the Pay Band and Grade Pay assigned to the Group B Officers of the Audit and Accounts, Incometax, , Central Excise and Customs and Postal Departments. (Agenda Item No. 1 and 8 taken together.) Despite agreeing that there existed an anomaly in the matter, the official side expressed their inability to proceed further in the matter as the Group B Gazetted Officers were beyond the ambit of the JCM scheme. However, they agreed that the Govt. would take up the issue specifically with the 7th CPC. Com.Shiv Gopal Mishra said that the Govt. must consider a JCM set up for the promote officers as their cases are not heard or discussed at any other forum. Com. Kutty said that the items were introduced as early as in 2009 and it was not correct on the part of the official sided to state that the same would be referred to the 7th CPC. Normally the Pay Commission would not entertain to consider the anomalies of the earlier Commissions. However, after some discussions, it was agreed that they would discuss the issue of audit & accounts scale (AAOs) separately after receiving a note from Staff Side and in respect of others, a note will be submitted to the 7thCPC.

(iii) Anomaly in the pay and Grade Pay of Data Processing Assistants Grade A.. The official side did not agree with the contention that the assigning of higher grade pay to certain categories of officers (7450-11500 and Grade Pay4600) was arbitrary. (iv) Item No.3. Grant of Grade pay of Rs. 4200 to Lab Technicians. The official side said that the orders have been issued in the matter.

(v) Item No.4. Up-gradation of Pay Band and Grade pay of LDCs and UDCs.
The Staff Side made the following points in support of the item:

(a) The Grade pay of Rs. 1900 assigned to LDCs by the 6th CPC was without any logic and without appreciating the existing vertical relativity between Group D and LDCs and LDCs and UDCs.

(b) While creating the non functional grade in the grade pay of Rs. 4200 in the Central Secretariat, the Department of Personnel, which is the nodal department for all matters concerning the common categories, did not extend the benefit to the UDCs in the Subordinate offices.

(vi) Item No.5. Senior Clerks in DMS to be assigned grade pay of Rs. 4200. The matter was stated to be sub-judice.

(vii) Item No. 6 and 12. – Removal of anomaly in the case of artisans staff of different departments & Master Craftsmen pay scale in MMS in Postal Department. The two agenda items being identical were take up together. The Staff side pointed out the glaring discrimination in the matter. They also stated that the number of employees involved is very small. On behalf of the Postal Department it was stated that the recruitment qualification in the Postal Department was VIII Standard and ITI whereas in other establishment, the academic qualification stipulated was X Standard. The Staff side contested the same pointing out that no person is entitled to be admitted to ITI without having X standard qualification. National JCA meeting on 8th June
The National JCA which met at the Staff side office on 8th June, 2015 took note of the fact quite a few States are yet to hold the State level conventions. The meeting also noted that the strike decision taken on 28th April, 2015 has not been percolated down to the rank and file of the workers. The meeting wanted the affiliate to realize that the denial of the demand for wage revision to be effective from 1.1.2014 and the consequent denial of interim relief and the benefit of merger of DA with pay must be viewed very seriously as the said decision will have a far reaching consequence. The Government would not in future will discard the age old practice of grant of I.R. and merger of DA for ever. It has decided to appeal to all the affiliates to chalk out independent programmes of actions in the months to come and to carry out the same in all seriousness so that the employees become fully aware of the possible outcome of the 7thCPC . The Chairman and Convenor of the National JCA will get in touch with those States, where the programme has not been carried out. The meeting decided to convey to the members that the minimum wage computation, in the given situation would be on an imaginary basis. The National JCA was of the opinion that a meeting of all office bearers of the participating organizations must be convened at Delhi somewere in the month of July to chalk out the programmes of action to be pursued by theCGEs togher

It was informed at the house that both Defence and Railways would be taking their strike ballot and would be concluded in the first week of October. The meeting decided to advise the other units to chalk out progammes of action in July so that an ambience of struggle could be created. The NJCA also took note of the painful fact that despite assurances, Government was not convening the Departmental Councils and the JCM has been allowed to become defunct.

The National JCA in conclusion decided to appeal to all affiliates to take concrete steps to invigorate the joint movement of the Central Government employees and meet the challenge that is like to arise on receipt of the recommendations of the 7th CPC.by creating an atmosphere of Unity, and determination to carry out the call of indefinite strike action scheduled to commence on 23rd November, 2015..

