Subject-: Promotion to the grade of Deputy Secretary, CSS on ad-hoc basis - Extension of period upto 30.06.2019 - regarding.

The undersigned is directed to refer to this Department's Order No. 4114/201 I-CS.I(D) dated 31.07.2012 and subsequent several orders for promotion of Under Secretaries of the CSS to the Grade of Deputy Secretary on ad-hoc basis.

2. With the approval of the competent authority, the tenure of ad-hoc basis appointment of all the Deputy Secretaries is hereby extended beyond 30.06.2018, i.e. from 01.07.20 18 and up to 30.06.2019 or till the posts are filled up on regular basis or till further orders, whichever is earlier, subject to vigilance clearance.

3. This order will be applicable to all such officers who are continuously holding the post of Deputy Secretary on ad-hoc basis as per aforementioned Orders. The continuation of ad-hoc promotion is subject to the conditions mentioned in the orders referred above and also the conditions mentioned below:
i. No disciplinary proceeding has been initiated during the period between last extension and now; and
ii. No penalty has been imposed during the period between last extension and now.
4. In case any of these conditions is attracted in respect of any of the officers, the same may be brought to the notice of this Department immediately for further appropriate action.

Subject:- Promotion of Personal Assistants (PAs) of CSSS to Private Secretaries (PSs) of CSSS on ad-hoc basis:-regarding

The undersigned is directed to refer to this Department's OM of even No. dated 25.10.2018, 26.10.2018 and 02.11.2018 respectively on the above mentioned subject. All the cadre units were requested to conduct DPCs of the eligible PAs of CSSS as shown in the Annexure-I to the OM of even no. dated 25.10,2018 to assess suitability for ad-hoc promotion to the grade of PS for a period upto 30.06.2019 .

2. The Cadre Units were also requested to complete the exercise of conducting the DPC meeting within one month and send duly filled option form to this Department as per Annexure­II of OM dated 25.10.2018.

3. Based on the information received from the Cadre Units, the Competent Authority has decided to nominate the PAs whose names appear in Annexure-1 of this OM to post them to the Cadre Units indicated against their names for their promotion to the Grade of PS of CSSS purely on ad-hoc basis and after having been found 'fit' by the DPC and clear from vigilance angle.

4. The ad-hoc appointment of these officials shall take place with effect from the date they assume charge of the post of PS in the allocated Cadre Units. The ad-hoc appointment shall not confer on the appointees any right to continue in the grade indefinitely or for inclusion in the Select List of PS for regular appointment or to claim seniority in the PS Grade of CSSS. The period of ad-hoc promotion would be upto 30.06.2019 or till the regular PSs become available, whichever is earlier.

5. If any of the officers shown in the list is on deputation, he/she may be given the option to revert within one month with a view to avail of the Promotion. The ad-hoc promotion is subject to the conditions mentioned in para 3 of this Department's OM of even number dated 10.2018.

6. The notification/order for promotion should be issued by allocated Cadre Units of officers after the due process is completed and a copy of such orders should invariably be endorsed to this Department for records. The fact that the appointment of the officer(s) would be subject to further orders which may be passed by Hon'ble Courts in the cases mentioned in para 3 (vi), (vii), (viii) and (ix) of OM dated 25.10.2018 and references to that extant in the connected court matters, should be clearly mentioned in the promotion order/notification.

7. Web Based Cadre Management System: Promotion of officers may be reflected in Web Based Cadre Management System. This is the responsibility of the nodal officers of all cadre units concerned.

Subject: Payment of arrears on ad-hoc basis of pay to Defence Forces Personnel pending issuance of Notification accepting 7th Central Pay Commission Award.

Sir,

Government of India have promulgated vide Resolution No.1(6)/2016/D(Pay/Services) dated 05 Sept 2016 and No.1(7)/2016/D (Pay/Services) dated 05th September, 2016 accepting the recommendations of 7th Central Pay Commission in so far as they relate to pay of Service Officers, MNS Officers, JCOs/ORs, NCs(E) including DSC Personnel. Since fixation of pay and consequent calculation of arrears may take some time, I am directed to convey the sanction of the President to the payment of arrears on an ad-hoc basis, @ 10% of existing Basic Pay plus Dearness Allowance @ 125%.

2. Payment of the above ad-hoc amounts will be made only to those personnel who were in service as on 01 Jan. 2016 and continue to be in service thereafter. The pay being drawn as on 01 Jan 16 would be reckoned for calculating the arrears. Pay for this purpose includes Pay in Pay Band, Grade Pay, Gp X Pay, MSP and NPA as applicable along with 125% DA thereon. Over-payment, if any, would be adjusted against the pay and allowances due. The amount so paid will be adjusted against the final computation of arrears on the revised pay scales.

