Dear Sir,

The Staff Side of the NC-JCM has submitted innumerable representations to your office and also to the office of Secretary DOPT on the various issues agitating the minds of the Central Government Employees and Pensioners. You will appreciate that is the Central Government Employees who kept the Government machinery cunning during the entire COVID-19 LockDown period. Many Central Government Employees because of their exposure to the risk of COVID-19 virus while performing their duty succumbed & death. Their families are suffering since Government has not paid any compensation to them after losing the sole breadwinner. Even the DA / DR being paid to them to compensate for the price rise has been frozen for 18 months without any reason. In this situation the NJCA has decided to observe 1/2/2021 (day of presentation of Central Budget 2021) as CALL ATTENTION DAY BY CENTRAL GOVERNMENT EMPLOYEES by holding demonstration throughout of the county in front of the all the Central Government Establishments / Units / Branches in support of the following major and outstanding demands :

Demands Of Central Government Employees

1. Withdraw the decision to corporatize Railway Production Units, 41 Ordnance Factories, GOCO Model in Army Base Workshops and stop Privatization and Outsourcing of permanent and perennial jobs

2. Immediate release of three installments of DA / DR due to the Central Government Employees and Pensioners from 1/1/2020, 1/7/2020 and 1/1/2021.

3. Implementation of the assurances given by the Group of Ministers on 7th CPC demands including minimum pay end fitment factor etc.

4. Settle all the 7 CPC Anomalies pointed out by the Staff Side of NC – JCM including the extension of one more option to switch over to 7 CPC, restoration of certain allowances and advances, and grant of two increments while on promotion/ MACP, etc.

5. Withdrawal of NPS and restoration of the Guaranteed defined Pension under CCS (Pension) Rules 1973.

6. Withdrawal of FR 56(j) which is being misused as a measure of punishment.

7. Issue Government Orders on all the demands agreed in the meeting of the Standing Committee of NC JCM and in the 47th Meeting of the NC-JCM

8. Settle the demands of the Staff Side with regard to regularization of the absence of the employees during COVID-I9 pandemic and Lockdown Period due to non-availability of Public Transport and home quarantine etc.

9. Payment of compensation to the Central Government employees who died due to COVID-19 Virus infection.

10. Ensure 100% Compassionate Appointment to the wards of the deceased Central Government Employees and those who are medically invalidated from service.

11. Implement the following Supreme Court Judgments for the similarly placed employees:-
(iii) Grant of Notional Increment to these employees who retired/ retiring on. 31st January / 30th of June.
(iv) Implementation of MACP Scheme w.e.f. 1/1/2006

12. Payment of Night Duty Allowance to the employees detailed on Nightshift duty without any basic pay ceiling limit

13. Reimbursement of the Actual Amount charged by the CGHS empanelled Hospitals for the treatment of COVID-19 infection

Sub: Payment of Dearness Allowance to Central Government employees and Dearness Relief to Central Government pensioners at current rates due to improved Covid and financial situation in the country.

Respected Madam,

Vide Office Memorandum dated 23rd April, 2020 of Government of India Ministry of Finance , Department of Expenditure letter No. 1/1/2020-E-II-B, the additional DA for CG employees and DR for pensioners was freezed from 1st January 2020 till 1st July 2021 due to the reason “view of the crisis arising out of COVID-19”. These orders are applicable to all Central Government employees and Central Government pensioners. Which has affected both the serving employees and pensioners and especially to those who have retired during the period 1st Jan 2020 to 1st Jan 2021.

The Covid-19 situation in India has improved considerably and under control with a vast population of the country are unaffected by the Covid-19, The Covid cases in September 2020 was around 95,000 cases daily , on 4th January 2021 is around17,000 cases which is lowest in six months, with less mortality rate.

The economic situation in the country has also improved compared to April- May 2020 situation, where the industrial production had gone down to minus 57% and in October to plus 3.6 % Industrial production has vastly improved with a recovery , the financial position of the country has also improved considerably the GST collections has shown a positivity in last four months.

The Goods and Service Tax collection for December 2020 touched a record high of Rs 1.15 lakh crore. This is the highest ever collections since the implementation of the countrywide tax in July 2017.

Request to the PM to release DA to the central government employees and DR to the pensioners

The Central Government employees have attended their assigned duties even during the pandemic situation, many have lost their sacrificed their life for the nation building, hence there contribution should be taken into the account.

The additional financial implication on account of this increase in Dearness Allowance for additional 11% DA is due which works out to 13,000 crores annually, which is manageable under the existing financial conditions , more over this will benefit about 49.93 lakh Central Government employees and 65.26 lakh pensioners who pump this money into the market which also improves the economy considerably and about 30% of the amount spent is collected back by the Government by way of taxes.

