Subject;- Payment of DA to Board level/below Board level executives and non- unionized supervisors following IDA scales of pay in Central Public Sector Enterprises (CPSEs) on 1987 and 1992 basis.

The undersigned is directed to refer to para No. 3 of this Department's OM. No. 2(50)786-DPF. (WC) dated 19.07.1995 wherein the rates of DA payable to the executives holding Board level post have been indicated. In accordance with the DA scheme spelt out in Annexure-II of the said OM. the installments of DA become payable from 1st January, 1st April, 1st July, 1st October, every year based on the price increase above quarterly Index average of 1099 (1960= 100).

2. In continuation of this Department's O.M. of even No. dated 05.04.2017, the rates of DA payable to the executives of CPSEs holding Board level post, below Board level post and Non-Unionized Supervisors following IDA pattern of 1992 pay scales may be modified as follows:-

Subject: Revision of rates of Non-Practicing Allowance (NPA) in respect of Veterinary posts on the basis of the recommendations of the 7th Central Pay Commission.

The undersigned is directed to refer to this Ministry's OM No. 7(19)/2008-E-lllA dated 30.8.2008 regarding the existing rates of Non-Practising Allowance (NPA) admissible to veterinary posts under the Central Government and to say that as provided for in para 7 of this Ministry’s Resolution No. 1-2/2016-IC dated 25th July, 2016, the question of revision of rates of allowances (except Dearness Allowance) based on the recommendations of the 7th Central Pay Commission was referred to a Committee under the Chairmanship of Finance Secretary and until a final decision thereon, all allowances were required to be paid at existing rates in the existing pay structure (the pay structure based on 6th Pay Commission) as if the pay has not been revised w.e.f. 1st January, 2016. Accordingly, NPA was also required to be paid at the existing rates specified in the aforesaid OM dated 30.8.2008.

2. The decisions of the Government on the revised rates of various allowances based on the recommendations of the 7th Central Pay Commission and in the light of the recommendations of the Committee under the Chairmanship of the Finance Secretary, have since been notified as per the Resolution No.11-1/2016-IC dated 6th July, 2017.

3. Accordingly, the President is pleased to decide that in modification of the existing rates of NPA as contained in the aforesaid OM dated 30.8.2008, the NPA shall now be paid at the rate of 20% of the basic pay in the revised pay structure in vogue based on the recommendations of the 7th Central Pay Commission, as contained in the CCS(RP) Rules, 2016, subject to the condition that the sum of basic pay and NPA does not exceed Rs. 2,37,500 (Rupees two lakh thirty seven thousand and five hundred only). The following conditions shall regulate the grant of NPA under these orders:

(i) The term "basic pay" in the revised pay structure shall mean "basic pay" as defined in Rule 3(x) of CCS(RP) Rules, 2016, Le, "basic pay" in revised pay structure means the pay drawn in the prescribed Level in the Pay Matrix.

(ii) The NPA shall continue to be treated as pay for the purpose of computation of Dearness Allowance and other allowances, except those allowances in respect of which the applicable orders provide othenwise, including calculation of retirement benefits. Dearness Allowance under these orders shall mean dearness allowance as sanctioned by the Central Government from time to time in the 7th Pay Commission- related pay structure.

(iii) NPA shall continue to be restricted to those veterinary posts for which minimum qualification of a Degree of B.V.Sc. & AH with registration in the Veterinary Council of India is required. The following conditions shall also be fulfilled as hitherto:-

(a) The post is a clinical one.
(b) The post is a whole time post.
(c) There is ample scope for private practice, and
(d) It is necessary to prohibit private practice in public interest.

4. The revised rate of NPA in terms of these orders shall take effect from 1st July, 2017.

5. These orders will not be applicable in respect of Veterinary posts under the Ministry of Railways, Defence and Department of Atomic Energy for which separate orders will be issued by the concerned administrative Ministry/Department.

Committee on Allowances makes minor changes to allowances

The Committee on Allowances has made only minor changes to allowances on the recommendation of the 7th Pay Commission.

The committee has also dittoed the pay commission recommendation of house rent allowance (HRA) of 24, 16 and 8 per cent respectively, instead of the present rate of HRA - of 30, 20 and 10 per cent of basic pay.
A top Finance Ministry official, who did not wish to be named told us after receiving the Committee on Allowances report from Finance Secretary Ashok Lavasa, who led the committee, the report is being currently examined by the Department of Expenditure.

The 7th Pay Commission, led by Justice A K Mathur, earlier proposed abolition of 52 allowances and subsuming of another 36 allowances into larger existing ones out of total 196 allowances, which triggered resentment among central government employees that government complied with formation of the Committee on Allowances.

The Committee on Allowances was constituted in June last year after the government gave nod the recommendation of the 7th Pay Commission from January 1, 2016 in respect of basic pay and dearness allowances.

The Committee on Allowances in its report agreed with the pay commission's recommendation for reducing house rent allowance (HRA) and made minor changes in little allowances for central government employees, the Finance Ministry official told us.

The recommendations of allowances would be finalised by May or June after examining by the empowered committee of secretaries and following that it will be placed before the Cabinet by Finance Minister Arun Jaitley, he said.