The Secretary, NCJCM Staff Side has already informed that a meeting NAC will be held after the final Meeting of NCJCM with 7th Pay Commission. Accordingly the DOPT is holding the National Anomaly Committee Meeting today at 3.00 PM at New Delhi. The office Memorandum issued to all Staff Side Members 0f The National Anomaly Committee stated that..
“In continuation of meeting held on 29/5/2015 the next meeting of the National Anomaly Committee is scheduled to be held under the Chairpersonship of Joint Secretary (Establishment) on 9th June, 2015 at 3.00 P.M. in the Conference Hall (Room No. 190) North Block, New Delhi. Agenda Notes for the meeting as suggested by the Staff Side are enclosed.
All the concerned are requested to kindly make it convenient to attend the meeting.”
The agenda points finalized for discussion in the NAC meeting
There are 12 Items listed in the Agenda Notes for Discussion ,

At Item Number 4 the issue of Upgradation of Pay Band and Grade Pay of LDC, UDCs and stenographers Gr.III In Subordinate offices is included for discussion. it is established in the point that LDCs may be placed in PB-i with Grade Pay of Rs.2800 and UDCs may be placed in PB-2 with Grade Pay of Rs.4200

ITEM No.4 : Upgradation of Pay Band and Grade Pay of LDC, UDCs and stenographers Gr.III In Subordinate offices.

Group ‘D’ employees have been placed in PB-I with Grade Pay Rs. 1800 and entry qualification now prescribed in Matriculation.

LDC/UDCB have been assigned the same PB-I with Grade Pay of Rs. 1900 and Rs. 2400.

Assistants and Stenographers of Central Secretariat who were in the pre revised pay scale of Rs.5500-9000 PB-2 with Grade Pay of Rs. 4200 has been granted upgraded pay scale in PB-2 with Grade Pay of Rs.4600 with retrospective effect from 1.1.2006. (0M dated 17.11.2009).

The result is that vertical relativity between Group ‘D’ and LDCs has been drastically reduced on the one hand and on the other vertical relativity between UDC sand Stenographer Gr.III of subordinate offices vis a vis the Assistants and Stenographers of Central Sectt. has been widened. In both way the relativities vis-à-vis Group D’ and LDCs and vis-à-vis UDCs/Stenographer III and Assistants have been disturbed without assigning any reasons therefore.

With a view to maintain the well established relativities it is proposed that LDCs may be placed in PB-i with Grade Pay of Rs.2800 and UDCs may be placed in PB-2 with Grade Pay of Rs.4200.

All Constituents of the
National Council(JCM)(Staff Side),
Dear Comrades,

Sub: Brief on the meeting of the NAC held today under the chairmanship of Jt. Secretary(E), DoP&T, Government of India

As per notification No.11/1/2015-JCA dated 12.05.2015 of the DoP&T(Government of India), meeting of the National Anomaly Committee was held today under the Chairmanship of Jt. Secretary(Estt.), Jt. Secretary(Pers.) and officials from other establishments and Ministry of Railways were also present.

At the outset, Secretary(Staff Side), National Council(JCM), Shri Shiva Gopal Mishra, expressed anguish for communication gap and non-finalization of the issues raised by the Staff Side JCM at various levels, and that is the reason, the staff working in the Central Government is quite agitated.

He also mentioned that, when we met the Secretary, DoP&T, we were given assurance that very soon meeting of the NC/JCM would be held, but unfortunately could not.

NAC was formed seven years back, and up-till now whatsoever had been agreed, that is not implemented, and wherever disagreement, items have not been sent for arbitration.

Out of 60 items, only 48 were discussed, and most of them are under review, and there are 12 items which are still pending, require urgent meeting on pending items.

Leader, Staff Side, Shri M. Raghaviah also shown his anguish and demanded meetings more frequently. Shri K.K.N. Kutty, Shri Sri Kumar and other members of the Staff Side also expressed their anguish on inordinate delay.

The J.S.(E) assured that the meeting on the pending items would be held soon. On the insistence of the Secretary(Staff Side), she agreed for the meeting on the pending items in the afternoon of 9th June, 2015. She also agreed for giving status papers.

