Subject: Revision of Pension of Pre-2016 pensioners - Stagnation Increment regarding

The undersigned is directed to say that in pursuance of the decision taken by the Government on the recommendations of the 7th CPC, orders were issued vide this Deptt's OM of even number dated 12.5.2017 for revision of pension/family pension in respect of pre-2016 pensioners/family pensioners by notionally fixing pay in the pay matrix recommended by the 7th CPC in the level corresponding to the pay in the pay scale/pay band and grade pay at which the Government servant / pensioner retired/died. Concordance tables for fixation of notional pay / pension of pre-2016 pensioners were issued vide this Department's OM of even number dated 6.7.2017.

2. References/representations have been received in this Department seeking clarification on the applicability of the OM dated 7.9.2016 for the purpose of notional pay fixation and revision of pension of pre-2016 pensioners and family pensioners w.e.f. 1.1.2016. The matter has been examined in consultation with the Ministry of Finance (Department of Expenditure). It is clarified that the benefit of additional increment has been granted to those officers who were serving as on 1.1.2016. Those who retired/died before 1.1.2016 are, therefore, not eligible for increment after retirement for the purpose of pension.

3. This issues with the approval of Department of Expenditure vide their I.D. No.1(3)/V-V/2018 dated 4.9.2018 and 1.D. No.1(3)/V-V/2018 dated 28.11.2018

Sir/Madam,
As you are aware that 7th CPC pension revision for Pre-2016 pensioners/family pensioners is going on in compliance to the DP&PW 0M dated 12th May, 2017. As on date, more than 5 Lakhs pension revision cases of central civil pensioners/family pensioners have been received in Central pension Accounting Office (CPAO). CPAO is receiving many queries from the pensioners/family pensioners regarding status of their pension revision. CPAO is providing the status of pension revision to the pensioners. The pension revision status can also be checked by the pensioners/family pensioners through CPAO website www.cpao.nic.in by entering their 12 digit PPO numbers. For the wider publicity of this facility among Central Civil Pensioners/family pensioners, it is felt necessary that a link of this facility available on CPAO website may be provided in the official websites of your Ministry/Department and its attached/subordinate offices for the benefits of pensioners.

It is therefore requested that a link of following URL Of CPAO website; http://cpao.nic.in/Pensioner/ppo_status.php may be created in the websites of your Ministry/Department by the NIC Wing under the caption-"Check Your 7th CPC Pension Revision Status".

1) DATE OF DEATH OF PENSIONER NOT MENTIONED IN COLUMN 3 [b]. (FAMILY PENSION CASE)

2) APPLICABILITY OF COMMUTED PENSION MAY BE CHECKED WHETHER IT IS APPLICABLE OR NOT.

3) CLASS/CATEGORY OF PENSION UNDER COLUMN 1 (g) MAY BE CHECKED.

4) NOTIONAL PAY SHOWN UNDER COLUMN 3 (e) MAY BE CHECKED.

5) PAY/NOTIONAL PAY SHOWN IN COLUMN 3 (e), DOES NOT MATCH WITH PAY FIXED UNDER 7TH CPC AS SHOWN IN COLUMN 4 (a).

6) LEVEL AND INDEX UNDER COLUMN 4 (a) MAY BE CHECKED.

7) BASIC PENSION IS NOT MATCHING WITH THE LAST PAY DRAWN AS PER 7TH CPC.

8) PAY MATRIX FOR LEVEL‐ 13 MAY BE CHECKED WITH REFERENCE TO REVISED PAY MATRIX IN TERMS OF MINISTRY OF FINANCE (DEPTT.OF EXPENDITURE) RESOLUTION DATED-16.05.2017.

Sub: Revision of Pension of pre-2016 Pensioners/Family Pensioners pursuant to Government’s decision on the recommendations of 7th CPC - Concordance Tables for pension revision to the former Running Staff-reg.

Ref: Railway Board’s letter No. 2016/F(E)III/1(1)/7 dated 11/07/2017.

Railway Board’s attention is invited to the instructions issued vide Board's letter dated 11/07/2017 (RBE No. 66/2017) vide which DoP&PW’s orders together with Concordance tables for revision of Pension of pre-2016 Pensioners/Family Pensioners have been circulated. The Concordance Tables circulated by the Board, unfortunately do not cover the pension revision of former Running Staff as no separate tables in favour of them staff have been circulated so far. Reports received by the Federation (NFIR) reveal that the Pension/Family Pension of pre-2016 Running Staff is not being revised by the Zonal Railways due to non-provision of separate Concordance Tables by the Railway Board.

In this connection, NFIR desires to clarify that in case of former Running Staff Pension/Family Pension is required to be calculated taking into account the Basic Pay + 55% add on pay element. A sample calculation sheet of the Pension in the case of pre-2016 Running Staff is enclosed as Annexure to this letter for appreciation and quick action.

NFIR, therefore, requests the Railway Board to communicate the Concordance Tables to the Zonal Railways for revision of Pension/Family Pension of former Running Staff. It is also urged that the Concordance Tables be finalized on the basis of specimen (vide Annexure to this letter) and instructions issued to the GMs of Zonal Railways.

Subject:  Implementation of Government's decision on the recommendations of 7th Central Pay Commission - Revision of pension of pre- 2016 Pensioners/ Family Pensioners, etc.-reg.

