Subject: Engagement of a consultant in the Department of Pension & Pensioners Welfare-reg.

The Department of Pension & Pensioners’ Welfare intends to engage a consultant to assist the Department for undertaking comprehensive review/revision of CCS (Pension) Rules and orders issued by the Government on the subject of pensionary benefits and other important issues requiring immediate attention. The revision and review of the rules etc. is being undertaken by the Department in compliance with recommendation of the Hon’ble Supreme Court in the matter of UoI Vs. R. Sethumadhavan and Other. In addition, the Department may also assign the consultant any other work related to this Department.

Accordingly, applications are invited from retired Central Government Employees having been retired from the post of Deputy Secretary/Director or equivalent i.e.to say from any-post carrying the following.Pay.Band/Pay Matrix
i. Rs.15600 – 39100 + 7600 Grade Pay; or
ii. Rs.37400 – 67000 + 8700 Grade Pay; or
iii. Pay Matrix 12 or 13 under 7th CPC
MANDATORY SERVICE EXPERIENCE
The applicant should have a minimum of 3 years experience in dealing with pension cases and pension related court cases of Central Government Employees.

AGE
Age should not be more than 65 years on the date of advertisement.

REMUNERATION
On selection, the consultant will be paid consolidated remuneration equivalent to his last pay drawn minus pension. He will also be paid Dearness Allowance on the remuneration amount kt the rates applicable for Central Government Employees on the date of engagement. No other allowance such as HRA/Transport Allowance etc. will be payable to the consultant.
The consultant may be required to undertake outstation visits also for which he will be paid Travelling Allowance/hotel/ guest-house reimbursement as per rules applicable to
equivalent scales.

DURATION OF ENGAGEMENT
The duration of engagement will be one year from the date of initial engagement which period may be curtailed or extended at the sole discretion of the Department and the same will be binding on the consultant.

The appointment of consultants would be on full-time basis and he will not be permitted to take up any other assignment during the period of Consultancy with the DoP&PW.

The appointment of consultant is of a temporary (non – official) nature and the appointment can be cancelled at any time by the Department without assigning any reason.

Retired central government officers desirous of consideration for the above assignment may submit their application in the prescribed proforma (Annexure-I), to Shri Ashok Kumar Singh, Under Secretary (Admn.I), Department of Pension & Pensioners Welfare, 3rd Floor, Lok Nayak Bhawan, Khan Market, New Delhi – 110 003 latest by 7th June, 2019 either in person or through post.

Applications received beyond the closing date or giving false information will not be entertained and will be summarily rejected, Only shortlisted candidates will be intimated and Department of Pension & PW reserves the right to reject any or all applications without assigning any reason.

Sub: Grant of Dearness Relief to Central Government pensioners/family pensioners - Revised rate effective from 01.01.2019 - reg

