Subject: Proposed Protest by Government Employees from March 15, 2019 to March 30, 2019 to protest against National Pension Scheme (NPS) and to demand hike in Minimum pay and fitment factor under 7th Central Pay Commission - Instructions under CCS (Conduct Rules), 1964 - Regarding.

It has been brought to the notice of the Government that a forum by the nomenclature of National Joint Council of Action (NJCA) has decided to organize protest from March 15, 2019 to March 30, 2019 to protest against National Pension Scheme (NPS) and to demand hike in Minimum pay and fitment factor under 7th Central Pay Commission

The instructions issued by the Department of Personnel and Training prohibit the Government servants from participating in any form of strike/protest including mass casual leave, go slow etc. or any action that abet any form of strike/protest in violation of Rule 7 of the CCS (Conduct) Rules, 1964. Besides, in accordance with the proviso to Rule 17(I) of the Fundamental Rules, pay and allowances is not admissible to an employee for his absence from duty without any authority. As to the concomitant rights of an Association after it is formed, they cannot be different from the rights which can be claimed by the individual members of which the Association is composed. It follows that the right to form an Association does not include any guaranteed right to strike/protest.

There is no statutory provision empowering the employees to go on strike. The Supreme Court has also agreed in several judgements that going on a strike/performing any sort of protest is a grave misconduct under the Conduct Rules and that misconduct by the Government employees is required to be dealt with in accordance with law. Any employee going on strike/protest in any form would face the consequences which, besides deduction of wages, may also include appropriate disciplinary action. Kind attention of all employees of this Department is also drawn to this Department’s O.M. No.33012/1/(S)/2008 Estt.(B) dated 12.9.2008, on the subject for strict compliance (enclosed as Annexure-A).

All officers are requested that the above instructions may be brought to the notice of the employees working under their control. All officers are also requested not to sanction Casual Leave or any other kind of leave to the officers and employees, if applied for, during the period of proposed Dharna/demonstration, and ensure that the willing employees are allowed hindrance free entry into the office premises.

In case employees go on protest anytime during the period 15.03.2019 to 30.03.2019, all Divisional Heads are requested to forward a report indicating the number and details of employees, who are absent from duty during the period of said protest, i.e. from 15.03.2019 to 30.03.2019.

Sub: Long pending prominent issues of the Central Government Employees

You may kindly recall that, aggrieved by retrograde recommendations of the VII CPC in general and particularly related to Minimum Wage and Fitment Formula as also on the issue of Restoration of Defined Old Pension Scheme for the Central Government Employees, the Central Government Employees, including Railwaymen, had decided to go on “Indefinite Strike” w.e.f. 11th July, 2016 since 06:00 hrs., in the morning. With a view to resolve these important issues amicably, a meeting was convened by your goodself on 30th June, 2016, wherein Hon’ble Finance Minister, Hon’ble Minister for Railways and Hon’ble Minister of State for Railways, were also present.

After detailed deliberations, the representatives of the Central Government Employees(NC/JCM) were assured that, the Union Government would favourably consider their demand of improvement in Minimum Wage and Fitment Formula, recommended by the VII CPC. It was also assured to look into the demand of Scrapping Contributory NPS in respect of the Central Government Employees and restoration of Defined Old Pension Scheme.

The representatives of the Central Government Employees were made to understand in the said meeting that, the Government would take decision in regard to above demands within a timeframe of four months by constituting committees for the purpose. On the assurance of the Group of Ministers, the proposed “Indefinite Strike” was deferred by the NC/JCM.

You may kindly appreciate that, substantially long time has already elapsed and the Federations of the Railways and other Central Government Employees, who had participated in the said meeting, have still been awaiting the positive outcome of the discussions held and assurances given by the Group of Ministers therein.

There is, therefore, serious discontentment brewing among the Central Government Employees, including the Railwaymen, and it is quite difficult to further contain the same any longer. There is, therefore, tremendous pressure to revoke the decision of the “Indefinite Strike” of the Central Government Employees due to non-settlement of the said issues.

It would, therefore, be largely fair and conducive for harmonious relations of the Central Government Employees with the Central Government, that, at least the following two major issues be settled without any further delay:-

(i) Restoration of Defined Old Pension Scheme for all Central Government Employees, irrespective of their date of appointment, which was available for the Central Government Employees appointed before 01.01.2004.

(ii) Improvement in Minimum Wage and Fitment Formula.

I earnestly hope that, your goodself will take these issues with all seriousness for resolving the same before it is too late, in the larger interest of conducive atmosphere in the country.