DP&PW vide OM No. 38/37/2016-P&PW (A) dated-12.05.2017 on the above subject had issued detailed instructions to all concerned to revise the pensions of pre-2016 pensioners/ family pensioners. But while issuing instructions to PAOs vide CPAOs OM No. CPAO /IT& Tech/ Revision (7th CPC)/ 19 Vol-III/2016-17/37 dated-25.05.2017 inadvertently an important point "that these orders would not be applicable for the purpose of revision of pension of those pensioners who were drawing compulsory retirement pension under Rule 40 of the CCS (Pension) Rules or compassionate allowance under Rule 41 of the CCS (Pension) Rules. The pensioners in these categories would continue to be entitled to get revised pension in accordance with the instructions contained in DP&PW O.M. No. 38/37/2016-P&PW(A)(ii) dated 04.08.2016" was missed.

Consequently, it has been noticed that some Ministries/Departments have revised the pensions of pensioners who were drawing compulsory retirement pension under Rule 40 of CCS (Pension) Rules, 1972 or Compassionate allowance under 41 of the CCS (Pension) Rules also and sent to CPAO. These cases are to be returned to the concerned PAOs by CPAO.

In view of the above, to avoid any further problems arising out of it, all Pr. CCAs/CCAs/ CAs/ AGs/ Administrators of UPS are requested to instruct their PAOs not to revise such cases.
This issues with the approval of the competent authority.

Instructions have been issued regarding revision of pre-2016 pensioners/family pensioners in line with 7th CPC recommendations vide Railway Board’s letter under reference above. These instructions envisage 'suo moto' revision in pension for all pre-2016 retirees. Till date 151982 pensioners PPO have been revised.

It may be appreciated that against the 14 lakh pensioners cases on Indian Railways, the pace of pension revision is slow. In the recently held review meeting, additional secretary (Expenditure) has also emphasized that adequate priority may be given to this area of work. Finance Secretary also expressed that exercise of pension revision may be completed in a time-bound manner. In this connection, Financial Commissioner, vide his DO letter No.2016/AC-II/21/8/PT-III dated 5.9.2017 has also advised that the exercise of revision may be carried out on a parallel track alongwith ARPAN to expedite the process.

As a welfare measure, it should be ensured to step up with pace for revision of pension. The work flow of pension revision envisages close coordination between the personnel and the accounts Department and hence, it is advised that PCPO and PFA to monitor the progress of revision of pension cases at their level to ensure that pension revision exercise is completed at the earliest.

Subject: Implementation of Government's decision on the recommendation of the Seventh Central Pay Commission - Revision of pension of pre-2016 pensioners / family pensioners etc - reg.

The undersigned is directed to refer to this Department's letter of even number dated 19th May 2017 vide which the instructions dated 12th May 2017 relating to revision of pension of pre-2016 pensioners issued by Department of Pension and Pensioner's Welfare in the context of implementation of VII CPC recommendations, were extended to All India Service (AIS) Pensioners. The said letter dated 19th May 2017 was also sent to all Ministries / Departments of Government of India (copy enclosed).

2.Many retired AIS Officers who are drawing pension from the Central Government, have since voiced grievances at various levels, stating that pension revision in pursuance of the order dated 19th May 2017 has not taken place so far.

3.It is observed in this regard that CPAO, with the approval of the Controller General of Accounts, have issued instructions on 25th May 2017 to Pr. Chief Controller of Accounts / Chief Controller of Accounts etc. about the modalities to be followed for expeditious implementation of the instructions dated 12th May 2017 of the D/o Pension & PW. Joint Secretary (Admn) / Admin in charge of Ministries / Departments have also been requested by CPAO to instruct their Head of Offices (HOOs) to start immediately sending the revised pension cases to the PAOs on the basis of records available with them and monitor the progress in this regard. Further follow up instructions have also been issued by CPAO on 7 th July 2017.

4.In view of the hardships being encountered by retired AIS Officers vis-a-vis revision of their pensions, all Ministries / Departments are requested to take necessary action for effective and expeditious implementation of the instructions dated 19th May 2017 pertaining to revision of pension of AIS Officers read with D/o Pension and PW instructions dated 12th May 2017.

Sub : Implementation of Government's decision on the recommendations of the Seventh Central Pay Commission Revision of pension of pre-2016 retired medical officers.

The undersigned is directed to say that in implementation of the decision taken on the recommendations of the 7th CPC, orders were issued vide this Departments OM No.38/37/2016-P&PW(A)(ii) dated 04.08.2016 for revision of pension of pre-2016 pensioners/family pensioners w.e.f. 01.01.2006 by multiplying the pre-revised pension/family pension by a factor of 2.57. Subsequently, vide OM No. 38/37/2016-P&PW(A) dated 12.05.2017, it has been decided that the pension/family pension w.e.f. 01.01.2016 in respect of all Central civil pensioners/family pensioners, who retired/died prior to 01.01.2016, may be revised w.e.f. 01.01.2016 by notionally fixing their pay in the pay matrix recommended by the 7th CPC in the level corresponding to the pay in the pay scale/pay hand and grade pay at which they retired/died. This will be done by notional pay fixation under each intervening Pay Commission based on the Formula for revision of pay

2. In the case of medical officers, the emoluments reckoned for calculation of pension include Non-practicing Allowance (NPA). The pay of the medical officers is revised in accordance with the specific provision made in the Revised Pay Rules. The manner in which the pay of the medical officers is to be revised w.e.f. 1.1.2016 is prescribed in Rule 7 of the CCS (Revised Pay) Rules, 2016. Accordingly, for the purpose of revision of pension of pre-2016 retired medical officers in accordance with this Department’s O.M. dated 12.05.2017, their pay will be notionally revised w.e.f. 1.1.2016 based on the formula for revision of pay as applicable to the medical officers in the 7th CPC as well as in the intervening Pay Commissions. NPA at the rate as applicable as on 01.01.2016 shall be added to such notional pay as on 1.1.2016 to arrive at pension/family pension of retired medical officers w.e.f. 1.1.2016.

