Subject: Dispensation of conditions of applying for Government Accommodation and furnishing of 'No Accommodation Certificate' for admissibility of House Rent Allowance.

Several reference are being received in this Department to review the condition applying for Government Accommodation and furnishing of 'No Accommodation Certificate' for admissibility of House Rent Allowance as contained in Para 4(a) of this Department's O.M. No.2(37)-E.II(B)/64 dated 27.11.1965 read with Para 1(1) of O.M. No.11011/1/E.II(B)/75 dated 25.02.1977.

2. The matter has been examined in this Department and in supersession of Para 4(a) of this Department's O.M. No. 2(37)- E.II(B)/64 dated 27.11.1965 read with Para 1(1) of O.M. No.11011/1/E.II (B)/75 dated 25.02.1977 and to simplify the procedure relating to grant of house rent allowance to Central Government employees, the President in consultation with Ministry of housing and urban affairs and the Staff side of the National council (J.C.M), is pleased to decide that the conditions of applying for Government Accommodation and furnishing of 'No Accommodation Certificate' by Central Government employees to become eligible for House Rent allowance (HRA), are dispensed with for all places, in respect of General pool Residential Accommodation (GPRA) controlled by Directorate of Estates.

3. Ministries / Departments having their separate pool of residential accommodation for their employees other than GPRA, may adopt these provisions, wherever feasible.

4. These orders shall be effective from the date of issue of the orders.

5. In so far as the persons serving in the Indian Audit and Accounts Department are concerned, these orders issue in consultation with the Comptroller & Auditor General of India.

Single Card for Seamless Travel through different Metros & Other Transport Systems

National Common Mobility Card - India's First Indigenously developed Payment Platform launched by PM in Ahmedabad

One Nation, One Card for transport mobility was launched by Prime Minister Narendra Modi at a function in Ahmedabad yesterday. The Indigenous Automatic Fare Collection System based on One Nation One Card Model i.e. National Common Mobility Card (NCMC) is the first of its kind in India.India's First Indigenously Developed Payment system for transport consisting of NCMC Card, SWEEKAR (SwachalitKiraya: Automatic Fare Collection System) and SWAGAT (Swachalit Gate) is based on NCMC Standards.

These are bank issued Debit/Credit/Prepaid cards and the customer may use this single card for payments across all segments including metro, bus, suburban railways, toll, parking, smart city and retail. The stored value on card supports offline transaction across all travel needs with minimal financial risk to involved stakeholders. The service area feature of this card supports operator specific applications e.g. monthly passes, season tickets etc.

The National Common Mobility Card (NCMC) to enable seamless travel by different metros and other transport systems across the country besides retail shopping and purchasesis an initiative of the Ministry of Housing & Urban Affairs. The card will address the challenges associated with the cash payment e.g. cash handling, revenue leakages, cash reconciliation etc. Various initiatives have been taken by transit operators to automate & digitize the fare collection using Automatic Fare Collection System (AFC). The introduction of closed loop cards issued by these operators helped to digitize the fare collection to a significant extent. However, the restricted usability of these payment instruments limits the digital adoption by customers.

The customers need not carry multiple cards for different usage. Further, the super quick contactless transactions will improve the seamless experience.This will also help in higher digital payments penetration, savings on closed loop card lifecycle management cost and reduced operating cost. The rich data insights may be used by operators for business intelligence leading to efficient operation.

CABINET APPROVES PROMULGATION OF AADHAAR AND OTHER LAWS (AMENDMENT) ORDINANCE, 2019

The Union Cabinet, chaired by the Prime Minister Narendra Modi has approved the promulgation of an Ordinance to make amendments to the Aadhaar Act 2016, Prevention of Money Laundering Act 2005 & Indian Telegraph Act 1885. The amendments proposed are the same as those contained in the Bill passed by the Lok Sabha on 4th January 2019.

Impact:-
The amendments would enable UIDAI to have a more robust mechanism to serve the public interest and restrain the misuse of Aadhaar. Subsequent to this amendment, no individual shall be compelled to provide proof of possession of Aadhaar number of undergo authentication for the purpose of establishing his identity unless it is so provided by a law made by Parliament.