3. Expenditure on account of payment of arrears on ad-hoc basis is debitable to the Major Head 2076 and Minor Head 101.A(C)1 of the Army and corresponding head of account of the Navy and Air Force.
4. This issues with the concurrence of Finance Division of this Ministry vide their Dy.No.400-PA dated 10.10.2016.

Armed Forces to get 10% Arrears before October 30 : The defence ministry has said a pending issuance of the pay commission notification has been sanctioned by the president on ad-hoc basis.

Even as the Central government and the three armed forces chiefs are trying to sort out a dispute over the new pay grades for the army, navy and the air force, the central government has planned a temporary payment for the armed forces.

The defence ministry has said a “pending issuance” of the pay commission notification has been sanctioned by the president on ad-hoc basis. The arrears will be 10 percent of the current pay drawn by the soldiers, which would be calculated from January 2016.

This means all the soldiers are set to receive roughly one month’s salary. The government is trying to ensure that the arrears are reflected in salary slips before October 30 (Diwali).

According to media reports, the army, navy, and the air force personnel (unlike the civil service) have neither received their arrears arising out of the pay-commission order, nor have their new salary scales come into force. The delay is due to the three service chiefs’ intervention seeking correction in the anomalies in the compensation structure for the forces.

The service chiefs have said that the services will not implement the pay commission’s recommendations until and unless the anomalies, which include those related to disability and pay pensions, are resolved.
In other news, the government on Monday refuted media reports, which suggested that the disability pension scheme for the armed forces had been cut. Government sources cited by a leading daily claimed that the disability pension for sepoys had increased by Rs 2,700 per month, for havaldars by Rs 1,450 per month and for naiks by Rs 2,300 per month post the implementation of the 7th pay commission.

Media reports indicated that the government has notified of a new set of rules for granting disability pensions to the armed forces. The new pension calculation method replaces the decade-old system put in place by the sixth pay commission (CPC) according to which, the pensions arising by disability aggravated by military services/wars were calculated on percentage basis on the last pay drawn.

Sub: Promotion of Group ’A' and Group 'B’ officers to Senior Scale on ad-hoc basis.


Ref: Board’s letter Nos. E(GP)85/1/48 dated 31.12.85, EV(GP)89/1/8 dated 17.04.90 and 22.08.90.

In terms of Board’s letter No. ElGP)85/1/48 dated 31.12.85, Group ‘A’/Junior Scale officers with more than 3 years of service but less than 4 years, were eligible to be considered for looking after the duties in Senior Scale, on payment of Special pay, as fixed from time to time by the Board, in addition to their pay in Junior Scale, and it was only in the absence of Group ’A’ officers who have completed their probation successfully, that Group 'B’ officers who have rendered not less than 3 years of service in Group ’B’ could be considered for ad-hoc appointment to Senior Scale. This was based on the fact that all Senior Scale posts are in Group ’A’ and, as such Group ‘B’ officers, irrespective of their length of service, can have no claim for promotion to Senior Scale, even on ad-hoc basis. However, while the position as contained in Board’s letter dated 31.12.85 basically remaining unchanged, it was decided by the Board vide Board's letter No. E(GP)89/1/8 dated 17.04.90, as a temporary measure in the overall administrative interest, that in cases where a Group 'A’/Junior Scale officer who was eligible for regular promotion to Senior Scale, having completed 4 years’ service, was not available, Group 'B’ officers, who had rendered not less than 6 years' service in Group 'B’, could be considered for ad-hoc promotion to Senior Scale, and in case, no such Group ‘B’ officer was available, the provisions contained in sub-paras 3.1(ii) and (iii) of Board's letter dated 31.12.85, would continue to be followed.

2. The matter has since been reconsidered by the Board. After careful consideration, it has been decided that the position as was laid down in Board’s letter No. E(GP)85/1/48 dated 31.12.85 which is in consonance with Rule 214(b) of IREC Vol.- I, be restored. Therefore, the order of preference to be followed henceforth, while considering Group ’A’ (Junior Scale/Group ’B' officers for ad-hoc promotion against Senior Scale vacancies, will be sunder:-

i) Vacancies arising in Senior Scale should be filled by Group .‘A’/Junior Scale officers with 4 years of service who are eligible for regular promotion to Senior Scale;


ii) If eligible Group ‘A'/Junior Scale officers are not available but Junior Scale officers with a minimum of 3 years of service in Junior Scale, who have completed the probation successfully, are available, they should be considered for looking after the duties in Senior Scale on payment of charge allowance, as fixed by the Board from time to time, in addition to pay in Junior Scale, subject to the condition that pay plus charge allowance does not exceed the pay admissible on regular promotion to Senior Scale on completion of 4 years of service in Junior Scale;

iii) Failing (i) and (ii) above, by Group ’B’ officers who have rendered not less than 3 years of service in Group 'B’ and have been adjudged suitable by a Committee of HODs for appointment against Senior Scale vacancies.