3. NPA to serving medical officers has been revised @ 20% of basic pay w.e.f. 1.7.2017. Accordingly, the pension/family pension of retired medical officers shall be further revised w.e.f. 1.7.2017 by adding NPA @ 20% to the notional pay as on 1.1.2016, instead of the NPA admissible as on 1.1.2016.

4. The revision of pension/family pension of retired medical officers in the above manner will be further subject to the condition that the notional pay as on 1.1.2016 plus NPA does not exceed the average of basic pay of the revised scale applicable to the Apex Level and the level of Cabinet Secretary.

5. This issues with the approval of Ministry Of Finance, Department of Expenditure vide their I.D.No.136/EV/2017 dated 25.08.2017.

Reference: i) DOP&PW OM No.38/37/2016-P&PW(A) dated 12th May, 2017 & 6th July, 2017 ii) Para 10.1.67 of 7th CPC Report for grant of Parity of Pension of Pre & Post Seventh CPC Pensioners

1. We draw your kind attention to the sad plight of large majority of Central Government Pensioners – especially the Pre-2006 Pensioners and more so the Pre-1996 Pensioners, who will suffer a major financial loss in fixation of their Revised Pension on account of an unjust decision on implementation of 7th CPC Report vide DOP&PW OM dated 12 -5-2017 cited above.

2. The Seventh Central Pay Commission (CPC) in Para 10.1.67 & 10.1.68 of its Report had for the first time conceded the long pending demand of the Central Government Pensioners for Parity of Pension between the Pre and Post CPC Pensioners and had recommended the following pension formulation for civil employees including CAPF personnel who had retired before 01.01.2016:
i) All the Civilian personnel including CAPF who retired prior to 01.01.2016 (expected date of implementation of the Seventh CPC recommendations) shall first be fixed in the Pay Matrix being recommended by this Commission, on the basis of the Pay Band and Grade Pay at which they retired, at the minimum of the corresponding level in the matrix. This amount shall be raised, to arrive at the notional pay of the retiree, by adding the number of increments he/she had earned in that level while in service, at the rate of three percent. Fifty percent of the total amount so arrived at shall be the revised pension.

ii) The second calculation to be carried out is as follows. The pension, as had been fixed at the time of implementation of the VI CPC recommendations, shall be multiplied by 2.57 to arrive at an alternate value for the revised pension.

iii) Pensioners be given option of choosing whichever formulation is beneficial to them.
3. Option 1, cited above, was very much feasible to implement as recommended by 7th CPC for revision of Pension of old Pension since according to the survey conducted by the DOP&PW, it was accepted that the Service Records of over 80% of old Pensioners were available, while those of the others could be re-built as per procedure prescribed in the Rules and as was done after 5th & 6th CPC and as per orders of the Courts in numerous cases.

4. Regrettably, the Committee formed by the Government, to consider the feasibility of implementation of Option 1 recommended by the Seventh CPC, while finding it non-feasible, did not care for the interest of the more than 80% of the Pensioners merely to save the Administration from the botheration of Re-building the Service Records of the rest less than 20% Pensioners. This was a great injustice since the 80% of the Pensioners who’s Records are available, shall suffer a loss of Pension just because of missing records of the rest 20%.

5. Instead, the Government accepted the following formula vide OM Dated 12-5-2017, as recommended by the Committee on Feasibility of Option 1:

"the revised pension/family pension w.e.f. 01.01.2016 in respect of all Central civil pensioners/family pensioners, including CAPF's, who retired/died prior to 01.01.2016, may be revised by notionally fixing their pay in the pay matrix recommended by the 7th CPC in the level corresponding to the pay in the pay scale/pay band and grade pay at which they retired/died. This will be done by notional pay fixation under each intervening Pay Commission based on the Formula for revision of pay. While fixing pay on notional basis the pay fixation formulae approved by the Government and other relevant instructions on the subject in force at the relevant time shall be strictly followed. 50% of the notional pay as on 01.01.2016 shall be the revised pension and 30% of this notional pay shall be the revised family pension w.e.f. 1.1.2016 as per the first Permutation."