Salient Features
The salient features of the amendments are as follows:
  • Provides for voluntary use of Aadhaar number in physical or electronic form by authentication or offline verification with the consent of Aadhaar number holder;
  • Provides for use of twelve-digit Aadhaar number and its alternative virtual identity to conceal the actual Aadhaar number of an individual;
  • Gives an option to children who are Aadhaar number holders to cancel their Aadhaar number on attaining the age of eighteen years;
  • Permits the entities to perform authentication only when they are compliant with the standards of privacy and security specified by the Authority; and the authentication is permitted under any law made by Parliament or is prescribed to be in the interest of State by the Central Government;
  • Allows the use of Aadhaar number for authentication on voluntary basis as acceptable KYC document under the Telegraph Act, 1885 and the Prevention of Money-laundering Act, 2002.
  • Proposes deletion of section 57 of the Aadhaar Act relating to use of Aadhaar by private entities;
  • Prevents denial of services for refusing to, or being unable to, undergo authentication;
  • Provides for establishment of Unique Identification Authority of India Fund;
  • Provides for civil penalties, its adjudication, appeal thereof in regard to violations of Aadhaar Act and provisions by entities in the Aadhaar ecosystem.
Background:
The Supreme Court in its judgement dated 26.9.2018 in W.P (civil) No.494 of 2012 and other tagged petitions held Aadhaar to be constitutionally valid. However, it read down/struck down few sections of the Aadhaar Act and Regulations and gave several other directions in the interest of protecting the fundamental rights to privacy.

Consequently it was proposed to amend the Aadhaar Act, Indian Telegraph Act and the Prevention of Money Laundering Act in line with the Supreme Court directives and the report of Justice B.N.Srikrishna (Retd.) committee on data protection, in order to ensure that personal data of Aadhaar holder remains protected against any misuse and Aadhaar scheme remains in conformity with the Constitution. Towards this, the Aadhaar and Other Laws (Amendment) Bill, 2018 was passed by the Lok Sabha in its sitting held on 4th January, 2019. However, before the same could be considered and passed in the Rajya Sabha, the Rajya Sabha was adjourned sine die.

Sub: Additional benefit on death/disability of Government servant covered by NPS - reg.

Attention is invited to Board's letter No. 2008/AC-II/21/19 dated 29.05.2009 on the above subject vide which instructions were issued providing for additional relief on death/disability of Government servants covered by New Defined Contribution Pension System (NPS).

In the wake of the above instructions, some of the Zonal Railways have raised the issue of admissibility of provisional family pension to the family members of the deceased railway servant who were governed by National Pension System (NPS) but died prior to allotment of PRAN Card and starting of the deductions towards NPS.

The above issue has been examined in consultation with Pension Fund Regulatory and Development Authority (PFRDA) and the Department of Pension & Pensioners' Welfare (DOP&PW). It is clarified that all the railway servants appointed on or after 01.01.2004 are to be covered by the National Pension System (NPS). Therefore, the provisional benefits granted vide Board's letter dated 29.05.2009 to all NPS employees in case of death in service/disability will be admissible to the family of the deceased subscribers/subscribers on fulfillment of the conditions specified therein irrespective of the fact that PRAN Card was not allotted at the time of death/disability or the deduction towards NPS had not started. However, while giving the provisional benefits instructions issued vide Board's letter No. 2012/ F(E)III/1 (1)/4 dated 08.09.2014 may also be kept in view.

Sub: Grant of Individual/Group Cash Award

The issue of revising guidelines for grant of individual awards and group cash award to officers/staff working in Board's Office in terms of Office Order No. 44 of 2000, 31 of 2004, 61 of 2005 and 83 of 2018 was under consideration and following has been decided:-

a) The upper limit for individual award/individual limit in group award to Officers/staff recommended/sanctioned by AMs, PEDs and Secretary/RB has been revised as under:-
  1. Upto Rs 4000/- for Group 'C' staff;
  2. Upto Rs 5000/- for Group 'B' staff and
  3. Upto Rs 6000/- for Group 'A' staff.
Further modalities on restricting the staff percentage for grant of awards to 10% and ceiling the Annual Gross Limit of sanctioning award by AMs, PEDs and Secretary/RB is under process and would be issued in due course.

b) The above limit for grant of individual award/ individual limit in group award would be applicable to DGs, Board Members and CRB also, however. in specific cases they may sanction award upto Rs 10,000/- per individual staff for meritorious service.

c) While recommending the names for Group Awards, the specific amount to be given to an individual should invariably be indicated. In the case of Group award announced on the spot by CRB or Board Mem ber or DG, a list containing the name of each awardee along with the amount of the award to be given to him/her should be submitted to the concerned Branch of Secretary's Directorate with the approval of the competent authority (not below the level of concerned ED/JS) for issue of sanction of award.

d) In case of awards by CRB/Members/DGs, there would be no restriction of time gap. For others, the gap would be minimum of 3(three) years.

e) In case of awards recommended by Board Members/DGs/AMs/PEDs etc no merit certificate would be issued, however, if any recommending/ sanctioning officer desires to issue an appreciation letter, the same would be prepared in the DO letter head of the award sanctioning authority under his own signature, a copy of which would be endorsed to Railway Board (Welfare) branch of Secretary Directorate for maintenance of records.

f) For grant of individual/group cash award or issuing appreciation letter, no D&AR or Vigilance Clearance or scrutiny of APARs would be required.

The above instructions/guidelines would not be applicable to Railway Week National Award, CRB Award, Awards granted by Minister of Railways/Minister of State of Railways and other prestigious awards.

This issues with the approval of the competent authority.