As you are aware that the Central Government employees are in quite anguish as agitating various issues since 1st January 2016 after submission of report of the 7th CPC. In the Standing Committee, JCM Staff Side have raised many issues which are still unresolved, the National Council is not taking place since more than a decade, the Standing Committee also not called since one year. The various Government employees are agitated and are demonstrating on the Charter of Demands submitted to you as well as Group of Ministers, headed by Hon'ble Home Minister on 30th June 2016.
Main issues of increasing Minimum Wage, Fitment Formula as well as announcing Guaranteed Pension at par with the Old Pension Scheme are creating lots of anguish in the mind of the Central Government Employees.
The JCM Staff Side feels that the Government have no priority for redressal of the grievances of Central Government employees which is a very serious trend and machinery of the JCM have become defunct.

We hope being the Chairman of National Council - JCM, you should immediately call a meeting of JCM and issue necessary instructions to Secretary DOPT and other Secretaries of other departments of Government of India to co-operate with the Staff Side and have regular meetings of National Council / Departmental Council JCM meetings as prescribed as per scheduled.

Comrades,
Today none of the 7th CPC related demands of Central Government Employees are settled. The assurance given by the Group of Ministers to the NJCA leaders regarding increase in Minimum Pay and Fitment formula is in paper even after a lapse of 20 months. Now the Finance Minister has replied in Parliament that "no change in Minimum Pay and Fitment formula is at present under consideration".

To avert the 11th July CG employees strike the Hon'ble Prime Minster had instructed the group of Hon'ble Ministers including Shri Rajnath Singhji, Hon'ble Home Minister, Shri Suresh Prabhuji , Hon'ble Railway Minister and Shri Arun Jaitelyji , Hon'ble Finance Minister to hold discussions with the Staff Side (JCM) on 30th June 2016 and the Shri Arun Jaitelyji , Hon'ble Finance Minister had published a written assurances in the Government website on 6th July 2016 leading to deferment of the strike .

Pay Commission Objective: It is the endeavour of every pay commission to ensure that the pay and allowances of employees should be ‘fair and reasonable'. The pay structure should also motivate the employees to reasonable levels of performance in the tasks assigned to them, so that the general public derive the benefit of their service as intended.

Our demand of revision of Minimum Pay and Fitment formula is quite justified.
Comparison of earlier wage hike we can observe that the fitment factor of 2.57 times is the lowest comparing to other pay commissions. If we make a study of earlier pay commission.

Many of the State Governments are following the Central Government pay scales, but a few state Governments have improved upon the Central Government pay scales. The examples are as under:

The financial position of the Central Government is very good. Even the GDP (Gross Domestic Product) has shown increase in last few years which is around 7% , the Indian economy is fastest growing and placed 7th in the world ( which is at 2,250.987 billions of $ ), comparing to wages paid in the world our wages are at lower level. The Government fiscal budget deficit equal to 3.50 percent of the country's Gross Domestic Product in 2016. Compared to 2008 where the fiscal deficit was at 7.8%, but today the fiscal deficit is contained at 3.5%. This is also a healthy sign of the economic status of the Central Government financial status, the budget fiscal deficit is always below 4%.

Direct tax collections in 2017-18 at Rs 9.95 lakh crore, exceeded the revised budgetary target of Rs 9.8 lakh crore. Also, 6.84 crore income tax returns filed in the year against 5.43 crore in the previous year signalling a rise of 26% . A net of 99.5 lakh new assesses were added to the tax net.

Net collection from corporate tax went up 17.1 per cent while that from personal income tax rose 18.9%.

The revenue collection from Goods and Services Tax (GST) exceeded Rs 1 lakh crore in April 2018, GST revenue collected in April 2018 came at Rs 1,03,458 crore.

With the improved economic climate, introduction of e-way bill and improved GST compliance, GST collections would continue to show a positive trend.

The wage bill of the Central Government on in its employees is less than 10% or 3.4% of the GDP, which is less compared to various countries world wide.

Vacancy of the Central Government is about 15% , more than 4 lakhs vacancies are existing in the Central Government the work load is being carried out by the existing employees. The Government being a model employer should pay for its employees and motivate them to work more for implementation of its policies.

Hence due to the improved revenue earning of the Central Government, as assured to the staff side JCM by the Group of Ministers in respect of increase of Minimum Pay and Fitment formula, the Central Government should increase the Minimum Pay and Fitment formula.

Central government employees unions leaders will meet today to discuss their demand of minimum pay hike.

