CHARTER OF DEMANDS

1. Urgent measures for containing price-rise through universalisation of public distribution system and banning speculative trade in commodity market.

2. (a) Containing unemployment through concrete measures for employment generation.
 
(b) No ban on creation of new posts. Fill up all vacant posts.

3. (a) Strict enforcement of all basic labour laws without any exception or exemption and stringent punitive measure for violation for labour laws. Withdraw the anti-worker Labour Law Amendments
 
(b) No labour reforms which are inimical to the interest of the workers.

4. (a) Universal social security cover for all workers
 
(b) Scrap PFRDA Act and re-introduce the defined benefit statutory pension scheme.

5. (a) Fix minium wage with provisions of indexation.
 
(b) Effect wage revision of the Central Government Employees from 01.01.2014 accepting memorandum of the staff side JCM; ensure 5-year wage revision in future; grant interim relief and merger of 100% of DA; Include Gramin Dak Sevaks within the ambit of 7th CPC. Settle all anomalies of 6th CPC.

6. (a) Stoppage of disinvestment in Central/State PSUs. Stoppage of contractorisation in permanent perennial work and payment of same wage and benefits for contract workers as regular workers for same and similar work.

(b) No outsourcing, contractorisation, privatization of governmental functions; withdraw the proposed move to close down the printing presses, the publications, form stores and stationery departments and medical stores Depots; regularize the existing daily-rated/casual and contract workers and absorption of trained apprentices.

7. Removal of all ceilings on payment and eligibility of bonus, provident fund; increase the quantum of gratuity.

8. (a) Compulsory registration of trade unions within a period of 45 days from the date of submitting applications; and immediate ratification of ILO Convention C 87 and C 98.

(b) Revive the JCM functioning at all level as an effective negotiating forum for settlement of
the demands of the Central Government Employees.

9. (a) Against FDI in Railways, Insurance and Defence.
 
(b) No Privatisation, PPP or FDI in Railways, Defence Establishment and no corporatization of Postal services.

10. Remove arbitrary ceiling on compassionate appointment.

11. Ensure five promotions in the serve career.

NO DIFFERENCE BETWEEN NDA AND UPA GOVERNMENT LET US PREPARE FOR A MAJOR INDUSTRIAL ACTION

Dear Comrades,

Confederation National Secretariat met at New Delhi on 26.09.2014, under the Presidentship of Com. K. K. N. Kutty, National President. Com. S. K. Vyas Ji, Advisor was also present. After detailed deliberations on all agenda items, the following decisions are taken.

1. Decided to further intensify the campaign and agitational programmes against the Governments attitude towards the legitimate demands of the Central Government Employees. It is decided to organize two hours MASS SQUATING of not less than 3000 Central Government employees on 18th November 2014, at a centrally located important place at all the state capitals. Effort should be made to ensure maximum participation of Lady comrades in the programme. Next phase of action will be decided after successful implementation of the above programme.

2. Decided to explore the possibility of joint action with Railways (AIRF) and Defence (AIDEF) culminating in strike.

3. Decided to participate and implement all the decisions taken in the National convention of workers organised by Central Trade Unions on 15.09.2014.

4. Decided to organize Two days All India Trade Union workshop of Confederation at Bangalore on 2015 January 3rd and 4th. Total number of delegates will be limited to 200. COC Karnataka has agreed to host the Trade Union workshop.

5. Decided to grant affiliation to the following two organizations.

(1) Forest Survey of India Employees Association
(2) Nehru Yuvak Kendra Sanghathan (NYKS) workers Welfare Association.

6. Decided to organize Dharna in front of all Government of India Presses and Stationery offices and also in front of Government Medical stores Depot to protest against the proposed move to close down these offices. In front of Government of India Presses Dharna will be organised by Confederation on 27th October 2014 and in front of Government Medical Stores Depot dharna will be organised on 30th October 2014.

7. Financial position of the Confederation was presented by Financial Secretary Com. Vrigu Bhattacharjee. CHQ is running with a ‘NIL’ balance. Unless and until all the affiliated Unions/Associations voluntarily clear all pending dues it will be very difficult to run the CHQ. It is decided that Financial Secretary shall issue notice to all affiliated organizations to clear the pending dues.

8. National Secretariat calls upon all Central Government employees and also the affiliated organisatons and state COCs to make the 18th October programme a thundering success.

Sub: Regulation of Transport Allowance at Faridabad Gurgaon, Ghaziabad and Nodia at par with Delhi rates.

Sir,
Your kind attention is invited to the OM No. 21(8)2010-E-II (B) dated 01.08.2012 of Ministry of Finance, Department of Expenditure regarding regulation of Transport Allowance at Faridabad, Gurgaon, Ghziabad and Noida wherein instructions have been issued to regulate the Transport Allowance at the rates applicable to ‘Other Cities’ i.e other than 13 classified cities as per the condition laid down in OM no. 21(2)12008-E-II (B) dated 29.08.2008. Issuance of the OM has created panics among the employees posted at these cities. Immediate action is required to be taken to avoid implementation of the OM.

In this connection following points are brought to your kind notice —

1. Ministry of Finance, Department of Expenditure had issued OM 2(4)-E.II (B)/65 dated 05.11.1974 vide which special dispensation was given to Faridabad at Delhi rates in respect of CCA & H RA.