Therefore, it is requested to kindly grant Payment of Dearness Allowance to Central Government employees and Dearness Relief to Central Government pensioners at current rates which is 28% as on 1st January 2021.

Respected Shri Narendra Modi ji,

I write to bring to your attention a matter affecting the rights and entitlements of Central Government employees in light of actions taken by the Finance Ministry. Deviating from the decision of the Cabinet to release 4% additional Dearness Allowance (DA) in light of the Covid-19 pandemic , the Ministry of Finance on 23rd April 2020 issued an order for freezing of DA to the central govt. employees and DR to the pensioners till July 2021. Effectively, these actions, amidst a pandemic, have subjected the Central Govt. employees and pensioners to undue financial hardship.

Successive Central Pay Commissions have dealt in detail about the payment of DA to the Central Govt. employees and its importance to the working conditions of Central Govt. Employees. The decision by the Finance Ministry is in complete disregard to the rights of these workers and the reasons for the grant of such an allowance by the Cabinet. The dearness allowance (DA) stems from the need to protect the erosion in the real value of basic salary on account of inflation and thereby provides employees with the ability to deal with the ever-increasing inflation in the country, even in their retirement. The Covid-19 pandemic has taken an unbearable toll on the lives of all people and while many have been able to avoid the pandemic at its deadliest, Central Govt. Employees have worked tirelessly to keep the country moving and their service to the nation cannot be ignored. Many of these workers have even succumbed to the deadly coronavirus.

In view of the above, I request you to kindly intervene in the matter and reconsider the decision, since the employees who have retired/retiring w.e.f. 01/01/2020 are not getting the benefit of the DA increase in their terminal benefits, such as leave encashment, gratuity etc. I once again request you to withdraw the decision taken by the Government to freeze the 3 installments of DA due for the employees and the pensioners and release the same to them at the earliest. The Government must ensure that its employees are treated with dignity and their rights are not compromised due to governmental apathy.

Appeal for review of decision Freezing of Dearness Allowance to Central Govt 

employees
1) Indian Railways Technical Supervisors Association (IRTSA) extends its fullest support and cooperation to the Government of India in its all-out effort to control COVID-19 pandemic. Railway men are working on the forefront risking their lives to keep freight & parcel services operational for ensuring uninterrupted supply of essential commodities across the country. Indian Railways have taken up many special tasks to fight against COVID-19 pandemic.

2) Railways’ and other government employees and pensioners have contributed generously to PM CARES for the fight against COVID-19.

3) It is, however, very disheartening that the Government has decided, as per the order cited above, that the DA/DR is frozen and would not be revised up to July 2021; and that no arrears will be paid. This has adversely affected the morale of the employees.

4) DA is a part of Pay, compensating for the erosion in the real value of the salary. DA can only be deducted either as a punitive measure or with the consent of the employees.

5) Assuming 4% additional DA & DR for each of 3 spans of six months, the total loss of employees and pensioners would be over 1.5 months of Pay & Pension and possibly even more than that, if the inflation is higher than 4 % in the next 2 spans.

6) Freezing of DA will also delay the revision of HRA rates since as per decision of the Government on 7th CPC, whenever DA crosses 25%, rates of HRA will be revised.

7) It will also cause additional heavy loss to the employees who retire between 1-1-2020 to 30-6-2021 in terms of Gratuity and Leave encashment as the DA is counted for the same.

8) We fully realize that a lot of funds are required to combat the social & economic impact of COVID. But freezing the DA & DR would be counter-productive, as freezing this huge amount would give a further blow to the market as well as to the employees and the pensioners since the amount paid as DA and DR will actually flow out to the market. This will help boost the sagging economy in post-COVID times.

9) Government had advised all private sectors to pay their employees for the lockdown period. Government, as a model employer should set an example by not making any cut in the pay & allowances of its own employees.

10) Lower and middle class employees and pensioners are hard pressed to meet their liabilities due to heavy inflation which is bound to increase in the post-COVID-19 scenario especially in respect of cost of Medicines and household requirements.

11) In the past,when funds were required for a National calamity like War, Floods or Cyclones etc., DA installments were deposited in the Provident Fund with the consent of the employees. It was never frozen as of now.

12) It is, therefore, requested that, keeping in consideration all the above aspects, the following proposals may please be considered sympathetically to avoid heart burning amongst employees and pensioners:
  • Order for freezing of Dearness Allowance and Dearness Relief may please be withdrawn.
  • Instead option may please be given to Employees for crediting of the amount of Additional DA to their Provident Fund in case of pre-1-4-2004 employees and to the Pension Fund (Tier 2) in case of those covered under the NPS.
  • Employees and pensioners may be encouraged to invest in Infrastructure Bonds etc. by increasing the ceiling limit thereof. This would provide the government with the requisite funds and the employees will not be at a loss in the long run.