It will be the meeting of the Standing Committee Members of Staff Side, National Council JCM over the demand of hiking minimum pay beyond the 7th Pay Commission recommendation.

National Council (staff Side) Joint Consultative Machinery (JCM) is an umbrella organisation of various Central Government employees’ unions, including Railways, post and telegraph and Income Tax.

In wake of DoPT letter letter, Shiva Gopal Mishra, Secretary National council (staff Side), Joint Consultative Machinery has called for the meeting to give proper reply to the Department of Personnel and Training (DoPT).

DoPT letter dated October 30, addressed to Shiv Gopal Mishra, Secretary, Staff Side, National Council JCM stating that the demand for increase in minimum Pay and fitment formula do not appear to be treated as an anomaly, therefore, these do not come under the purview of National Anomaly Committee (NAC).

However, National Anomaly Committee (NAC) has been formed in September, 2016 to look into pay anomalies arising out of the implementation of the 7th Pay Commission’s recommendations and the government had said the NAC would discuss any pay hike agenda.

Earlier, Finance Minister Arun Jaitley had promised with central government employees unions’ leaders in Home Minister Rajnath Singh’s house on June 30, 2016 for hiking Pay and fitment formula through the appoint of a High Level Committee, when the unions had threatened to carry out an indefinite strike on July 11, 2016.

The High Level Committee has not yet been constituted, while the Cabinet cleared the 7th Pay Commission recommendations on June 29, 2016.

Shiva Gopal Mishra Secretary National council (staff Side) JCM is also planning to meet PM Modi to raise the minimum pay hike issue before him.

Accordingly, he said, “We have faith in Prime Minister’s office, we have faith in PM Modi. We are sure that in order to maintain good industrial relations in the country, PM Modi will find an alternate solution.”

Media reports already stated that minimum pay and fitment factor beyond 7th Pay Commission recommendation was under consideration of the Central government and NAC was likely to recommend minimum pay hike to Rs 21,000 from existing Rs 18,000 and fitment factor to 3.00 times from existing 2.57 times, but DoPT letter now says minimum pay and fitment factor doesn’t come under the purview of the NAC.

The Unions have been demanding minimum pay Rs. 26,000 instead of Rs 18,000 with 3.68 fitment factor.

LATEST POSITION REGARDING MINIMUM PAY AND FITMENT FORMULA — GOVT INFORMED STAFFSIDE NATIONAL COUNCIL JCM THAT INCREASE IN MINIMUM PAY AND FITMENT FORMULA WILL NOT COME UNDER ANOMALY COMMITTEE ITEM.
During the last 2 – 3 months both print and electronic media are continuously reporting that increase in 7th CPC Minimum Pay and Fitment Factor is under serious consideration of the Govt. and National Anomaly Committee will give its recommendation to Govt. and orders for increased Minimum Pay and Fitment Formula will be given effect from April 2018. We are reproducing below a letter from Govt. dated 30.10.2017 addressed to Secretary, Staff Side , National Council JCM stating that the demand for increase in Minimum Pay and Fitment Formula will not come under the purview of National Anomaly Committee. Further Govt. has not yet constituted the HIGH LEVEL COMMITTEE for increasing Minimum Pay and Fitment Formula as assured by the Group of Ministers including Home Minister Sri Rajnath Singh, Finance Minister Shri Arun Jaitley on 30.06.2016. The so-called Senior Officers Committee has also not discussed this agenda even though staff Side has repeatedly demanded discussion and settlement as per the assurance given by Senior Cabinet Ministers. Now 17 months are over. 32 lakhs Central Govt. Employees and 33 lakhs Pensioners are being continuously betrayed by the NDA Govt.

Minimum wage and fitment formula hike issues

There are various reports in the news media, print media & social media regarding the hike in the minimum wage of Central Government employees from the existing Rs 18,000/-  to Rs 21,000/- and fitment formula from 2.57 to 3.00, which shall be implemented from 1st January 2018. The same shall be announced in the National Anomaly Committee due on 9th of October.

Comrades, 
We cannot confirm this news, comrades we should concentrate on struggle path as the Confederation has given the series of programs , I hope the Government will implement the hike in minimum wage for CG employees and revise the fitment formula also from the existing 2.57 to 3.00 even though the Staff side JCM has demanded Rs 26,000/ as minimum wage and fitment formula of 3.56 , this hike should be from 1/1/2016 not 1/1/2018 as per media reports.

In fact the Central Government has to take the political decisions on the wage hike , in fact the group of ministers of the Central Government have agreed to raise the minimum wage for CG employees on 30th June 2016 . I hope the commitment of the union minsters shall be honoured now.