3. For making ad-hoc promotion to Senior Scale, number of vacancies arising during the period 1st July of any year to 30th June of the following year shall be computed and while empanelling Group ’B’ officers for ad-hoc promotion to Senior Scale against any such vacancies it shall be ensured that there may be no reasonable likelihood of any such Group B’ officers not getting empanelled for regular promotion to Group ’A’/Junior Scale at a later date by the DPC constituted by the UPSC, and also adequate number of Senior Scale vacancies are available for Group 'A’/Junior Scale officers so as to consider them for ad-hoc promotion on completion of 3 years of service, so that there may be no occasion for Group 'B' officers having to be reverted once they have been promoted to Senior Scale on ad-hoc basis.

In case the officers who are on depuation do not furnish their choices by the stipulated time, it will be presumed that they are not willing to repatriate to the cadre to avail ad-hoc promotion and their names will be considered in future only on receipt of written communication conveying their willingness to repatriate to the cadre to avail promotion.

4. The officers before submission of options should ensure that data in their respect is complete and update in the web based cadre management system (cscms.nic.in). If the data is not complete it should be first got updated before submission of option.

Subject: Promotion of UDCs of Central Secretariat Clerical Services (CSCS) to the Assistants’ Grade of Central Secretariat (CSS) on ad-hoc basis.

The undersigned is directed to refer to this Department’s O.Ms. of even number dated 1ih February, 2015 and 2ih March, 2015 on the subject mentioned above vide which ad-hoc promotion was granted to UDCs of SL-2003 (Extended).

2. This Department, vide O.M. No. 12/5/2015-CS. 11(8) dated 2nd November, 2015 had finalized CSL-2003(Extended) in the UDC grade. Thereafter, it has been observed that finalization of CSL-2003 (extended) has resulted in change in seniority position of many officials. A number of representations have been received in this Department indicating the anomaly as per which many officials who are senior as per the Final CSL-2003(extended) have been working as UDCs, whereas many of their juniorsare working as ad-hoc Assistants. In order to overcome this anomaly, it has been decided with the approval of the competent authority to promote the remaining UDCs of SL-2003(extended) ( who are yet to be promoted till date) as Assistants on ad-hoc basis till further orders. All the concerned Departments/ Ministries are, therefore, requested to promote the remaining UDCs of SL-2003(extended) as Assistants on ad-hoc basis.

3. The officials may be promoted/ appointed as Assistants on ad-hoc basis, after assessing their suitability for promotion by screening the records (APARs) of the officials after ensuring that these officials are clear from the vigilance angle. The ad-hoc promotion/apPointment is subject to the following conditions:-
i) The ad-hoc appointment shall not confer on the appointees any right to continue in the grade indefinitely or inclusion in the Select List or to claim seniority in the Assistant grade of CSS;
ii) Ad-hoc appointments may be terminated at any point of time without giving any reason therefore;
iii) The appointment on ad-hoc basis will take effect from the date of taking over charge to the post of Assistant of CSS.
iv) The ad-hoc appointees would attend and qualify the mandatory training as and when nominated by CS.I (training) section to this Department,(if not already done), failing which they shall have no claim for inclusion in the regular Select List of Assistant.
4. The willingness of the Officials on deputation as to whether they are willing to revert to the Cadre with a view to avail of the promotion will be obtained by the Ministry/ Department from where the Official(s) have proceeded on deputation.

5. Procedure regarding deployment of surplus officials:-

A cadre unit consists of sub-cadre units as well. Choices of the UDCs of the sub-cadre who are to be promoted as Assistant may be obtained and deployed in the cadre unit/sub-cadre units. For example, if 10 UDCs are covered in the list who are to be promoted to Assistant grade and only 6 posts are available in the cadre unit and sub-cadre units put together, the 6 ad-hoc Assistant (senior most) shall be allotted as per their choices and the details of the remaining 4 officials Uunior most) along with their preferences shall be sent to CS.II Division for their onward deployment in those cadre units where there are surplus vacancies. The ope proceedings and the promotion of the officials as ad-hoc Assistants in the manner as indicated above shall be completed as quickly as possible and in no case later than 15-12-2015. The details of the surplus officials who could not be accommodated in the cadre/sub-cadre unit shall be sent to CS.II Division before by 15-12-2015 positively.