Central Government’s decision to freeze three instalments of Dearness Allowance (DA) of Central Government Employees and Dearness Relief (DR) of Pensioners from 01.01.2020 to 30.06.2021 is a severe and unexpected blow to the Central Government Employees and Pensioners. Already most of the Central Government employees and Pensioners have contributed one day’s salary and Pension to PM CARES Fund.

Confederation strongly oppose and protest the unilateral decision of the Central Government. We demand the Government to review the decision immediately and withdraw the DA & DR freezing orders.

The freezing of Dearness Allowance would have a serious effect on Central Govt Employees HRA. Pursuant to recommendations from the 7th CPC and as approved by the Govt.The HRA rates in "X" cities will be revised from 24% to 27% and in "Y" cities from 16% to 18% and in "Z" cities from 8% to 9%.

Dear Sir,
The constituent organizations of the National Council (JCM) are very much shocked to note the arbitrary decision taken by the Government to freeze the DA to Central Govt.Employees and Dearness Relief to the Central Govt. Pensioners up to 30/06/2021. Before taking such a major policy decision the Govt. has not bothered to consult the staff side of the NC(JCM) and without even hearing the views of the staff side, the decision taken especially on a policy matter which effects the wages of the employees and the pension of the senior citizens is against the spirit of the JCM scheme. The entire 48 lakh Central Govt. Employees (including Armed Forces Personnel) and the 65 lakh Pensioners are very much disappointed against the most drastic decision taken by the Govt. against is own employees.

The Central Govt. and State Govt. employees are the one who are playing their front line role in the fight against COVID-19 Virus, by taking all risk and working in the field exposing themselves without any sufficient Personal Protective Equipment. The Railway employees, Defence Civilian employees, Postal employees and all other Central Govt. employees have already contributed their one day wages to the PM-CARES Fund. The Ordnance Factory Employees have contributed their two days wages, In the Railways , Employees belonging to different categories are deployed for various activities such as PW Tracks, signaling, Electrical and Mechanical assets, cenrunning freight trains, parcels special trains, Transport essential goods etc. Almost all the Central Government Departments are involved in one or other activities during the entire lockdown period. The Ordnance Factory Employees are directly involved in manufacturing of various Protective Equipment required for the Doctors, Nurses & Health Care Workers and for other Civil Authorities. Ignoring all these contribution of the Govt. Employees, the Govt. is targeting them on the plea of  crisis arising out of COVID- 19?.

The Staff side of the National Council (JCM) is of the first view that the 48 Lakh Central Govt. Employees (including Armed Forces Personnel) and 65 lakh Pensioners do not deserve such a treatment from the Government.

A part from that many of all our affiliates of JCM Staff Side have contributed to PM-CARES Fund crores of rupees. As well as they are providing shelter, Food , Transport etc to mitigate the problem of poor employees I workers who have lost their job and everything in this Lockdown.

Moreover the freezing of DA will have a serious impact of the HRA of the Central Govt. employees. In accordance with 7th CPC recommendations and as approved by the Govt. the HRA rates will be revised from 24% to 27% in “X” cities, and from 16% to 18% in “Y” Cities and 8% to 9% in “Z” cities.

The manner in which the price for the essential commodities are rocketing sky high, DA is expected to cross 25% from 01/07/2020 on wards. Since the DA is freezed the employees will loose this hike in the HRA also.

You will appreciate that the Pensioners who are senior citizens are most vulnerable in the fight of the COVID-19 virus and any stoppage of DA in their case at this juncture is not an appreciable decision on the part of the Government.

The decision of the Govt. has subjected the Central Govt. Employees and the Pensioners to unnecessary financial hardship and mental agony when they all are on the field fighting from the front line against the spread of COVID-19 Virus through various official activities.

Therefore we request you to convey our feelings to the Hon’ble Prime Minister and also our request to reconsider the above decision of the Govt. and withdraw the same, so as to motivate the Central Govt. employees to perform their responsibilities, especially in this crisis period.

Subject : Freezing of Dearness Allowance to Central Government employees and Dearness Relief to Central Government pensioners at current rates till July 2021.

The undersigned is directed to say that in view of the crisis arising out of COVID-19, it has been decided that the additional installment of Dearness Allowance payable to Central Government employees and Dearness Relief to Central Government pensioners, due from 1st January 2020 shall not be paid. The additional installments of Dearness Allowance and Dearness Relief due from 1st July 2020 and 1st January 2021 shall also not be paid. However, Dearness Allowance and Dearness Relief at current rates will continue to be paid.

