Subject: Revision of rates of Non Practicing Allowance (NPA) to the officers of Armed Forces Medical Services consequent on acceptance of recommendations of 7th Central Pay Commission.

Sir,
I am directed to refer to Department of Expenditure, Ministry of Finance’s Resolution No.11-1/2016-IC dated 6th July, 2017 and OM No 12- 2/2016-EIII.A dated 7th July, 2017 and to convey the sanction of the President of India for the grant of Non Practicing Allowance (NPA) to the officers of Directorate General of Armed Forces Medical Services which shall now be paid at the rate of 20% of the basic pay in the revised pay structure in vogue based on the recommendations of 7th CPC, subject to the condition that the sum of the basic pay, Military Service Pay (MSP) and NPA does not exceed Rs.2,37,500 (Rupees two Lakh thirty seven thousand and five hundred only). The following conditions shall regulate the grant of NPA under these orders:
(i) The term ‘basic pay’ in the revised pay structure shall mean "basic pay" in Army/Navy/Air Force Officers Pay Rules/Regulations, 2017, i.e., "basic pay" in revised pay structure means the pay drawn in the prescribed Level in the Pay Matrix.

(ii) The NPA shall continue to be treated as pay for the purpose of computation of Dearness Allowances, pension and other allowances, except those allowance in respect of which the applicable orders provide otherwise, including calculation of retirement benefits. Dearness Allowance under these orders shall mean dearness allowance as sanctioned by the Central Government from time to time in the 7th Pay Commission - related pay structure.

(iii) As per provision in relevant Rules of Army/Navy/Air Force Officers Pay Rules/Regulation,2017, NPA shall not be calculated on MSP.

(iv) NPA shall continue to be restricted to those medical posts for which medical qualifications recognized under the Indian Medical Council Act, 1956 or under the Dentist Act, 1948 have been prescribed as an essential qualification. The following conditions shall also be fulfilled as hitherto:

(a) The post is a clinical one.
(b) The Post is a whole time post.
(c) There is ample scope for private practice, and
(d) It is necessary to prohibit private practice in public interest.
2. The revised rates of NPA in terms of these orders shall take effect from 1st July,2017.

3. This issues with the concurrence of Ministry of Defence (Finance) vide UO No.3(01)/2017/AG/289-PA dated 19.09.2017.

Subject : Pay Revision of Board level and below Board level Executives and Non-Unionised Supervisors of Central Public Sector Enterprises (CPSEs) w.e,f. 01,01.2017 - decision on Location based compensatory allowances and Non-Practicing Allowance (NPA)

The undersigned is directed to refer to para 10 of this department's O.M. of even. No. dated 3rd August, 2017 and sub-para. 3(b) of pars 1 of OM of even No. dated 4th August, 2017 regarding the issue of separate guidelines in respect of Location based Compensatory Allowance and Non-Practicing Allowance. After due consideration, the Government has decided on Location based Compensatory Allowance and Non- Practicing Allowance as follows:

Location based Compensatory Allowance:

(i) For serving in North-East States and Ladakh Region:
Assam, Meghalaya, Manipur, Nagaland, Tripura, Arunachal Pradesh, Mizoram and Sikkim10% of Basic Pay
Ladakh Region10% of Basic Pay

(ii) For serving in Island territories of Andaman and Nicobar (A&N) Islands and Lalishadweep
Areas around Capital Towns (Port Blair in A&N Islands, Kavaratti and Agatti in Lakshadwespi10% of Basic Pay
Difficult Areas (North and Middle Andaman, South Andaman excluding Port Blair, entire Lakshadweep except Kavaratti, Agatti and Minicoy10% of Basic Pay
More Difficult Areas (Little Andaman, Nicobar group of Islands, Narcondam  Islands, East Islands and Minicoy)10% of Basic Pay

(iii) Special allowance: For serving in the difficult and far flung areas:

Non-practicing Allowance (NPA):
NPA upto 20% of Basic Pay would be paid to Medical Officers. NPA will not be considered as pay for the purpose of calculating other benefits.

2. The allowances specified in this O.M. will be outside the purview of Ceiling of 35% of Basic Pay wider 'Cafeteria Approach' and would be effective from the date of issue of presidential directive.

Subject: Revision of rates of Non-Practicing Allowance (NPA) in respect of medical posts other than the posts included in the Central Health Services-recommendations of the 7th Central Pay Commission.