Secondly the economy of the country which was going very well during past three years has showed down ward trend in last one year as the GDP which was at 9.1 in 2015-16 has reduced to 5.7 in 2017-18 .The economic activity has to take place, it is also observed during the past one year, in spite of economic recessions, the Government revenue collection has increased considerably. To improve the economic activity of the country and increase the GDP the Central Government should spend its funds which is available with them .

If the Central Government increases the minimum wage and fitment formula for its employees, the Central Government employees gets back 40% of the wage increase through the Income Tax and GST . So hardly a Government servant is left out with 60% wage hike , here also he spends the amount credited to him , as such an economic activity is induced in the public which will help to create more demand and employment activity.

I hope the Central Government takes a political decisions on increase of minimum wage hike and fitment formula for more than one crore employees which will also benefit the public and the CG employees.

UPDATE ON STANDING COMMITTEE MEETING OF NATIONAL COUNCIL JCM HELD ON 03.05.2017.

Meeting of the Standing Committee of National Council (JCM) held on 03.05.2017. Only Action Taken Report (progress report) on old items discussed in the Standing Committee meeting held on 25.10.2016 was discussed from 3 to 7 PM.

The protest of the staffside regarding abnormal delay in implementation of revised allowances from 01.01.2016 , increase in minimum pay and fitment formula , Option -1 parity of Pensioners , revision of pension and grant of dearness relief to autonomous body pensioners etc was conveyed to Secretary , Department of Personnel who chaired the meeting. The proposed move to close down DGS&D was also raised.

To discuss the new items another meeting will be held shortly.

On behalf of Confederation Coms: K.K.N.Kutty , M.Krishnan and M.S.Raja attended. Cabinet has approved the parity in pension recommended by the Pension Committee constituted by Govt w.e.f.01.01.2016. (whether it is 5th CPC recommended parity can be confirmed only after seeing the orders).

It is confirmed that Option-1 recommended by 7th CPC is rejected.

Sir,
Indian National Defence Workers Federation in its 21st Conference held on 21nd and 22nd March, 2017 unanimously resolved to conduct agitation programme from 24.04.2017 to 29.04.2017 in order to demand Ministry of Defence and Government of India to settle the demands.

INDWF being one of the constituent organisations of National Council (JCM) under the National Joint Council of Action (NJCA) of Central Government Employees. NJCA deferred the proposed Indefinite Strike which was to commence from 11.07.2016 based on the assurances given by the group of Ministers Chaired by Shri Rajnath Singh, Hon'ble Home Minister that Government will constitute committee on on Minimum Pay, Fitment Formula, Allowances, NPS and Pre-2016 pensioners. It was also the National Council (JCM) within 4 months. However, even after more than 6 months it is regretted to note that none of the demands of the NJCA pertaining to 7th CPC are accepted by the Government Employees in genera and Defence Civilian Employees in particular.

In addition to the above, it is to be pertinent to mention that the Government is going ahead very fast to privatise and outsource the entire defence production activities. We are in dark about the development which is taking place about the letter received from Hon'ble Prime Minister's office to the Department of Defence Production and OFB asking various information's of the production activities of the above unhelpful attitude and decision of Government of India and Ministry of Defence, the Defence Civilian Employees are very much agitated in this regard. Therefore, the Indian National Defence Workers Federation has decided to observe All India Demand Week from 24.04.2017 to 29.04.2017 by holding gate meetings, demonstration, wearing demand badges and submit memorandum for your favourable consideration and for early settlement of these demands.

CHARTER OF DEMANDS

1. Stop privatisation and outsourcing of Defence Production and withdraw 100% in Defence

2. Fill up all the existing vacancies including freezed vacancies during the period of ban on recruitment considering the increased work load.

3. Withdraw NEW PENSION SCHEME (NPS) for the Defence Civilian Employees and extend Defined Pension facilities at par with Armed Forces personnel as per CCS Pension Rules 1972 ensuring 50°/o pension on the last pay drawn and also extend Family Pension. Disability pension.

4 Regularise all the Casual. Contract, Outsource employees, Part time employees employed in permanent and perennial jobs.

5. Withdraw arbitrary decisions of stopping detailment of employees on Sundays/Holidays working in Ordnance Factories in order to achieve the projected targets.