2. 5th Central Pay Commission had made recommendations to grant of transport allowance to Central Government employees to compensate the cost incurred on commuting between the place of residence and the place of duty. Transport allowance was implemented vide 0M No. — 1(13)97-E-Il (B) dated 03.10.1997, according to which, transport allowance was to be regulated on the basis of classification of cities for the purpose of CCA. Para 3.1 of said order Is reproduced below-

The cities referred to as ‘A’ and ‘A-1’ in these orders shall be the same as those classified as such for the purpose of Compensatory (City) Allowance (CCA) in terms of the orders issued separately regulating grant of CCA to the Central Government employees.

3. Vide para 4.2 8, 6 CPC had recommended abolition of CCA and increased the rates of transport allowance subsuming the element of CCA. The abolition of CCA was compensated by increasing the rates of transport allowance.

4. Faridabad has been given the status of A-1 city (as being part of the Urban Agglomerate of Delhiat par with NOIDA, Ghazia bad and Gurgan etc.) since 1974 for the purposes of HRA & CCA and since August, 1997 for the purpose of transport allowance as given above. These facilities are being extended to the Central Government employees/officers posted at Faridabad accordingly.

5. It may further be noted that, Ministry of Finance, vide No. 21 (2)/2008-E.ll dated 29.08.2008 has classified 13 cities as A-I/A which, inter-alia, includes Delhi (UA). Delhi (Urban Agglomerate) includes Faridabad, Ghaziabad, Noida & Gurgaon As such, the rates of Transport Allowance admissible for the City of Delhi, automatically stands extended to the other constituents of the Urban Agglomerate.

6. If rate of the transport allowance is reduced the rate payable to other cities, employees posted at Faridabad, Ghaziabad, Noida & Gurgaon will be deceived from the benefit given by the 6th CPC by subsuming the element of CCA in transport allowance as they were being paid CCA at Delhi rates.

7. In view of the above, it reveals that the transport allowance was being regulated on the basis of classification of cities for the purpose of CCA and payment of transport allowance at Delhi rates, to the employees posted at Faridabad is fully justified. This stands already concluded by the orders and judgments of the Hon’ble CAT Principal Bench, New Delhi (copy enclosed for ready reference) as given below-

1) OA No. 483/2005, Judgment dated 16.09.2005.
2) OA No. 2441/2005, Judgment dated 02.08,2006
3) RA No. 296/2010, Judgment dated 14.01.2011.
4) OA No. 368/2011, Judgment dated 21.07.2011.
5) OA no. 459/2011, Judgment dated 05.08.2011.
6) CP No. 302/2011, Judgment dated 30.03.2011.

8. These judgments squarely covers this issue wherein the Hon’ble CAT, Principal Bench, New Delhi had upheld the payment of Transport Allowance at par with Delhi (UA) and the said judgments were accepted by the Government and duly implemented. It appears that the Department of Expenditure has not noticed the above judicial pronouncement and issued the clarification vide OM dated 1” August, 2012, which seem to be in contravention of the directions of the Hon’ble CAT.

It is therefore, requested to kindly take cognizance of the facts and particularly the binding judgments of the Hon’bel CAT, New Delhi as mentioned above to withdraw the latest instructions issued vide ID No. 21 (8)12010-E-Il (B) dated 01.08.2012 for reducing the Transport Allowance on par with “Other Cities”.
An early action ¡n this regard is highly solicited.

Sub: – Child Care Leave for removal of limit of 3 spell in a calendar year – reg.

A kind reference is invited on the above cited OM. While we welcome the removal of earlier stipulation of child care leave for minimum period of 15 days at a time, it is requested now to dispense the limitation of three spells in a calendar year.

The condition spelled in the DOPT OM No. 13018/1/2010-Estt (Leave) dated 07.09.2010 limiting the grant of three spells in a calendar year now become a constraint to the less leave takers and needs a revision. It is quite beneficial both to the administration and staff to enhance the three spells limit to more or without limit. This will encourage the beneficiaries to utilize their CCL to the extent of optimal level.

Hence, it is requested to-remove the condition of limiting three spells in a calendar for availing child care leave in the backdrop of removal of 15 days condition for each spell.

PFRDA BILL LISTED IN THE AGENDA OF THE CURRENT SESSION OF THE PARLIAMENT

CONFEDERATION CALLS UPON THE CENTRAL GOVERNMENT EMPLOYEES TO ORGANIZE TWO HOURS WALK-OUT PROGRAMME ON THE DAY WHEN THE BILL IS TAKEN UP FOR DISCUSSION IN PARLIAMENT

As you are aware, Central Government is going ahead with their agenda on pension privatization. The controversial PFRDA Bill (Pension Fund Regulatory and Development Authority Bill) is listed as an agenda item for the current Parliament session. The bill may be taken up for discussion in Parliament on any day. Confederation of Central Government Employees & Workers has opposed the Contributory Pension Scheme and also the PFRDA Bill from the very beginning.

We have conducted so many agitational programmes including strike. The left parties in the parliament have also strongly opposed the Bill. Inspite of the opposition from employees (both Central Government and State Government Employees & Teachers) and also from left political parties, the Central Government is not ready to withdraw the contributory Pension scheme or to scrap the PFRDA Bill.

The National Secretariat of the Confederation has viewed the move of the Government with grave concern and decided to call upon the entirety of the Central Government Employees & Workers to organize mass protest demonstration in front of all offices throughout the country after walking out from offices for two hours, on the day when the bill is taken up for discussion in Parliament or on the next day if information is received late.

All India office bearers, State level COCs and other COCs are requested to make the two hours walk out programme a grand success.
