Subject: Central Civil Services (Leave Travel Concession) Rules, 1988 - Relaxation to travel by private airlines to visit Jammu & Kashmir.

The undersigned is directed to refer to this Ministry’s O.M. of even no. dated 28.11.2014 on the subject noted above and to say that vide aforesaid O.M., facility to travel on LTC by private airlines to Jammu & Kashmir (J&K) under the special dispensation scheme was allowed for a period of one year. This facility ended w.e.f. 28.11.2015 and was re-introduced on 01.06.2016.

2. Many references have been received about Govt. employees who had inadvertently travelled by private airlines to J&K during the gap period i.e. from 28.11.2015 to 31.05.2016, under the impression that the facility was still operational and were later facing difficulties in settlement of their LTC claims.
3. The issue has been examined in consultation with Department of Expenditure and Ministry of Civil Aviation. In relaxation to this Department’s O.M. of even no. dated 28.11.2014, it has been decided to allow the claims of those Government employees who had travelled by private airlines to Jammu & Kashmir on LTC during the gap period of 28.11.2015 - 31.05.2016. This shall be subject to the condition that tickets have been booked through the authorised modes and at LTC-80 fare or less and other conditions prescribed in DoPT’s O.M. No. 31011/7/2014-Estt.A-IV dated 28.11.2014.

Sub: Old outstanding Demand on a/c of TA/LTC/PT Claims.

During scrutiny of Super Review Report, it has come to notice that a large amount of Outstanding Demands on a/c of TA / LTC /PT Claims is lying un adjusted for more than one year. In case of a few Branch Accounts Offices, the demand is lying outstanding for several years.

Further, it is noticed that intimation in regard to recovery/deposit of debit amount on a/c of passing of TA / LTC / PT Final Adjustment Claim is not being received by this office regularly from all Branch Accounts offices.

Hence, it is requested to all concerned to carry out periodical review of Outstanding Demand in r/o advances paid by your office and debit balances as per debit memo forwarded by Main Office, so that the demand is liquidated forthwith. Further, it is requested to forward recovery intimation of debit balance to this office invariably on monthly basis.

The undersigned is directed to say that some instances where some Government servants colluded with private travel agents to submit LTC claims showing inflated airfare to  clandestinely obtain undue benefits like free boarding/lodging/transport or cash refunds have come to notice of the Government.

2. In order to curb these malpractices the following steps may be taken:
(i) As per instructions reiterated from time to time, in all cases whenever a Govt. servant claims LTC by air, he/she is required to book the air tickets either directly  through the airlines (Booking counters, website of airlines) or by utilizing the service of  authorized travel agents viz. 'M/s Balmer Lawrie & Company', 'M/s Ashok Travels &  Tours' and 'IRCTC'. Proposals from different Ministries/Departments for relaxation  continue to be received on the plea that the Government servant was not aware of this  requirement. Vide the OM dated No. 31011/3/2015-Estt (A.IV) dated 18th February, 2016 detailed guidelines on submission and processing of claims were circulated. These guidelines are required to be made available to Government servants whenever they apply for LTC. Plea of ignorance of the instructions therefore cannot be used by such Government servants.

The nodal Ministries of M/s Balmer Lawrie & Co. (Ministry of Petroleum and Natural Gas), M/s Ashok Travels & Tours (Ministry of Tourism) and IRCTC (Ministry of Railways) shall issue instructions to these organisations to ensure compliance to the instructions issued vide O.M. dated 18 th  February, 2016 on issue of air tickets. Any violation of these instructions shall invite blacklisting.

(ii) Vide the Department of Expenditure's O.M. No. 19024/1/2009-E.IV dated 04.03.2011, it was clarified that reimbursement of air fare lower than LTC-80 fare of Air India is admissible for the journey(s) performed by Air India under LTC-80. LTC-80 fare is to be used as the ceiling beyond which no claim will be entertained. It has now been decided that in accordance with the canons of financial propriety, Government servants should purchase tickets at the lowest rate available at the time of booking for the date and time of scheduled journey. Government servant will be required to submit the print out of the tickets showing date and time of booking in addition to the fare charged. It may, however, be kept in mind that in some cases of cancellation/rescheduling, a refund fee may be applicable. This will be borne by the employee unless the journey had to be rescheduled/cancelled due to exigencies of work. The Authority which has approved the LTC will have the powers to cancel or reschedule it.

(iii) While submitting the LTC claim after completion of the LTC journey, the Govt. servant will be required to submit a self-certificate on plain papers as follows:

(1) I certify that the airfare claimed by me is in respect of the fare charged by the Airline for the air journey only and does not include any charges for any facility/undue benefit including boarding/lodging/local transport.

(2) I also certify that I have booked the ticket at the lowest fare available for the destination at the time of booking for the scheduled date and time of departure. I am aware that suppression of any information or furnishing wrong information will render me liable to disciplinary action.

