The Joint Secretary(Pers.)
Department of Expenditure,
North Block,
New Delhi-110 001
Dear Madam,

Sub: Grant of HRA/CCA at Hyderabad Rates to the Defence Civilian Employees working at Ordnance Factory Yeddumailaram (Medak) and Eddumailaram (Census Town), Medak

Ministry of Finance, Department of Expenditure vide ID No. 2(2)12007/E-li (B) dated 19.02.2007 have informed MoD that the MoD should checkup the matter with the State Government/Local Authorities to confirm whether Yeddumailaram (Medak) and Eddumailaram (Census Town), Medak are two different cities or both are one and the same. It was further clarified that if it happen to be the same city then HRA / CCA is already admissible at Hyderabad rates being part of Hyderabad (UA). Accordingly, Ministry of Defence after consulting the State Government Authorities have issued instructions vide ID No. 6(6)/2005 D (Civ.) dated 16.05.2007 clarifying Yeddumailaram (Medak) and Eddumailaram (Census Town). Medak are one and the same city and accordingly they are eligible for HRA / CCA as applicable to Hyderabad (UA).

Ministry of Finance vide its ID No. 2(2)/2007-E-li(B) dated 01.12.2014 have advised Ministry of Defence that payment of HRA at Hyderabad rates to the employees of Ordnance Factory Yeddumailaram (Medak) and Eddumailaram (Census Town), Medak may be stopped with immediate effect. Accordingly, Ministry of Defence have issued instructions to Ordnance Factory Board to immediately reduce the rate of HRA to the above employees from existing 30% to 10%.

In this regard it is stated that Eddumailaram (Census Town) was declared / treated as Urban (i.e. Census Town) at 2001 Census vide Government of India, Ministry of Home Affairs, Director of Census Operation Letter No. 4646/Census CeIl/2001 dated 12.08.2002 (copy enclosed for ready reference) Moreover, as per the publication of Government of Andhra Pradesh regarding concept of Urban Agglomeration defined in Chapter 1 of introduction, concepts and definitions, jurisdictional changes, Rural – Urban Frame Andhra Pradesh in Para 1.3.7 it is clearly mentioned that the Medak District falls within the Urban Agglomeration of Hyderabad (UA).

In view of the above Department of Expenditure is requested to re-examine the whole issue in terms of the supporting documents stated in the Preceding Para and arrange to issue instructions to continue 30% HRA for the Defence Civilian Employees of Ordnance Factory Yeddumailaram (Medak) and Eddumailaram (Census Town), Medak, This issue may please be considered seriously and urgently since the Defence Production Unit is facing serious industrial unrest owing to stoppage of HRA at par with Hyderabad (UA) rates.

An early decision is solicited.
Yours faithfully,
(Shiva Gopal Mishra)

Parity between Assistant, SO of Ordnance Factory and CSS/CSSS Pay Scale: Judgement by HC citing "Equal pay for Equal Work"

delhi+high+court+decision+ordnance+factory

Parity between Assistant, SO of Ordnance Factory and CSS/CSSS Pay Scale: Landmark Judgement by HC citing "Equal pay for Equal Work".  Text of Hindustan Times News reproduced below:-
New pay scale benefits for ordnance staff too: HC
UNIFORMITY Citing ‘equal pay for equal work’ principle, Delhi High Court tells Centre to grant pay parity to ordnance factory employees