The undersigned is directed to refer to this Department's OM No. 42/0612018-P&PW(G) dated 18.09.2018 on the subject mentioned above and to state that the President is pleased to decide that the Dearness Relief admissible to Central Government pensioners/family pensioners shall be enhanced from the existing rate of 9% to 12% w.e.f 01.01.2019.
  1. These rates of DR will be applicable to (i) Civilian Central Government Pensioners/Family Pensioners including Central Govt. absorbee pensioners in PSU/ Autonomous Bodies in respect of whom orders have been issued vide this Department's OM No. 4/34/2002-P&PW(D) Vol.1I dated 23.06.2017 for restoration of full pension after expiry of commutation period of 15 years (ii) The Armed Forces Pensioners, Civilian Pensioners paid out of the Defence Service Estimates, (iii) All India Service Pensioners (iv) Railway Pensioners/family pensioners (v) Pensioners who are in receipt of provisional pension (vi) The Burma Civilian pensioners/family pensioners and pensioners/families of displaced Government Pensioners from Burma/ Pakistan, in respect of whom orders have been issued vide this Department’s OM No. 23/3/2008-P&PW(I3) dated 11.09.2017.
  2. The payment of Dearness Relief involving a fraction of a rupee shall be rounded off to the next higher rupee.
  3. The payment of arrears of Dearness Relief shall not be made before the date of disbursement of pension/family pension of March,2019.
  4. Other provisions governing grant of DR in respect of employed family pensioners and re-employed Central Government Pensioners will be regulated in accordance with the provisions contained in this Department's OM No. 45173/97-P&PW (G) dated 2.7.1999 as amended vide this Department’s OM No. F.No. 38/88/2008-P&PW(G) dated 9th July, 2009. The provisions relating to regulation of DR where a pensioner is in receipt of more than one pension will remain unchanged.
  5. In the case of retired Judges of the Supreme Court and High Courts, necessary orders will be issued by the Department of Justice separately.
  6. It will be the responsibility of the pension disbursing authorities, including the nationalized banks, etc. to calculate the quantum of DR payable in each individual case.
  7. The offices of Accountant General and authorised Pension Disbursing Banks are requested to arrange payment of relief to pensioners etc. on the basis of these instructions without waiting for any further instructions from the Comptroller and Auditor General of India the Reserve Bank of India in view of letter No. 528-TA, IV34-80-II dated 23/04/1981 of the Comptroller and Auditor General of India addressed to all Accountant Generals and Reserve Bank of India Circular No. GANB No. 2958/GA- 64 (ii) (CGL)/81 dated the 21st May, 1981 addressed to State Bank of India and its subsidiaries and all Nationalised Banks.
  8. In their application to the pensioners/family pensioners belonging to Indian Audit and Accounts Department, these orders issue after consultation with the C&AG.
  9. This issues in accordance with Ministry of Finance, Department of Expenditure's OM No. 1I112019 -E.II(B) dated 27th Feb,2019.

Subject: Clarificatory OM for payment of two family pensions on death attributable to Govt.Service of a re-employed pensioner-regarding.

The undersigned is directed to say that references have been revived in this Department Seeking clarification as to whether a second family pension is admissible under CCS(EOP)Rules when a military/civil pensioner is re-employed in civil service dies and his death is attributable to government service.

2. Vide this Documents Notification No. G.S.R 938(E) dated 27.12.2012,sub-rule 13A 13B of Rule 54,prohibiting two family pension have been deleted.Subsequently vide OM No 1/33/2012-P&PW(E) dated 16.1.2013,two family pensions have been allowed in the event of death of a re-employed pensioner,in service or after retirement, The financial benefits for the pest cases however is with effect from 24th September 2012 Thus under CCS(Pension) Rules,two family pensions are admissible with effect from 24th September.

3. The matter has been examined in the context of the provisions of CCS(Extra-ordinary Pension)Rules. it is clarified that the provisions of two family pensions,one in respect of Millay/civil service and the other for civil service after re-employment as available i terms of CS(Pension)Rules is also applicable under CCS(EOP)Rules in other words on death of a pensioner who was re-employed civil service where death is attributable to government services family pension under CCS (EOP)Rules in respect of services in re-employment would be admissible in addition to ordinary family pension n respect of the previous military/civil service.

4. Where, however, on death of a re-employed civil Government servant the family is eligible for Special/extra- ordinary family pension under the EOP rules in respect of the first spell of service,family pension for the second spell of service would be admissible under the CCS(Pension)Rules,1972 only.

5. The extra-ordinary family pension shall be granted only in one service in no case both the family pension shall be granted under EOP Rules.

6. The financial benefits in the past cases will accure with effect from 24th September 2012 as in the case of family pension under CCS (Pension)Rules.

7. Formal amendment in Central Civil Service (Extraordinary Pension)Rules will be made in due course.

8. This issues with the approval of Department of Expenditure, vide their ID No.1 (5)/EV/2012 dated 3/4/2017 and 15/01/2019.