6. Early implementation of granting of Allowances on 7m CPC Pay scales on HRA, TA and Other Allowances. Revise the Minimum Pay, implement 7th CPC recommendation of Option-I for pensioners and accepted by Government regarding pension of pre-2016 Pensioners without any further delay

Sub: Grievances of the Central Government Employees

Owing to serious discontentment on various retrograde recommendations of the VII CPC, there had been countrywide resentment among the Central Government Employees, and the Staff Side(JCM), under the aegis of the NJCA, had decided for an "Indefinite Countrywide Strike", commencing from 6th July, 2016, which was deferred after negotiations with the GoMs, comprising of Hon'ble Minister for Home Affairs, Finance Minister, Railway Minister and State Minister for Railways, held on 30.06.2016, wherein it was assured that, demands of the Central Government Employees, viz. improvement in Minimum Wage and Fitment Formula, Rates of Allowances, Guaranteed Pension/Family Pension in lieu of NPS etc. would be resolved within a fixed time frame of four months, for which committees were constituted by the Government of India.

While substantial delay took place in setting-up of various committees itself, however, it is a matter of deep concern that, the committees have not yet finalized their reports despite lapse of more than eight months time.
The Staff Side had, at the very outset, opposed setting-up of Committee on Allowances, demanding upward revision and restoration of certain allowances which were recommended to be abolished by the 7th CPC, nevertheless, the government on the contrary constituted the said committee.

It may be recalled that, it has been an established convention in the past also that, payment of the revised rates of the allowances is done w.e.f. the date of implementation of the report of the Central Pay Commission, but this time, unlike previous occasion, the Central Government Employees are still being paid House Rent Allowance, Transport Allowance etc. on the pre-revised rates.

It was being expected that, Committee on Allowances would complete its proceedings within the fixed timeframe and the CGEs would be paid allowances on the revised rates w.e.f. the date of implementation of the 7th CPC report, but unfortunately, it is being delayed inordinately, owing to which there is serious resentment brewing among the CGEs.

While Committee on Allowances also met on the previous day, i.e. 28.03.2017, and we were expected that it would finalize its recommendations in the said meeting, but on enquiring we have been made to understand that, the issue of revision of rates of HRA was even not discussed in the said meeting.

We, therefore, take this opportunity to apprise you that, unjustified and inordinate delay in finalizing the reports of the committees is not only breach of the assurance given to the Staff Side by the GoMs, but also creating an uncongenial atmosphere among the CGEs.

It would, therefore, be quite appropriate that, the issue may be considered with all seriousness as per assurance given to the Staff Side, and revision of the rates of the allowances, NPS, Minimum Wage and Fitment Formula and Pension/Family Pension, along with restoration of certain allowances abolished by the 7th CPC, be finalized without further loss of time in the larger interest of industrial harmony in the country.

OFFICE MEMORANDUM

Subject : Grant of Dearness Allowance to Central Government employees - Revised Rates effective from 1.1.2017.

The undersigned is directed to refer to this Ministry's Office Memorandum No. 1/2/2016-E-II (B) dated 4th November, 2016 on the subject mentioned above and to say that the President is pleased to decide that the Dearness Allowance payable to Central Government employees shall be enhanced from the existing rate of 2% to 4% of the basic pay with effect from 1st January, 2017.

2. The term 'basic pay' in the revised pay structure means the pay drawn in the prescribed Level in the Pay Matrix as per 7th CPC recommendations accepted by the Government, but does not include any other type of pay like special pay, etc.

3. The Dearness Allowance will continue to be a distinct element of remuneration and will not be treated as pay within the ambit of FR 9(21).

4. The payment on account of Dearness Allowance involving fractions of 50 paise and above may be rounded to the next higher rupee and the fractions of Tess than 50 paise may be ignored.

5. The payment of arrears of Dearness Allowance shall not be made before the date of disbursement of salary of March, 2017.

6. These orders shall also apply to the civilian employees paid from the Defence Services Estimates and the expenditure will be chargeable to the relevant head of the Defence Services Estimates. In respect of Armed Forces personnel and Railway employees, separate orders will be issued by the Ministry of Defence and Ministry of Railways, respectively.

7. In so far as the employees working in the Indian Audit and Accounts Department are concerned, these orders are issued with the concurrence of the Comptroller and Auditor General of India.