6. The above said formula will very seriously and adversely affect the Revised pension of a large majority of the Pre-2016 Pensioners on account of following reasons:
a) "Parity of Pension" between Pre and Post-2016 Pensioners - recommended by the Seventh CPC - would be denied to the Pre-2016 Pensioners.

b) In the process of notional pay fixation in successive Pay Commissions, there is a lot of dilution particularly for pensioners who retired in 4th CPC period resulting in big financial loss.

c) Irrespective of the date of retirement, Option 1 would have given the same pension to pre-2016 pensioners depending upon the number of increments earned in the last Level. By denying option 1 there will be sub-groups even within the homogenous group of pre-2016 pensioners.

d) None of the above losses would occur to the Pre-2016 Pensioners if the Option 1 recommended by the 7th CPC is implemented and if the new formula is allowed as a 3rd Option in addition to Option 1 & 2 Recommended by the 7th CPC in the interest of natural justice to all Pre- 2016 Pensioners.
2. It is, therefore, requested that the Pension of Pre-2016 Pensioners be fixed at the highest of the 3 Options - including first two Options as recommended by 7th CPC and 3rd Option as accepted by the Government and Notified vide DOP&PW OM Dated 12-5-2017.

Sir/Madam,

Kindly refer to this office letter of even number dated 23.5.2017 circulating DoP&PW O.M. No. 38/37/2016-P&PW(A) dated 6.7.2017 regarding implementation of Government decision for revision of pension of pre-2016 pensioners/family pensioners.

2. Department of Pension & Pensioners Welfare has circulated O.M. No. 38/37/2016- P&PW (A) dated 6.7.2017 concordance tables for fixation of notional pay and pension/family pension of employees who retired/died in various grades during the 4th , 5th and 6th Pay Commission periods. A copy of the OM is forwarded herewith for information and compliance. The concordance table is available on the website of Department of Pension & PW at http://www.doppw.gov.in and appropriate table may be utilized in terms of instructions of DoP&PW O.M. dated 6.7.2017. In the case of those employees who retired/died before 01.01.1986, these concordance tables may be used based on their notional pay as on 01.01.1986, which was fixed m accordance with DoP&PW's O.M. No. 45/86/97- P&PW(D)(iii) dated 10.02.1998.

3. Separate tables have been given in respect of pre-01.01.2016 pensioners who retired in the Group D pay scales corresponding to 6th CPC grade pay of Rs 1300/-, Rs 1400/-, Rs.1600 and Rs. 1650/- (Table No. 1 to Table No.4) and for pensioners who retired during 6th CPC period after upgradation to the Grade pay of Rs 1800/- (Table No. 5 to Table No. 8). The pension/family pension of such pensioners/family pensioners may be revised using the appropriate table.

4. In case of any inconsistency in the concordance tables vis- a-vis the relevant rules/instructions, the notional pay and pension/family pension of pre-2016 pensioners/family pensioners may be fixed in accordance with the rules/instructions applicable for fixation of pay in the intervening Pay Commission periods.

5. It is requested that all concerned subordinate authorities may be instructed accordingly. Vigorous efforts may be made to complete all revision cases by 30.09.2017.  The nodal officer in each circle/DAP may please send the progress report on fortnightly basis in time.

Kind attention is invited towards the DOP&PW OM Dated 12-5-2017 regarding Implementation of Government's decision on the recommendations of the Seventh Central Pay Commission - Revision of pension of pre-2016 & post-2016 pensioners/family pensioners.

Incidentally, Fitment Tables and the Ready Reckoners have not been issued with the said orders as was done after every Pay Commission - both in respect of the Pay and Pension.

This will make the Revision of Pension very difficult, and time consuming as Notional Pay has to be fixed from one Pay Commission to the next since the Retirement of the employee for Revising their Pension as per Notional Pay in the Pay Matrix of 7th CPC.

This will substantially delay the issue of Revised PPOs and implementation of the said orders this time, causing hardship to the old Pensioners.

It is, therefore, earnestly requested that
i) Scale-wise Fitment Tables and Ready Reckoners may please be issued early for the Pensioners who had retired in the regimes of various Pay Commissions (especially those who retired from Pay Scales of Fourth, Fifth, Sixth and Seventh Pay Commissions.

ii) A dedicated Software may please be posted on the Pensioners Portal for the Revision of pension of pre-2016 & post-2016 pensioners/family pensioners and for expeditious issue of the Revised PPOs and for placing them on the Internet.

How, the battle is lost
One rank one pension denied

OPTION 1 recommended by 7th CPC for the revision of Pension/Family pension of pre-2016 Denied inspite of availability of service records of over 80% of old pensioners.

The alternative given vide OM dated 12.5.2017 though to some extent it will benefit a good % of old pensioners, it cannot make up the lifelong loss old pensioners will suffer due to denial of option 1. Ever since Honourable Supreme Court land mark judgement dated_____ in UOI vs D S Nakra. In the hide and seek game with UOI for 100% parity between present & past Civil Pensioners Bharat Pensioners Samaj had this time secured Penalty Corner but the Babu in DOP & PW foiled the final hit.

Why only DOP& PW, our own people must share the blame! The war veterans whom we had been supporting for years in their struggle for one rank one pension were the first to oppose 'Bharat Pensioners Samaj' demand for 100% parity/one rank one pension through electronic media as well as through representations (backed by their serving HODs) to GOI pleading that they only are entitled to this benefit and not the Civil pensioners

The final blow was delivered in the 7th meeting of feasibility committee on 17.10.2016 when as mentioned in Para 4 of the official minutes vide No. 38/37/2016-P&PW(A) GOI Ministry of Personnel, P.G. and Pensions -DOP &PW dated the 31st October, 2016 (placed here under). JCM (staff side) agreed with govt's alternative proposal.