2. As and when the decision to release the future installment of Dearness Allowance and Dearness Relief due from 1st July 2021 is taken by the Government, the rates of Dearness Allowance and Dearness Relief as effective from 1st January 2020, 1st July 2020 and 1st January 2021 will be restored prospectively and will be subsumed in the cumulative revised rate effective from 1st July 2021. No arrears for the period from 1st January 2020 till 30th June 2021 shall be paid.

ORDER

Subject: Grant of Dearness Relief to State Government Pensioners.

The Governor is pleased to order that the existing rate of Dearness Relief sanctioned vide Finance Department Order of even number dated 22-02-2019 to the State Government Pensioners who are in receipt of superannuation, retiring, invalid, compensation, family and extraordinary pension etc. shall be revised from 12% to 17% with effect from 01-07-2019.

For the purpose of this order -

(i) Pension / Family Pension in the case of pre-01-01-2016 retirees and where Family Pension was sanctioned prior to 01-01-2016, means the Revised Pension or Revised Family Pension, as the case may be, effective from 01-01-2016 in terms of Finance Department Memorandum No.F.12(6)FD(Rules)/ 2017 dated 30-10-2017 as amended vide Order No.F.12(6)FD(Rules)/ 2017 dated 09-12-2017 and F.12(6)FD(Rules) 2017 Pt.-I dated 06-06-2018.

(ii) In the case of pensioners who retire from service on or after 01-01-2017 or where family pension is sanctioned for the first time on or after 01-01-2017, Pension/Family Pension means the Basic Pension / Basic Family Pension, as the case may be, in terms of Finance Department Notification No.F.12(6)FD (Rules)1 2017 dated 30-10-2017 as amended vide Order No.F.12(6)FD (Rules)1 2017 dated 09-12-2017.

(iii) Dearness Relief will also be admissible on the additional quantum of pension / family pension allowed to the pensioners who have attained the age of 80 years and above.
(iv) Payment of Dearness Relief involving a fraction of a rupee shall be rounded off to the next higher rupee.

(v) Other provisions governing grant of dearness relief to pensioners’ such as regulation of dearness relief during employment/ re-employment, regulation of dearness relief where more than one pension is drawn etc., will remain unchanged.

(vi) This order shall also be applicable in case of Pensioners/Family Pensioners who are in receipt of provisional pension.

(vii) This order shall not be applicable in case of Old Age Pensions, Political Pensions or any other kind of similar pensions, which are not related to the service rendered under Government.

(viii) Dearness Relief at revised rates as above would also be admissible to pensioners who retired/retire from service of Panchayat Samiti or Zila Parishad and whose Pension Payment Orders have been issued by the Director, Local Fund Audit Department or director, Pension and Pensioners Welfare Department, Rajasthan, Jaipur.

(ix) The payment of arrears of Dearness Relief from 1-7-2019 to 29-02-2020 shall be paid in April,2020 and cash payment shall be admissible from 1-3-2020 i.e. pension for the month of March,2020 payable on 01-04- 2020.

(a) Whether it is a fact that Daily Allowance (DA) and Dearness Relief (DR) for Central Govt. employees and pensioners have become due with effect from 4th January, 2020.

(b) If so, the details thereof

(c) Whether DA/DR is based on rise in inflation and increase in prices of essential commodities; and
(d) If so, whether the increase in DA allowance is in line with increase in price of essential items and if not, the reason therefore?

Also check: 4% DA hike to Central Government employees is confirmed as from 1 January 2020

(a) & (b): Yes Sir. Dearness Allowance and Dearness Relief are granted to serving employees and pensioners of the Central Government respectively each year with effect from 1st January and 1st July and normally paid in the month of March and September respectively.

(c) & (d): Yes Sir. The level of inflation for the purpose of DA/DR to Central Government employees/pensioners is calculated on the basis of All India Consumer Price Index for Industrial Workers which is issued by Labour Bureau, Shimla

Subject: Grant of Dearness Relief to Central Freedom Fighter Pensioners w.e.f. 01.07.2019 - regarding.

Sir,
I am directed to refer to this Ministry's letter No.45/08/ 2017-FF(P) dated 26.03.2019 (copy enclosed) regarding 10% Dearness Relief to be paid to the freedom fighter pensioners w .e.f. 01.01.2019 and to say that recently Dearness Relief in respect of Central Government pensioners has been enhanced by 5% by the Government of India, Ministry of Personnel, Public Grievances & Pensions, Department of Pension & Pensioners’ Welfare, New Delhi’s O.M. No.42/04/ 2019-P&PW(D) dated 21.10.2019. Hence the Dearness Relief admissible to the Central Freedom Fighter/ spouse/ daughter pensioners shall be enhanced from the existing rate of 10% to 15% w .e.f. 01.07.2019. All the banks are requested to calculate the arrears w.e.f. 01.07.2019.