No matter when the recommendations are finalised, the new allowances will be made effective from January 1 last year, the official asserted.

Comrades ,
The budget for the year 2017-18 was presented by the Shri Arun Jaitleyji Hon’ble Minister of Finance on 1st Feb 2017 , the Central Government employees had lot of hopes of this budget especially on increasing the tax slabs and tax rates reduction , also on allowances and increasing our wages i.e. revision of the fitment formula . One more important issue of filling up of vacant post in the Central Government.

Shri Arun Jaitleyji Hon’ble Minister of Finance had not uttered a single word about Central Government employees in his budget speech of nearly two hours, even though the Central Government employees work with dedication and implement the programmes and policy of the Central Government either way of revenue collection, transportation, public service , working for the welfare of the people of the country etc . This has caused dissatisfaction amongst Central Government employees as many of the demands of the Central Government employees are not considered. The tax proposals provided only a small relief to the Central Government Employees, actually a big relief should have been provided. The Central Government employees are disappointed of the outcome of the budget.

Now let us focus main issues of the CG employees and the budget 2017-17 especially this budget is being presented after the demonetization. As stated earlier the financial position of the Central Government is very good even after demonetization. The budget 2017-18 has once again proved that the Central Government resources are very good the revenue expenditure has been at 21.47 lakh crores. The fiscal deficit will be 3.2 % of GDP.
Now coming to the revenue growth of the Central Government in last four years we can observe from the financial year 2013-14 the Revenue Expenditure which was at is Rs 14.88 lakh crores the Revenue Expenditure the financial year 2017-18 which stands at 21.47 lakh crores . The fiscal deficit has also reduced from 4.8 % to 3.2 % of GDP in last four years . This shows that the financial status of the Central Government is very good. The growth rate of the revenue collection is about 15% annually. In fact the Shri Arun Jaitleyji Hon'ble Minister of Finance had stated the revenue collection is increasing to about 17 % annually. We should be proud that your country economy is in good shape. Indian economy is a stable economy can accommodate any additional financial expenditure to be made for the welfare of Central Government employees.

The revenue of the Central Government is increasing at about 15% annually, from last three years the revenue of the Central Government has increased by 45% the expenditure towards salary of Central Government employees including the defence employees has risen only by 14.5 % on wage hike due to 7th CPC and also Dearness Allowances expenditure. So total rise in pay hike is about 22% , even if allowances are released in next financial year additional expenditure is likely at just 3% as 70% of the employees don’t avail HRA which is the major allowances, . which is very much less than the 45% of the revenue collection of the Central Government. So the Central Government can afford to increase our wages considerably i.e revision of fitment formula and minimum wage . The allowances should be made effectively from 1st Jan 2016.

Next on the tax slabs the Shri Arun Jaitleyji: Hon'ble Minister of Finance had made announcement of the tax proposals provided only a small relief to the Central Government Employees by reducing the taxes for the slab 2.5 lakhs to 5 lakhs from 10% to 5% . This is only a very small gestures on the part of Shri Arun Jaitleyji Hon’ble Minister of Finance , actually a big relief should have been provided by way of abolishing the taxes up to Rs 5 lakhs . The expenditure loss for reduction of taxes for the slab 2.5 lakhs to 5 lakhs(1.95 crore show income between Rs 2.5 to Rs 5 lakh) from 10% to 5% is just at Rs 15,500/- crores only , if the Hon'ble Minister of Finance had announced the abolishing the taxes up to Rs 5 lakhs it could have been additional expenditure of Rs 15,000 crores only which at just half percent of the total budget revenue collections , next Rs 5 to Rs10 lakhs slab (only 52 lakh show income between Rs 5 to Rs 10 lakhs ) here also there should have been reduction in taxes from 20% to 10% , the limit of Rs 1.5 lakh under Section 80C for investment should have been increased upto 2.5 lakh which would have encouraged savings , all these measures could have gone a long way benefiting the Central Government employees and the salaried class employees a lot.

Today hardly 3 % of the country population are paying the income tax, the rest 97% do not pay income tax .The Central Government Employees are honestly paying the taxes. A big tax relief is genuinely due for them.
One more important problem faced by the Central Government Employees is that the no filling up of the vacant post in the Central Government, nearly 4 lakhs post are vacant, even in Railway safety post of 1.41 lakh post are vacant and Income tax department post are vacant, more manpower is required for effectively collection of the taxes and implementation of the programmes and policy of the Central Government. This will also provide jobs for the youth of the country.

We sincerely hope the Hon'ble Minister of Finance would reconsider his decision and improve the taxation policy and consider the demands of the CG employees effectively in true spirit.

Simultaneous issue of orders for the release of Dearness Allowances: Issue taken as agenda by DPPW in the SCOVA meeting

Ministry of Personnel, Public Grievances & Pensions published an order yesterday regarding the four new agenda items will be discussed in the meeting of Standing Committee of Voluntary Agencies (SCOCA) under the Chairmanship on 3.2.2015.