Dear comrades

          We know that all of you are in the midst of hectic preparation and campaign for making the 16thMarch Strike action a great success.  As has been explained in the article, which we have placed on our website, the NDA Government, led by BJP has exhibited the worst anti-employee attitude in the post independent  era of our country.  This Government has treated its own employees as its worst enemy. The decision taken by the Union Cabinet on 29th June, 2016 rejecting even the recommendations made by the high level committee chaired by the Cabinet Secretary was unprecedented. Even the setting up of various committees was nothing but an eye wash. Nothing will come out of that.  Even the NPS Committee on which the young comrades had pinned some hope of at least  getting a minimum guaranteed pension will produce nothing.  The discussions at the JCM fora has been converted into mostly monologues i.e. the official side simply listening and not reacting.  The Government, it appears, has made the Pension department to reject the one and only recommendation of the 7th CPC which was considered to be positive i.e. Option No.1 for pensioners on the specious ground that the same is not feasible to be implemented. The allowances committee has dilly dallied its deliberation and would now submit its report after the extended period of 6 months expires on 22.02.2017. Even if they make any positive recommendation, which is seldom expected, the NDA Government would not act upon it.  They have very successfully postponed the payment of the revised allowance for 15 months.

In the face of such terrible onslaught, betrayal and chicanery, which no Government in the past has every indulged in,  it is surprising that some of our friends who has a predominant role in the movement of the Central Government employees has unfortunately chosen to wait and watch.  It appears that they have chosen to wait endlessly hurting the cause of the workers.

We have no hesitation to affirmatively state the obvious that we have chosen the right path, the path of struggles, which can only the choice of the working class against tyrannical attitude of the employer, howsoever, powerful they may be. We must realize that those who are  in the saddle of power today are not permanently posted there. We were witness to the abysmal downfall of persons who were arrogant personified.  It appears that the reasonableness, righteousness and patience we had exhibited have been taken as signs of cowardice. The undeniable fact is that those who fight, only can win. We, therefore, appeal to you to carry on with conviction and courage.

Eight months will be over on 6th March, 2017, when the Group of Ministers held out the assurance of revisiting the minimum wage and multiplication factor.  It is now crystal clear that that was an act of chicanery.  No committee was set up and no discussions were held to seriously consider the issue.  We, therefore, appeal to all of you to ensure that the day, i.e. 6thMarch, 2017 is observed as a day of betrayal and all our members are requested to wear a Black badge with the following words inscribed on it in bold letters and conduct demonstrations in front of all Central Government offices.

Not a single word about Central Government Employees uttered in Budget Speech of FM

The budget for the year 2017-18 was presented by the Shri Arun Jaitleyji Hon’ble Minister of Finance on 1st Feb 2017 , the Central Government employees had lot of hopes of this budget especially on increasing the tax slabs and tax rates reduction , also on allowances and increasing our wages i.e. revision of the fitment formula . One more important issue of filling up of vacant post in the Central Government.

Shri Arun Jaitleyji Hon'ble Minister of Finance had not uttered a single word about Central Government employees in his budget speech of nearly two hours, even though the Central Government employees work with dedication and implement the programmes and policy of the Central Government either way of revenue collection, transportation, public service , working for the welfare of the people of the country etc . This has caused dissatisfaction amongst Central Government employees as many of the demands of the Central Government employees are not considered. The tax proposals provided only a small relief to the Central Government Employees, actually a big relief should have been provided. The Central Government employees are disappointed of the outcome of the budget.

Now let us focus main issues of the CG employees and the budget 2017-18 especially this budget is being presented after the demonetization. As stated earlier the financial position of the Central Government is very good even after demonetization. The budget 2017-18 has once again proved that the Central Government resources are very good the revenue expenditure has been pat 21.47 lakh crores. The fiscal deficit will be 3.2 % of GDP.

Now coming to the revenue growth of the Central Government in last four years we can observe from the financial year 2013-14 the Revenue Expenditure which was at is Rs 16.64 lakh crores the Revenue Expenditure the financial year 2017-18 which stands at 21.47 lakh crores . The fiscal deficit has also reduced from 4.8 % to 3.2 % of GDP in last four years . This shows that the financial status of the Central Government is very good. The growth rate of the revenue collection is about 15% annually. In fact the Shri Arun Jaitleyji Hon'ble Minister of Finance had stated the revenue collection is increasing to about 17 % annually. We should be proud that your country economy is in good shape. Indian economy is a stable economy can accommodate any additional financial expenditure to be made for the welfare of Central Government employees.

The revenue of the Central Government is increasing at about 15% annually, from last three years the revenue of the Central Government has increased by 45% the expenditure towards salary of Central Government employees including the defence employees has risen only by 14.5 % on wage hike due to 7th CPC and also Dearness Allowances expenditure. So total rise in pay hike is about 22% , even if allowances are released in next financial year additional expenditure is likely at just 3% as 70% of the employees don’t avail HRA which is the major allowances, . which is very much less than the 45% of the revenue collection of the Central Government. So the Central Government can afford to increase our wages considerably i.e revision of fitment formula and minimum wage . The allowances should be made effectively from 1st Jan 2016.