Agenda Items

Item No.1 – Review of MACP to GP of Rs.2000 where there is no such grade pay in Railways
Though the Official Side was not in the mood to make any change, but on the insistence of the Staff Side, they agreed to review the matter once again.

Item No.2 – Granting of Additional Pay to Loco & Traffic Running Staff
The Jt. Secretary(Pers.) asked the Railways to give some more logical arguments, so that they can reconsider the issue of Additional Pay to Loco Pilots and Guards of the Goods Trains.

Item No.3 – Treatment of employees selected under LDCE/GDCE Scheme
The Official Side informed that, they have already sent a letter on 27.09.2012, that whatsoever benefit is available to the employees selected under LDCE and GDCE in the ACP, that will continue in the MACPS also. The item is closed.

Item No.4 – Grant of minimum entry pay meant for Direct Recruits to Promotees
There had been lots of arguments and when the Staff Side insisted that, in the JCM Scheme, once the items have been finalized and we reach to an agreement in the Standing Committee, there is no provision of referring back the issue to JCM again. The Secretary Staff Side told pointblank to the Official Side that we are not going to yield on this issue, and if the Official Side feels that the Hon’ble Finance Minister has some specific objection for implementing this issue where Promotee should get bottom of the grade where Direct Recruitment is available, we would like our meeting with Hon’ble Finance Minister. The Official Side agreed that they will put up the case to the competent authority to approach the Hon’ble Finance Minister once again.

Highlights of the meeting :

The Chairman indicated that the next 47th National Council Meeting (JCM) is likely to be scheduled soon under the Charimanship of Cabinet Secretary.

Shri M. Raghaviah, Leader of the Staff Side mentioned that presently JCM is almost defunct which has caused much anguish and frustration. He observed that the basic framework for which Joint Consultative Machinery (JCM) has been set up is defeated if meetings are not held and no result oriented interaction takes place.

Secretary Staff side, Shri Shiva Gopal Mishra, stated the anguish of the Central Government Employees about communication deadlock. He further mentioned that no date has been fixed for National
Anomaly Committee and that no meeting of the National Council has been fixed till date.

Other members from Staff Side that many anomalies of 6th CPC have not been resolved and since 7th CPC has been constituted, this has become an excuse to keep the anomalies pending as they stand referred to the 7th CPC.

Memorandum was submitted earlier by Staff Side for merger of DA and interim relief in view of the erosion of the value of rupees and cost hike.

1. Effect wage revision of Central Government employees from 1.1.2014 accepting the memorandum of the staff side JCM; ensure 5- year wage revision in future; grant interim relief and merger of 100% of DA. Ensure submission of the 7th CPC report with the stipulated time frame of 18 months; include Grameen Dak Sewaks within the ambit of the 7th CPC. Settle all anomalies of the 6th CPC.

2. No privatization, PPP or FDI in Railways and Defence Establishments and no corporatization of postal services

3. Non-resolving of the issues as referred by the Ministry of Railways to MoF (Exp.)

4. No Ban on recruitment/creation of post.

5. Scrap PFRDA Act and re-introduce the defined benefit statutory pension scheme.

6. No outsourcing; contractorisation, privatization of governmental functions; withdraw the proposed move to close down the Printing Presses; the publication, form store and stationery departments and Medical Stores Depots; regularize the existing daily rated/casual and contract workers and absorption of trained apprentices

7. Revive the JCM functioning at all levels as an effective negotiating forum for settlement of the demands of the Central Government Employees (CGEs).

8. Remove the arbitrary ceiling on compassionate appointments.

Respected Prime Minister,
Government of India,
New Delhi

Sub: Reg. the grievances of Central Government Employees

Sir,
For the past few years, a solution hasn’t been found to the problems faced by the Central Government Employees. The National council JCM formed for the grievances of Central Government Employees has been totally disabled and the NC JCM meeting has not been held for the past five years.

The Pending demands of the Central Government, which include the merge of Dearness Allowance with Basic Pay, the enforcement of Old Pension Scheme in the place of New Pension Scheme, Interim Relief, Filling up of Vacancies, Increasing the bonus range, Promotion Opportunities, etc didn’t yield to a decision, hence the Railway, Defence (Civil Employees), Postal, other Central Government Sectors are forced to give a presentation in the Parliament under NC J.C.M. on 28th April 2015.

