Sub: Grant of HRA/CCA at Hyderabad Rates to the Defence Civilian Employees working at Ordnance Factory Yeddumailaram (Medak) and Eddumailaram (Census Town), Medak

Ministry of Finance, Department of Expenditure vide ID No. 2(2)12007/E-li (B) dated 19.02.2007 have informed MoD that the MoD should checkup the matter with the State Government/Local Authorities to confirm whether Yeddumailaram (Medak) and Eddumailaram (Census Town), Medak are two different cities or both are one and the same. It was further clarified that if it happen to be the same city then HRA / CCA is already admissible at Hyderabad rates being part of Hyderabad (UA). Accordingly, Ministry of Defence after consulting the State Government Authorities have issued instructions vide ID No. 6(6)/2005 D (Civ.) dated 16.05.2007 clarifying Yeddumailaram (Medak) and Eddumailaram (Census Town). Medak are one and the same city and accordingly they are eligible for HRA / CCA as applicable to Hyderabad (UA).

Ministry of Finance vide its ID No. 2(2)/2007-E-li(B) dated 01.12.2014 have advised Ministry of Defence that payment of HRA at Hyderabad rates to the employees of Ordnance Factory Yeddumailaram (Medak) and Eddumailaram (Census Town), Medak may be stopped with immediate effect. Accordingly, Ministry of Defence have issued instructions to Ordnance Factory Board to immediately reduce the rate of HRA to the above employees from existing 30% to 10%.

In this regard it is stated that Eddumailaram (Census Town) was declared / treated as Urban (i.e. Census Town) at 2001 Census vide Government of India, Ministry of Home Affairs, Director of Census Operation Letter No. 4646/Census CeIl/2001 dated 12.08.2002 (copy enclosed for ready reference) Moreover, as per the publication of Government of Andhra Pradesh regarding concept of Urban Agglomeration defined in Chapter 1 of introduction, concepts and definitions, jurisdictional changes, Rural – Urban Frame Andhra Pradesh in Para 1.3.7 it is clearly mentioned that the Medak District falls within the Urban Agglomeration of Hyderabad (UA).

In view of the above Department of Expenditure is requested to re-examine the whole issue in terms of the supporting documents stated in the Preceding Para and arrange to issue instructions to continue 30% HRA for the Defence Civilian Employees of Ordnance Factory Yeddumailaram (Medak) and Eddumailaram (Census Town), Medak, This issue may please be considered seriously and urgently since the Defence Production Unit is facing serious industrial unrest owing to stoppage of HRA at par with Hyderabad (UA) rates.

An early decision is solicited.

The undersigned is directed to invite reference to this Department’s OM No. 14015/176-Estt.(D) dated 4th August, 1980 vide which instructions regarding appointment of meritorious sportsmen to Group C and D posts in relaxation of the procedure were circulated. Subsequently, consolidated instructions on incentives for sportspersons were also circulated vide this Department’s OM No. 14034/01/2013-Estt.(D) dated 03.10.2013.

2. All Ministries/Departments are again requested to bring the aforesaid instructions mentioned in the preceding paragraph to the notice of all concerned for appointment of meritorious sportspersons to Central Government Civil posts. Strict compliance of these instructions may be ensured for making appointment of meritorious sportspersons, thereby achieving the desired objectives of encouraging and promoting sports in the country.

The Aadhaar Seeding and Regularization for pensioner in Delhi NCR in collaboration with the Punjab National Bank is being held at Auditorium Hall, Scope Tower, Laxmi Nagar of Delhi NCR, today. These camps are being held by the Department of Pension and Pensioner’s Welfare for the benefit of the pensioners. Similar camps were held in Rajendra Place and Civil Lines areas of Delhi NCR on July 13, 2015 and July 14, 2015 respectively.

Pensioners residing in the Laxmi Nagar area of Delhi NCR may visit an Aadhaar Camp held today at Auditorium Hall, Scope Tower, Laxmi Nagar, Delhi with original PPO, Aadhaar Card, and bank pass book along with photocopies of these documents before 5.00 pm.

Pensioners who do not have Aadhaar number yet may in addition carry a photo ID like Voters Card. Jeevan Pramaan is in addition to the other existing facilities for submission of Life Certificate. All the Nationalised banks, as also UIDAI will participate in these camps which are proposed to be held later in other parts of the country.

Aadhaar camp will be held in Sector 1, Noida on July 16, 2015 at Punjab National Bank, C-13 Sector -1 Noida near Sec 15 Metro Station.

For implementation of Jeevan Pramaan- an Aadhaar based life certification system – all pensioners are requested to furnish their Aadhaar Numbers to their bank, if not already done. The pensioners who do not have “Aadhaar” are requested to obtain Aadhaar number.

ORDER:

In the Government Order second read above, orders were issued revising the scales of pay of employees/ teachers on a ” pay scale to pay scale basis” notionally with effect from 1-1-2006 with monetary benefit from 1-1-2007 based on the recommendations of the Official Committee. Subsequently, One Man Commission was constituted to examine the anomalies, consequent on the implementation of the revised scales of pay and more specifically to examine the representations of the teachers associations to extend Central Scales of pay. The recommendation of the One Man Commission was accepted by Government in toto and 87 Government Orders were issued department-wise revising the pay scales of various categories.