3.  The Administrative Ministries/Departments may also from time to time do random checks from airlines whether the tickets were booked at the lowest fare available on that date.  Attention of the Ministries/Departments is also invited to Rule 3(1)(i) of the Central Civil Services (Conduct) Rules, 1964 which requires the Government servants to maintain absolute integrity at all times. In addition, cheating/fraud also attract various sections of the Indian Penal Code 1860. Ministries/Departments should therefore not hesitate to take severe action against employees guilty of deliberate malpractices, particularly in collusion with travel agents etc.

4. All the Ministries/ Departments of Government of India are requested to bring the contents of this O.M. to the notice of all concerned.

Government announced the Leave Travel Concession (LTC) rules for easy settlement of the LTC claims

The amended Office Memorandum No.31011/3/2015-Estt(A.IV) seek to ease the procedural difficulties faced by government employees while applying for and settling LTC claims.

Setting outer time-limits for various LTC procedures, the DoPT today said leave or sanction of LTC leave advance would take no more than five days each. This would be extendable by three days where the government employee is away for the headquarters.

Besides, the administration will take no more than 10 days (13 where the employee is away from headquarters) to verify LTC claims after the LTC bill is submitted by the government employee.

The government also proposes to allow its employees to self-certify their proposed LTC journey. Under existing CCS (LTC) Rules, government employees are required to inform their controlling officer before the journey on LTC is to be undertaken.

Also, whenever a government employee applies for LTC, he /she may be provided with a copy of the guidelines to be followed while availing of the concession.

A government servant is allowed to avail of LTC once in a block of two years to visit his/her hometown, while LTC to any place in India can be availed once in a four-year block. If not availed during these blocks, the LTC may also be availed in the first year of the following block.

All Central government employees will soon be sharing their photos and interesting details of holidays.
Besides, they will be exempted from informing their controlling officers before going on holiday and a self-certification from them would suffice.

These are some of the changes the Centre has decided to make in the relevant rules for availing leave travel concession (LTC).

All LTC claims will be settled in a maximum of one-month’s time, as per the new rules. An additional ten days will be given to settle dues related to LTC travels by an employee in case he is posted away from the headquarters.

“Employees may be encouraged to share interesting insights and pictures, if any, of the destination he or she visited while availing LTC on an appropriate forum,” the rules finalised by Department of Personnel and Training (DoPT) said.

“Sometimes, the government servants claim that failure to follow the correct procedure was on account of a lack of knowledge of the rules or instructions while in the other cases the delay is caused in the late processing of LTC claims.

“To remove these bottlenecks, this department has decided to simplify the procedure of application and make the procedure of processing of LTC claims time-bound,” the DoPT said.

Subject : Proposal for seeking one time relaxation in respect of LTC 80 claims of Defence Civilian Employees
Defence Civilian Employees’ Federations are pursuing the above issue in the meetings of the JCM Departmental Council wherein they have informed that many Defence civilian employees while availing LTC by Air to destinations like A&N Islands, J&K and NER, did not follow the instructions regarding purchase of these air tickets only from the booking counters/websites of Air India or from the Authorized Travel Agents [M/s Balmer Lawrie & Co, M/s Ashok Travels & Tours and IRCTC]. A number of employees being first time travellers by air, did not observe these instructions due to ignorance. As a result, there administrative authorities have rejected their claims under LTC 80 submitted by them after performing the journey. To resolve this issue, the employees Federations have approached this Ministry and have requested to take up the matter to DoP&T with recommendation that:
 
a) Claims of Group C and B employees who are otherwise not entitled for Air Travel, in case they have availed LTC 80 by purchasing Air tickets from other than the authorized agents may be considered as a one time measure and a relaxation may be granted to pass their LTC claims as a special case;

b) For such employees who have purchased Air Tickets prior to 26 Sep 2014 from other than authorized agents to travel to A&N Islands, in their case, the LTC claim may be restricted to their entitled class in Steamer/Ship

2. The DoP&T have communicated vide their letter No.31011/6/2015-Estt.A IV dated 1st July addressed to JCM, National Council, that it would not be feasible to relax the LTC rules as a one-time measure. However, cases of individual hardship as recommended by Ministries/ Departments would be considered on a case to case basis.

3. Accordingly, it is proposed to take up the matter with the DoP&T for a decision on the LTC claims submitted by the defence civilian employees where the air tickets have not been purchased by these employees in accordance with the Government instructions. It is requested that the details of such cases may please be furnished in the enclosed proforma latest by 17 Aug 2015, along with views/comments, so that a consolidated proposal could be sent to the DoP&T for consideration of one time relaxation.