Modifications in the 7th CPC recommendations on pay and pensionary benefits approved by the Cabinet on 3rd May, 2017

The Union Cabinet chaired by the Prime Minister Shri Narendra Modi approved important proposals relating to modifications in the 7th CPC (Central Pay Commission) recommendations on pay and pensionary benefits in the course of their implementation. Earlier, on 29th June, 2016, the Cabinet had approved implementation of the recommendations with an additional financial outgo of Rs.84,933 crore for 2016-17 (including arrears for 2 months of 2015-16).

The benefit of the proposed modifications will be available with effect from 1stJanuary, 2016, i.e., the date of implementation of 7th CPC recommendations. With the increase approved by the Cabinet, the annual pension bill alone of the Central Government is likely to be Rs.1,76,071 crore. Some of the important decisions of the Cabinet are mentioned below:

1. Revision of pension of pre -2016 pensioners and family pensioners
The Cabinet approved modifications in the recommendations of the 7th CPC relating to the method of revision of pension of pre-2016 pensioners and family pensioners based on suggestions made by the Committee chaired by Secretary (Pensions) constituted with the approval of the Cabinet. The modified formulation of pension revision approved by the Cabinet will entail an additional benefit to the pensioners and an additional expenditure of approximately Rs.5031 crore for 2016-17 over and above the expenditure already incurred in revision of pension as per the second formulation based on fitment factor. It will benefit over 55 lakh pre-2016 civil and defence pensioners and family pensioners.

While approving the implementation of the 7th CPC recommendations on 29thJune, 2016,the Cabinet had approved the changed method of pension revision recommended by the 7th CPC for pre-2016 pensioners, comprising of two alternative formulations, subject to the feasibility of the first formulation which was to be examined by the Committee.

In terms of the Cabinet decision, pensions of pre-2016 pensioners were revised as per the second formulation multiplying existing pension by a fitment factor of 2.57, though the pensioners were to be given the option of choosing the more beneficial of the two formulations as per the 7th CPC recommendations.
In order to provide the more beneficial option to the pensioners, Cabinet has accepted the recommendations of the Committee, which has suggested revision of pension based on information contained in the Pension Payment Order (PPO) issued to every pensioner. The revised procedure of fixation of notional pay is more scientific, rational and implementable in all the cases. The Committee reached its findings based on an analysis of hundreds of live pension cases. The modified formulation will be beneficial to more pensioners than the first formulation recommended by the 7th CPC, which was not found to be feasible to implement on account of non-availability of records in a large number of cases and was also found to be prone to several anomalies.

2. Disability Pension for Defence Pensioners
The Cabinet also approved the retention of percentage-based regime of disability pension implemented post 6thCPC, which the 7th CPC had recommended to be replaced by a slab-based system.

The issue of disability pension was referred to the National Anomaly Committee by the Ministry of Defence on account of the representation received from the Defence Forces to retain the slab-based system, as it would have resulted in reduction in the amount of disability pension for existing pensioners and a reduction in the amount of disability pension for future retirees when compared to percentage-based disability pension.
The decision which will benefit existing and future Defence pensioners would entailan additional expenditure of approximately Rs.130 crore per annum.

3. Changes in Pay Structure and Revision of the three Pay Matrices:
The Cabinet, while approving the 7th CPC recommendations for their implementation on 29thJune, had made two modifications in the Defence Pay Matrix as under:
(i) Index of Rationalisation (IOR) of Level 13A (Brigadier) may be increased from 2.57 to 2.67.

(ii) Additional 3 stages in Levels 12A (Lt. Col.) , 3 stages in Level 13 (Colonel) and 2 stages in Level 13A (Brigadier) may be added.
The Cabinet has now approved further modifications in the pay structure and the three Pay Matrices, i.e. Civil, Defence and Military Nursing Service (MNS). The modifications are listed below:

(i) Defence Pay Matrixhas been extended to 40 stages similar to the Civil Pay Matrix: The 7th CPC had recommended a compact Pay Matrix for Defence Forces personnel keeping in view the number of levels, age and retirement profiles of the service personnel.Ministry of Defence raised the issue that the compact nature of the Defence Pay Matrix may lead to stagnation for JCOs in Defence Forces and proposed that the Defence Pay Matrix be extended to 40 stages. The Cabinet decision to extend the Defence Pay Matrix will benefit the JCOs who can continue in service without facing any stagnation till their retirement age of 57 years.

(ii) IOR for Levels 12 A(Lt. Col. and equivalent)and 13(Colonel and equivalent)in the Defence Pay Matrix and Level 13 (Director and equivalent)in the Civil Pay Matrix has been increased from 2.57 to 2.67: Variable IOR ranging from 2.57 to 2.81 has been applied by the 7th CPC to arrive at Minimum Pay in each Level on the premise that with enhancement of Levels from PayBand 1 to 2, 2 to 3 and onwards, the role, responsibility and accountability increases at each step in the hierarchy. This principle has not been applied in respect of Levels 12A (Lt. Col. and equivalent), 13 (Colonel and equivalent) and 13A (Brigadier and equivalent) of Defence Pay Matrix and Level 13 (Director and equivalent) of the Civil Pay Matrix on the ground that there was a disproportionate increase in entry pay at the level pertaining to GP 8700 in the 6thCPC regime. The IOR for Level 13A (Brigadier and equivalent) in the Defence Pay Matrix has already been revised upwards with the approval of the Cabinet earlier. In view of the request from Ministry of Defence for raising the IOR for Levels 12 A and 13 of the Defence Pay Matrix and requests from others, the IOR for these levels has been revised upwards to ensure uniformity of approach in determining the IOR.