The payment of arrears of Dearness Relief shall not be made before the date of disbursement of pension/ family pension of October, 2019. The revised amount of pension for various categories of pensioners after increase of 5% DR i.e. total 15% Dearness Relief will be as follows:

Subject: Payment of Dearness Relief on pension to the re-employed teachers of Delhi Administration

References have been received from the re-employed teacher of Delhi Administration that the authorized banks are not making payment of dearness relief on pension to them.

Earlier, the banks have stopped the payment of DR on pension on the instruction of Govt. of NCT Delhi and now some authorized banks are not acting upon the instructions of the Govt. of NCT Delhi for payment of Dearness Relief on pension to the re-employed teachers of Delhi Administration.

In this connection, attention is drawn towards the guidelines mentioned in the OM No 45/73/97-P&Pw (G) dated 02.07.1999, wherein it is mentioned that the pension Disbursing Authority (Banks) shall release Dearness Relief on pension to those re- employed pensioners who submit the certificate issued by the re-employing department as per Para + (II) (a) of the said OM.

All the authorized banks are advised to make payment of Dearness Relief on pension to the re-employed teachers on the basis of the instruction issued by the Govt. of NCT or Delhi.

Sub: Grant of Dearness Relief to Central Government pensioners/family pensioners - Revised rate effective from 01.01.2019 - reg

The undersigned is directed to refer to this Department's OM No. 42/0612018-P&PW(G) dated 18.09.2018 on the subject mentioned above and to state that the President is pleased to decide that the Dearness Relief admissible to Central Government pensioners/family pensioners shall be enhanced from the existing rate of 9% to 12% w.e.f 01.01.2019.
  1. These rates of DR will be applicable to (i) Civilian Central Government Pensioners/Family Pensioners including Central Govt. absorbee pensioners in PSU/ Autonomous Bodies in respect of whom orders have been issued vide this Department's OM No. 4/34/2002-P&PW(D) Vol.1I dated 23.06.2017 for restoration of full pension after expiry of commutation period of 15 years (ii) The Armed Forces Pensioners, Civilian Pensioners paid out of the Defence Service Estimates, (iii) All India Service Pensioners (iv) Railway Pensioners/family pensioners (v) Pensioners who are in receipt of provisional pension (vi) The Burma Civilian pensioners/family pensioners and pensioners/families of displaced Government Pensioners from Burma/ Pakistan, in respect of whom orders have been issued vide this Department’s OM No. 23/3/2008-P&PW(I3) dated 11.09.2017.
  2. The payment of Dearness Relief involving a fraction of a rupee shall be rounded off to the next higher rupee.
  3. The payment of arrears of Dearness Relief shall not be made before the date of disbursement of pension/family pension of March,2019.
  4. Other provisions governing grant of DR in respect of employed family pensioners and re-employed Central Government Pensioners will be regulated in accordance with the provisions contained in this Department's OM No. 45173/97-P&PW (G) dated 2.7.1999 as amended vide this Department’s OM No. F.No. 38/88/2008-P&PW(G) dated 9th July, 2009. The provisions relating to regulation of DR where a pensioner is in receipt of more than one pension will remain unchanged.
  5. In the case of retired Judges of the Supreme Court and High Courts, necessary orders will be issued by the Department of Justice separately.
  6. It will be the responsibility of the pension disbursing authorities, including the nationalized banks, etc. to calculate the quantum of DR payable in each individual case.
  7. The offices of Accountant General and authorised Pension Disbursing Banks are requested to arrange payment of relief to pensioners etc. on the basis of these instructions without waiting for any further instructions from the Comptroller and Auditor General of India the Reserve Bank of India in view of letter No. 528-TA, IV34-80-II dated 23/04/1981 of the Comptroller and Auditor General of India addressed to all Accountant Generals and Reserve Bank of India Circular No. GANB No. 2958/GA- 64 (ii) (CGL)/81 dated the 21st May, 1981 addressed to State Bank of India and its subsidiaries and all Nationalised Banks.
  8. In their application to the pensioners/family pensioners belonging to Indian Audit and Accounts Department, these orders issue after consultation with the C&AG.
  9. This issues in accordance with Ministry of Finance, Department of Expenditure's OM No. 1I112019 -E.II(B) dated 27th Feb,2019.

31. When will the arrears get paid?
Ans: Payment of arrears, on account of revision of pension etc., received at Centralized Pension Processing Cell (CPPC) of the Bank up to one week before last date of a month, will normally be made along with monthly pension.