2) As per the orders of the Hon’ble High Court, dated:OS-03-2012 in W.P.No.7006 of 2011, the Government constituted “Pay Grievance Redressal Cell” (PGRC) to examine the representations received from the employees associations / Heads of Department / individual employees including the aggrieved petitioners in Writ Petitions filed challenging the G.O.Ms.No.71, Finance (Pay Cell) Department, dated:26-02-2011. An elaborate exercise was done by the PGRC on 4376 representations received from various associations / individuals / Writ Petitioners and heard their grievances in person before arriving at conclusions. Based on the recommendations of the PGRC, 89 Government Orders were issued benefitting around two lakhs employees.

3) In spite of further revision in pay scales as indicated above, several court cases have been filed by individual employees /associations, seeking further pay revision. Further a number of requests are being made by individual employees /associations and information on present their request are sought under Right to Information Act 2005, which has resulted in voluminous work in Finance Department. Further, nine years has already lapsed since the implementation of revised pay scales· and therefore requests for further pay revisions cannot be entertained at this juncture with retrospective effect.

4) The Government after careful consideration has decided to examine the anomalies /requests for further pay revision at the time of general pay revision by constituting Commission /Committee. Accordingly, Government direct that the representations received from the associations /individual employees requesting for further revision of Pay Band /Grade Pay be deferred till a Commission /Committee is constituted for general pay revision. The Principal Secretaries /Secretaries to Government shall issue necessary instructions in this regard to the Heads of Department under their administrative control for strict adherence.

Thiruvananthapuram: A handsome hike for government employees’ salaries and an increase in their retirement age to 58 from the present 56 are among the key recommendations made by Kerala’s 10th Pay Commission.

The panel, headed by Justice CN Ramachandran, handed its report to Chief Minister Oommen Chandy at a function here today.

Among the various recommendations of the much-awaited report includes a proposal for minimum salary of Rs 17,000 and maximum of Rs 1.2 lakh for government employees under various categories.
High school teachers with service of 28 years should be promoted to the post of deputy headmasters, it proposed, adding that the minimum period of service needed for awarding pension should be lowered to 25 years from the present 30.

Accepting the report, Chandy said that the government would consider the recommendations and take appropriate steps regarding those.

An official release said that the first part of the report, that covers pay revision and pension, has been handed in now with the next part to be submitted within November.

Sub: System improvement regarding selection of Apprentices for training under the Apprentices Act, 1961-reg.

Ref: Railway Board’s letter No. E(MPP)/2009/6/14 dated 30/06/2015.

In this connection, NFIR has following suggestions to be considered for incorporating appropriately in the instructions.
(i) The observations of Ministry of Labour who have been repeatedly bringing to the notice of Railway Board that the number of Apprentices being trained in Railway Establishments is significantly lower than the seats allocated by the Regional Directors of Apprenticeship Training needs to be included in the instructions.

(ii) Depending upon the strength of skilled staff, the joint survey conducted by the Railway Officials and the Ministry of Labour, it is seen that nearly 16,772 Apprentices are to be trained and the seats allotted accordingly vide Board’s letter dated 30/0712012 and modified para 3.3 of Board’s letter dated 22/07/2002. Therefore, the selection of units again as mentioned at’A’of the draft instructions is not acceptable.

(iii) NFIR desires to state that the draft instructions do not contain the provision that Railway should ensure that only those designated trades are included in the survey which have a potential for future recruitment/absorption. This is an important feature needed to be incorporated as the same is also based on Hon’ble Supreme Court’s Judgement in the case of UP State Road Transport Corporation V/s UP Berozgar Samiti and is already existing in para 3.2.1 of Board’s instructions dated 22/07/2002.
(iv) Since the minimum educational qualification prescribed for recruitment in the lowest category i.e. GP 1800/- is l0’n pass or its equivalent in all Government Departments including Indian Railways, the same should be made applicable for Apprentice also. This fulfils the condition mentioned in clause 3 (v) of chapter-ll of the Act. There is thus no need for adding the qualification of ITI or giving any – additional weightage for the same. The bench mark of 50% marks in aggregate taking into account the ITI qualification need not be prescribed. The merit list would however be prepared on the basis of marks obtained in matriculation or 10th pass or equivalent;
(v) The selection for training as apprentices should be from following sources duly following Government of India’s Rules for reservation and age relaxation for various communities/categories as revised by the Railway Board from time to time:-
(a) Nearest employment exchanges,
(b) SC/ST & OBC Organisations,
(c) Recognised Unions/Associations,
(d) Wards of Railway employees
There is no need for centralised notification by the Zonal Railway. The job could be left for the concerned Divisions/Workshops to process and form lists accordins to merit among the eligible candidates.
NFIR also desires that the proposal be discussed with the Federations further before formulating policy.