(iii) To give effect to the decisions to extend the Defence Pay Matrix and to enhance the IORs, the three Pay Matrices -Civil, Defence and MNS -have also been revised. While doing so, two calculation errors noticed in the MNS Pay Matrix have also been rectified.

(iv) To ensure against reduction in pay, benefit of pay protection in the form of Personal Pay was earlier extended to officers when posted on deputation under Central Staffing Scheme (CSS) with the approval of Cabinet. The benefit will also be available to officers coming on Central Deputation on posts not covered under the CSS.

Central Government does not issue any instructions regarding implementation of recommendations of the Central Pay Commission PERTAINING TO PENSION IN RESPECT OF EMPLOYEES OF AUTONOMOUS BODIES. In view of this , NO ORDERS REGARDING IMPLEMENTATION OF RECOMMENDATIONS OF 7th CPC IN RESPECT OF EMPLOYEES OF AUTONOMOUS BODIES IN THE MATTER OF PENSION ARE TO BE ISSUED BY FINANCE MINISTRY. The appropriate decision is to be taken by the concerned Autonomous Body in consultation with the concerned Administrative Ministry in keeping with the practice on the previous occasions and also in the light of the Rules and Regulations/Bye-laws governing the service conditions of respective Autonomous Bodies.

Subject:  Providing breakup of pension and arrear payments & recoveries to pensioners.

Attention is invited to para 4.6.7 of the Accounting and Operating Procedure for Central Pension Processing Centre of Authorised Banks for Pension Disbursement to Central Government (Civil) Pensioners (February, 2012) whereby it has been provided that "The CPPC software will display on the computer screen, options and view of the details of calculation of pension and its breakup of the pension paid to the pensioner/ family pensioner. The Home Branch will act as intermediary with the CPPC and, besides providing accounts statement, provide to the pensioners the payment of TDS details, pension slip, the Due and Drawn Statement in respect of each arrear and the Annual Income Statement".

2. Taking into consideration the grievances reported by Pensioners’ Associations and Pensioners, CPAO had issued instructions to Heads of CPPCs and Government Business Divisions vide OM No. CPAO/Tech/Banks Performance/2015-16/60 dated-14.06.2016 for strict compliance of above guidelines for providing detailed breakup of pension payments.

3. It has again been reported by Pensioners Associations and Pensioners that "arrears of arrear of Revision of Pension, Fixed Medical Allowance, Additional Pension, Life Time Arrear etc. are clubbed with monthly payment of pension for which it becomes difficult for pensioner/family pensioner to understand if pension and arrears are disbursed correctly. Even recovery of overpayment or wrong payment is not shown separately".

4. Therefore, banks are instructed to follow the provisions of CPPC guidelines and instructions issued vide OM dated-14.06.2016 and provide full breakup of pension payment dearly to the pensioners. A compliance report in this regard may be sent to CPAO latest by 31.01.2017 positively.

Subject: Revision of pension of Pre-2006 pensioners (JCOs/ ORs and Commissioned Officers) - delinking of qualifying service of 33 years for revised pension.

Reference: This office Circular Nos. 547 dated 11.09.2015, 548 dated 11.09.2015, 549 dated 30.09.2015, 551 dated 28.12.2015, 554 dated 14.01.2016, 562 dated 13.06.2016 and , 567 dated 16.09.2016.

A copy of GOI, MOD letter No.1(2)/2016-D(Pen/Pol) dated 30th September 2016 on the above subject is forwarded herewith for information and necessary action which is self explanatory.

2. Prior to issue of the above letter dated 30th September, 2016, the minimum guaranteed pension was revised w.e.f. 01.01.2006 as per GOI, MOD letter No.17(4)/2008(1)/D(Pen/ Policy) dated 11.11.2008 circulated vide this office Circular No. 397 dated 18.11.2008. Further, it was revised vide this office Circular Nos. 547 dated 11.09.2015 and 548 dated 11.09.2015. Similarly, the minimum guaranteed pension of Ordinary Family Pension was revised vide this office circular Nos. 397 dated 18.11.2008, 494 dated19.03.2013 and 567 dated 16.09.2016. Now, consequent upon the issue of the above Govt. letter dated 30th September 2016 , the consolidated revised pension ordinary family pension of all Pre-2006 Armed Forces pensioners/ Family pensioners w.e.f.1.1.2006 shall not be less than 50% and 30% respectively of the minimum of the pay in the Pay band plus Grade Pay corresponding to the pre-revised scale from which the pensioner had retired/ discharged/ invalided out/ died including Military Service Pay and ‘X’ group pay, if any, without pro-rata reduction of pension even if they had rendered qualifying service of less than 33 years at the time of retirement.

3. The revised consolidated enhanced rate of Ordinary Family Pension w.e.f. 01.01.2006 (consolidated as per Para-4 of GOI, MOD letter No.17(4)/2008(1)/D(Pen/Policy) dated 11.11.2008) in respect of Pre-2006 Armed Forces Family Pensioners shall not be less than 50% of the minimum of the fitment tables for the rank in the revised pay band.