32. How the payment of Dearness Relief at revised rate is to be paid to the pensioners?
Ans: Whenever any additional relief on pension/family pension is sanctioned by the Government, the same is intimated to the agency banks for issuing suitable instructions to their pension paying branches for payment of relief at the revised rates to the pensioners without any delay. The orders issued by Govt. Departments are also hosted on their websites and banks have been advised to watch the latest instructions on the website and act accordingly without waiting for any further orders from RBI in this regard.

33. Where can a pensioner get information about the changes in the pension/ Dearness Relief or any pension related issue?
Ans: The pensioner can visit the Official Website of the concerned Government Department as also Reserve Bank of India Website (www.rbi.org.in) to get the information about pension related issues.

34. Can pensioners get pension slips?
Ans: Yes, monthly pension slip is automatically sent to the pensioner’s e-Mail ID if available with the Bank. In other cases pension slip can be obtained by the pensioner from any pension paying branch.

35. How to get SMS for the details of monthly pension
Ans: To get SMS Pensioner has to visit Pension Paying Branch (Home Branch) with request to upload his/her Mobile number in the Pension Application Software. Pensioner can get the details of monthly pension such as Basic Pension, D.A., Medical Allowance, Other Allowances, Commutation, Income Tax, Net Pension credited and the date of credit along with amount of commutation and gratuity paid through SMS from State Bank of India on regular basis.

Sub:- Grant of Dearness Relief in the 5th CPC series effective from 01.07.2018 to CPF beneficiaries in receipt of ex-gratia payment-reg

In continuation of this Department's OM No. 42/06/2018-P&PW(G) dated 19.04.2018 the President is pleased to decide that the Deamess Relief w.e.f 01 .07.2018 to the CPF beneficiaries in receipt of ex-gratia payment shall be paid in the following manner:-
(i) The surviving CPF beneficiaries who have retired from service between the period 18.11.1960 and 31.12.1985. and were sanctioned ex-gratia @ Rs. 600/ p.m. w.e.f. 01.11.1997 under this Department's OM No. 45/52/97-P&PW(E) dated 16.12.1997 and revised to Rs.3000, Rs.1000. Rs.750 & Rs.650 for Group A, B, C & D respectively w.e.f 4th June.2013 vide OM No. 1/10/2012-P&PW(E) dtd. 27th June 2013 shall be entitled to enhanced Dearness Relief from 274% to 284% w.e.f 01.07.2018.

(ii) The following categories of CPF beneficiaries who are in receipt of ex-gratia payment in terms of this Department's OM No. 45/52/97-P&PW(E) dated 16.12.1997 shall be entitled to enhanced Dearness Relief from 266% to 276% w.e.f. 01.07.2018.

(a) The widows and eligible children of the deceased CPF beneficiary who had retired from service prior to 01.1.1986 or who had died while in service prior to 1.1.1986 and were sanctioned ex-gratia payment of Rs. 605/- p.m. and revised to Rs.645/-p.m w.e.f  4th June, 2013 vide OM No 1/10/2012-P&PW(E) dated 27th June 2013.

(b) Central Government employees who had retired on CPF benefits before 18.11.1960 and in receipt of Ex-gratia payment of Rs.654/-, Rs. 659/-, Rs.703/- and Rs. 965/-

2. Payment of DR involving a fraction of a rupee shall be rounded off to the next higher rupee.

3. It will be the responsibility of the pension disbursing authorities, including the nationalized bank etc. to calculate the quantum of DR payable in each individual case.

4. In their application to the Indian Audit and Accounts Department, these orders issue after the concurrence of O/o C&AG.

5. This issues in pursuance of Ministry of Finance, Department of Expenditure OM No. IG/2008-E(B) dated 11th Sept, 2018.

Sub: Payment of dearness relief to re-employed pensioners and employed family pensioners: Clarification thereof.
Ref: This office Circular No. 166 dated 07/03/2013, Circular No. 173 dated 07/04/2014 and Circular No. 179 dated 12/05/2015.

Provisions for payment of dearness relief to re-employed pensioners and employed family pensioners is laid down in Ministry of Personnel, Public Grievances & Pensions (Deptt. of Pension & Pensioners Welfare) OM No. 45/73/97-P&PW(G) dated 02/07/1999 issued under this office Important Circular No. 07 dated 13/08/1999. As per the ibid OM, before 18/07/1997, in terms of the existing orders, Dearness Relief to pensioners and family pensioners is to remain suspended during the period a pensioner/family pensioner is re-employed/employed under the Central or State Govt. or in a Statutory Corporation/Company/Body/Bank under them in India or abroad. The above facts are also applicable to the pensioners and family pensioners permanently absorbed in Statutory Corporation/Company/Body/Bank under the Central or State Government.