Employees at Ordnance Factories (OF) – who have been contesting their omission from the benefits of the sixth pay commission for over seven years have finally more than one reason to rejoice.
Reining in the principle of ‘equal pay for equal work’ at public offices, the Delhi High Court has directed the Centre to grant pay parity to employees in the OF with that of identically ranked official in the Central Secretariat Service (CSS) and Central Secretariat Stenographer’s Service (CSSS).
The direction will be applied retrospectively from 2006 — when the sixth CPC was implemented. Not only this, the HC order will come in handy for the employees of the OF when the seventh central pay commission is implemented.
The HC order came in response to a petition filed by Ordnance Factory Employees Association challenging the decision of the finance ministry declining their request for the assistants working in the OF Board to be given same pay scale as was given to similarly placed officials in CSS, CSSS, Ar my Headquarters, UPSC and other services.
The starting point of discrimination against the employees of the OF Board came soon before the acceptance of recommendation of the sixth CPC when a pay upgradation of employees of CSS and CSSS was made in September 2006.
While the OFs and Armed Forces Head Quarters (AFHQs) — both non-secretariat organization — were excluded from the pay upgradation, the latter took the matter to the Central Administrative Tribunal (CAT) and got an order in its favour.
In the case of OF Board, the central government took the view that since it was a nonattached office working outside the Secretariat, there cannot be parity of pay scales. The OF Board was denied benefit of upgradation and the replacement scales given by the sixth CPC. The CAT, too, took a similar stand and denied any relief to the OF Board.
The matter finally reached the Delhi HC last year and after over a year of deliberation a bench of Justice S Ravindra Bhat and Justice Vipin Sanghi termed the discrimination meted out to the OF Board as “over-classification.”
The HC said the discrimination was illogical and artificial. It also took note that the cadre structure of CSS and CSSS is identical to that of the OF. In all the above organisations, the cadre of upper divisional clerks (UDCs) is filled by the feeder of the cadre of the lower divisional clerks (LDCs).
The cadre of assistants on the OF Board is filled by promotion from the feeder cadre of UDCs with at least five years of experience on regular basis.
“The OF Board was treated historically as equals to CSS/CSSS employees and enjoyed equal pay and all benefits flowing from equal pay,” the high court noted adding, “This was based on the previous four instances of determinations by successive pay commissions that they performed equal work.”

Focus point discussed in the preliminary meeting with 7th CPC
(details are available in our memorandum displayed
at website: www.iofgoa.blogspot.in
  • IOFGOA represents Group-B Gazetted Officers-Junior Work Managers (JWMs) , PS & Sr. PS Cadres and Promotee Group-A Officers-Assistant Works Managers of Indian Ordnance Factories under OFB.
  • Ordnance Factories are not profit making organization but the fourth arm of Indian defence. These are meant to serve Armed Forces & Paramilitary forces by providing broad ranging critical to simple defence products & services, which needs a highest level of dedication & integrity in its employees. It should not be treated as general industrial set-up.
  • JWM is the 1st managerial and administrative level (not supervisory cadre) in Indian Ordnance Factories. Sometimes it is mistaken by some authorities as supervisory cadre. 7th CPC may please treat JWMs as Managerial and administrative cadre. This cadre implements all the policies/directives of Govt/MOD/OFB at the ground of work i.e. shop Floor. This is the cadre which has maximum technical skill & experience in the organization which contributes in transformation of resources into output through Technocratic, Managerial & Administrative efficiency. It should be given due care by 7th CPC because it has been ignored by 5th & 6th CPC.
  • Minimum recruitment qualification of JWM/Tech is Degree in Engg./ PG in Engg./ M.Sc. in Physics or Chemistry or relevant subject or equivalent and for JWM/Non-Tech is Graduate degree in engineering, technical, humanities, science, commerce & law.
  • The next Promotional Post for JWM is Asst Works Manager (AWM) IOFS Cadre.
  • Recruitment to the post of JWM is done through promotion from Chargeman, LDCE & DR through UPSC.
  • Minimum recruitment qualification of the feeder cadre Chargeman/Tech is three years Engg. Diploma/ B.Sc. with Physics, Chemistry & Mathematics. For Chargeman/Non-Tech it is degree from recognized University.
  • Sanctioned strength of AWM is 375 out of which only 188 is available for promotion from JWMs against sanction strength of JWM – 7694 & remaining 187 for DR. JWMs are stagnated after getting only one promotion from the post of Chargeman.
  • JWM cadre needs to be strengthened for “Indigenisation of Defence Procurement”.
  • Corrective actions & special care is required by 7th CPC against the anomalies created by 5th CPC & 6th CPC as stated in chapter (4.0). i.e. that is related to MACP, Annual Increment, Fitment Table, Fixation, Pension Commutation, Un-harmonic distribution of Pay Scales, Entry Pay for DR, Unequal Multiplication-Factor, Distortion in Parity in Pay Scales amongst equivalent Cadres, Distortion in Quarters entitlement Criteria etc.
  • There is a need for maintaining inter-departmental Horizontal & Vertical Harmony in Central Govt Posts, Pay Scales & Promotional prospect as available for Group-‘A’ Organized Services at present.
  • The number of total Pay Scales should be reduced from 19 to 15, as proposed in Chapter (6.15).
  • 6th CPC Grade Pay & Pay Band should not be taken as exclusive basis for new pay determination.
  • Grade Pay system should be abolished and open-ended pay scales should be evolved as per Chapter (6.14.1).
  • Recommendation of 7th CPC should be implemented from 01/01/2014, as DA was 100% on that day.   The feeder grade of JWM i.e. Chargeman (pre-revised Grade Pay Rs. 4200, PB-II) should be upgraded to pre revised Grade Pay 4800 PB-II, before deriving new Pay Scale.
  • JWM (pre revised Grade Pay Rs 4600, PB-II) should be rationalized (from its pay scale in 4th CPC) & be upgraded to the pre revised Grade Pay 5400 (PB-III), before deriving new Pay Scale in 7th CPC.
  • The next higher post above JWM which is AWM (pre revised Grade Pay Rs 5400 PB-III) should be upgraded & merged with the post of WM (pre revised Grade Pay Rs 6600 PB-III), before deriving new Pay Scale.
  • PS & Sr. PS Cadre of Ordnance should be treated at par with counter parts in Ministries and OFB while deriving new pay scale.
  • Higher emoluments for Higher Posts including all allowances (Piece Work Profit & Overtime Allowance) should be provided to maintain the hierarchical status. JWM of Ordnance factories are getting letter emoluments as compare to Chargeman & Industrial Employees.
  • Principles of determination of Pay Structure as per chapter number (6.1).
  • The minimum pay scale should be 27,000 as on 01/01/2014 & maximum salary should be 284000 with ratio of (1) : (10.5) and the difference between minimum & maximum salary should be harmonically distributed amongst all the cadre falling in between , as proposed in chapter (6.17).
  • Annual increment should be 5% with provision of option i.e. 1st January & 1st July.
  • Minimum Promotional benefit should be 10% of Basic Pay.