4. Revised tables indicating minimum guaranteed retiring/ service pension and ordinary family pension have been annexed to this letter as follows:-

Annexure- A for Commissioned officers (Army, Navy, Air Force)
Annexure- B for JCOs/ ORs Pensioners (Army)
Annexure- C for JCOs/ ORs Pensioners (Air Force)
Annexure- D for JCOs/ORs Pensioners (Navy)

5. Pension Disbursing Agencies (PDAs) are hereby authorized to step up the pension/ family pension of the affected pre-2006 pensioners where the existing pension being paid to the pensioners, is less than the rate of pension indicated in above said annexure.

6. The provisions of above Govt. letter shall take effect form 01.01.2006 and arrears, if any, shall be payable from 01.01.2006. Further, the Pension/ Family pension of the Armed Force Personnel has been revised a number of times in past vide various letters issued by Ministry of Defence, therefore, if pension already revised w.e.f. 01.01.2006, 01.07.2009, 24.09.2012 & 01.07.2014 (OROP) under respective Govt. orders happens to be more than this amount, then Retiring/ Service and Family Pension as per above orders will continue to be paid as basic pension during that period.

7. Prior to issue of above Govt. letter dated 30th September, 2016, this office has issued corrigendum PPOs on the basis of annexures mentioned in previous circulars for revision of minimum guaranteed pension for less than 15 years and 20 years of qualification service for JCOs/ ORs and Officers respectively. Now, consequent upon issue of the above Govt. letter dated 30th September, 2016, the revision of service element for less than 15 years and 20 years of qualification service for PBORs and Officers respectively will also be revised as per this circular only. Therefore, the Annexure for revision of service element as required by previous circulars is not necessary.

8. It is also mentioned that all cases of service element/ service pension in respect of War Injury Pensioners will be revised by the Pension Disbursing Agencies (PDAs). Therefore, the revision claims in respect of War Injury pensioners called for vide this office Circular No. 562 dated 13.06.2016 has been dispensed with henceforth.

9. Further, no table for Hony. Naik, Hony. Havildar and Havildar granted Hony. rank of Nb Subedar has been indicated. It is hereby clarified that since Hony. Rank of Naik, Havildar and Havildar holding Hony rank of Nb Sub are drawing pay in the pay scale of Sepoy, Naik and Havildar respectively, therefore, they are entitled for modified parity with reference to substantive rank held at the time of retirement/ discharge/ invalidment except Naik (TS) who draws the pay of Naik. Naik (TS) should be entitled for modified parity with respect to Naik rank.

10. Provisions of this circular will also be applicable to pensioners of TA and DSC (irrespective of single or dual pension).

11. LTA and Additional Pension will be regulated as per extant orders.

12. All other terms and conditions shall remain unchanged.

Subject: Implementation of Govt’s decisions on the recommendations of the Seventh Central Pay Commission – Revision of Pension of Pre-2016 Pensioners/Family Pensioners etc.

A copy of GOL, Ministry of P,PG and Pensions, Deptt. of P&PW OM No.38/37/2016-P&PW (A) (ii) dated 4th August, 2016 is enclosed for immediate implementation of Govt’s decision on recommendations of the Seventh Central Pay Commission relating to revision of Pension of Pre-1-1-2016 Pensioners/Family Pensioners w.e.f. 1-1-2016.

2. The following further instructions are issued for smooth implementation of the ibid Govt. OM on the subject:-

APPLICABILITY
3.1 Para-2 of the enclosed Govt. OM provides the extent of its applicability. Present orders are applicable to the Pensioners/family pensioners in whose respect pension payment order (PPO) have been issued by CDA (Pensions)/Chief CDA (Pensions)/Pr.CDA (Pensions) from time to time in respect of Defence Civilians/Civilians under Ministry of Defence (MoD).

3.2 As stated in Para 2.2 of the enclosed OM, nothing contained in the enclosed OM applies to Commissioned Officers and Personnel Below Officer Rank (PBOR) of Armed forces. Separate orders will be issued for them by Ministry of Defence.

REVISION OF PENSION
4.1 For existing pensioners, who have retired before 01.01.2016, the revised pension/Family pension with effect from 01.01.2016 shall be determined by multiplying the pension/family pension, as had been fixed at the time of implementation of 6th Central Pay Commission (CPC) recommendations, by a factor of 2.57. The amount of revised pension/family pension so arrived at shall be rounded off to next higher rupee.

4.2 For calculation of revised pension, the existing pension/family pension will be the basic pension/family pension only without the element of additional pension available to the old pensioners/family pensioners of the age of 80 years and above. The additional pensions/Family pension payable to old pensioners/family pensioners will be worked out in accordance with para 4.5 of the OM.

4.3 Since the consolidated pension will be inclusive of commuted portion of pension, if any, the commuted portion will be deducted from the said amount while making monthly disbursements.

4.4 MINIMUM/MAXIMUM PENSION/FAMILY PENSION : The minimum pension w.e.f 01.01.2016 will be Rs.9000/- Per month (excluding the element of additional pension to old pensioners). The upper ceiling on pension/family pension will be 50% and 30% respectively of the highest pay in the Government (The highest pay in the Government is Rs.2,50,000 w.e.f. 01.01.2016).