The undersigned is directed to refer to this Ministry's OM No. 7(19)/2008-E-IIIA dated 30.8.2008 regarding the existing rates of Non-Practising Allowance (NPA) admissible to medical posts other than the posts included in the Central Health Services and to say that as provided for in para 7 of this Ministry's Resolution No.1- 2/2016-lC dated 25th July, 2016, the question of revision of rates of allowances (except Deamess Allowance) based on the recommendations of the 7th Central Pay Commission was referred to a Committee under the Chairmanship of Finance Secretary and until a final decision thereon, all allowances were required to be paid at the existing rates in the existing pay structure (the pay structure based on 6th Pay Commission) as if the pay has not been revised w.e.f. 1st January, 2016. Accordingly, NPA was also required to be paid at the existing rates specified in the aforesaid OM dated 30.8.2008.

2. The decisions of the Government on the revised rates of various allowances based on the recommendations of the 7th Central Pay Commission and in the light of the recommendations of the Committee under the Chairmanship of the Finance Secretary have since been notified as per the Resolution No. 11-1/2016-10 dated 6th July, 2017.

3. Accordingly, the President is pleased to decide that in modification of the existing rates of NPA as contained in the aforesaid OM dated 30.8.2008, the NPA shall now be paid at the rate of 20% of the basic pay in the revised pay structure in vogue based on the recommendations of the 7th Central Pay Commission, as contained in the CCS(RP) Rules, 2016, subject to the condition that the sum of basic pay and NPA does not exceed Rs. 2,37,500 (Rupees two lakh thirty seven thousand and five hundred only). The following conditions shall regulate the grant of NPA under these orders:

The undersigned is directed to refer to this Ministry's OM No. 7(19)/2008-E-lllA dated 30.8.2008 regarding the existing rates of Non-Practising Allowance (NPA) admissible to veterinary posts under the Central Government and to say that as provided for in para 7 of this Ministry’s Resolution No. 1-2/2016-IC dated 25th July, 2016, the question of revision of rates of allowances (except Dearness Allowance) based on the recommendations of the 7th Central Pay Commission was referred to a Committee under the Chairmanship of Finance Secretary and until a final decision thereon, all allowances were required to be paid at existing rates in the existing pay structure (the pay structure based on 6th Pay Commission) as if the pay has not been revised w.e.f. 1st January, 2016. (a) The post is a clinical one.
(b) The post is a whole time post.
(c) There is ample scope for private practice, and
(d) It is necessary to prohibit private practice in public interest.
4. The revised rate of NPA in terms of these orders shall take effect from 1st July, 2017.

5. These orders will not be applicable in respect of Veterinary posts under the Ministry of Railways, Defence and Department of Atomic Energy for which separate orders will be issued by the concerned administrative Ministry/Department.

Fixation of Pay for Medical Officers who are drawing Non Practicing Allowance (NPA)

In the case of medical officers in respect of whom Non Practicing Allowance (NPA) is admissible, the pay in the revised pay structure shall be fixed in the following manner :

the existing basic pay shall be multiplied by a factor of 2.57 and the figure so arrived at shall be added to by an amount equivalent to Dearness Allowance on the pre-revised Non-Practicing Allowance admissible as on 1st day of January, 2006. The figure so arrived at will be located in that Level in the Pay Matrix and if such an identical figure corresponds to any Cell in the applicable Level of the Pay Matrix, the same shall be the pay, and if no such Cell is available in the applicable Level, the pay shall be fixed at the immediate next higher Cell in that applicable Level of the Pay Matrix.

The pay so fixed under sub-clause (i) shall be added by the pre-revised Non Practicing Allowance admissible on the existing basic pay until further decision on the revised rates of Non Practicing Allowance.

