Subject: Non- Statutory Departmental Canteens functioning in Central Government Offices procuring License under Food Safety and Standards Act, 2006 and Rules & Regulations framed there under.

The undersigned is directed to refer to this Department;s D.M. No. 10/1/2004-Dir.(C) dated 30.05.2016 on the above subject and to say that Food Safety & Standards Authority of India has rationalized the license/ registration fee for Departmental tiffin rooms/ canteens functioning in Central Government Offices. All the Non- Statutory departmental tiffin rooms/ canteens having turnover of less than Rs. 12 lakhs per annum would be registered on payment of fee Rs. 100/- per annum and those having turnover of more than Rs.12 lakhs would be licensed on payment of fee Rs. 2000/- per annum.

2. As a facilitation measure, FSSAI is orgainising an on-spot registration camp for departmental canteens having turnover less than Rs. 12 lakhs per annum at FSSAI- HQ on 7th August, 2018. The following documents are required for on-spot registration:-

i) Aadhar Card/ PAN Card
ii) One Passport size photo
iii) Employer ID Card
iv) Fee i.e. Rs 100 (registration fee)

3. All the Ministries/ Departments who have not registered their departmental canteens under Food Safety & Standards Act, 2006 are requested to nominate individual from Canteen Staff for the said on-spot registration camp.

Ref: HQ office letter No.AT/II/2455-VI dated 06.07.2018

Kindly find, enclosed, HQ office letter quoted under reference on the above subject alongwith its enclosure.

It has been inferred in Para 5 of the aforesaid letter that the provisions of Para 8(iii) of DoP&T OM No 3/3/2016-Estt (Pay-II) dated 01.05.2017 and hence Para 3(v) of DoP&T OM No 3/19/2009-Estt (Pay II) dated 05.04.2010, which is analogical to para 8(iii) of OM No 3/3/2016-Estt (Pay-II) dated 01.05.2017, are applicable only for the pay fixation of retired Gr A officers on re-employment and not for the pay fixation of PBORs on re-employment in civil posts. Accordingly, pay fixation of persons who retired as PBOR and got re-employed in civil posts, in the revised structure of 6th CPC is to be regulated as per the provisions laid down in para 4(b)(i), 4(b)(ii) read with para 4(d) of DoP&T OM No 3/19/2009-Estt (Pay II) dated 05.04.2010.

Affected cases may be dealt with accordingly.

Dearness Allowance for Workmen and Officer Employees in Banks for the month of August, September and October 2018 under 10th BPS / Joint Note dated 25.5.2015

The confirmed All India Average Consumer Price Index Numbers for Industrial Workers (Base 1960=100) for the quarter ended June 2018 are as follows…

April 2018 - 6573.86
May 2018 - 6596.69
June 2018 - 6642.34

The average CPI of the above is 6604.29 and accordingly the number of DA slabs is 541 (6604.29 - 4440 = 2164.29 / 4 = 541 Slabs).

In the last quarter, payment of DA was at 529 slabs. Hence, there is an increase in DA Slabs of 12, i.e. 541 slabs for payment of DA for the quarter August, September and October 2018.

In therms of clause 7 of the 10th Bipartite Settlement dated 25.05.2015 and clause 3 of the Joint Note dated 25.05.2015, the rate of Dearness Allowance to workmen and officer employees for the months of August, September and October 2018 shall be 54.10% of 'Pay'. While arriving at dearness allowance payable, decimals from third place may please be ignored.

Dear Sir,
Sub: Implementation of Pass Rules and grant of travel facility on privilege pass as per the choice of pass holder - Railway Board's clarification-requested.