2. Representations from various agencies as well as pensioners/family pensioners including Pension Disbursing Agencies are being received for clarification on Payment of dearness relief to re-employed pensioners and employed family pensioners. The matter has been examined in this office and following points are clarified.

3. However, w.e.f. 18/07/1997, it has been decided by the Govt that: (i) In so far as re-employed pensioners are concerned, the entire pension admissible is to be ignored at present only in the case of those civilian pensioners who held post below Group 'A' and those ex-servicemen who held post below the ranks of Commissioned Officers at the time of their retirement. Their pay, on re-employment, is to be fixed at the minimum of the pay scale of the post in which they are re-employed. Such pensioners will consequently be entitled to Dearness Relief on their pension. (A) For this purpose, the Central Government Departments concerned, including subordinate organizations. State Government, Corporation/Company/Body/Bank etc. employing a Central Government pensioner shall be required to issue of certificate indicating the following:
(a) The re-employed pensioner retired from a civil or military post in the Central Government and was holding a post not included in classified as group 'A' or a post below the rank of commissioned officer in the armed forces;
(b) The entire amount of pension sanctioned by the Central Government was ignored in fixation of the pay on re-employment i.e. no part of the pension was taken into account in such fixation of pay in the pay scale of the post in which the Central government retired/retiree was re-employed/absorbed; and
(c) The pay of the re-employed/absorbee was/is fixed at the minimum of the pay scale of the post in which he had/has been initially re-employed after his retirement from the Central Government.
(d) If the pay fixed at a higher stage because of advance increments and no protection of the last pay drawn is being given.
(B) In the cases where PBOR (below Commissioned Officer) retired before attaining the age of 55 years and re-employed thereafter and their pay fixed at a higher stage because of advance increments and no protection of the last pay drawn were given, the pay should be treated as fixed at a minimum for the purpose of ignoring the entire pension and allowing Dearness Relief on pension. For benefit of advance increments, the policy for the same should exist in the re-employing department and a copy of such policy matter should be enclosed with the required certificate. But, after granting benefit of advance increments, the last pay drawn by the pensioner is protected, the pensioner in such case will not be entitled for dearness relief on pension.

The Union Cabinet, chaired by the Prime Minister Shri Narendra Modihas approved to release an additional instalment of Dearness Allowance (DA) to Central Government employees and Dearness Relief (DR) to pensioners w.e.f. 01.07.2018 representing an increase of 2% over the existing rate of 7% of the Basic Pay/Pension, to compensate for price rise.

The combined impact on the exchequer on account of both Dearness Allowance and Dearness Relief would be Rs.6112.20 crore per annum and Rs.4074.80 crore in the financial year 2018-19 (for a period of 08 months from July, 2018 to February, 2019).

This will benefit about 48.41 lakh Central Government employees and 62.03 lakh pensioners.
This increase is in accordance with the accepted formula, which is based on the recommendations of the 7th Central Pay Commission.

Sub: Payment of dearness relief to re-employed pensioners and employed family pensioners: Clarification thereof.

Ref: This office Circular No. 166 dated 07/03/2013, Circular No. 173 dated 07/04/2014 and Circular No. 179 dated 12/05/2015.

Provisions for payment of dearness relief to re-employed pensioners and employed family pensioners is laid down in Ministry of Personnel, Public Grievances & Pensions (Deptt. of Pension & Pensioners Welfare) OM No.45/73/97-P85PW(G) dated 02/07/1999 issued under this office Important Circular No. 07 dated 13/08/1999. As per the ibid OM, before 18/07/ 1997, in terms of the existing orders, Dearness Relief to pensioners and family pensioners is to remain suspended during the period a pensioner/family pensioner is re- employed/employed under the Central or State Govt. or in a Statutory Corporation/Company/Body/Bank under them in India or abroad. The above facts are also applicable to the pensioners and family pensioners permanently absorbed in Statutory Corporation/Company/Body/Bank under the Central or State Government.

2. Representations from various agencies as well as pensioners/family pensioners including Pension Disbursing Agencies are being received for clarification on Payment of dearness relief to re- employed pensioners and employed family pensioners. The matter has been examined in this office and following points are clarified.

3. However, w.e.f. 18/07/ 1997, it has been decided by the Govt that:

(i) In so far as re-employed pensioners are concerned, the entire pension admissible is to be ignored at present only in the case of those civilian pensioners who held post below Group 'A' and those ex-servicemen who held post below the ranks of Commissioned Officers at the time of their retirement. Their pay, on re- employment, is to be fixed at the minimum of the pay scale of the post in which they are re-employed. Such pensioners will consequently be entitled to Dearness Relief on their pension.