Revision of pension of pre-2006 pensioners – inclusion of Non-Practicing Allowance (NPA) in revision of pension of retired medical officers

Subject :- Revision of pension of pre-2006 pensioners – inclusion of Non-Practicing Allowance (NPA) in revision of pension of retired medical officers

The undersigned is directed to say that in accordance with para 4.2 of this Department’s OM No.38/37/08-P&PW(A) dated 1.9.2008 (as clarified vide OM dated 3.10.2008 and 14.10.2008), the revised pension of pre-2006 pensioners shall, in no case, be lower than fifty per cent of the minimum of the pay in the pay band plus the grade pay corresponding to the pre-revised pay scale from which the pensioner had retired. In the case of HAG and above scales, this will be fifty per cent of the minimum of the revised pay scale. Further, in accordance with OM No.38/37/08-P&PW(A) dated 28.1.2013, the normal pension in respect of pre-2006 pensioners/family pensioners as revised w.e.f. 1.1.2006 in terms of para 4.1 or para 4.2 of the aforesaid OM dated 1.9.2008 would also be further stepped up w.e.f. 24.9.2012 to 50% of the sum of minimum of pay in the pay band and the grade pay corresponding to the pre-revised pay scale in which the Government servant had retired, as arrived at with reference to the fitment tables annexed to the Ministry of Finance, Department of Expenditure OM No.1/1/2008-IC dated 30th August, 2008. In the case of HAG and above scales, this will be 50% of the minimum of the pay in the revised pay scale arrived at with reference to the fitment tables annexed to the above OM dated 30.8.2008 of Ministry of Finance (Department of Expenditure).

2. In its judgment dated 27.11.2013 in Civil Appeal No.10640-46/2013 and other connected matters, Hon’ble Supreme Court observed that in accordance with Ministry of Health and Family Welfare’s OM No.45012/11/97-CHS.V dated 7.4.1998, NPA counts as pay for all service benefits including retirement benefits. In implementation of the aforesaid judgement of Hon’ble Supreme Court, orders have been issued vide this Department’s OM No.38/31/11-P&PW(A)(Vol.IV) dated 14.10.2014 read with OM dated 21.10.2014 that in the case of pre-1996 retired medical officers, NPA @ 25% shall be added to the minimum of the revised scale of pay as on 1.1.1996 corresponding to the pre-1996 pay scales from which the pensioner had retired, in cases where consolidated pension/family pension was to be stepped up to 50% / 30% respectively of the minimum of revised pay-scale in terms of OM No.45/10198-P&PW(A) dated 17.12.1998 read with OM No.45/86/97-P&PW(A) (Pt.) dated 11.5.2001.

3. In this Department’s OM of even number dated 14.7.2009, it was clarified that in the case of pre-2006 pensioners, Non-Practicing Allowance is not to be added to the minimum of the revised pay band+Grade Pay/revised pay scale in cases where consolidated pension/family pension as on 1.1.2006 is to be stepped up to 50% / 30% respectively in terms of para 4.2 of Department of Pension & Pensioners’ Welfare OM No.38/37/08-P&PW(A) dated 1.9.2008 (as clarified vide OM dated 3.10.2008 and 14.10.2008).

4. In the OM No. A.45012/2/2008-CHS.V dated 29.9.2008 of Ministry of Health & FW, it is provided that NPA will be treated as pay for the purpose of computing Dearness Allowance, entitlement of Travelling Allowance and other allowances as well as for calculation of retirement benefits. Therefore, the ratio of the said judgement dated 27.11.2013 in CA No.10640-46/2013 would be applicable for revision of pension/family pension of pre-2006 retired civilian medical officers w.e.f. 1.1.2006 also. Accordingly, the OM dated 38/37/08-P&PW(A) dated 14.7.2009 is hereby withdrawn. In the case of pre-2006 retired medical officers, NPA @ 25% would be required to be added to the minimum of the pay in the revised pay band plus grade pay (or minimum of pay in the revised pay scale in the case of HAG and above) as on 1.1.2006 corresponding to the pre-revised pay scale from which they retired, in cases where pension family pension is to be stepped up to 50%130% of the minimum pay respectively.

5. Similarly, for revision of pension family pension w.e.f. 24.9.2012 in terms of OM dated 28.1.2013, NPA @ 25% would be required to be added to the minimum of the pay in the revised pay band plus grade pay (or minimum of pay in the revised pay scale in the case of HAG and above) corresponding to the pre-revised pay scale from which they retired as arrived at with reference to the fitment table annexed to the Department of Expenditure’s OM dated 30.8.2008 subject to the condition that the basic pay plus NPA does not exceed Rs.85,000/- .

6. This issues with the approval of Ministry of Finance, Department of Expenditure vide their I.D. No. 7211E-V/2014 dated 2.1.2015 and Ministry of Law F.No.213/Advice’A’/2015 dated 29.1.2015.