Minutes of DoPT Meeting by INDWF: 7th CPC Appointment, GP 4600 to MCM under 3rd MACP, 30 Days EL iro Piece Worker, Ex-gratia on Death

Minutes of DoPT Meeting by INDWF: 7th CPC Appointment, GP 4600 to MCM under 3rd MACP, 30 Days EL iro Piece Worker, Ex-gratia on Death

INDIAN NATIONAL DEFENCE WORKERS FEDERATION

Minutes of Meeting with Secretary DOP&T held on 24.10.2013 at New Delhi

INDWF/Circular/015/2013
Date: 25.10.2013
To
All Affiliated Unions of INDWF

Indian National Defence Workers Federation continuously representing in various forums and also raised before Hon’ble Defence Minister on the pending issues of Defence Civilian employees.  Now on the following issues, decisions were taken by Ministry of Defence which are as follows.

1. GRANTING OF 3rd MACP UNDER FINANCIAL UPGRADATION TO MCM AND CHARGEMAN

Master craftsman pay was upgraded to Rs.4200/- Grade Pay w.e.f. 01.01.2006 and was clarified by PC of A (Fys) that it was not considered as promotion and accordingly all these MCMs and re-designated Chargeman(T) were granted 3rd MACP on completion of 30 years of service to Rs.4600/-.  Subsequently DOP&T vide their letter dated 13.07.2012 and M of D vide their letter dated 23.07.2013 clarified that their upgradation was treated as promotion thereby denied the MACP – III and conveyed by PC of A (Fys), Kolkatta to recover the payment paid excess from Rs.4200/- to Rs.4600/- Grade Pay. This was strongly protested and represented by Indian National Defence Workers Federation to DOP&T, M of D and OFB to review the decision and grant Rs.4600/- Grade Pay.   The reduction of Grade Pay and recovery was stopped awaiting for the decision from DOP&T.  The recovery was stopped including the reversion from Rs.4600/- Grade Pay to Rs.4200/- Grade Pay in respect of serving employees.

Now, due to our efforts, DOP&T sent back the file to M of D on 14.10.2013 stating that if the MCM is not the feeder grade to Chargeman for promotion as per the existing Recruitment Rules, it may be confirmed and if so the employees completed 30 years can be considered for granting 3rd MACP to Rs.4600/-.  Now M of D had made out the proposal in conformity with SRO that MCM is not the feeder grade to Chargeman and only HS I is the feeder grade and the file was sent to M of D (Finance) for their acceptance and after obtaining clearance from M of D (Defence Finance), formal order will be issued by DOP&T revising its order dt 13.07.2013 and then all the MCMs granted Rs.4600/- under 3rd MACP will be allowed is continue.