6. All the cadre units are requested to take necessary action and the whole process may be completed on top priority basis within 15-12-2015. A copy of the appointment order may be endorsed to this Department. A report indicating the names and details of the UDCs who have been appointed/promoted to the post of Assistant on ad-hoc basis as well as those who have not been found fit, with reasons therefore, may be, furnished to this Department by 15th December, 2015, in the prescribed proforma enclosed.

ORDER

Approval of the President is hereby conveyed for promotion of 48 Section Officers of Central Secretariat Service (CSS) to Grade-I (Under Secretary) of CSS in PB-3 (Rs.15600-391 00) with Grade Pay of RS.6600/- purely on ‘ad-hoc’ basis for a period up to 31.12.2015 or till the posts are filled up on regular basis, or until further orders whichever is earlier. The ‘ad-hoc’ promotion is subject to the following conditions:
(i) The ad-hoc promotion shall not confer any right to continue in the grade indefinitely or for inclusion in the Select List for regular appointment or to claim seniority in the Grade I of the CSS.

(ii) Ad-hoc appointments may be terminated at any point of time without giving any reason there for.

(iii) The appointment on ad-hoc basis will take effect from the date of assuming the charge of the post of Under Secretary in the Ministry/
Department to which the officer has been allocated.

(iv) The service rendered on ad-hoc basis in the Under Secretary grade would not count for the purpose of seniority in that grade or for promotion to the next higher grade.

(v) The appointment is subject to vigilance clearance in terms of DoPT’s OM No.22034/4/2012-Estt.(D) dated 02.11.2012 and other relevant instructions on the subject. The Ministry/ Department where the officer is working should relieve him/her or promote him/her only after verifying that no disciplinary proceedings are pending or contemplated against the officer.

(vi) The Officers, who have not undergone mandatory Level ‘O’ Training as enjoined in Cadre Training Plan for the CSS, will have to undergo the aforesaid training as per nominations made by this Department.

(vii) No request for retention of the Officers who are transferred on promotion would be entertained.

(viii) The officers who fail to avail ad-hoc promotion would not be considered for ad-hoc promotion for a period of one year from the date of issue of this promotion order.

(ix) Officers undergoing any training other than mandatory training under CSS (CTP) will not be allowed proforma promotion and the officer has to join the post to avail promotion. In this regard attention is invited to this Department’s O.M. No. 21/3/2015-CS.I(P) dated 19.3.2015.

2. The posting of, officers on their promotion is as shown against their names in the Annexure to this OM. Allocation has been made in terms of the proposed revised Rotational Transfer Policy for CSS Officers.

3. The Officers promoted vide this order will be required to join the allocated Ministries/Departments by 27.07.2015 and failure to do so may attract punitive action by DoPT. It will also be incumbent upon the Ministry/Department and the officer concerned not to draw salary beyond the stipulated date. If any Officer fails to join by the stipulated date, the promotion order is liable to be cancelled. Officers covered in this order and presently on deputation should repatriate to the cadre immediately to avail promotion, failing which promotion order will be cancelled.

4. Notification appointing the officers will be issued by the Ministry/Department and a copy of the notification issued should be endorsed to this Department.

5. Web Based Cadre Management System: Promotion of officers have been reflected in the Web Based Cadre Management System. Accordingly, relieving / joining of officers should be immediately updated in the Transfer module of the Web Based Cadre Management System hosted at cscms.nic.in. This is the responsibility of the nodal officers concerned.

The President hereby appoints the officers of Grade-I (Under Secretary) of the Central Secretariat Service (CSS), whose names appear in para 2 below,to the Selection Grade (Deputy Secretary) in PB-3 (Rs.15600 – 39100) with a grade pay of Rs.7600/-by promotion on ad-hoc basis with immediate effect,initially for a period upto 30.06.2015 or until further orders, whichever is earlier.

2. On promotion on ad-hoc basis,the officers are allocated to the Ministries/Departments as shown against their names:

3. The aforesaid ad-hoc promotion of the officers is Subject to the following conditions:-
(i) The ad-hoc promotion is subject to the final outcome of the pending Writ Petition No. 4097/2011 (Arun Gaur Vs Garima Singh & Ors), W.P. No.4616/2011  (V.S.Pandey & OrsVs. Garima Singh & Ors), W.P. No. 7619/2011 ( UPSC Vs Garima Singh & Ors), W.P.No.2176/2012 (Union of India Vs. Garima Singh & Ors) and other connected Writ Petitions Nos.W.P.(C) 2523/2012 (Union of India Vs. Anant Kishore Saran), W.P.(C) 2524/2012 (Union of India Vs. Shersha and Anr), W.P.(C) 2525/2012 (Union of  India Vs. Syed Eram Rizvi and Anr), W.P.(C) 2526/2012 (Union of India Vs. Sandeep Kumar Gupta), and W.P.(C) 2527/2012 (Union of India Vs. Soumya Chattopadhyay and Anr) in the High Court of Delhi and also any other order by any competent court in any of the connected matters, apart from the above.