(A) For this purpose, the Central Government Departments concerned, including subordinate organizations. State Government, Corporation/ Company/ Body/ Bank etc. employing a Central Government pensioner shall be required to issue of certificate indicating the following:

(a) The re-employed pensioner retired from a civil or military post in the Central Government and was holding a post not included in classified as group 'A' or a post below the rank of commissioned officer in the armed forces;

(b) The entire amount of pension sanctioned by the Central Government was ignored in fixation of the pay on re-employment i.e. no part of the pension was taken into account in such fixation of pay in the pay scale of the post in which the Central government retired / retiree was re-employed / absorbed; and

(c) The pay of the re-employed/absorbee was/is fixed at the minimum of the pay scale of the post in which he had/ has been initially re-employed after his retirement from the Central Government.

(d) If the pay fixed at a higher stage because of advance increments and no protection of the last pay drawn is being given.

(B) In the cases where PBOR (below Commissioned Officer) retired before attaining the age of 55 years and re-employed thereafter and their pay fixed at a higher stage because of advance increments and no protection of the last pay drawn were given, the pay should be treated as fixed at a minimum for the purpose of ignoring the entire pension and allowing Dearness Relief on pension. For benefit of advance increments, the policy for the same should exist in the re-employing department and a copy of such policy matter should be enclosed with the required certificate. But, after granting benefit of advance increments, the last pay drawn by the pensioner is protected, the pensioner in such case will not be entitled for dearness relief on pension.

Illustration 1: A Military pensioner was drawing the pay of Rs. 6,330 in the pay scale of Rs. 5,770-140-8,290 from 01/07/2002 and retired from service on 31/ 10/2002 before attaining the age of 55 years. He was granted a military pension of Rs. 3,165. He was re-employed in a Civil Post on 01/12/2003 in the pay scale of Rs. 5,000-150-8,000. The post which the pensioner held in the Army before retirement is a non- commissioned post. If his pay is fix for Rs. 5,600 / - after granting 4 advance increments in re-employed post, then he will be entitled for dearness relief on pension as his pay fix for Rs. 5,600/- in re-employed post is less than Rs. 6,330/- already drawing in the Army before retirement. However, if his pay is fix for Rs. 6,500 / - after granting 10 advance increments in the re-employed post, then he will be not entitled for dearness relief on pension as his pay fix for Rs. 6,500 / - in re- employed post is more than Rs. 6,330 / - already drawing in the Army before retirement as his last pay has been protected.

Illustration 2: If the pensioner quoted in Illustration 1 above is re- employed in a Civil Post in the pay Scale of Rs. 7,500-250-12,000, his pay is required to be fixed at the minimum of the pay scale of the re- employed post for payment of dearness relief on pension. Any advance increment granted in such situation, will disqualify dearness relief on pension.
(ii) In all other cases of re-employed pensioners, no dearness relief shall be admissible on pension during the period of their re-employment.

(iii)
(A) In terms of the existing orders on the subject, the pay of re-employed pensioners who held Group 'A' post or posts of the ranks of Commissioned Officers at the time of their retirement is to be fixed at present
  • at the same stage as last drawn before retirement or, if there is no such stage, at the stage next above the pay last drawn;
  • at the maximum of the pay scale, if the pay last drawn is more than the maximum of the pay scale of the post in which re- employed;
  • at the minimum of the pay scale of the post in which re-employed, if it is more than the pay last drawn.
(B) Further, the pay on re-employment is required to be fixed after ignoring only a portion of the pension as revised time to time received for the previous employment. In view of the fact that (i) the pension is taken into account in such cases and not entirely ignored; (ii) The pay in the post of re-employment is not required to be fixed at the minimum of the scale in all cases; and (iii) Dearness Allowance at the rates applicable from time to time is also admissible on the pay fixed in terms of the orders on the subject, these re-employed pensioners will not be entitled, in addition, to any Dearness Relief on their pension.

(iv) Disability element of disability pension is also a type of pension. As such dearness relief on such service / disability pension (including disability element) during re-employment is required to be regulated as per the above procedure.

(v) Payment of dearness relief where discontinued due to re-employment, shall become admissible only with effect from the date they cease to be re-employed. The Pension Disbursing Authority shall require such a pensioner to produce certificate of cessation of re-employment from the office in which the pensioner had been re-employed.

(vi) However, dearness relief is payable to those re-employed pensioners who get consolidated pay without dearness allowance, consolidated fee, daily wages, or elected as Members of Legislative Assembly or Parliament, Ministers / Deputy Ministers of Central or State Government, Indian Red Cross Society and Extra Departmental Agents in the Department of Post.

(vii) As regards employed family pensioners, since the family pension received by the eligible dependents of Central Government employees is, in any case, not taken into account in determining their pay on employment, Dearness Relief at the rates applicable from time to time shall be admissible on their family pension.