This is a major achievement for Indian National Defence Workers Federation in succeeding to get this issue resolved with going to Court.  This will benefit existing employees and the retired employees who got the benefit of 3rd MACP Rs.4600/-.

2. ENTITLEMENT OF 30 DAYS EL IRRESPECTIVE OF OPTION IN RESPECT OF PIECE WORKERS OF ORDNANCE FACTORIES

Piece Workers are denied 30 days EL and were granted only 18 days in a year whereas 30 days EL was granted to all Industrial Employees in defence vide the agreement reached between Government of India and Staff side National Council JCM reached signed on 11.09.1997.   Since, the Piece workers have opted leave under Factories Act, 1948, they are denied the benefit of 30 days.

The issue was discussed at JCM III, II and with DOP&T by Indian National Defence Workers Federation and a proposal was sent to DOP&T through M of D, that one set of Leave Rules (Departmental Leave Rules) is acceptable for all employees and therefore, the Leave Rules under Factories Act, 1948 is to be ignored and the benefit of Leave Rules under Departmental Leave rules be granted to all Industrial Employees in Ordnance Factories.

The above proposal was agreed by M of D, Department of Defence Production to DOP&T and the same was agreed.  Accordingly, Department of Defence Production D(Estt/NG) vide their letter No. I.D.No.8/IR/08/D(Fy-II) dt 25.09.2013/04.10.2013 issued clarification to Ordnance Factory board that all  the employees are now eligible as per the agreement and as per clarification issued by Ministry of Labour for 30 days.  OFB with the approval of PC of A (Fys), Kolkatta is issuing instructions to all Ordnance Factories within 3 days granting 30 days EL which Indian National Defence Workers Federation demanded that the benefit to be granted with retrospective effect i.e. from the date of granting 30 days EL (11.09.1997 agreement).

This is an important achievement of Indian National Defence Workers Federation by which thousands of retired employees will get the benefit of 12 days in a year for encashment.  This may be communicated to the retired employees also.

3. GRANT OF EX-GRATIA LUMPSUM COMPENSATION TO THE FAMILY MEMBERS OF THE DECEASED EMPLOYEES OF ORDNANCE FACTORY ORGANISATION IN CASE OF DEATH A DUE TO ACCIDENTS WHILE ON DUTY.

All Civilian employees of Government of India are entitled for grant of Ex-gratia lump-sum compensation for an amount of Rs.10,00,000/- as per the provisions contained in Para 07 of DOP & W OM No.45/55/97-P & PW(C) dt 11.09.1998 read with para 11 of DOP & PW OM No.38/37/08-P & PW(A) dated 02.09.2008.  There are many employees expired due to accidents in Ordnance Factories has been seriously represented by Indian National Defence Workers Federation President     Shri Ashok Singh also written number of letters to Hon’ble Defence Minister to grant the Ex-gratia Rs.10 lakhs to the affected families though they have been provided employment assistance out of turn.

Now we are pleased to inform that Ministry of Defence, Department of Defence Production vide their letter no.444/IE/05/D/(Fy-II) dt 18.10.2013 issued sanction to Ordnance Factory Board for 30 cases with a total amount of Rs.3 Crores for disbursement immediately to the families of deceased employees.  This will be in respect of Ordnance Factory Bhandara, Cordite Factory Aruvankadu, Ammunition Factory Khadki, Ordnance Factory Khamaria, Ordnance Factory Itarsi and other factories where accidents have taken place.  This is a great achievement.

4.  APPOINTMENT OF 7th PAY COMMISSION

On the approach of INTUC, UPA Government agreed to appoint 7th Pay Commission and will be effective from 01.01.2016.  Government invited the Federations (National Council Standing Committee members) for discussing the Terms of reference for the 7th Central Pay commission.  A meeting was held under the Chairmanship of Secretary, DOP& T on 24.10.2013 at 1500 Hrs at North Block on behalf of Staff side we have proposed the following:
a)  Government of India should come out with their proposal on Terms of Reference and then Staff side will give their proposal.
b)  All anomalies pending including MACP to be settled.
c)  One Labour leader to be included in the commission.
d)  All pending cadre Review proposals should be delinked from 7th CPC.

After consulting the Ministry of Finance, the proposal of Draft will be given to us for discussion.

Yours Sincerely,
(R.SRINIVASAN)
General Secretary.