You may be aware of that Shri S N Batwe, Patron/BPMS highlighted some of the following issues related to LTC, thereupon vide letter No. BPMS / DoP&T/ LTC / 50 (7/2/R), Dated 10.11.2014 this federation requested the DoP&T as well as MOD to consider the issues sympathetically :-



(i) Earlier { DoP&T F.No. 31011/412007-Estt.(A), dated 02.05.2008} the Group ‘B’ Central Government employees were entitled to travel by Air from their place of posting or nearest airport but now {vide DoP&T O.M. No. 31011/ 3/ 2014-Estt.(A-IV), dated 26.09.2014} only eligible Government servants may travel from their place of posting or nearest airport, hence necessary clarification was required so that the Group ‘B’ employees may be entitled to travel by Air from their place of posting or nearest airport;

(ii) Vide DoP&T F.No. 31011/4/2007-Estt (A), Dated 30.04.2012 the Air travel relaxation under LTC for NER was extended for 02 yrs from 01.05.2012, i.e., applicable upto 01.05.2014 and vide DoP&T F. No. 31011/2/2003-Estt.A-IV, dated 15.06.2012 the Air travel relaxation under LTC for J&K was extended for 02 yrs from 18.06.2012, i.e., applicable upto 18.06.2014 whereas this order grants the relaxation for air travel w.e.f. 26.09.2014. There were some of the employees who have travelled by Air under LTC in the intervening period, i.e., 01.05.2014 / 18.06.2014 and 26.09.2014 in anticipation of extension of such relaxation as per prevailing practice. To mitigate the financial hardships of such employees, the DoP&T O.M. No. 31011/ 3/ 2014-Estt.(A-IV), dated 26.09.2014 should have retrospective effect, i.e., 01.05.2014.

(iii) Some of the defence civilian employees while availing LTC by Air to destinations like A&N Islands, J&K and NER, did not follow the instructions regarding purchase of their air tickets only from the booking counters/websites of Air India or from the Authorized Travel Agents [M/s Balmer Lawrie & Co, M/s Ashok Travels & Tours and IRCTC] and their LTC claims are not being allowed. Hence, one time relaxation is required to settle these cases.

Now, Min of Defence is considering the case (iii) and invited the details from concerned authorities. Hence, all are requested to forward their details through proper channel in given format only.

To resolve this issue, the employees Federations have approached this Ministry and have requested to take up the matter to DoP&T with recommendation that:

a) Claims of Group C and B employees who are otherwise not entitled for Air Travel, in case they have availed LTC 80 by purchasing Air tickets from other than the authorized agents may be considered as a one time measure and a relaxation may be granted to pass their LTC claims as a special case;

b) For such employees who have purchased Air Tickets prior to 26 Sep 2014 from other than authorized agents to travel to A&N Islands, in their case, the LTC claim may be restricted to their entitled class in Steamer/Ship

2. The DoP&T have communicated vide their letter No.31011/6/2015-Estt.A IV dated 1st July addressed to JCM, National Council, that it would not be feasible to relax the LTC rules as a one-time measure. However, cases of individual hardship as recommended by Ministries/ Departments would be considered on a case to case basis.

3. Accordingly, it is proposed to take up the matter with the DoP&T for a decision on the LTC claims submitted by the defence civilian employees where the air tickets have not been purchased by these employees in accordance with the Government instructions. It is requested that the details of such cases may please be furnished in the enclosed proforma latest by 17 Aug 2015, along with views/comments, so that a consolidated proposal could be sent to the DoP&T for consideration of one time relaxation.

The instances have come to the notice, where employees apply for LTC and proceed without sanction of LTC as well as the leave. It has also been noticed in some of the cases that the Divisional Head (Leave Sanctioning Authority) has only recommended the leave which does not mean the leave is granted. For proceeding on LTC it is informed to all that without grant of leave and sanction of LTC an employee cannot proceed on LTC.  The Member Secretary, Central Board has viewed it very seriously and following instructions are issued for information and for strict compliance by all the employees;

(a) Without issue of LTC order as well as leave sanction order an employee shall not proceed for LTC.

(b)  Even if, LTC is not applied, an employee shall not leave their Head Quarter without sanction of the leave order.

(c) The employees are advised that they should well plan their LTC programme before applying for the same and the leave must be granted by the concerned Divisional Heads/ Incharge Zonal Offices.

(d) The intended place of visit (other than declared home town) should be well decided before applying the LTC.

(e) Once the LTC is sanctioned, only genuine request beyond the control of the employee, for preponement/postponement or cancellation whatsoever will be considered by the Competent Authority.

(f)  Employee must enquire the correct fare per ticket of their entitled class from Railways or Airlines for the intended place of visit, before applying for LTC.

(g) When no advance is taken, the LTC claim should be submitted within three months from the completion of return journey. Otherwise, the claim will be forfeited.

(h)  When advance is taken, the claim should be submitted within one month from the date of return journey. If not, the outstanding advance will be recovered in one lumpsum and the claim will be treated as one where no advance is sanctioned. Further, panel interest @ 2% over & above of CPF interest on the entire advance from the date of drawal to the date of recovery will be charged.

(i)  When claim submitted within stipulated time but unutilized portion of advance not refunded, interest is chargeable on that amount from the date of drawl to the date of recovery.

(j)  When a part of the advance becomes excess drawl due to genuine reasons beyond the control of the employees, the Competent Authority, if satisfied, exempt charging of interest.

This issues with the approval of the Competent Authority, Central Pollution Control Board.