The four fresh agenda points are given below…

1. Simultaneous issue of orders for the release of Dearness Allowances:

Based on the rise in Consumer Price Index, Dearness Allowance and Dearness Relief are granted to serving employees and pensioners respectively with effect from 1st January and 1st July each year. The orders sanctioning DA are issued by the Finance Ministry and the orders sanctioning DR are issued by the Ministry of Personnel, Public Grievances and Pensions after the same. While serving employees get the increase in cash after a couple of days from the date of issue of Office Memorandum, the pensioners get it after some days since the issue of O.M, for DR needs to be further approved by Department of Expenditure and CAG. As the payment of DA and DR is being made from the Consolidated Fund of India, the issuance of separate orders for the grant of DA and DR could be unnecessary.

2. Co-authorisation of Family Pension of permanently disabled children/dependent parents and permanently disabled siblings

As a policy initiative of DoPPW, the CPAO vide its O.M no. CPAO/Tech/Simplification/2013-14/252 dated 06.02.2014 allowed co-authorisation
of family pension of permanently disabled’ children/dependent parents and permanently disabled siblings. A similar benefit may be considered by Department of Defence and Ministry of Railways to its pensioners.

3. Non-adherence of extant rules with regard to submission of life certificate

Despite clear instructions from the Ministry of Finance,vide CPAO/Tech/Grievances/2010-11/531 dated 30.06.2011, it has been reported that some’ banks branches are insisting on personal appearance of pensioners for submission of life certificates along with PPOs. The extant rules now exempt personal appearance and the prescribed form is to be signed by any of the persons specified therein.The pensioners thus got put to untoward hardship in addition to stress and strain which could have been avoided. As such, Department of Financial Services is requested to take necessary steps to get the instructions complied with strictly without fail.

4. Provision of CGHS facility for life time to dependent disabled/mentally retarded children of Central Government Employees/Pensioners

a) In the “Definition of Family” under CGH_S,furnished in Ministry of Health & FW O.M. No. 3T-1/2009-C&P/CGHS (P) dated 23-2-2011, daughter as indicated at 51 No.5(ii) can avail the benefits till she starts earning or gets married irrespective of the age-limit, where as son indicated at 51. No. 5(iii) of the list, suffering from any permanent Physical/Mental disability is entitled to avail the facility “irrespective of age- limit”, and son’s marital status may not result in denial of CGHS facility to him ,in as much as there is no mention of marital status in the definition, unlike the definition at 51.5 (i) On the other hand, daughter suffering from any permanent disability (physical disability or mental retardation) loses the facility if she gets married as per the definition at 51. (5)(ii). Hence, the case of a physically disabled/mentally retarded daughter needs to be considered for extension of CGHS facility “irrespective of age-limit, even after her marriage” .

b) Further under CCS (Pension) Rules, 1972, by an amendment to explanations 1 and 3 after Sub-rule 6 of Rule 54, as communicated vide Department of Pension & PW’O.M. No. 1/33/2012-P&PW(E) dated 16-1-2013, mentally /physically disabled children have been allowed to continue to draw family pension even after their marriage thereby removing the condition of marital status for continued drawal of family pension.

c) Thus on the analogy of pension rules, mentally/physically disabled children (both son and daughter) of Central Government Employees/Pensioners may be allowed to continue to avail CGHS facilities even after their marriage by removing the condition of marital status now existing in respect of daughters only. The “definition of family” under CGHS would need to modified suitably.

Subject: Clarification on increase in certain allowances by further 25% as a result of enhancement of Dearness Allowances w.e.f. 1.1.2014

The undersigned is directed to refer to para 1(j) of this Department’s OM. No.12011/03/2008-Estt. (Allowance) dated 2.9.2008. This provides that the limits of Children Education Allowance would be automatically raised by 25% every time the Dearness Allowance on the revised pay structure goes up by 50%. References are being received from various quarters with regard to the amount of Children Education Allowance admissible consequent upon enhancement of Dearness Allowance payable to Central Government employees @ 100% w.e.f. 1 January, 2014 announced vide Ministry of Finance, Department of Expenditure O.M. No.1/l/2014-E-1I (B) dated 27th March, 2014.

2. In accordance with the above, the following shall be the revised limits:

a) The annual ceiling limit for reimbursement of Children Education Allowance shall be Rs.18,000/- per child. Accordingly, the quarterly claim could be more than Rs.4500/- in one quarter. The Hostel Subsidy shall be Rs.4500/- per month per child;

b) The rates of Special Allowance for Child Care to women with disabilities stands revised to Rs. 1500/- per month; and

c) The annual ceiling for reimbursement of Children Education Allowance for disabled children of Government employees shall be treated as revised to Rs.36,000/- per annum per child and the rates of Hostel Subsidy for disabled children of Government employees shall be treated as revised to Rs.9000/- per child per month.

3. These revisions are applicable with effect from 1st January, 2014.

4. These revisions shall be subject to other terms and conditions mentioned in this Department’s O.M. No.12011/03/2008-Estt (Allowance) dated 2.9.2008, O.M. No.12011/04/2008 dated 11.9.2008 and 12011/07(i)12011-Estt.(AL) dated 21.2.2012.