4.5 ADDITIONAL PENSION : the quantum of pension/family pension available to the old pensioners/family pensioners shall continue to be as follows:-

The amount of additional pension will be shown distinctly in the pension payment order. For example, in cases where a pensioner is more than 80 years of age and his/her revised pension in terms Para 4.1 above is Rs.10,000 pm, the pension will be shown as (i) Basic Pension = Rs.10,000 and (ii) Additional Pension = Rs.2,000 pm. The pension on his/her attaining the age of 85 years will be shown as (i) Basic Pension = 10,000 adn (ii) additional Pension = Rs.3000 pm. Dearness Relief will be admissible on additional pension available to the old pensioners also.

4.6 In cases, where the Govt. Servants have drawn one time lump-sum terminal benefits equal to 100% of their pensions and have become entitled to the restoration of one third commuted portion of pension, their cases will not be covered by these orders. Orders for regulating pension of such pensioners will be issued separately.

4.7 The revised pension/family pension arrived at as per paragraph 4.1 includes dearness relief sanctioned from 1.1.2016

5. Where the revised pension/family pension in terms of paragraph 4.1 above works out to an amount less than Rs.9000/-, the same shall be stepped up to Rs.9000/-. This will be regarded as pension/family pension w.e.f. 01.01.16.

6. PENSIONER EMPLOYED/RE-EMPLOYED: The existing instructions regarding regulation of dearness relief to employed/re-employed pensioners/family pensioners, as contained in Department of Pension & Pensioners Welfare O.M.No.45/73/97-P&PW (G) dated 02.07.1999, as amended from time to time, shall continue to apply.

7. CONSTANT ATTENDANT ALLOWANCE: The matter regarding CAA admissible to existing pensioners shall be examined by the Committee constituted by the Gol. For this purpose, till a final decision is taken based on the recommendation of the Committee, constant Attendant Allowance shall be paid at the existing rates.

8. DEARNESS RELIEF: The Pension/family pension as worked out in accordance with provision of Para 4.1 above shall be treated as ‘Basic Pension’ with effect from 01.01.2016. The revised pension/family pension includes dearness relief sanctioned from 1.1.2016 and shall qualify for grant of Dearness Relief sanctioned there after.

9. ARREARS OF PENSION: The arrears of pension/Family pension, as a result of consolidation of pension, will be worked out by PDAs and will be paid to pensioner or credited to their accounts by 31st August 2016 positively.

10. If any overpayment is in the process of recovery, the amount still due for recovery should be adjusted in lump – sum against the arrears payable.

11. PROCEDURE: The Govt. has authorised the Pension Disbursing Authorities including Public Sector Banks to pay the consolidated pension/Family Pension without further aughorization from this office at the revised rates in terms of Para 4.1 and 5 above. Wherever the age of Pensioner/Family Pensioner is available in the PPO, the additional pension/family pension in terms of Para 4.5 above may also be paid by the PDAs without any further authorization from this office. The following points may specially be kept in view while authorizing disbursement under the captioned order:
(a) A Suitable entry regarding the revised pension shall be recorded by the pension Disbursing Authorities on face of Pension Payment Orders.
(b) a suitable entry regarding revised consolidated pension/Family Pension w.e.f 1-1-2016 should also be recorded in the check register/payment Register/Pension Payment scroll.
(c) In every case, where revision is done by PDA’s, intimation to this office in the form given as Annexure-I to this circular will be prepared in triplicate. Two copies thereof will be sent to this office in covers bearing the following address in convenient batch(s):-
SAO, O/IC Audit Section, O/o the Pr.C.D.A. (P), Allahabad – 211 014.
A consolidated soft copy of all such payment in CSV format may be sent in a CD to this office and also be mailed to us in the format attached in Annexure-II on the email sevenpaycomalbd.dad@hub.nic.in specially created for the purpose.
(d) All cases where such revision is carried out will Change entitlements and other data which must be reflected as such in the Pension Payment Account in a separate schedule/scroll.
12. In cases where the PDAs are in doubt about the entitlement on revision in individual cases or in regulation of minimum pension/revised pension for pensioners in receipt of more than one pension, the cases with full details of pensioner and PPO NO. may be referred to Audit Section of this office for advice and further action on the same address mentioned in para 11(c) or a mail may be sent on the email address given in para 11 (C).

In pursuance of Government’s decision on the recommendations of Seventh Central Pay Commission, the Department of Pension & Pensioners’ Welfare (DOP&PW), vide their O.M.F.No.38/37/2016-P&PW(A)(ii) dated 4th August, 2016, has issued instructions for revision of pension of pre-2016 pensioners/family pensioners. In terms of pars 2.1 of the said O.M., the instructions contained therein apply to all pensioners/family pensioners, who were drawing pension/family pension before 01.01.2016 under the Central Civil Services (Pension) Rules, 1972, Central Civil Services (Extraordinary Pension) Rules and the corresponding rules applicable to Railway pensioners. A pensioner/family pensioner who became entitled to pension/family pension w.e.f. 01.01.2016 consequent on retirement/death of railway servant on 31.12.2015, would also be covered by these orders. The corresponding rules applicable to Railway pensioners/family pensioners are Railway Services (Pension) Rules, 1993 and Railway Services (Extraordinary Pension) Rules, 1993.

2. Compliance of instructions contained in DOP&PW’s 0.M. ibid may be ensured expeditiously.