(ii) The ad-hoc promotion is further subject to vigilance clearance in terms of this Department’s O.M. No.22011/4/91-Estt.(A) dated 14.9.92,  O.M.No. 22012/1/99- Estt.(D) dated 25.10.2004 and O.M.No. 22034/4/2012-Estt(D) dated 2.11.2012, The Ministry/Department where the officer is working should relieve the officer only after verifying that no disciplinary proceedings are pending or contemplated against the officer. In case of pendency of such proceedings, the matter may be reported to this Department immediately.

(iii) The promotion on ad-hoc basis is effective from the date of assumption of charge by the officer of the post of Deputy Secretary in the Ministry/Department to which he/she has been posted.

(iv) The ad-hoc  promotion to the Selection grade (Deputy Secretary) of CSS shall not bestow on the incumbents any claim for regular promotion to the grade.

(v) The service rendered on ad-hoc basis in the grade would not count for the purpose of seniority in that grade or for promotion to the next higher grade.

(vi) The adhoc promotion shall not confer any right on the incumbents to continue in the grade indefinitely and may be terminated at any point of time without giving any reasons thereof.
4. No request for retention shall be entertained.  Ministry/Department concerned should relieve the officers to enable them to join the allocated Ministries/Departments immediately, latest by 10.06.2015.

5. If any officer declines ad-hoc promotion, he/she would not be considered for ad-hoc promotion for one year from the date of refusal.

6. A copy of the notification implementing the order should be endorsed to this Department.

The undersigned is directed to refer to this Department’s OM of even number dated 13.02.2015 on the subject mentioned above and to say that the revised vacancy position in the grades of DS/Director of CSS as on 01.03.2015 is given in Annex. I.


2. It has since been decided that the officers presently posted in Group ‘A’ Ministries/Departments may opt for posting in the same Group. However, on posting to a Ministry/Department in Group ‘A’ the tenure will be counted afresh for five/four years as the case may be. However, this option will not be available to officers currently posted in Group ‘B’ to remain in Group ‘B’.


3. The officers concerned are requested to furnish their fresh options as per revised vacancy position/policy by 24.02.2015 through fax number given below or personally. If any officer is not exercising option he/she may submit an undertaking by 24.02.2015 for posting in any Ministry/Department as may be decided by the competent authority.

Dearness Allowance for Workmen and Officer Employees in banks for the months of February, March & April 2015. under IX BPS/Joint Note dt. 27.4.10

The confirmed All India Average Consumer Price Index Numbers for Industrial Workers (Base 1960=100) for the quarter ended December 2014 are as follows:-

Oct 2014 – 5774.95
Nov 2014 – 5774.95
Dec 2014 – 5774.95

The average CPI of the above is 5774.95. Consequently, dearness allowance to employees is payable for 734 slabs for the period February, March & April 2015 i.e., an increase of 2 slabs over the Current level.
In terms of clause 7 of the 9th Bipartite Settlement dated 27.04.2010 and clause 3 of the Joint Note dated 27.04.2010, the rate of dearness allowance payable to workmen and officer employees for the months of February, March & April 2015 shall be 110.10% of ‘pay’. While arriving at dearness allowance payable, decimals from third place may please be ignored.

We advise banks to pay the difference between the old and revised salary and allowances to officers on an ad hoc basis, pending amendments to Officers’ Service Regulations.

The undersigned is directed to refer to this Department’s O.M. of even number dated 17th December, 2013 whereby cadre units were permitted to continue the ad-hoc appointments in the UD Grade of CSCS up to 30th June, 2014 and to say that the continuation of the ad-hoc appointments in the U.D grade made by the cadre units has been reviewed in this Department. Since availability of regular UDCs through normal modes of recruitment prescribed under the CSCS Rules may take some more time, it has been decided that the period of ad-hoc appointment of those LDCs who are working as UDC of on ad-hoc basis may be extended up to 31st December, 2014 or till  regular UDCs become available, whichever is earlier.

2. Continuance of ad-hoc appointment shall not confer on the appointees any right to continue in UDC Grade indefinitely or for inclusion in the Select List of UDC of CSCS or to claim seniority in UDC Grade of CSCS.