Next on the tax slabs the Shri Arun Jaitleyji Hon’ble Minister of Finance had made announcement of the tax proposals provided only a small relief to the Central Government Employees by reducing the taxes for the slab 2.5 lakhs to 5 lakhs from 10% to 5% . This is only a very small gestures on the part of Shri Arun Jaitleyji Hon’ble Minister of Finance , actually a big relief should have been provided by way of abolishing the taxes up to Rs 5 lakhs . The expenditure loss for reduction of taxes for the slab 2.5 lakhs to 5 lakhs(1.95 crore show income between Rs 2.5 to Rs 5 lakh) from 10% to 5% is just at Rs 15,500/- crores only , if the Hon’ble Minister of Finance had announced the abolishing the taxes up to Rs 5 lakhs it could have been additional expenditure of Rs 15,000 crores only which at just half percent of the total budget revenue collections , next Rs 5 to Rs10 lakhs slab (only 52 lakh show income between Rs 5 to Rs 10 lakhs ) here also there should have been reduction in taxes from 20% to 10% , the limit of Rs 1.5 lakh under Section 80C for investment should have been increased upto 2.5 lakh which would have encouraged savings , all these measures could have gone a long way benefiting the Central Government employees and the salaried class employees a lot.

Today hardly 3 % of the country population are paying the income tax, the rest 97% do not pay income tax .The Central Government Employees are honestly paying the taxes. A big tax relief is genuinely due for them.

One more important problem faced by the Central Government Employees is that the no filling up of the vacant post in the Central Government, nearly 4 lakhs post are vacant, even in Railway safety post of 1.41 lakh post are vacant and Income tax department post are vacant, more manpower is required for effectively collection of the taxes and implementation of the programmes and policy of the Central Government. This will also provide jobs for the youth of the country.

We sincerely hope the Hon’ble Minister of Finance would reconsider his decision and improve the taxation policy and consider the demands of the CG employees effectively in true spirit.

New Delhi: With widespread resentment against the "meagre" pay hike implemented in the 7th Pay Commission and not get the the higher allowances, central government employees are annoyed with PM Modi government.

They are annoyed at little pay hike without allowances.

The Prime Minister Narendra modi government has fixed the minimum pay at a meagre Rs 18,000 in the 7th Pay Commission. In the last Pay Commission, the basic pay was Rs 7,000. The government multiplied it by 2.57 (fitment formula) and came to Rs 18,000. The employees unions are demanding 3.68 fitment formula.

The major contention is on the minimum pay, which unions are demanding to be Rs 26,000.

The employees unions had a meeting with a group of ministers, including the Home Minister Rajnath Singh, Finance Minister Arun Jaitley and Railway Minister Suresh Prabhu on the evening of June 30, 2016. The ministers said it will be considered and would be referred to High Level Committee.

The ministers assured the employees unions of hiking minimum pay but the government now decided not to appoint High Level Committee to examine the 7th Pay Commission recommendations in respect of minimum pay.

"The government will not clear any proposal on hike in minimum Pay including others pay related matter under the 7th Pay Commission recommendations because the cabinet had already passed it. Hence cabinet only will take higher allowances which was not given nod by it", the top Finance Ministry sources told The Sen Times.

The government had set up the committee on allowances headed by Finance Secretary to examine the recommendations of 7th Pay Commission on allowances other than dearness allowance for cabinet nod in July, 2016 as the pay commission had recommended abolition of 51 allowances and subsuming 37 others out of 196 allowances. The committee on allowances was given four months by the government to complete its task.

The government gave the extension of the term of the committee on allowances up to February 22, 2017 in November.

However, the committee on allowances head Finance Secretary Ashok Lavasa said in October, 2016, "We are ready to submit our report, when the Finance Minister Arun Jaitley calls up."

The government gave the extension on the pretext of demonetisation for getting normalized the position of the cash crunch.

Now, the government said that the higher allowances may be announced in March after the completion of five states assemblies poll process as the model code of conduct has come into effect from January 4 and the implementation is to come in April after nine to ten months of getting basic pay hike of the central government employees.

The sources told us that the government had no plan to give allowances in arrears from August.

So, the 7th pay commission recommendations gave an agonizing pain for the central government employees.

Whatever angle we look the 7th CPC has cheated us on the minimum wage and fitment formula compared to the earlier pay commission this pay commission has given us the lowest wage hike of just 14% compared to last 40 years."