We Central Government Employees whether in Railways, Defence, Postal Department or other Central Government Sectors, are working with complete devotion towards service to the society and progress to the country. Being an integral part of your administration, we hope that you would provide us an opportunity to meet you as well as extend your help to solve our problems.

Yours Faithfully,
(Shiv Gopal Mishra)

Mass Demonstration at New Delhi on 28.04.2015: National Joint Council of Action – Protest to settle 10 Point Charter of Demands

You are all aware that the constituents of the National Council (JCM) representing the employees in Railways, Defence, Postal, Income Tax, Audit Departments etc., have jointly conducted a convention at New Delhi on 11.12.2014 and adopted a joint declaration demanding the central government to settle the Ten Point Charter of demands also against the anti workers policies.

Subsequently, National Joint Council of Action (NJCA) was formed at National level and Railway Federations have taken the responsibilities of forming Joint Council of Action at State level and District levels. Accordingly the employees were organised and conducted protest meetings demanding the Government of India to consider to settle the demands.
1. Effect wage revision of Central Government Employees from 01.01.2014 accepting the memorandum of the Staff Side JCM: ensure 5 year wage revision in future: grant Interim Relief and Merger of 100% of DA. Ensure submission of the 7th CPC report with the stipulated time frame of 18 months; include Gramin Dak Sevaks within the ambit of the 7th CPC. Settle all anomalies of the 6th CPC.

2. No Privatisation, PPP or FDI in Railways and Defence Establishments and no corporatisation of Defence Ordnance Factories and Posta Services.

3. No Ban on recruitment / creating of posts.

4. Scrap PFRDA Act and re-introduce the defined benefit statutory pension scheme.

5. No outsourcing; Contractorisation, Privatisation of government functions; withdraw the proposed move to close down the Printing presses; the publication, form store and stationery departments and Medical Stores Depots; regularise the existing daily rated/casual and contract workers and absorption of trained apprentices;

6. Revive the JCM Functioning at all levels as an effective negotiating forum for settlement of the demands of the Central Government Employees.

7. Remove the arbitrary ceiling on compassionate appointments.

8. No labour reforms which are inimical to the interest of the workers.

9. Remove the Bonus Ceiling.

10. Ensure five promotions in the service career.
Since, no response was reviewed from the Government of India to settle the demands, it was decided by the NJCA decided in its meeting to conduct a Mass Demonstration at New Delhi on 28.04.2015 at 09.00 Hrs by organising the Central Government Employees to participation in large numbers.

Meeting of National Council JCM (Staff Side) with 7th Pay Commission on 23, 24 March 2015

Meeting of National Council JCM (Staff Side) with 7th Pay Commission on 23, 24 March 2015
Meeting of 7th pay commission with NC JCM will be held for two days
The sources close to the 7th pay commission said, a Meeting of the National Council JCM (Staff Side) with the 7th Central Pay Commission has been scheduled to be held on two successive days ie on 23rd and 24th March 2015, at New Delhi.

The 7th pay commission held series of Meetings with various Associations, Ministries and Departments for the past 9 Months from June 2014

The Commission has had the occasion to interact with the National Council (Staff Side) and its constituents in May 2014. After it finished the series of Meetings held as scheduled with Associations and Ministries/Departments, the 7th pay commission invited National Council JCM to discuss the Major issues before it firms up its views. A meeting was held on 25 February 2015 with the National Council where it was agreed that the 7th Pay Commission would accord time to the National Council for their deposition before the Commission.

The Sources said that accordingly now the 7th pay commission has decided to allot two days for the Meeting with National Council JCM (Staff Side) on 23rd and 24th March 2015. Earlier the NCJCM has sought 7th pay commission to allot three days’ time slot to discuss the serving employee’s issues and one separate day for discussing Pensioners Issues.

Anyway, This will be a crucial meeting, as this may be considered as the last chance for the National council to know the views of seventh pay commission and put their demands on various issues pertaining to central government employees to convince the pay commission.

It is expected that the outcome of the Meeting will however reveal the matters of what can be considered in the recommendation of 7th pay commission.