NFIR invites attention of the Railway Board to the provisions contained in Advance Correction Slip No. 32 to the Railway Servants (Pass) Rules, 1986 (2nd Edition 1993) where in Rule 3 (vi) which are as under :-

"Privilege pass shall be issued for journey from the starting station to the destination station as desired by the Railway servant, via shortest route, provided that a longer route may be permitted on the Privilege Pass in the following circumstances:-

a) Two alternative routes are available for a destination, for example - Bombay to Calcutta via Nagpur or via Allahabad and Bombay to Delhi by the Central Railway or by the Western Railway - such pass may be permitted by either route irrespective of the distance involved;
or

b) If the distance to destination via a longer route preferred by the Railway servant does not exceed by fifteen percent of the distance via the direct route such pass may be issued even if a double journey over a small portion is involved (for example - ex Chittaranjan to Kancharapara via Howrah or ex-Lucknow to a station on the Southern/ South Central Railway via Bombay VT), provided the distance does not exceed the distance via the shortest route by more than 15% to take advantage of terminal facilities as in Bombay VT - Kalyan or Madras - Arakkonam sections;
or

c) If the longer route to destination is quicker than the direct route irrespective of distance involved."
Federation has received staff representations (also retired staff) that when entitlement and choice is available between (a), (b) & (c) as per ACS No.32, the authorities have been reluctant in issuing the privilege/complimentary passes by wrongly interpreting to the effect that clauses 3(vi) (b) and (c) are independent provisions as they have been separated by the word ‘or’ between them, thereby, the provision in Rule 3(vi) (a) is also independent.

Federation contends that the interpretation as above is not correct in view of the fact that the three provisions are meant to allow staff to avail either 3(vi) (a) or (b) or (c) as per their convenience. The incorrect interpretation by the Railway authorities has resulted deprival of right to employee to take journey on his privilege pass, Similarly, the retired staff are also denied, the privilege of travel as per their choice route on their post retirement complimentary passes.

NFIR, therefore, requests the Railway Board to issue suitable clarification to the Zonal Railways etc., to enable the staff to avail privilege/complimentary passes and take journey as per their choice in terms of provisions contained in ACS No.32. copy of clarificatory instructions may be endorsed to the Federation.

The undersigned is directed to refer to RTI Cell’s Note dated 24.7.2018 on the above mentioned subject and to state that Shri R. K.Kureel, Deputy Secretary (RTI), Department of Expenditure has been appointed as Nodal Central Public Information Officer for RTI matters in the Ministry of Finance.
It is further stated that the role of the Nodal officer for RTI in the Ministry of Finance would be limited to receiving the RTI applications/ appeals addressed to Ministry of Finance and forwarding the same to the concerned CPIOs in all the Departments under the Ministry of Finance.

Subject: Payment of Dearness Allowance/Dearness Relief to the State Government employees/ pensioners/family pensioners.

No.2/6/2010-FD(PIC)(Pt): The undersigned is directed to refer to this Government Office Memorandum No.2/6/2010-FD(PIC) dated 08/10/2015 on the above subject and to state that the Governor of Manipur is pleased to decide that the Dearness Allowance/Dearness Relief payable to the State Government employees/pensioners/family pensioners shall be enhanced from the existing rate of 125% to 131% with effect from 01/07/2018.

2. The term ‘basic pay’ in the revised pay structure means the pay drawn in the prescribed Pay Band plus the applicable Grade Pay but does not include any other type of pay like special pay, etc.

3. The Dearness Allowance will continue to be a distinct element of remuneration and will not be treated as pay within the ambit of FR 9(21).

4. The payment on account of Dearness Allowance involving fractions of 50 paise and above may be rounded off to the next higher rupee and the fractions of less than 50 paise may be ignored.

5. The Dearness Relief at the rate indicated above will also be admissible on the additional basic pension/additional family pension available to older pensioners/family pensioners based on their age.

6. The payment of Dearness Relief involving a fraction of a rupee shall be rounded off to the next higher rupee.

7. Other provisions governing grant of Dearness Relief in respect of employed family pensioners and re-employed State Government pensioners and those relating to regulation of Dearness Relief where pensioners is in receipt of more than one pension will remain unchanged.

8. These orders relating to grant of Dearness Relief shall not be applicable to the Old Age Pension, Political Pension or any other kinds of similar pensions which are not related to the service rendered under the Government of Manipur.

9. It will be the responsibility of the Pension Disbursing Authority, including the Nationalized Banks, etc. to calculate the quantum of Dearness Relief payable in each individual case.

10. The Accountant General (A&E), Manipur and the Authorized Public Sector Banks shall arrange payment of relief to pensioners etc. on the basis of the above instructions.