16th March Strike Importance

Dear Comrades,
The main demands of the Staff Side (JCM) which led to declaration of the 11th July strike is the revision of the NPS, minimum wage, fitment formula, allowances and pension cases etc. this is due to lowest wage hike of just 14% recommended by the 7th CPC.

Under the 7th Pay Commission slab - which was implemented ten years after the previous pay commission the salaries of the government employees saw a marginal rise of just 14% . The basic pay under the 7th CPC the minimum wage was increased to Rs 18,000 from Rs 7,000 (2.57 times) while the salary of the senior government officials has gone up to Rs 2.50 lakh from Rs 90,000(2.77 times).

The minimum wage was increased by 2.57 times but in actual terms this increase is of just Rs 2250/- in 7th CPC, while taking into account of 125% DA was merged this due to rising inflation and price rise already the CG employees wage factor was 2.25 time, that is basic of Rs 7000/- plus DA of 125% of Rs 8750 works out to Rs 15750/- , staff side had already demanded for a hike of more than three times which is Rs 26,000 per month.

Comparison of earlier wage hike we can observe that the fitment factor of 2.57 times is the lowest comparing to other pay commissions. If we make a study of earlier pay commission.

" The minimum qualification required at lower level appointments from the year 2008 has been revised from 8th pass to 10th pass (SSLC) as per the 6th CPC recommendations, hence the minimum wage should increase by 25% compared to earlier pay commissions.

The minimum wage has increased considerably due to price inflation from 4th CPC (1986) onwards the average wage hike is 3.32 times. During the period 1946 to 1972, the financial position of the Central Government was not that good. The financial position of the Central Government has been improving from the 4th CPC onwards that is from 1986 onwards, the pay fixation depends on the paying capacity of the Central Government. The revenue collection of the Central Government has increased especially from last few years. The revenue expenditure in respect of salaries of Central Government employees is just under 10% of the Central Government revenue. In respect of the many State Governments the revenue expenditure towards salaries is around 20%. Whereas the Central Government is spending just 10% of the revenue collection on salary head.

The wages of CG employees are determined based Dr. Aykroyd formula, the Staff Side (JCM) has calculated minimum wage as on 1st Jan 2014 as per the Dr. Aykroyd formula as Rs 26,000/- taking into market prices. Even if we adopt the retail prices of The Directorate of Economics & Statistics Department of Agriculture & Cooperation Ministry of Agriculture Government Of India New Delhi of the month of July 2016 the minimum wage works out to Rs 24,000/ which is 3.42 times increase. The 7th CPC has also adopted Dr. Aykroyd formula for the computation of the minimum wage and fixed at Rs 18000/- and thereafter the fitment formula is calculated.

We solicit your kind reference to the discussions; the representatives of the Staff Side JCM had with you on 30th June 2016 in the wake of impending strike action that was to commence from 11th July 2016. Hon'ble Home Minister, Shri Rajnath Singh, your goodself, Hon'ble Minister for Railways, Shri Suresh Prabhakar Prabhu and Hon'ble MoSR, Shri Manoj Sinha, on having detailed deliberations with the Staff Side, had appreciated that, the Central Government employees were not generally happy with the decision taken by the Union Cabinet on 29th June 2016, while accepting the recommendations of the 7th CPC, particularly in the matter of Minimum Wage and Fitment Formula. After detailed discussions it was agreed by your goodself and other Hon'ble Ministers present in the meeting that, the government would address the grievances of the employees, whereupon the NJCA had decided to defer the "Indefinite Strike". Accordingly, a committee was set-up to consider the demand of Revision of Minimum Wage and Fitment Formula with a mandate to finalize its report within four months.

We (Staff Side) interacted with the said committee, headed by Shri P.K. Das, Addl. Secretary (Expenditure), on 24.10.2016. It would be quite appropriate to bring to your kind notice that, we have felt, during the course of meeting, that, the proceedings of the committee are extremely disappointing and are left with the impression that, the committee is dilly-dallying the issue.

We are, therefore, left with no option, but to address this communication with the fervent hope that, your goodself will direct the said committee to interact with the Staff Side in a fruitful manner and arrive at a mutually agreeable proposal on the issues of Minimum Wage and Fitment Formula.

We have full trust and believe that, the government would honour the decision taken in the meeting held on 30.06.2016 in your benign presence, and suitable direction will be given to the committee to complete the assigned task within the stipulated timeframe in a satisfactory manner.

It would be the most unfortunate development, we regret to state, if we are constrained to tread the path of struggle once again in the event of the committee not coming up with a satisfactory settlement.
